1 . " निर्यात एवं वसूली बैंक प्रमाण पत्र " से संबंधित परिशिष्ट 22 क और " डी ई पी बी आवेदन प्रपत्र " से संबंधित ए एन एफ 4छ क्रमशः 1 एवं 2 के रूप में इस सार्वजनिक सूचना के साथ संलग्न संशोधित परिशिष्ट 22 क और ए एन एफ 4छ द्वारा प्रतिस्थापित किया जाता है ।

2. वास्तविक रुप में प्राप्त पोत पर्यन्त निःशुल्क मूल्य और निर्यात आय की प्राप्ति की तिथि उन सभी मामलों में देनी पड़ेगी, जहाँ स्पष्ट अपरिवर्तनीय साख पत्र के मद्दे खेप भेजा गया है अथवा भारत सरकार/ एग्ज़िम बैंक लाइन आफ क्रेडिट के मद्दे किया गया निर्यात अथवा रोके गए भुगतान के प्रति किया गया निर्यात/ ईपीसीजी कवर द्वारा समर्थित सप्लायर्स लाईन आफ क्रेडिट संविदा को छोड़कर । इस प्रभाव के पृष्ठांकन को बी आर सी में पृष्ठांकित करने की आवश्यकता होगी ।
3. हमने यह भी सत्यापित किया है कि निर्यात की तिथि...... * (केवल वायुयान के द्वारा होने वाले निर्यात के सम्बन्ध में लागू) .......... है ।
4. यह प्रमाणित किया जाता है कि हमने निर्यातक द्वारा ऊपर घोषित अनुसार, जी.आर. प्रपत्र में .(अंको और शब्दों में) अदा की गई/ अदा की जाने वाली कमीशन की राशि प्रमाणित कर ली है और सही पाई गई है ।

टिप्पणी:
1. एक से अधिक खेप के लिए बैंक एक समेकित प्रमाण - पत्र (खेपवार) जारी कर सकता है ।
2. अपरिवर्तनीय शाखा पत्र के प्रति भेजी गई खेप के मामलों को छोड़कर सभी मामलों में किए गये निर्यात का वास्तविक रुप से वसूल किया गया पोत पर्यन्त निःशुल्क मूल्य और निर्यात की वसूली की तारीख दी जानी है ।
3. जहाँ नीति/ प्रक्रिया में विशेषतः उल्लेख किया गया है, वहाँ इसकी आवश्यकता होगी ।
4. इस परिशिष्ट में संदर्भित बैंकों में उन अन्य प्राधिकृत डीलर्स को भी शामिल किया जाएगा जिन्हें भारतीय रिजर्व बैंक द्वारा बी आर सी जारी करने की अनुमति दी गई है । आवेदन को इस संबंध में भारतीय रिजर्व बैंक से अनुमति के परिपत्र/ पत्र की एक प्रति प्रस्तुत करने की आवश्यकता होगी ।

