का.आ. 145(अ).-केन्द्रीय सरकार ने , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल परिवहन और राजमार्ग मंत्रालय ( सड़क खंड ) की अधिसूचना सं. का.आ. 196( अ ) तारीख 6 मार्च , 2000 और पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय ( सड़क परिवहन और राजमार्ग विभाग ) की अधिसूचना सं. का.आ. 465 ( अ ) तारीख 26 अप्रैल , 2002 , द्वारा तमिलनाडु राज्य में राष्ट्रीय राजमार्ग सं. 7 के 94.000 कि.मी. से 134.000 कि.मी. और 141.000 कि.मी. से 156.000 कि.मी. ( कर्नाटक/तमिलनाडु सीमा से सेलम खंड ) और 134.000 कि.मी. से 141.000 कि.मी. ( कृष्णागिरी से सेलम से मादुरई खंड ) और 156.000 कि.मी. से 163.000 कि.मी. ( बैंगलोर- सेलम - मादुरई खंड) तक के भूखंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् प्राधिकरण कहा गया है ) को सौंपा था;
और प्राधिकरण ने उक्त अधिनियम की धारा 14 द्वारा प्रदत्त शक्तियों के अनुसरण में राष्ट्रीय राजमार्ग संख्या 7 पर 94.00 कि. मी. से 156.00 कि.मी. तक के विद्यमान दो लेन वाले भाग को चौड़ा करने के लिए और 156.00 कि.मी. से 163.400 कि.मी. तक के खंड को चार लेन बनाने और विकास के लिए एल एण्ड टी कृष्णागीरी थोपुर टौल रोड प्राइवेट लिमिटेड, जिसका रजिस्ट्रीकृत कार्यालय माउंट पूनामाली रोड , चेन्नई-600089 ( जिसे इसमें इसके पश्चात् " रियायतग्राही " कहा गया है ) के साथ करार जिसे इसमें इसके पश्चात् उक्त करार कहा गया है किया है;
अतः , अब , केंद्रीय सरकार, राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्ग सेक्शन/राष्ट्रीय राजमार्गों पर स्थायी पुल/अस्थायी पुल के उपयोग के लिए किसी व्यक्ति द्वारा फीस का संग्रहण ) नियम , 1997 के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा 8क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त राष्ट्रीय राजमार्ग के खंडों के निर्माण, अनुरक्षण , प्रबंध और प्रचालन में अंतर्ग्रस्त व्यय , विनिघात पूंजी पर ब्याज, युक्तियुक्त प्रत्यागम , यातायात परिमाण और करार की अवधि को ध्यान में रखते हुए , यह अधिसूचित करती है कि तमिलनाडु राज्य में राष्ट्रीय राजमार्ग संख्या 7 के 94.00 कि.मी. से 163.40 कि.मी. तक खंड के उपयोग के लिए यांत्रिक यानों पर इसमें उपाबद्ध अनुसूची में विनिर्दिष्ट दरों पर फीस उद्ग्रहीत और संदत्त की जाएगी और उक्त रियायतग्राही को वाणिज्यिक प्रचालन या इस अधिसूचना के राजपत्र में प्रकाशन इनमें से जो भी पूर्वतर हो , की तारीख से ही उक्त करार में यथाविनिर्दिष्ट समाप्ति की तारीख तक फीस संग्रहीत करने और प्रतिधारित करने के लिए प्राधिकृत करती है ।

रियायतग्राही नीचे दी गई सारणी के स्तंभ (2) में विनिर्दिष्ट यांत्रिक यानों पर तामिलनाडू राज्य में राष्ट्रीय राजमार्ग संख्या 7, के 94.000 कि.मी. से 163.400 कि.मी तक के खंड के उपयोग के लिए उक्त सारणी के स्तंभ (3 ) में विनिर्दिष्ट आधार फीस की दर पर फीस संग्रहीत और प्रतिधारित करेगा ।
** फीस पथक प्लाजा पर 154.440 कि.मी. पर संग्रहीत की जाएगी ।

