का.आ. 3006 (अ).- केन्द्रीय सरकार ने कीटनाशी अधिनियम , 1968 ( 1968 का 46 ) की धारा 27 की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत सरकार के कृषि मंत्रालय ( कृषि और सहकारिता विभाग ) की अधिसूचना सं. 1792 ( अ ) , तारीख 23 अक्तूबर , 2007 द्वारा चाय में डोजोमेट के उपयोग को प्रतिषिद्ध करने के लिए अपने आशय की घोषणा करने के लिए एक प्रारूप आदेश प्रकाशित किया था और ऐसे सभी व्यक्तियों से , जिनके उससे प्रभावित होने की संभावना थी , उस तारीख से, जिसको उस राजपत्र की प्रतियां , जिसमें उक्त अधिसूचना प्रकाशित की गई थी , जनता को उपलब्ध करा दी गई थी, पैंतालीस दिन की अवधि के समाप्त होने तक आक्षेप और सुझाव मांगे गए थे;

और उक्त राजपत्र की प्रतियां 26 अक्तूबर , 2007 को जनता को उपलब्ध करा दी गई थी;

और उक्त प्रारूप आदेश की बाबत प्राप्त आक्षेप पर केंद्रीय सरकार द्वारा सम्यक् रूप से विचार किया गया था;

अतः अब , केंद्रीय सरकार , कीटनाशी अधिनियम , 1968 ( 1968 का 46 ) की धारा 28 के साथ पठित धारा 27 की उप- धारा (2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित आदेश करती है , अर्थात्:-

आदेश

1. इस आदेश का संक्षिप्त नाम डोजोमेट के उपयोग पर निर्बंधन आदेश , 2008 है ।

2. चाय में डोजोमेट का उपयोग अनुज्ञात नहीं है ।

3. रजिस्ट्रीकरण प्रमाणपत्र के सभी धारक लेबलों और पत्रकों पर स्पष्ट अक्षरों में " चाय में उपयोग के लिए अनुज्ञात नहीं " चेतावनी को सम्मिलित करने के लिए रजिस्ट्रीकरण समिति को रजिस्ट्रीकरण प्रमाणपत्र वापस करेंगे ।

4. यदि कोई व्यक्ति , जो रजिस्ट्रीकरण प्रमाणपत्र धारक है, छह मास की अवधि के भीतर खंड ( 3 ) में निर्दिष्ट रजिस्ट्रीकरण समिति को रजिस्ट्रीकरण प्रमाणपत्र वापस करने में असफल रहता है तो उनको प्रदत्त रजिस्ट्रीकरण प्रमाणपत्र नवीकृत नहीं किया जाएगा या उक्त अधिनियम की धारा 14 के अधीन कार्यवाही की जाएगी ।

5. प्रत्येक राज्य सरकार उक्त अधिनियम और उसके अधीन बनाए गए नियमों के उपबंधों के अधीन सभी ऐसे उपाय करेगी जो राज्य में इस आदेश के निष्पादन के लिए वह आवश्यक समझे ।

New Delhi , the 31st December, 2008

S.O. 3006 (E) .- Whereas , the Central Government , in exercise of the powers conferred by sub - section (2 ) of section 27 of the Insecticides Act , 1968 (46 of 1968 ) published a draft Order for declaring its intention to prohibit the use of Dazomet in tea vide notification of the Government of India in the Ministry of Agriculture (Department of Agriculture and Cooperation) number S.O. 1792 (E) dated the 23rd October, 2007, and invited objections and suggestions from all persons likely to be affected thereby, till the expiry of a period offorty five days from the date on which copies of the Official Gazette in which the said notification was published were made available to the public;

And whereas , copies of the said Gazette were made available to the public on the 26th day of October 2007;

And whereas , the objection received in respect of the said draft Order was duly considered by the Central Government ;

Now, therefore, in exercise of the powers conferred by sub - section (2) of section 27 read with section 28 of the Insecticides Act , 1968 (46 of 1968) , the Central Government hereby makes the following Order , namely: -

ORDER

1. This Order may be called the Restriction on Use of Dazomet Order, 2008 .

2. Use of Dazomet is not permitted on tea .

3. All the holders of certificate of registration shall return the certificates of registration to the Registration Committee for incorporation of the warning in bold letters "NOT PERMITTED FOR USE IN TEA " on labels and leaflets .

