नई दिल्ली, 12 जनवरी , 2009 सं. 1/2009- केन्द्रीय उत्पाद शुल्क
सा.का.नि. 19(अ).-केन्द्रीय सरकार, केन्द्रीय उत्पाद शुल्क अधिनियम , 1944 ( 1944 का 1 ) की धारा 5क की उप- धारा ( 1 ) के साथ पठित अतिरिक्त उत्पाद शुल्क ( विशेष महत्व का माल ) अधिनियम , 1957 ( 1957 का 58 ) की धारा 3 की उप- धारा (3 ) और वित्त अधिनियम, 2001 ( 2001 का 14 ) की धारा 136 की उप- धारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह समाधान हो जाने पर कि लोकहित में ऐसा करना आवश्यक है, भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग ) की अधिसूचना सं. 8/2004- केन्द्रीय उत्पाद शुल्क, तारीख 21 जनवरी , 2004 , जो भारत के राजपत्र , असाधारण, भाग II , खंड 3 , उप- खंड ( i ) में सं. सा.का.नि. 60( अ ) , तारीख 21 , जनवरी , 2004 द्वारा प्रकाशित की गई थी , में निम्नलिखित और संशोधन करती है, अर्थात्:-
उक्त अधिसूचना में, शर्त ( घ ) में, खंड ( 1 ) में, शब्दों और कौमा " मुख्य आयुक्त, उत्पाद शुल्क , शिलोंग , उस प्रदेश के उद्योग विभाग का प्रधान सचिव, जिसमें विनिवेश किया गया है और उस प्रदेश के उद्योग का प्रधान जिसमें इकाई स्थित है " के स्थान पर शब्द और कौमा " मुख्य आयुक्त , उत्पाद शुल्क, शिलोंग , उस प्रदेश के उद्योग विभाग का प्रधान सचिव या सचिव या आयुक्त, जिसमें विनिवेश किया गया है और उस प्रदेश के उद्योग का प्रधान सचिव या सचिव या आयुक्त, जिसमें इकाई स्थित है " प्रतिस्थापित किए जाएंगे ।

टिप्पण:- मूल अधिसूचना सं. 8/2004- केन्द्रीय उत्पाद शुल्क, तारीख 21 जनवरी , 2004 भारत के राजपत्र , असाधारण , भाग II , खंड 3 , उप- खंड ( i ) में सं. सा.का.नि. 60 ( अ ) , तारीख 21 जनवरी , 2004 द्वारा प्रकाशित की गई थी और उसमें अंतिम संशोधन अधिसूचना सं. 11 /2007 - केन्द्रीय उत्पाद शुल्क, तारीख 1 मार्च , 2007 द्वारा किया गया था जो भारत के राजपत्र, असाधारण , भाग II , खंड 3 , उप- खंड ( 1 ) में सा.का.नि. 140(अ ) , तारीख वही, द्वारा प्रकाशित की गई थी ।

No. 1/2009-Central Excise
G.S.R. 19 (E) . In exercise of the powers conferred by sub - section (1 ) of Section 5A of the Central Excise Act, 1944 (1of1944), read with sub- section (3) ofSection 3 ofthe Additional Duties of Excise (Goods of Special Importance) Act, 1957 (58 of 1957) and sub- section (3 ) of Section 136 of the Finance Act, 2001 (14 of 2001 ) , the Central Government , on being satisfied that it is necessary in the public interest so to do , hereby makes the following further amendment in the notification oftheGovernment ofIndia in the Ministry of Finance (Department of Revenue) , No. 8/2004- Central Excise , dated the 21st January, 2004 which was published in the Gazette of India, Extraordinary , Part II , Section 3 , Sub- section (i) vide number G.S.R. 60(E) ofthe same date , namely:---
Inthe said notification, in condition (D), in clause (i) , for the words and comma " Committee , consisting ofthe Chief Commissioner of Central Excise, Shillong, the Principal Secretary in the Department of Industry of the State concerned in which the unit is located and the Principal Secretary in the Department of Industry of the State in which the investment is being made , " the words and comma " Committee , consisting of the Chief Commissioner of Central Excise , Shillong, the Principal Secretary or the Secretary or the Commissioner in the Department of Industry of the State concerned in which the unit is located and the Principal Secretary or the Secretary or the Commissioner in the Department of Industry of the State inwhich the investment is being made ," shall be substituted.