"वास्तविक फीस " से निम्नलिखित आधार पर उक्त खंड के सड़क प्रयोक्ताओं से प्रभारित वास्तविक (i) फीस अभिप्रेत है
(क) परियोजना राजमार्ग की लम्बाई, (ख) इस आधिसुचना की सारणी में दी गई आधार फीस, और जो एक रूपये के निकटतम पूर्णांक में होगी ।
(ii ) "वाणिज्यिक प्रचालन की तारीख " से वह तारिख अभिप्रेत है जिसको तामिलनाडू राज्य में राष्ट्रीय राजमार्ग संख्या 7 , के 94.000 कि.मी. से 163.400 कि.मी के उक्त खंड पर करार के उपबन्धों के अनुसार उक्त राष्ट्रीय राजमार्ग के उक्त खंड के पूरा होने पर स्वतंत्र परामर्शी द्वारा , यथास्थित , पूर्णता प्रमाणपत्र अथवा अनंतिम प्रमाणपत्र, जारी किए जाने के पश्चात् वाणिज्यिक प्रचालन प्रारंभ होता है ।
(iii) संदेय फीस के सम्बंध में "स्थानीय यातायात से यातायात के निम्नलिखित प्रवर्ग अभिप्रेत है ।
(क) स्थानीय यातायात प्रवर्ग अभिप्रेत है और इसमें सम्मिलित है । I से निम्न लिखित प्रवर्गों में से किसी के अंतर्गत आने वाले प्रयोक्ता
(i) ऐसे ग्रामों/ कस्बों/ शहर के निवासी जिसकी सीमा फीस संग्रहण बूथों (पथकर प्लाजा) से 10 कि.मी. के घेरे के भीतर आती है ।

(ii) फीस संग्रहण बूथों ( पथकर प्लाजा) के 10 कि.मी. के घेरे के भीतर अवस्थित स्थापनों/औधोगिक ईकाई है ।
(iii) ऐसे स्थापनों/संस्था/ औधोगिक ईकाईयों के कर्मचारी , जो फीस संग्रहण बूथों (पथकर प्लाजा) के दस कि.मी. के घेरे के भीतर अवस्थित हैं या उनका कार्यालय स्थित है; और
(iv) स्वनियोजित व्यक्ति/ कारोबारी जिनका काम करने का स्थान फीस संग्रहण बूथों (पथकर प्लाजा) के दस कि.मी. के घेरे के भीतर अवस्थित है
(ख) 'स्थानीय यातायात प्रकार II में निम्न लिखित प्रवर्ग में से किसी के अंतगर्त आने वाले स्थानीय प्रयोक्ता अभिप्रेत है और इसमें सम्मिलित है ।
(i) ग्रामों/कस्बों/ शहर के निवासी जिसकी सीमा फीस संग्रहण बूथों (पथकर प्लाजा) के 10 से अधिक किन्तु 20 कि.मी. तक के घेरे के भीतर आती है ।
(ii) फीस संग्रहण बूथों ( पथकर प्लाजा) के 10 कि.मी. से अधिक किन्तु 20 कि.मी. तक के घेरे के भीतर अवस्थित/ स्थापन ऐसे स्थापनों/ औधोगिक ईकाईया है ।
(iii) ऐसे स्थापनों/औधोगिक ईकाइयों के कर्मचारी जो फीस संग्रहण बूथों (पथकर प्लाजा) के 10 कि.मी. से अधिक किन्तु टोल प्लाजा से 20 कि.मी. तक के घेरे के भीतर अवस्थित है या जिनका कार्यालय स्थित है ।
(iv) स्वनियोजित व्यक्ति/ कारोबारी जिनका काम करने का स्थान फीस संग्रहण बूथों (पथकर प्लाजा) के 10 कि.मी. से अधिक किन्तु 20 कि.मी. तक के घेरे के भीतर अवस्थित है
(iv) " समाप्ति की तारीख " से वह तारीख अभिप्रेत है जिसको प्राधिकरण और रियायतग्राही के बीच किया गया उक्त करार, उक्त करार के उपबंधों के अनुसरण में समाप्त होता है या समाप्ति सूचना द्वारा समाप्त किया जाता है ।
(v) शब्द और पदों को जो इस अधिसूचना में प्रयुक्त है और परिभाषित नहीं है किन्तु उक्त धारा के सम्बन्ध में प्राधिकरण और रियायतग्राही के बीच किए गए करार में परिभाषित है वही अर्थ होंगे जो उक्त करार, उक्त करार में क्रमशः उनके हैं ।
2. फीस की वास्तविक दर की संगणना चालू वर्ष के लिए की जाएगी और प्रत्येक वर्ष 1 सितम्बर से निम्नलिखित आधार पर पुनरीक्षित की जाएगी: -