घोषणा/ वचनबद्धता
1. मैं/ हम एतद्वारा घोषणा करता हूँ। करते हैं कि इस आवेदन में दिए गए ब्यौरे और विवरण मेरी जानकारी/ विश्वास के अनुसार सत्य और ठीक हैं तथा इससे कुछ भी छुपाया अथवा रोका नहीं गया है । यदि कोई जानकारी गलत या झूठी साबित होगी तो मुझे/ हमें कोई भी दण्डात्मक कार्रवाई अथवा अन्य परिणाम भुगतने पड़ सकते हैं जैसे कि विधि द्वारा निर्धारित या अन्यथा अपेक्षित हो ।
2. मैं/ हम विदेश व्यापार नीति, प्रक्रिया पुस्तक खण्ड 1 , प्रक्रिया पुस्तक खण्ड-2 और निर्यात और आयात मदों के आईटीसी एचएस वार्गीकरण के तहत बने नियमों व आदेशों, विदेश व्यापार (विकास और विनियमन) अधिनियम के प्रावधानों का पालन करने की शपथ लेता हूँ/ लेते हैं ।
3. मैं/ हम एतद्वारा प्रमाणित करता हूँ। करते हैं कि कोई भी स्वामी/ साझीदार (साझीदारों) /निदेशक ( निदेशकों) कर्ता/ फर्म का न्यासी/ कम्पनी, जैसा भी मामला हो, किसी अन्य फर्म/कम्पनी में स्वामी/ साझीदार (साझीदारों) / निदेशक ( निदेशकों) कर्ता/ न्यासी नहीं है जो कि विदेश व्यापार महानिदेशक की जानकारी में प्रतिकूल है ।
4. मैं/ हम सत्यापित करता हूँ। करते हैं कि फर्म/ कम्पनी का स्वामी/साझीदार/ निदेशक/कर्ता/ न्यासी, जैसा भी मामला हो, किसी ऐसी अन्य फर्म/ कम्पनी में स्वामी/ साझीदार/ निदेशक/ कर्ता के रुप में सम्बद्ध नहीं है जो भारतीय रिजर्व बैंक की चेतावनी सूची में आती है ।
5. मैं/ हम एतद्वारा घोषणा करता हूँ। करते हैं कि मैंने/ हमने निर्यात और आयात मदों के आईटीसी (एचएस) वर्गीकरण 2004-09 की अनुसूची 2 की परिशिष्ट 3 में शामिल स्कोमेट मदों की सूची का अनुसरण किया है और निर्यातित / निर्यात के लिए प्रस्तावित मद(मदें) इस सूची में नहीं आती हैं और मैं/ हम विदेश व्यापार नीति, आईटीसी (एचएस) की अनुसूची 2 और प्रक्रिया पुस्तक खण्ड 1 में शामिल स्कोमेट मदों के निर्यात के लिए विदेश व्यापार नीति के प्रावधानों का पालन करने का वचन देता हूँ/ देते हैं चाहे स्कीम कोई भी हो जिसके अधीन मद का निर्यात किया गया है/किया जाना है । ( रेखांकित हिस्से को हटा दिया जाएगा, यदि स्कोमेट मद के लिए निर्यात लाइसेंस के लिए आवेदन के मामले में प्रस्तुत की गई है )
6. मैं/ हम एतद्वारा घोषणा करता हूँ। करते हैं कि आरबीआई द्वारा निर्धारित अवधि अथवा आरबीआई की अनुमति से विस्तारित अवधि के बाद कोई निर्यात आय बकाया नहीं है ।
7. मैं एतद्वारा प्रमाणित करता हूँ कि विदेश व्यापार नीति के पैराग्राफ 9.9 के अनुसार मैं इस घोषणा को सत्यापित करने और हस्ताक्षर करने के लिए प्राधिकृत हूँ ।

