सं. टीएएमपी/71 /2005-जीटीआईपीएल. महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 48 द्वारा प्रदत्त शक्तियों का उपयोग करते हुए, महापत्तन प्रशुल्क प्राधिकरण , एतद्वारा , गेटवे टर्मिनल्स इंडिया प्राइवेट लिमिटेड के दरमान की वैद्यता को , संलग्न आदेशानुसार 31 मार्च, 2009 तक बढ़ाते हैं ।

इस प्राधिकरण ने दिनांक 23 अगस्त, 2006 के अपने आदेश द्वारा गेटवे टर्मिनल्स इंडिया प्राइवेट लिमिटेड ( जीटीआईपीएल ) के दरमान को 31 दिसम्बर , 2008 तक की वैधता के साथ , अधिसूचना सं. 138 के माध्यम से 13 सितम्बर , 2006 को अधिसूचित किया था ।
2. जीटीआईपीएल ने दिनांक 14 अक्तूबर , 2008 के अपने पत्र द्वारा अपने प्रशुल्क के सामान्य संशोधन के लिए प्रस्ताव दाखिल किया है । जीटीआईपीएल के प्रस्ताव को आनुषंगिक उपयोगकर्ताओं/उपयोगकर्ता संगठनों के साथ परामर्श पर ले लिया गया है ।
3. जीटीआईपीएल प्रस्ताव पर परामर्शी प्रक्रिया जारी है और इस प्राधिकरण द्वारा उस पर अंतिम विचार - विमर्श के लिए परिपक्व होने में इस प्रकरण को कुछ और समय लगेगा । इसलिए , जीटीआईपीएल के प्रचलित दरमान की वैधता को 31 दिसम्बर , 2008 से आगे बढ़ाना आवश्यक हो गया है ।
4. अतएव, यह प्राधिकरण जीटीआईपीएल के प्रचलित दरमान की वैधता को 31 मार्च , 2009 तक अथवा अपने प्रशुल्क के सामान्य संशोधन हेतु जीटीआईपीएल के प्रस्ताव पर पारित होने वाले आदेश के क्रियान्वयन की प्रभावी तिथि तक , इनमें से जो भी पहले हो , विस्तार प्रदान करता है ।

TARIFF AUTHORITY FOR MAJOR PORTS
NOTIFICATION
Mumbai , the 26th December , 2008
No. TAMP/ 71/2005-GTIPL . In exercise ofthe powers conferred under Section 48 of the Major Port Trusts Act , 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of the Scale of Rates at the Gateway Terminals India Private Limited up to 31st March, 2009 as in the Order appended hereto .
ORDER
Case No. TAMP/71 /2005- GTIPL
(Passed on this 17th day of December, 2008)
This Authority vide its Order dated 23rd August, 2006 had notified the Scale of Rates of Gateway Terminals India Private Limited (GTIPL) with a validity period till 31st December , 2008 vide Notification No. 138 dated 13th September, 2006 .
2. The GTIPL vide its letter dated 14th October , 2008 has filed its proposal for general revision of its tariff. The GTIPL proposal has been taken on consultation with the relevant users/user organizations .
3. The consultation process on the GTIPL proposal is on and it will take some more time for the case to mature for final consideration by this Authority . It is , therefore , necessary to extend the validity of the existing Scale of Rares at GTIPL beyond 31 st December, 2008 .
4. This Authority, therefore , extends the validity of the existing Scale of Rates at GTIPL till 31st March, 2009 or till the effective date of implementation of the Order to be passed on the proposal of GTIPL for general review of its tariff, whichever is earlier .