* डब्लयू पी आई से आर्थिक सलाहाकार, वाणज्यिक और औधिगिक मंत्रालय भारत सरकार द्वारा जारी किया गया थोक कीमत सूचकांक या उसकों प्रतिस्थापित करने वाला कोई अन्य सूचकांक अभिप्रेत है ।
3. जब एक ही यान को राष्ट्रीय राजमार्ग के उक्त खण्ड को एक दिन में एक से अधिक बार पार करना हो, तो उपयोक्ता के पास यह विकल्प होगा कि वह पहले ही चक्कर में गेट को पार करते समय अनुसूची में यथाविनिर्दिष्ट दरों पर अनेक चक्करों के लिए फीस का एक ही बार संदाय कर दे या यदि उसी यांत्रिक यान को उक्त खंड का पूरे मास में बार- बार प्रयोग करना हो तो यान का स्वामी उक्त अनुसूची में यथाविनिर्दिष्ट उसको लागू तीस एकल दरों के समतुल्य प्रभारों को संदाय करके मासिक पास प्राप्त कर सकता है ।
4. "दिन पद से 24 घंटे की निरंतर अवधि अभिप्रेत है ।
5. रियायतग्राही खंड के वाणिज्यिक प्रचालन की तारीख से उक्त राष्ट्रीय राजमार्ग के 94.000 कि.मी. से 163.400 कि.मी. तक चार लेन के कार्य को पूरा होने और उसके सुधार के पश्चात् उपयोक्ताओं से उपयोक्ता फीस का उदग्रहण और संग्रहण प्रारम्भ करेगा ।
6. निम्नलिखित प्रकार के यानों के संबंध में कोई फीस प्रभारित या संग्रहीत नही की जाएगी, अर्थातः-
ऐसे यान -
जो " अति महत्वपूर्ण व्यक्ति " प्रतीक वाले हैं या शासकीय रूप से निम्नलिखित के हैं : - (i) (अ)
भारत के राष्ट्रपति;
(क)
भारत के उपराष्ट्रपतिः
(ख)
राज्य के राज्यपाल या संघ राज्य क्षेत्रों के उप- राज्यपाल;
(ग)
(घ) भारत के राजकीय दौरे पर उच्च पदस्थ विदेशी व्यक्ति;
(ड़) " सी डी" । " सी सी " नंबर प्लेटों वाली कारों का उपयोग करने वाले भारत में रह रहे विदेशी राजनयिक;
(च) राज्य सभा के सभापति या लोक सभा के अध्यक्ष या राज्य विधान परिषद या राज्य विधान सभा के अध्यक्ष या केंद्रीय अथवा राज्य मंत्री अथवा लोक सभा या राज्य सभा या राज्य विधान मंडलों के विपक्ष के नेता जिनकी हैसियत कैबिनेट मंत्री की है, यदि वे स्वयं यान में बैठें हों; या
(छ) सम्पूर्ण देश में संसद सदस्य , या अपने राज्य किसी राज्य की विधान सभा का सदस्य या राज्य की विधान परिषद का सदस्य, यदि वह, यथास्थिति, संसद अथवा राज्य के संबंधित विधान मंडल द्वारा जारी किया गया पहचान पत्र प्रस्तुत करता है;
(आ) शौर्य पुरस्कारों अर्थात् परमवीर चक्र, अशोक चक्र, महावीर चक्र, कीर्ति चक्र, वीर चक्र और शौर्य चक्र के विजेता यदि ऐसा पुरस्कार प्राप्तकर्ता ऐसे पुरस्कार के लिए सक्षम प्राधिकारी द्वारा सम्यक् रूप से अधिप्रमाणित किया गया अपना फोटो पहचान पत्र प्रस्तुत करता है ;

