का.आ. 133(अ).-केन्द्रीय सरकार , न्यूनतम मजदूरी अधिनियम , 1948 की धारा 4 की उप- धारा ( 1 ) के खंड ( i ) और धारा 5 की उप- धारा ( 1 ) के खंड ( ख ) के साथ पठित धारा 3 की उप- धारा ( 1 ) के खंड ( क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , सलाहकार बोर्ड के साथ परामर्श करने के पश्चात्, भारत सरकार , श्रम और रोजगार मंत्रालय की राजपत्र अधिसूचना संख्या का.आ. 1352 ( अ ) , तारीख 24 अगस्त, 2006 को अधिक्रांत करते हुए, " जिप्सम खानों, बैराइट्स खानों , बाक्साइट खानों, मैंगनीज खानों, चाइना क्ले खानों , क्यानाइट खानों, ताँबा खानों, क्ले खानों, मेग्नेसाइट खानों , व्हाइट क्ले खानों , पत्थर खानों , स्टेटलाइट खानों ( सोप स्टोन एवं टैल्क उत्पादित करने वाली खानों सहित ) , गेरू खानों, ऐस्बेस्टस खानों, फायर क्लेखानों, क्रोमाइट खानों, क्वार्टजाइट खानों, क्वार्ट्ज खानों , सिलिका खानों, ग्रेफाइट् खानों, फेल्सपर खानों, लेटेराइट खानों, डोलोमाइट खानों, रेड आक्साइड खानों, वॉल्फार्म खानों, लौह अयस्क खानों, ग्रेनाइट खानों, रॉक फास्फेट खानों , हेमेटाइट खानों, संगमरमर खानों और कैलसाइट खानों, यूरेनियम खानों, अभ्रक खानों, लिग्नाइट खानों, ग्रेवल खानों , स्लेट खानों एवं मेग्नेटाइट खानों " में लगे कर्मचारियों को प्रारूप प्रस्ताव और संदर्भ में यथा- उल्लिखित और अनुसूची में यथा- विनिर्दिष्ट मजूदरी दरों में संशोधन करने का प्रस्ताव करती है । इससे प्रभावित होने वाले सभी व्यक्तियों को सूचना दी जाती है कि उक्त प्रारूप प्रस्ताव पर इस अधिसूचना के राजपत्र में प्रकाशित प्रतियां जनता को उपलब्ध कराये जाने की तारीख से दो मास की अवधि समाप्त होने के पश्चात्विचार किया जायेगा ।
उपर्युक्त निर्धारित समय सीमा के भीतर उक्त प्रारूप प्रस्ताव के संबंध में किसी व्यक्ति या संगठन से प्राप्त आक्षेपों या सुझाव पर केन्द्रीय सरकार द्वारा विचार किया जायेगा । आपेक्ष और सुझाव, सचिव , श्रम और रोजगार मंत्रालय , श्रम शक्ति भवन, रफी मार्ग , नई दिल्ली -110001 को भेजे जायेंगे ।

प्रारूप प्रस्ताव
प्रस्तावित न्यूनतम मजदूरी दरों में इस अधिसूचना में नीचे दी गई अनुसूची के भाग- । और 2 के स्तंभ (2) में यथाउल्लिखित क्षेत्रों में कार्यरत श्रेणियों के कर्मचारियों के लिए (क) अनुसूची के भाग 1 के स्तंभ (3) और (4) में निर्धारित मूल मजदूरी दरें, और (ख) अनुसूची के भाग-2 के स्तंभ (3) और (4) में दिए गए अनुसार देय विशेष भत्ता ( जिसे इसमें इसके पश्चात् परिवर्ती महंगाई भत्ते कहा गया है) सम्मिलित होंगे । परिवर्ती महंगाई भत्ते को मुख्य श्रमायुक्त(केन्द्रीय) द्वारा प्रत्येक वर्ष 1 अक्तूबर और 1 अप्रैल से प्रारंभ होने वाली छमाही अवधि के लिए क्रमशः 30 जून और 31 दिसम्बर को समाप्त पूर्ववर्ती छमाही अवधि के लिए औद्योगिक श्रमिकों संबंधी औसत उपभोक्ता मूल्य सूचकांक (आधार 2001 = 100 ) के आधार पर , अनुसूची के भाग 2 के स्तंभ (3 ) और (4) में विनिर्दिष्ट दर और रीति से निम्नानुसार समायोजित की जाएगी । अनुसूची के भाग 3 में यथा-वर्णित कर्मचारियों का वर्गीकरण निम्नानुसार है: -

