विषय : ओक्सो एलकोहॉल ( अकाईलिक अल्कोहल्स ) के भारत में आयात से सम्बन्धित रक्षोपाय अन्वेषण का प्रारम्भ ।
[सीमा शुल्क टैरिफ ( रक्षोपाय शुल्क की पहचान और निर्धारण नियमावली , 1997 ) के नियम 6 के अधीन ]
सा.का.नि. 31(अ) .-भारत में ओक्सो एलकोहॉल (अकाईलिक अल्कोहल्स ) के वर्धित आयात के परिणामस्वरूप ओक्सो एलकोहॉल ( अकाईलिक अल्कोहल्स ) के घरेलू उत्पादकों को होने वाली गम्भीर क्षति से बचाने के लिए ओक्सो एलकोहॉल (अकाईलिक अल्कोहल्स ) के आयात पर रक्षोपाय शुल्क लगाने के लिए मैसर्स आन्ध्रापेट्रोकेमिकल्स लिमिटेड , सैफाबाद , हैदराबाद , आन्ध्रा प्रदेश के द्वारा सीमा शुल्क टैरिफ ( रक्षोपाय शुल्क की पहचान और निर्धारण) नियमावली , 1997 के नियम 5 के अधीन मेरे समक्ष एक आवेदन प्रस्तुत किया गया है ।
2. घरेलू उद्योग.-ओक्सो एलकोहॉल ( अकाईलिक अल्कोहल्स ) के घरेलू उत्पादकों की ओर से इस उत्पाद के आयात पर रक्षोपाय शुल्क लगाने हेतु मैसर्स आन्द्रा पेट्रोकेमिकल्स लिमिटेड, सैफाबाद , हैदराबाद के द्वारा यह आवेदन प्रस्तुत किया गया है । यह आवेदन भारत में आक्सो अल्कोहॉल का अकेला उत्पादक है , जो कि भारत के कुल उत्पादन का 100 प्रतिशत उत्पादन करता है । घरेलू उत्पादक , सैचुरेटिड ( Saturated ) ब्यूटयन-1- ol ( एन-ब्यूटाईल एल्कोहॉल ) का उत्पादन करते हैं, जो कि कस्टम टैरिफ नियमावली, 1975 , आई.टी.सी. और एच.एस.एन. ( HSN ) संख्या 29051300 में 232 GI/2009
वर्गीकृत है । घरेलू उत्पादक 2- इथाईल हेक्सानॉन का भी उत्पादन करते हैं जो कि कस्टम टैरिफ नियमावली , 1975 , आई.टी.सी. और एच.एस.एन ( HSN ) संख्या 29051620 में वर्गीकृत है । साथ ही घरेलू उत्पादक अन्य ब्यूटानॉल्स का भी उत्पादन करते हैं जो कस्टम टैरिफ नियमावली , 1975 , आई.टी.सी. और एच.एस.एन. संख्या 29051490 में वर्गीकृत हैं । इसका उत्पादन एकसार, परिष्कृत रैडियम उत्प्रेरक की विद्यमानता में प्रौपिलीम और संश्लेषित गैस ( कार्बन मोनोआक्साईड और हाईड्रोजिन का मिश्रण ) की प्रतिक्रिया द्वारा किया जाता है । यह उपर्युक्त प्रतिक्रिया सामान्य ताप और दबाव पर पूर्ण किए जाते हैं ।
3. संबद्ध उत्पाद. आवेदकों द्वारा भारत में ओक्सो एलकोहॉल (अकाईलिक अल्कोहल्स) के वर्धित आयात से घरेलू उत्पादकों को गम्भीर क्षति होने का आरोप लगाया गया है । जो उत्पाद इसमें शामिल हैंवह निम्न हैं :-