(ii) रक्षा यान, जिनके अतंर्गत वे यान भी है जो भारतीय पथकर (सेना और वायुसेना) अधिनियम 1901 और उसके अधीन बनाए गए नियमों (नौसेना को यथा विस्तारित) के उपबन्धों के अनुसार छूट के पात्र हैं ।
(iii) पुलिस यान, अग्नि शमन यान, एम्बुलेंस, अन्त्येष्टि यान, डाक और तार विभाग के यान, केंद्रीय सरकार और सज्य सरकार के कर्त्तव्यारूढ़ यान ।
7. रियायतग्राही स्थानीय निजी यातायात और स्थानीय वाणिज्यिक यातायात से निम्निलिखित छूट प्राप्त दरों से अधिक कोई फीस वसूल नहीं करेगा अर्थात्ः
कार/जीप/ वैन के लिए
(क)
150.00 रूपये का मासिक पास
स्थानीय यातायात प्रवर्ग 1 :
(i)
300.00 रूपये का मासिक पास
स्थानीय यातायात प्रवर्ग 2 :
(ii)
बसों के लिए
(ख)
(i) राज्य परिवहन बसों के लिए मासिक पास ऐसे सक्षम प्राधिकारी के प्रमाणन पर जो महाप्रबंधक राज्य सरकार सडक परिवहन की पंक्ति से निम्न नहीं होगा द्वारा उस मार्ग पर प्रतिदिन चलने वाली बसों की संख्या प्रमाणित किए जाने पर विनिर्दिष्ट दर पर राज्य सरकार परिवहन के पक्ष में मासिक पास जारी किये जायेगें और निजी स्थानीय प्रचालकों के मामले में मासिक पास जिला परिवहन प्राधिकारी द्वारा स्म्यक् रूप से प्रमाणित मार्ग प्रचालन के लिए अपने परमिट और मार्ग प्रचालन की समय सारणी प्रस्तुत किये जाने पर जारी किए जाएंगे ।
(ii ) स्कूली छात्रों को ले जाने वाली स्कूल बसों के लिए पथकर प्लाजा पार करने के लिये स्कूल के प्राचार्य के लिखित अनुरोध के साथ स्कूल की मान्यता तथा बस का रजिस्ट्रीकरण दर्शाने वाले दस्तावेजों की प्राप्ति पर 1,000/ - रू० (एक हजार रूपये) की दर से मासिक पास जारी किये जायें ।
हल्के वाणिज्यिक यान/ ट्रक (स्थानीय परिवहन प्रचालक):
(ग)
स्थानीय परिवहन प्रचालकों कों 20 कि.मी. के भीतर उन्हें चलानें का सबूत (अर्थात् स्पष्ट रूप से वाहन की वापसी के ब्योरे विनिर्दिष्ट करते हुये प्रारम्भिक और अन्तिम स्थान के लिए माल का चालान) प्रस्तुत करने पर रियायती फीस ली जाएगी और ऐसे वाहनों के लिये, प्रत्येक प्रवेश पर ट्रकों के लिये 25 रू० (पच्चीस रूपये) और हल्के वाणज्यिक वाहनों के लिये 15 रू० (पन्द्रह रूपये) कीफीस होगी:

