सं. टीएएमपी/33/ 2003 - एनएमपीटी. महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 49 द्वारा प्रदत्त शक्तियों का उपयोग करते हुए , महापत्तन प्रशुल्क प्राधिकरण , एतद्वारा , न्यू मंगलौर पत्तन न्यास द्वारा पट्टे पर दिए भूखंड के पट्टा किराए की वैद्यता को दीर्घ अल्प कालिक आधार पर, संलग्न आदेशानुसार विस्तार प्रदान करता है ।

न्यूमंगलौर पत्तन न्यास ( एनएमपीटी ) द्वारा दीर्घकालिक/ अल्पकालिक आधार पर पट्टे पर आबंटित भू- खंडों के पट्टा किराया इस प्राधिकरण द्वारा पिछली बार 20 जनवरी , 2005 को संशोधित किए गए थे । इस प्राधिकरण द्वारा अनुमोदित पट्टा किराया पिछले प्रभाव 20 फरवरी , 2002 से लागू किए गए थे और 19 फरवरी , 2007 तक पांच वर्ष की अवधि के लिए वैध थे ।
2. इस प्राधिकरण ने इन पट्टा किरायों की वैधता 20 फरवरी , 2007 से छः माह बढ़ाने के लिए 28 मार्च , 2007 को एक आदेश पारित किया था । तदनन्तर , इनकी वैधता को दिनांक 28 जनवरी , 2008 के आदेश द्वारा 30 जून , 2008 या उस आदेशक के क्रियान्वयन की प्रभावी तिथि, जो पत्तन न्यास द्वारा दाखिल किए जाने वाले प्रस्ताव पर पारित किया जाएगा , इनमें से जो भी पहले हो , तक बढ़ाया गया था ।
3. भूखंडों के पट्टा किराया के संशोधन के लिए एनएमपीटी द्वारा दाखिल प्रस्ताव पर , सामान्य परामर्शी प्रक्रिया का अनुपालन करते हुए आवश्यक प्रक्रिया कर दी गई है । परामर्शी प्रक्रिया के एक भाग के रूप में संयुक्त सुनवाई का आयोजन किया जाना है । संयुक्त सुनवाई के पश्चात् आंतरिक जांच पड़ताल और विश्लेषण के लिए कुछ और समय की आवश्यकता होगी ।

4. जैसा कि वर्तमान पट्टा किरायों की वैधता 30 जून , 2008 को समाप्त हो गयी है और क्योंकि पट्टा किरायों को अंतिम रूप देने के लिए संयुक्त सुनवाई के बाद कुछ और समय की आवश्यकता होगी , यह प्राधिकरण वर्तमान पट्टा किरायों की वैधता इनकी समाप्त होने की तिथि से 31 मार्च , 2009 तक या इस प्राधिकरण द्वारा पारित किये जानेवाले आदेश के क्रियानवयन की प्रभावी तिथि तक इनमें से जो भी पहले हो , वैधता को विस्तार प्रदान करता है ।

TARIFF AUTHORITY FOR MAJOR PORTS
NOTIFICATION
Mumbai , the 26th December, 2008
No. TAMP/33/2003 -NMPT . In exercise of the powers conferred by Section 49 of the Major Port Trusts Act, 1963 (38 of 1963) , the Tariff Authority for Major Ports hereby extends the validity of lease rentals in respect of land leased bythe New Mangalore Port Trust on long/short term basis as in the Order appended hereto.

The lease rental of the lands allottedby the New Mangalore Port Trust (NMPT) of long term/short term basis were last revised by this Authority on 20th January, 2005. The lease rentals approved by this Authority were implementable with retrospective effect from 20th February, 2002 and were valid for period offive years , i.e. upto 19th February , 2007 .
2. This Authority had passed an Order on 28th March, 2007 extending the validity of the lease rentals for six months period with effect from 20th February , 2007. Subsequently , the validity was further extended vide Order dated 28th January, 2008 up to 30th June , 2008 or till the effective date of implementation of the Order to be passed on the proposal filedby the Port Trust whichever is earlier .
3. The proposal filed by the NMPT for revision of lease rentals of lands has been processed following the usual consultation process . As part of the consultative process , a joint hearing is to be set up . Subsequent to the joint hearing , some more time may be required for internal scrutiny and analysis .
4.As thevalidityof the existing lease rentals has expired on 30th June , 2008 and as some more time may be required after the joint hearing for finalising the case, this Authority extends the validity of the existing lease rentals from the date of its expiry till 31st March, 2009 or till effective date of implementation ofthe Order to be passed by this Authority, whichever isearlier.
