सं. टीएएमपी/33/2004-वीएसएल. महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 48 द्वारा प्रदत्त शक्तियों का उपयोग करते हुए, महापत्तन प्रशुल्क प्राधिकरण , एतद्वारा , विशाखापत्तनम् पत्तन न्यास स्थित ईक्यू-४ और ईक्यू-9 संख्या वाली बंथों के प्रचालन के लिए वैज़ाग सीपोर्ट प्राइवेट लिमि. के प्रचलित दरमान की वैद्यता , संलग्न आदेशानुसार बढ़ाता है ।

यह प्रकरण विशाखापत्तनम् पत्तन न्यास ( वीपीटी ) स्थित ईक्यू-8 और ईक्यू-9 संख्या वाली बर्थों के प्रचालन के लिए वैज़ाग सीपोर्ट प्राइवेट लिमिटेड (वीएसपीएल ) के प्रचलित दरमान की वैद्यता को विस्तार देने से संबधित है ।
2. इस प्राधिकरण ने वीएसपीएल के प्रचलित दरमान की वैद्यता को 30 जून , 2008 तक विस्तार देते हुए , 28 जनवरी , 2008 को एक आदेश पारित किया था । वैद्यता को 30 सितम्बर, 2008 के आदेश द्वारा 31 दिसम्बर , 2008 तक या स्वीकृत किए जाने वाले संशोधित दरमान को लागू करने की प्रभावी तिथि तक, इनमें से जो भी पहले हो , विस्तार दिया गया था ।
3. वीएसपीएल ने, लागत अनुमानों को परिवर्तित करते हुए, एक संशोधित प्रस्ताव प्रस्तुत किया है और इसने मूलरूप से प्रस्तावित दरमान में कुछ फेर बदल प्रस्तावित किए हैं ।
4. संशोधित प्रस्ताव पर संयुक्त सुनवाई के आयोजन के बाद ही संशोधित प्रस्ताव पर निर्णय लिया जाएगा । इस तथ्य को ध्यान में रखते हुए कि प्रकरण को बंद करने से पहले और अधिक विश्लेषण और जाँच- पड़ताल के लिए कुछ और समय की आवश्यकता हो सकती है, यह प्राधिकरण प्रचलित दरमान की वैद्यता 31 मार्च, 2009 या स्वीकृत किए जाने वाले संशोधित दरमान को लागू करने की प्रभावी तिथि तक, इनमें से जो भी पहले हो , विस्तार प्रदान करता है ।

NOTIFICATION
Mumbai , the 26th December , 2008
No. TAMP/33/2004- VSL .--In exercise of the powers conferred by Section 48 ofthe Major Port Trusts Act, 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of the existing Scale of Rates of the Visag Seaport Private Limited for operation of the berth numbers EQ- 8 and EQ- 9 at the Visakhapatnam Port Trust as in the Order appended hereto.

This case relates to the extension of the validity of the existing Scale of Rates ( SOR) of the Vizag Seaport Private Limited (VSPL) for its operation at the berth numbers EQ- 8 and EQ-9 at the Visakhapatnam Port Trust (VPT) .
2. This Authority has passed an Order on 28th January, 2008 extending the validity of the existing Scale of Rates (SOR) of the VSPL till 30th June , 2008. The validity was further extended vide Order dated 30th September, 2008 till 31st December, 2008 or till effective date of implementation of the revised Scale of Rates to be approved, whichever isearlier .
3. The VSPL has filed a revised proposal modifying the cost estimates and has also proposed modifications in the SOR proposed originally .
4. The revised proposal will be decided after the joint hearing in the revised proposal is held . Considering the fact that the some more time might be required for further analysis and scrutny before closing the case , this Authority extends the validity of the existing Scale of Rates till 31st March, 2009 or till effective date of implementation of the revised Scale of Rates to be approved , whichever is earlier .