आवेदकों के लिए दिशा निर्देश
( प्रक्रिया पुस्तक खण्ड 1 के पैराग्राफ 4.43 देखें )
1. आवेदन की दो प्रतियाँ अवश्य प्रस्तुत की जानी चाहिए यदि अन्यथा उल्लेख नहीं किया गया हो । यदि आवेदन डिजिटल हस्ताक्षर द्वारा जमा किया गया है तो हार्ड काफी की आवश्यकता नहीं है ।
2. आवेदक द्वारा आवेदन का प्रत्येक पृष्ठ हस्ताक्षरित होना चाहिए ।
3. यदि आर सी एम सी का ब्यौरा आयातक निर्यातक कोड लेते समय दिया जा चुका है तो वह दोबारा देने की आवश्यकता नहीं है ।
4 आवेदन के साथ नीचे दिए गए दस्तावेज होने चाहिए
क. परिशिष्ट 21 ख के अनुसार आवेदन शुल्क के भुगतान के लिए बैंक रसीद (दो प्रतियाँ) / डिमांड ड्राफ्ट/ ईएफटी ब्यौरे ।
ख. पोत लदान बिल ( बिलों) की निर्यात संवर्धन प्रति । एस इ जैड यूनिटों / विकासक/ एस ई जैड का सह- विकासक, पोत लदान बिल के स्थान पर निर्यात का बिल स्वीकार किया जाए ।
दिनांक ग. परिशिष्ट - 22 क में दिए गए निर्यात और प्राप्तियों के बैंक प्रमाण पत्र अथवा दस्तावेज़ों के सीधे लेने - देन के मामले एफ आई आर सी अथवा आर बी आई के अनुमोदन से निर्यात आय की आफ सेटिंग के मामले में परिशिष्ट घ/ एफ आई आर सी के मामले में पोतलदान सं० के संबंध में , छूट के बारे में निर्यातक को एक घोषणा प्रस्तुत करनी होगी । तथापि, यदि पोतलदान पुष्ट अपरिवर्तनीय साख पत्र, अथवा बैंक द्वारा बिना शर्त प्राप्त/ सह- स्वीकृत/ गारंटी के बिल आफ एक्सचेंज और निर्यातक बैंक द्वारा पुष्टि की गई हो तथा परिशिष्ट-22 क के कालम 14/15 में बैंक द्वारा सत्यापन के मद्दे किए गए हैं तो निर्यात आय की प्राप्ति पर बल नहीं दिया जाएगा ।
(घ) सेज़ की यूनिट को डी टी ए यूनिट द्वारा आपूर्ति के संबंध में , प्राप्ति यूनिट के बैंक द्वारा विशिष्ट प्रमाणपत्र या सेज यूनिट के विदेशी मुद्रा लेखे से रुपये में की गई अदायगी का बी आर सी प्रमाण का विशिष्ट पृष्ठांकन भारत का राजपत्र असाधारण

GUIDELINES FOR APPLICANTS

1. Two copies of the application must be submitted unless otherwise mentioned . In case application is filed through digital signature , no hard copy is required .

3. RCMC details need not be given if the same has already given at the time obtaining IEC .
4. Application must be accompanied by documents as per details given below :
a. Bank Receipt ( in duplicate ) / Demand Draft/EFT details evidencing payment of application fee in terms of Appendix 21B .
b. Export Promotion ( EP ) copy of Shipping Bill ( s) . In case of exports to SEZ Units/Developer/ Co-developer of SEZ , Bill of Export may be accepted in lieu of Shipping Bill .
c. Bank Certificate of Exports and Realisation as given in Appendix 22A or Foreign Inward Remittance Certificate ( FIRC ) in the case of direct negotiation of documents or Appendix 22 D in the case of offsetting of export proceeds with the approval of RBI . In case of FIRC , a declaration from the exporter that the remittance is in respect of Shipping Bill ( s) No dated shall also be furnished . However , realisation of export proceeds shall not be insisted if the shipments are made against confirmed irrevocable letter of credit or bill of exchange is unconditionally Availed / Co- Accepted/ Guaranteed by a bank and the same is confirmed by the exporters bank and certified by the bank in column 14/15 of Appendix 22A . For status holders , irrevocable letter of credit would suffice.
d. In case of supply by DTA unit to a unit in SEZ, either a separate Certificate from the bank of the Receiving unit or specific endorsement in the BRC evidencing payment in Rupeemade from the Foreign Currency Account of SEZ unit.

1. Bank can issue a consolidated certificate ( consignment- wise ) for more than one consignment.
2. FOB actually realised and date of realisation of export proceeds are to be given in all cases except where consignment has been sent against conformed irrevocable letter of credit .
3. This shall be required wherever specifically prescribed in the Policy/ procedure .
4. Banks referred in this Appendix shall also include other authorized dealers who have been permitted by RBI to issue BRC. Applicant should be required to furnish a copy of RBI permission circular/ letter to this effect.