परन्तु, जहां स्थानीय यातायात द्वारा स्वतंत्र उपयोग के लिए पृथक सेवा लेन खुली हुई है वहाँ ऐसे वाहनों से चार लेन के राजमार्ग का उपयोग करने पर ही रियायतग्राही फीस उद्ग्रहीत और संग्रहीत करेगा ।
8. जब कभी किसी सेवा लेन का निर्माण किया जाएगा तो रियायतग्राही सेवा लेन के प्रयोक्ताओं से कोई संग्रहीत नही करेगा ।
9. रियायतग्राही, वाणिज्यिक प्रचालन की तारीख से कम से कम दस दिन पहले इस अधिसूचना का सार कम से कम दो स्थानीय समाचार पत्रों में ( जिनमें से एक स्थानीय भाषा में होगा) प्रकाशित करेगा, जिसमें इस अधिसूचना के उपबन्धों के अनुसार वाणिज्यिक प्रचालन की तारीख का भी उल्लेख होगा और ऐसा सार, इस अधिसूचना के अनुसार पुनरीक्षित फीस को प्रभावी करने के लिए 10 दिन पहले पुनः प्रकाशित किया जाएगा ।
10. रियायतग्राही फीस संग्रहण के भार साधक के रूप में किसी अधिकारी को नामनिर्दिष्ट करेगा तथा रियायतग्राही और उक्त अधिकारी यह सुनिश्चित करने के लिए उत्तरदायी होंगे कि फीस का संग्रहण करार की गई दरों से ऊंची दर पर नही किया जाता है और सड़क उपयोक्ताओं को और उससे सभी विषयों के लिए असम्यक् कठिनाई पहुँचाए सहज रूप से किया जाता है ।
11. फीस की दर, फीस के संदाय से छूट प्राप्त यानों के प्रवर्ग और रियायतग्राही का नाम, पता और टेलीफोन संख्या, जिसे शिकायत, यदि कोई हो, संबोधित की जानी चाहिए, पथकर बूथों से 500 मी. आगे , पथकर बूथों से 100 मी. आगे और पथकर बूथों पर भी सहजदृश्य रूप से और प्रमुख रूप से संप्रदर्शित की जाएगी और संप्रदर्शन बोर्ड की ऊंचाई और अक्षरों का आकार इस प्रकार का होगा कि चालकों के लिए संप्रदर्शन बोर्ड का पढ़ना आसान हो सकें ।
12. उपयोक्ताओं से प्रभारित की जाने वाली वास्तविक फीस की संगणना रियायतग्राही द्वारा की जाएगी और प्रतिवर्ष 31 मार्च के बाद किंतु पुनरीक्षित दर प्रभावी होने से कम से कम 45 दिन पहले , यथासम्भव शीघ्र विधिमान्यता के लिए प्राधिकरण को भेजी जाएगी । जिससे कि प्राधिकरण , उक्त प्रस्ताव की प्रप्ति की तारीख से 15 दिन के भीतर कोई टीका टिप्पणियां कर सके या स्पष्टीकरण यदि कोई हो मांग सके और यदि प्राधिकरण इस अवधि के दौरान कोई टीका टिप्पणी नहीं करता है या स्प्ष्टीकरण नहीं मांगता है तो रियायतग्राही द्वारा यथा प्रस्तावित पुनरीक्षित फीस की प्राधिकरण द्वारा पुष्टि की गई मानी जाएगी ।

NOTIFICATION

S.O. 145(E) .- Whereas , by the notifications of the Government of India in the erstwhile Ministry of Surface Transport and Highways ( Road Wing ) number S.O. 196 ( E) , dated the 6th March , 2000 and in the Ministry of Shipping , Road Transport and Highways ( Department of Road Transport and Highways) number S.O. 465 (E) , dated the 26th April , 2002 , issued under section 11 of the National Highways Authority of the India Act , 1988 (68 of 1988) , hereinafter referred to as said Act , the Central Government had entrusted the stretches from Km 94.000 to Km 134.000 and Km 141.000 to Km 156.000 ( Karnataka/ Tamil Nadu Border to Salem section) and Km 134.000 to Km 141.000 ( Krishnagiri Salem - Madurai section) and Km 156.000 to Km 163.400 (Bangalore Salem - Madurai section) of National Highway No. 7 in the State of Tamil Nadu to the National Highways Authority of India (hereinafter referred to as the Authority) ;
And whereas , pursuant to the powers conferred by section 14 of the said Act, the Authority has entered into an Agreement (hereinafter referred to as said agreement) with L& T Krishnagiri Thopur Toll Road Private Limited , a company having its registered office at Mount Poonamallee Road , Chennai - 600089 ( hereinafter referred to as the Concessionaire) for the widening of existing two laned portion of the section from Km 94.000 to Km 156.000 to four lanes , and improvement , operation and maintenance of the section from km 156.000 to km 163.400 of National Highways No. 7 on Build, Operate and Transfer basis.

