का.आ. 168(अ).- दक्षिण एशियाई विश्वविद्यालय की स्थापना के लिए एक करार पर, दक्षिणी एशियाई क्षेत्रीय सहयोग संगम के सदस्य राज्यों की संबंधित सरकारों की ओर से 4 अप्रैल , 2007 को हस्ताक्षर किए गए थे;
और नई दिल्ली में दक्षिण एशियाई विश्वविद्यालय की स्थापना के लिए भारत गणराज्य की सरकार और सार्क सचिवालय के बीच मुख्यालय संबंधी करार पर 30 नवम्बर , 2008 को हस्ताक्षर किए गए थे ;
और दक्षिण एशियाई विश्वविद्यालय की स्थापना करने का आवश्यक कार्य करने के प्रयोजन के लिए सार्क की अंतर- शासकीय स्टीयरिंग समिति ने नई दिल्ली में परियोजना कार्यालय स्थापित किया है;
और सार्क की अंतर -शासकीय स्टीयरिंग समिति के विनिश्चय के अनुसरण में परियोजना कार्यालय और उसके पदधारियों तथा दक्षिण एशियाई विश्वविद्यालय , उसके अध्यक्ष , रजिस्ट्रार और संकाय सदस्यों को संयुक्त राष्ट्र ( विशेषाधिकार और उन्मुक्तियां ) अधिनियम, 1947 ( 1947 का 46 ) की अनुसूची के अनुच्छेद 2 , अनुच्छेद 3 , अनुच्छेद 4 , अनुच्छेद 5 , अनुच्छेद 6 और अनुच्छेद 7 में अंतर्विष्ट विशेषाधिकारों और उन्मुक्तियों के समान भारत में विशेषाधिकार और उन्मुक्तियां प्रदान करना समीचीन है;
अतः , अब केंद्रीय सरकार उक्त अधिनियम की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह घोषणा करती है कि मुख्यालय संबंधी करार को प्रभावी करने के लिए उक्त अधिनियम की अनुसूची के अनुच्छेद 2 , अनुच्छेद 3 , अनुच्छेद 4 , अनुच्छेद 5 , अनुच्छेद 6 और अनुच्छेद 7 के उपबंध परियोजना कार्यालय और उसके पदधारियों तथा दक्षिण एशियाई विश्वविद्यालय , उसके अध्यक्ष , रजिस्ट्रार और संकाय सदस्यों को, यथावश्यक परिवर्तन सहित , लागू होंगे ।

NOTIFICATION
New Delhi , the 15th January, 2009
S.O. 168 ( E ) . Whereas an Agreement for the Establishment of the South Asian University was signed on behalf ofthe respective Governments of the Member States of the South Asian Association for Regional Co - operation on the 4th day ofApril , 2007;
AND Whereas , the Headquarters Agreement between the Government of the Republic of India and the SAARC Secretariat for the establishment of the South Asian University at New Delhi was signed on the 30th day of November, 2008 ;
AND Whereas, the Inter -governmental Steering Committee of the SAARC has set up the Project Office at New Delhi for purpose of doing necessary task for establishing the South Asian University;
AND Whereas , in pursuance of the decision of the Inter -governmental Steering Committee of the SAARC , it is expedient to accord the Project Office and officials thereof, and the South Asian University, its President, Registrar and faculty members the privileges and immunities in India similar to those contained in Articles II , III , IV , V, VI and VII of the Schedule to the United Nations (Privileges and Immunities ) Act , 1947 (46 of 1947) ;
No Therefore, the Central Government in exercise of the powers conferred by Section 3 of the said Act hereby declares that the provisions of Articles II , III , IV, V, VI and VII ofthe Schedule to the said Act shall apply mutatis mutandis to the Project Office and officials thereof, and the South Asian University, its President , Registrar and faculty members for giving effect to the said Headquarters Agreement .