4. If any person who holds the certificate of registration fails to return the certificate to the Registration Committee , referred to in clause (3) , with in a period of six months, the certificate of registration granted to them shall not be renewed or action shall be taken under section 14 of the said Act.

5 Every State Government shall take all such steps under the provisions of the said Act and the rules made thereunder , as it considers necessary for the execution of this Order in the State .

अतः, अब केंद्रीय सरकार, कीटनाशी अधिनियम, 1968 ( 1968 का 46) की धारा 28 के साथ पठित धारा 27 की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित आदेश करती है, अर्थात् :--

आदेश

1. इस आदेश का संक्षिप्त नाम क्लोरोफेनविनफोस का प्रतिबंध आदेश , 2008 है ।

2. कोई व्यक्ति क्लोरोफेनविनफोस का विनिर्माण, आयात और उपयोग नहीं करेगा ।

3. रजिस्ट्रीकरण समिति, सभी रजिस्ट्रीकृत व्यक्तियों से, जिसके अंतर्गत नए रजिस्ट्रीकृत व्यक्ति भी हैं, क्लोरोफेनविनफोस के लिए अनुदत्त रजिस्ट्रीकरण प्रमाणपत्रों को वापस ले लेगी ।

4. यदि कोई व्यक्ति, जो रजिस्ट्रीकरण प्रमाणपत्र धारक है, खंड (3) में निर्दिष्ट रजिस्ट्रीकरण समिति को छह मास की अवधि के भीतर प्रमाणपत्र वापस करने में असफल रहता है तो उक्त अधिनियम की धारा 14 के अधीन कार्यवाही की जाएगी ।

Now, therefore , in exercise of the powers conferred by sub - section (2) of section 27 read with section 28 of the Insecticides Act, 1968 (46 of 1968 ) , the Central Government hereby makes the following Order , namely: -

ORDER

1. This Order may be called the Banning of Chlorofenvinphos Order, 2008 .

2. No person shall manufacture , import and use Chlorofenvinphos .

3. The Registration Committee shall call back the certificates of registration granted for Chlorofenvinphos from all registrants including new registrants .

4. If any person who holds the certificate of registration fails to return the certificate to the Registration Committee , referred to in clause (3 ) , within a period of six months , action shall be taken under section 14 of the said Act .

5. Every State Government shall take all such steps under the provisions of the said Act and the rules made thereunder , as it considers necessary for the execution of this Order in the State .

का.आ. 3008(अ). केंद्रीय सरकार ने कीटनाशी अधिनियम, 1968 ( 1968 का 46) की धारा 5 के अधीन रजिस्ट्रीकरण समिति का गठन किया है और इस बात का अन्वेषण करने के लिए कि भारत में कतिपय कीटनाशियों के निरंतर उपयोग से मानवों या पशुओं में ऐसा जोखिम अंतर्वलित होगा जो उसे तुरंत कार्रवाई करने के लिए समीचीन और आवश्यक बनाता हो , विशेषज्ञ समूह का गठन किया है ;

और केंद्रीय सरकार का उक्त विशेषज्ञ समूह की सिफारिशों पर विचार करने के पश्चात् और उक्त अधिनियम के अधीन गठित रजिस्ट्रीकरण समिति से परामर्श करने के पश्चात् यह समाधान हो गया है कि आईप्रोडीन का उपयोग मानव स्वास्थ्य और पर्यावरण के लिए हानिजनित है ;

वह प्रारूप आदेश, जिसे केंद्रीय सरकार बनाने का प्रस्ताव करती है, ऐसे सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है जिनके उससे प्रभावित होने की संभावना है ; और यह सूचना दी जाती है कि उक्त प्रारूप आदेश पर उस तारीख से, जिसको उस आदेश वाले भारत के आदेश की प्रतियां जनता को उपलब्ध करा दी जाती है, पैंतालीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ;

उक्त प्रारूप आदेश के संबंध में कोई सुझाव या आक्षेप इस प्रकार विनिर्दिष्ट अवधि के भीतर केंद्रीय सरकार को, संयुक्त सचिव (वनस्पति संरक्षण) , कृषि मंत्रालय कृषि और सहकारिता विभाग, कृषि भवन, नई दिल्ली 110001 को भेजा जा सकेगा ।