Km 94.000 to Km 163.400 of National Highway No. 7 in the state of Tamilnadu at the rate specified in the Schedule annexed hereto and authorises the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette , whichever is later , till the termination date as specified in the said agreement;
SCHEDULE
The Concessionaire shall collect and retain the fee on mechanical vehicles specified in column (2) of the Table below, for the use of the section from Km 94.000 to Km 163.400 of National Highway No. 7 in the state of Tamilnadu , at the rate of base fee specified in column (3) of the said Table .
The fee shall be collected at the Toll Plaza at Km . 154.440

Notes: -
1. For the purposes of this notification , -
(i) " actual fee" means the fee actually charged from the road users of the said section on the basis of -
(a) length of the project highway ;
(b) base fee given in the Table to this notification , and shall be rounded off to nearest one rupee .
(ii) "date of commercial operation " means the date on which commercial operation of the section from Km 94.000 to Km 163.4000 of National Highway No. 7 in the State of Tamilnadu begins after issue of the completion certificate or the provisional completion certification as the case may be , by the Independent Consultant , upon completion of the said section of the said 9

National Highways in accordance with the provisions of the agreement .
(iii) " local traffic" , in relation to fee payable , means the following categories of traffic
( a) " Local Traffic Category I " means and includes users falling into any of the following categories -
(i) whose residents of villages/ towns / cities boundary falls within a radius of 10 km of the fee collection booths (toll plaza) .
(ii) establishments / industrial units located within a radius of 10 km of the fee collection booths (toll plaza).
(iii) employees of establishments / industrial units located or which have their office , within a radius of 10 km of the fee collection booths ( toll plaza); and
(iv) self employed persons./businessmen having a place of work within a radius of 10 km of the fee collection booths (toll plaza) .
(b) " Local Traffic Category II " means and includes local users falling into any of the following categories-
(i) residents of villages /towns / cities whose boundary falls within a radius of more than 10 km but upto 20 km of the fee collection booths (toll plaza) .
(ii) establishments / Industrial units located within a radius of more than 10 km but upto 20 km of the fee collection booths (toll plaza) .
(iii) employees of Establishments / Industrial units located or which have their office , within a radius of more than 10 km but upto 20 km of the fee collection booths (toll plaza: and
(iv) self employed persons/ business having a place of work within a radius of more than 10 km but upto 20 km of the fee collection booth (toll plaza).
(iv) "termination date" means the date on which the said agreement entered into between the Authority and the Concessionaire expires pursuant to the provisions of the said agreement or is terminated by termination notice;

(v) words and expressions used in this notification and not defined butdefined in the agreement entered into between the Authority and the Concessionaire in respect of the said section , shall have the same meaning as assigned to them respectively in the said agreement .
2. The actual rate of fee shall be computed for the current year and shall be revised every year with effect from the 1st September on the following basis : -

WPI - A = is the Wholesale Price Index as on June , 1997 .
WPI - B is the Wholesale Price Index for the end of the preceding financial year.
WPI means the Whole Sale Price Index as released by the Office of the Economic Advisor , Ministry of Commerce and Industry , Government of India or any other index replacing the same .
3 . When the same vehicle has to cross the said section of the National Highway more than once in a day , the user shall have the option to pay the fee for multiple trips at 1.5 times the rates as given in the Schedule above while crossing the toll plaza in the first trip itself or where the vehicle has to use the said section continuously and frequently for entire month or even beyond that , the vehicle owner can have a monthly pass on payment of charges equal to thirty (30) times rate applicable for single trip as specified in the aforesaid Schedule .
4. The expression " day " shall mean a continuous period of twenty- four hours .
5. The Concessionaire shall commence levying and collecting user fee from the users after completion of four laning and improvement of the section from Km 94.000 to Km 163.400 of the said National Highway from the date of Commercial Operation of the section.
6. No fee shall be charged or collected in respect of the following vehicles , namely : -