स्पष्टीकरण: - अधिसूचना के प्रयोजन के लिए
1. मजदूरी की न्यूनतम दरों में मूल दरें , निर्वाह भत्ते अर्थात् विशेष भत्ते की लागत तथा आवश्यक वस्तुओं की रियायती आपूर्ति का नकद मूल्य , यदि कोई हो, सहित सभी कुछ शामिल हैं ।
2. मजदूरी की न्यूनतम दरों में साप्ताहिक अवकाश दिवस की मजदूरी भी शामिल है ।
3. मजदूरी की न्यूनतम दरें ठेकेदारों द्वारा नियोजित कर्मचारियों पर लागू होती है ।
4. विकलांग व्यक्तियों के लिए मजदूरी की न्यूनतम दरें समुचित श्रेणी के कर्मकारों को संदेय दरों के समान ही होगी ।
5. (क) " अकुशल कार्य " से वह कार्य अभिप्रेत है जिसमें यह साधारण प्रचालन शामिल है जिसके लिए कार्य के संबंध में अल्प या किसी भी कौशल अथवा अनुभव की आवश्यकता नहीं है;
(ख ) " अर्ध- कुशल कार्य " से वह कार्य अभिप्रेत है जिसके लिए कार्य के संबंध में अनुभव द्वारा अर्जित कुछ मात्रा में कौशल या सक्षमता शामिल है और जो एक कुशल कर्मचारी के पर्यवेक्षण या मार्गदर्शन के अंतर्गत किये जाने के योग्य है और इसमें पर्यवेक्षी कार्य शामिल है;
(ग) "कुशल कार्य " से वह कार्य अभिप्रेत है जिसमें कार्य के संबंध में अनुभव द्वारा या किसी तकनीकी या व्यावसायिक संस्थान में एक शिक्षु के रूप में प्रशिक्षण के माध्यम से अर्जित कौशल या सक्षमता शामिल है और जिसका निष्पादन पहल करने या निर्णय लिने के लिए आवश्यक है;
(घ) " खनिक" से वह कर्मकार अभिप्रेत है जो किसी खान में उत्खनन , बटोरने , छंटाई, ड्रेसिंग , संसाधन और भार ढोने और उसके आनुषंगिक कार्यों के माध्यम से खुदाई/निष्कर्षण के कार्य में सीधे लगे हुए हैं; और
(ङ) " अत्यधिक कुशल कार्य " से वह कार्य अभिप्रेत है जिसके लिए कतिपय कार्यों के निष्पादन में उच्च श्रेणी में पूर्णता और पूर्ण सक्षमता आवश्यक है जो गहन तकनीकी या व्यावसायिक प्रशिक्षण अथवा दीर्घ अवधि के लिए व्यावहारिक कार्य अनुभव के माध्यम से अर्जित की हो और इसमें कर्मचारी को अपने कार्य के निष्पादन में शामिल उसके निर्णय या विनिश्चय के लिए पूर्ण उत्तरदायित्व भी आवश्यक है ।
6. किसी खान में कार्यरत या नियोजित अथवा इसके संबंध में कार्यरत अथवा नियोजित व्यक्ति को " भूमिगत " कार्यों में या नियोजित कहा जाता है यदि वह निम्नलिखित में कार्यरत 9

अथवा नियोजित हो: -
(i) ऐसी शाफ्ट जो पानी में डूबी रही हो अथवा डूबने की अवस्था में हो; या
(ii ) उपरिवर्ती भूमि के नीचे किए जाने वाले उत्खनन में; या
(iii) किसी ऐसी ओपन कास्ट में कार्य जिसमें इसके उच्च्तम शिखर से इसके सबसे निचले बिन्दु तक की मापी गई गहराई छः मीटर से अधिक हो ।
7. जहां किसी संविदा अथवा अन्यथा के आधार पर किसी कर्मचारी की मजदूरी की न्यूनतम दरें अधिसूचित दरों से उच्च हैं, वहां उच्चतर दरें संरक्षित होंगी और इस अधिसूचना के प्रयोजन के लिए लागू मजदूरी की न्यूनतम दरों के रूप में मानी जाएंगी ।
8. जहां किसी क्षेत्र में पत्थर खानों के संबंध में इस अधिसूचना के अनुसार निर्धारित मजदूरी की न्यूनतम दरें किसी खान या खदान अथवा किसी अन्य व्यवस्था के अंतर्गत किए जाने वाले पत्थर तोड़ने या पत्थर कूटने से संबंधित कार्यों के नियोजन में नियोजित कर्मचारियों के लिए राज्य सरकार द्वारा निर्धारित मजदूरी की न्यूनतम दरों से उच्चतर हैं, वहां पत्थर खानों के नियोजन में नियोजित कर्मकारों को मजदूरी की उच्च दर संदेय होगी और उस मजदूरी को इस अधिसूचना के अंतर्गत निर्धारित मजदूरी की न्यूनतम दर समझा जाएगा ।
9. पुरुष और महिला कर्मचारियों को समान प्रकृति के कार्य या कार्यों के लिए समान दर पर मजूदरी प्राप्त होगी ।
10. न्यूनतम मजदूरी अधिनियम , 1948 के अंतर्गत प्रवर्तनीय मजदूरी की न्यूनतम दरों में मजदूरी की न्यूनतम दरें और परिवर्ती महंगाई भत्ता , दोनों शामिल हैं ।