अतः , अब केंद्रीय सरकार, कीटनाशी अधिनियम, 1968 (1968 का 46) की धारा 28 के साथ पठित धारा 27 की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित आदेश करने का प्रस्ताव करती है, अर्थात्:-

प्रारूप आदेश

1. इस आदेश का संक्षिप्त नाम आईप्रोडीन का प्रतिबंध आदेश , 2008 है ।

2. कोई व्यक्ति कृषि में आईप्रोडीन का उपयोग नहीं करेगा ।

3. रजिस्ट्रीकरण समिति, सभी रजिस्ट्रीकृत व्यक्तियों से, जिसके अंतर्गत नए रजिस्ट्रीकृत व्यक्ति भी हैं, आईप्रोडीन के लिए अनुदत्त रजिस्ट्रीकरण प्रमाणपत्रों को वापस ले लेगी ।

4. यदि कोई व्यक्ति, जो रजिस्ट्रीकरण प्रमाणपत्र धारक है, छह मास की अवधि के भीतर खंड (2) में निर्दिष्ट रजिस्ट्रीकरण समिति को रजिस्ट्रीकरण प्रमाणपत्र वापस करने में असफल रहता है तो उक्त अधिनियम कीधारा 14 के अधीन कार्यवाही की जाएगी ।

Whereas , the Central Government has constituted the Registration Committee under section 5 of the Insecticides Act . 1968 (46 of 1968) and set up an Expert Group with a view to investigate as to whether the continued use of certain insecticides in India will involve such risk to human beings or animals as it render it expedient or necessary to take immediate action;

And whereas the Central Government, after considering the recommendations of the said Expert Group and after consultation with the Registration Committee, set up under the said Act is satisfied that the use of Iprodione involves health hazards to human beings and environment;

The Draft Order , which the Central Government proposes to make, is hereby published for information of all persons likely to be affected thereby ; and notice is hereby given that the said Draft Order shall be taken into consideration after expiry of a period of forty - five days from the date on which the copies of the Gazette of India containing the Order are made available to the public .

Any suggestion or objection in respect of the said Draft Order may be forwarded to the Central Government within the period so specified to the Joint Secretary (Plant Protection), Ministry of Agriculture , Department of Agriculture and Cooperation , Krishi Bhavan , New Delhi - 110 001.

Now, therefore, in exercise of the powers conferred by sub - section (2) of section 27 read with section 28 of the Insecticides Act , 1968 (46 of 1968 ) , the Central Government hereby proposes to make the following Order , namely:

DRAFT ORDER

1. This Order may be called the Banning of Iprodione Order , 2008 .

2. No person shall use Iprodione in Agriculture .

3. The Registration Committee shall call back the certificates of registration granted for Iprodione from all registrants including new registrants.

4. If any person who holds the certificate of registration fails to return the certificate to the Registration Committee, referred to in clause (3 ) , within a period of six months , action shall be taken under section 14 of the said Act .

5. Every State Government shall take all such steps under the provisions of the said Act and the rules made thereunder , as it considers necessary for the execution of this Order in the State .

3. रजिस्ट्रीकरण समिति, सभी रजिस्ट्रीकृत व्यक्तियों से, जिसके अंतर्गत नए रजिस्ट्रीकृत व्यक्ति भी हैं, लिनयूरोन के लिए अनुदत्त रजिस्ट्रीकरण प्रमाणपत्रों को वापस ले लेगी ।

4. यदि कोई व्यक्ति, जो रजिस्ट्रीकरण प्रमाणपत्र धारक है, छह मास की अवधि के भीतर खंड (3) में निर्दिष्ट रजिस्ट्रीकरण समिति को रजिस्ट्रीकरण प्रमाणपत्र वापस करने में असफल रहता है, उक्त अधिनियम की धारा 14 के अधीन कार्यवाही की जाएगी ।

4. If any person who holds the certificate of registration fails to return the certificate to the Registration Committee , referred to in clause (3 ) , within a period of six months , action shall be taken under Section 14 of the said Act .

5. Every State Government shall take all such steps under the provisions of the said Act and the rules made thereunder , as it considers necessary for the execution ofthis Order in the State .