(A) having VIP symbols or officially belonging to:
(a) the President of India;
(b) the Vice- President of India;
(c) the Governor of a State and Lt. Governor of a Union territory;
(d) a Foreign dignitary on State visit to India;
(e) a Foreign Diplomat stationed in India using cars with " CD" / " CC" number plates;
(1) the Chairman of Rajya Sabha or Speaker of Lok Sabha or Chairman of a State Legislative Council or Speaker of a State Legislature Assembly or a Minister for the Union or State or Leader of Opposition in Lok Sabha or Rajya Sabha or State Legislatures having the Status of Cabinet Minister if he is sitting in the vehicle ; or
(g) a Member of Parliament , in the entire country or a Member of Legislative Assembly of a State or a Member of Legislative Council of a State, in his State , if he produces his identity card issued by the Parliament or concerned Legislature of a State , as the case may be;
(B) belonging to winner of Gallantry awards such as Param Vir Chakra , Ashok Chakra , Maha Vir Chakra , Kirti Chakra , Vir Chakra and Shaurya Chakra , if such awardee produces his photo identity card duly authenticated by the Competent Authority for such award;
(ii) defence vehicles , including those eligible for exemption in accordance with the provisions of the Indian Toll (Army and Air Force) Act , 1901 and the rules made there under (as extended to Navy) ;
(iii) police vehicles , fire fighting vehicles , Ambulances , Funeral vans , Post and Telegraph Department's vehicles , Central and State Government vehicles on duty.
7 . Concessionaire shall not collect fee from Local Traffic in the excess of the following discounted rate-
(a) for car /jeep/ van:
Monthly pass of Rs 150.00
i) Local Traffic Category I :
Monthly pass of Rs 300.00
ii ) Local Traffic Category II :

(i) monthly passes for the State Transport buses may be given at the specified rate in favour of the State Government Transport on the certification of the competent authority who shall be not below the rank of the General Manager , State Government Road Transport , certifying the number of buses plying in that route per day and in the case of private local operators monthly passes shall be issued on production of their route permit and timetable of the route operation duly certified by the District Transport Authority .
(ii) monthly passes for School buses carrying school students crossing the toll plaza at a monthly rate of Rs 1000 (rupees one thousand) after obtaining written request of the school principal along with the documents showing recognition of the school and the registration of the bus .
(c) Light Commercial Vehicle /Trucks ( Local Transport Operators) :
Concessional fee shall be given to Local Transport Operators on production of proof for plying within 20 km of goods challan origin and destination clearly specifying the return details of the vehicle and the fee for such transport shall be Rs 25 ( rupees twenty five ) for trucks for each entry and Rs 15 ( rupees fifteen) for Light Commercial Vehicle for each entry:
Provided that if a separate service lane is opened for free use by local traffic , the Concessionaire shall levy and collect fee from such local traffic , only if they use the four lane highway.
8. As and when a service lane is constructed , the Concessionaire shall not collect any fee from the users of such lane ( s)
9. The Concessionaire shall publish substance of this notification in two local newspapers ( one of which shall be in vernacular language) , which shall also state the date of commercial operation as per the provisions of this notification , at least ten days prior to the date of commercial operation and such substance shall also be repeated , ten days prior to giving effect to revised fees as per this notification .
10. The Concessionaire shall nominate an officer as in- charge of fee collection and the Concessionaire and the said officer shall be responsible to ensure that fee are collected at not more than the agreed rates and the fee colleted is smooth without causing undue hardship to the road users and for all matters connected therewith .

11. The rate of fee , the categories of vehicles exempted from payment of fee and the name , address and telephone number of Concessionaire to whom complaints , if any , should be addressed , shall be conspicuously and prominently displayed 500 meters ahead of the toll booths , 100 meters ahead of the toll booths and at the toll booths also , the height of the display boards and size of letters being such that the driver can easily read the display boards.
12. The actual fee to be charged from users shall be computed by the Concessionaire and sent to Authority for validation as soon as possible after 31st March in every year but at least forty- five days before the revised rate is to be effective so as to enable the Authority to provide any comments or seek clarifications , if any , within a period of fifteen days from the date of receipt of the said proposal and if the Authority does not offer comments or seek clarifications during this period , the revised fee , as proposed by the Concessionaire , shall be deemed to have been confirmed by the Authority.