New Delhi , the 13th January , 2009
S.O. 133 (E) . In exercise of the powers conferred by clause (a) of sub- section ( 1 ) of section 3 read with clause ( i ) of sub section ( 1 ) of section 4 and clause ( b ) of sub section ( 1 ) of section 5 of the Minimum Wages Act , 1948 , the Central Government after consulting the Advisory Board hereby proposes to revise the rate of wages as specified in the Schedule as mentioned hereinafter in the Draft Proposal and payable to the employees engaged in " Gypsum Mines , Barytes Mines , Bauxite Mines , Manganese Mines , China Clay Mines , Kyanite Mines , Copper Mines , Clay Mines , Magnesite Mines , White Clay Mines , Stone Mines , Steatite Mines (including the mines producing Soap Stones and Talc ), Ochre Mines , Asbestos Mines , Fire Clay Mines , Chromite Mines , Quartzite Mines , Quartz Mines , Silica Mines , Graphite Mines , Felspar Mines , Laterite Mines, Dolomite Mines , Red Oxide Mines , Wolfram Mines , Iron Ore Mines , Granite Mines , Rock Phosphate Mines , Hematite Mines , Marble and Calcite Mines , Uranium Mines , Mica Mines , Lignite Mines , Gravel Mines , Slate Mines and Magnetite Mines " in supersession of the Gazette notification number S.O. 1352 ( E ) , dated the 24th August, 2006 of the Government of India , Ministry of Labour and Employment . Notice is hereby given to all persons likely to be affected thereby that the said draft proposal shall be taken into consideration after expiry of two months from the date on which copies of this notification , as published in the Official Gazette , are made available to the public.
Any objection or suggestion , which may be received from any person or organization with respect to the said Draft Proposal within the time frame stipulated above, will be considered by the Central Government. The objections and suggestions shall be addressed to the Secretary , Ministry of Labour and Employment , Shram Shakti Bhawan , Rafi Marg , New Delhi -110001.

DraftProposal
The proposed minimum rates of wages shall consist of ( a) basic rates of wages as set out in columns (3) and (4) of Part I of the schedule mentioned hereunder and (b) a special allowance ( hereinafter referred to as Variable Dearness Allowance) in column (3) and ( 4) of Part Il of the Schedule and payable to the categories of employees working in mines mentioned in Column (2) of Parts - I and II thereof. The Variable Dearness Allowance shall be adjusted by the Chief Labour Commissioner (Central) at an interval of every six months commencing on the 1st October and 1st April of every year on the basis of the average Consumer Price Index Number for industrial Workers ( Base 2001 = 100) for the preceding period of six months ending on the 30th June and the 31st December every year respectively, at the rate of and in the manner specified in the columns ( 3) and (4) of Part II of the Schedule. The classification of workers will be as mentioned in Part - III of the Schedule as below:

Explanation : - For the purposes of this notification : -
1. The minimum rates of wages shall consist of all inclusive rates and include also the basic rates , the cost of living allowance say special allowance and the cash value of the concessional supply , if any , of essential commodities.
2. The minimum rates of wages also include the wages for weekly day of rest .
3. The minimum rates of wages are applicable to employees engaged by contractors also .
4. The minimum rates of wages for disabled persons shall be the same as payable to the workers of the appropriate category.
5. (a) "Unskilled work " means work which involves simple operations requiring little or no skill or experience on the job.
(b) " Semi- skilled work " means work which involves some degree of skill or competence acquired through experience on the job which is capable of being performed under the supervision or guidance of a skilled employee and includes supervisory work;
(c) "Skilled work " means work which involves skill or competence acquired through experience on the job or through training as an apprentice in a technical or vocational institute and the performance of which calls for initiative and judgment;
(d ) "Miner " means a worker who is directly involved / engaged in excavation /extraction by way of digging , picking , sorting , creasing , processing and loading and other incidental works thereto in a mine ; and
( e) "Highly Skilled work " means work which calls for a high degree of perfection and full competence in the performance of certain task acquired through intensive technical or professional training or practical work experience for long years and also requires of a worker to assume full responsibility for his judgment or decision involves in the execution of these tasks .

6. A person working or employed in or in connection with a mine is said to be working or employed " below ground " if he is working or employed: -
(i ) in a shaft which has been or in the course of being sunk ; or
(ii) in any excavation which extends below superjacent ground; or
(iii) in an open cast working in which the depth of the excavation measured from its highest to its lowest point exceeds six metres .
7. Where the existing rates of wages of any employee, based on contract or agreement or otherwise are higher than the rates notified , the higher rates shall be protected and treated as the minimum rates of wages for purpose of this notification .
8. Where in any area the minimum rates of wages fixed as per this notification in relation to stone mines are lower than the minimum rates of wages fixed by the State Government for the employees employed in the employment of stone- breaking or stone crushing operations carried on in any mine or quarry or under some other arrangement , the higher rate of wages shall be payable to the workers employed in the employment in the stone mines and that wage shall be considered to be the minimum rates of wages fixed under this notification .
9. Men and Women employees shall get the same rates of wages for the same work or works of a similar nature .
10. The minimum rates of wages and Variable Dearness Allowance both constitute the minimum rates of wages to be enforceable under the minimum Wages act , 1948.
