आ.अ. ३( अ ). यतः, मध्य प्रदेश राज्य की विधान सभा के निर्वाचित सदस्यों द्वारा निर्वाचित श्री लक्ष्मीनारायण शर्मा का स्थान, उनकी पदावधि जो 29 जून, 2010 को सम्मिलित करते हुए, उस तारीख तक थी, के समाप्त होने से पूर्व उनकी मृत्यु होने के कारण 17 अक्तूबर , 2008 को रिक्त होगई है; और
यतः , इस प्रकार हुई रिक्ति को भरने के प्रयोजन से उप - निर्वाचन कराना है;
अतः, अब, लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43 ) की धारा 147, धारा 39 की उप- धारा ( 1 ) और धारा 56 के अनुसरण में, भारत निर्वाचन आयोग एतद्वारा :-
(अ) मध्य प्रदेश राज्य की विधान संभा के निर्वाचित सदस्यों से यह अपेक्षा करता है कि वे 24 जनवरी , 2009 ( शनिवार ) से पूर्व तथा उक्त अधिनियम और तद्दीन बनाए गए नियमों और किए गए आदेशों के उपबंधों के अनुसार राज्य सभा में उक्त रिक्ति को भरने के प्रयोजन से एक :
व्यक्तिनिर्वाचित कर दें ;
(आ) उक्तनिर्वाचन के संबंध में,-
(क) नाम- निर्देशन करने की अन्तिम तारीख
12जनवरी , 2009 (सोमवार)
(ख) नाम-निर्देशन की संवीक्षा की तारीख
13जनवरी , 2009 (मंगलवार)
(ग) अभ्यर्थिताएं वापस लेने की अंतिम तारीख
15जनवरी , 2009 (गुरुवार)
(घ) वह तारीख, जिसको यदि आवश्यक हुआ तो मतदान होगा , और 22जनवरी, 2009 ( गुरुवार)
(ङ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न कर लिया जाएगा
24जनवरी , 2009 ( शनिवार )
नियत करता है , और
(इ) 9.00 बजे पूर्वाह्न से 4.00 बजे अपराह्न तक का समय ऐसे समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ तो, निर्वाचन के लिए उपर्युक्तविनिर्दिष्ट तारीख को , मतदान होगा ।

NOTIFICATION
New Delhi , the 5th January, 2009
Ο.Ν. 3 (E) .- Whereas , the seat of Shri Laxminarayan Sharma in the Council of States , elected by the elected members ofthe Legislative Assembly of the state of Madhya Pradesh , has become vacant on 17th October, 2008 by the reason ofhis death , before the expiration of his term of office which was up to and including the 29th June , 2010 ; and
Whereas , a bye - election is to be held for the purpose of filling the vacancy so caused;
Now, therefore, in pursuance of Section 147 sub- section ( 1 ) of Section 39 and Section 56 of the Representation of the People Act, 1951 (43 of 1951 ) , the Election Commission of India hereby:----
(A) calls upon the elected members of the Legislative Assembly of the State of Madhya Pradesh to elect , before 24th January, 2009 ( Saturday) and in accordance with the provisions of the said Act and of the rules and orders made thereunder , a person for the purpose of filling the said vacancy in the Council of States ;
(B) appoints, with respect to the said election :
(a) the 12th January , 2009 ( Monday) , as the last date for making nominations ;
(b) the 13th January , 2009 ( Tuesday) , as the date for the scrutiny of the nominations ;
(c) the 15th January, 2009 ( Thursday) , as the last date for the withdrawal of candidatures;
(d) the 22nd January , 2009 ( Thursday) , as the date on which a poll shall, if necessary , be taken; and (e) the 24th January, 2009 ( Saturday) , as the date before which the election shall be completed ; and }
(C) fixes the hours from 9.00 A.M. to 4.00 P.M. as the hours during which the poll shall , if necessary be taken on the date specified above for the election.

आ.अ. 4( अ). लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 21 के अनुसरण में और धारा 22 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निर्वाचन आयोग , मध्य प्रदेश राज्य सरकार के परामर्श से एतद्वारा , तारीख 5 जनवरी , 2009 को भारत के राजपत्र में प्रकाशित आयोग के अधिसूचना के अनुसरण में इस राज्य में राज्य सभा के लिए उप - निर्वाचन के संबंध में : -
( i ) नीचे की सारणी के स्तम्भ ( 1 ) में विनिर्दिष्ट अधिकारी को रिटर्निंग आफिसर के रूप में पदाभिहित करता है; और
( ii ) उक्त सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट अधिकारी को रिटर्निंग आफिसर की उसके कृत्यों के पालन में सहायता के लिए सहायक रिटर्निंग आफिसर नियुक्त करता है ।

O.N. 4(E). In pursuance of Section 21 , and in exercise of the powers conferred by sub- section (1 ) of Section 22, of theRepresentation of the People Act, 1951 (43 of 1951 ) , the Election Commission of India , in consultation with the Government of the State of Madhya Pradesh, hereby:---
(i) designates the officer, specified in column ( 1) of the Table below, to be the Returning Officer, and
(ii) appoints the officer, specified in column (2) of the said Table, to be the Assistant Returning Officer to assist the Returning Officer in the performance ofhis functions;
in respect of the bye-election to the Council of States , to be held in that State in pursuance ofthe Commission's Notification, published in the Gazette of India on 5th January, 2009 :---