6. घरेलू उत्पादकों ने ओक्सो एलकोहॉल ( अकाईलिक अल्कोहल्स ) के आयात पर चार वर्ष का रक्षोपाय शुल्क लगाए जाने की माँग की है । उन्होंने विषम परिस्थितियों के फलस्वरूप अपूर्णीय क्षति की संभावनाओं को देखते हुए तत्काल प्रभाव से तत्कालिक रक्षोपाय शुल्क लगाने की प्रार्थना की है ।
आवेदकों द्वारा यह तर्क दिया गया है कि आयात की जा रही वस्तुएं , भारत में उत्पादित वस्तुओं के प्रतिरूप/सामान या फिर प्रत्यक्ष रूप से उसके प्रतिस्पर्धात्मक है । आक्सो एलकोहॉल का प्रयोग कर्मक/कच्ची सामग्री के तौर पर प्लास्टीसाईज़र उद्योग में होता है ।
7. आवेदन पत्र को जाँचा गया और पहली दृष्टि में यह पाया गया है कि ओक्सो एलकोहॉल ( अकाईलिक अल्कोहल्स ) के वर्धित आयात से ओक्सो एलकोहॉल ( अकाईलिक अल्कोहल्स ) के घरेलू उत्पादकों को गम्भीर क्षति तथा गम्भीर क्षति की आशंका उत्पन्न हुई है , तद्नुसार इस नोटिस के माध्यम से जांच शुरू करने का निर्णय लिया गया है ।
8. सभी संबद्ध पक्ष इस नोटिस की तिथि से 30 दिनों की अवधि के अन्दर दृष्टिकोण से अधोहस्ताक्षरी को सूचित कर सकते हैं ।
4. वर्धित आयात ओक्सो एलकोहॉल का आयात भारत में कोरिया गणराज्य, साउदी अरेबिया , यू.ए.ई. , मलेशिया और अमेरिका से होता है । ओक्सो एलकोहॉल ( अकाईलिक अल्कोहल्स ) का आयात वास्तविक रूप से एवं घरेलू उत्पाद सापेक्ष-दोनों ही प्रकार से आयात वृद्धि प्रदर्शित करता है । 2006-07 से 2007-08 में आक्सो एलकोहॉल के आयात में 63181 मीटर टन वृद्धि दर्ज की गई है । पुनः छः महीने में 2008-09 में यह वृद्धि देखने को मिली । आक्सो एलकोहॉल का 2004-05 से 2008-09 के प्रथम छः माह के दौरान आयात निम्नानुसार रहा :

5. क्षति.-ओक्सो एलकोहॉल ( अकाईलिक अल्कोहल्स) के वर्धित आयात से ओक्सो एलकोहॉल ( अकाईलिक अल्कोहल्स ) के घरेलू उत्पादकों को जिन कारणों से गम्भीर क्षति या उसकी आशंका है, वह निम्नानुसार है-

Sub : Initiation of safeguard investigation concerning imports of Oxo Alcohols (Acylic Alcohols) into India.
क घरेलूउद्योग काहिस्सा. घरेलू उत्पादकों का 2005-06 से 2008-09 अक्तूबर तक के दौरान उत्पादन गम्भीर रूप से गिरावट की ओर रहा । आवेदक की एक इकाई जो मैसर्स आन्द्रा पेट्रोकेमिकल्स सफियाबाद , हैदराबाद में स्थित है , उसे 8-11-2008 से 7-12-2008 की अवधि के दौरान बन्द कर दिया गया ।
ख क्षमता का प्रयोग. अक्तूबर , 2008 के दौरान घरेलू उत्पादकों द्वारा क्षमता के प्रयोग में भी गिरावट देखी गई है । यह गिरावट पुनः अधिक मात्रा में नवम्बर , 2008 में कारखानों के बन्द हो जाने के कारण देखी गई ।

in 2007-08 and six months trend during 2008-09 shows further increase . The imports of Oxo Alcohols (Acylic Alcohols) during 2004-05 to 2008-09 (first six months) are as under :

2. Domestic Industry: The application has been filedby M/ s . Andhra Petrochemicals Limited, Saifabad, Hyderabad for imposition of Safeguard Duty on imports ofOxo Alcohols (Acylic Alcohols) . The applicant is the sole producer of Oxo Alcohols (Acylic Alcohols) in India accounting for 100% of the total production . The domestic industries manufacture Saturated Butan- 1 -ol (N-Butyl Alcohol) classified under 2905 13 00 of HSN Customs Tariff Act, 1975 and ITC , 2Ethyl Hexanol classified under 2905 16 20 of HSN , Customs Tariff Act, 1975 and ITC and other Butanols classified under 2905 14 90 of HSN, Customs Tariff Act, 1975 and ITC . It is produced by reacting propylene with synthesis gas (a mixture of carbon monoxide and hydrogen) in the presenceence of homogeneous modified rhodium , catalyst . The reactions are carried out at moderate temperature and pressure.

(b) Capacity Utilisation : The capacity utilization of the domestic industry has fallen down during the month of October 2008. There has been further fall in the capacity utilization during the month of November 2008 on account of closure of the plant.

(c) Other Factors : Other factors , including price, profit and loss have been considered .
It has been contended by the applicant that the products involved are like or a directly competitive article to what is produced in India. Oxo Alcohols (Acylic Alcohols) are mainly used as an agent/ raw material in the Plasticizer Industry.
6. The domestic producer have requested for imposition of Safeguard Duty on imports of Oxo Alcohols (Acylic Alcohols) for a period of four years . They have also requested for an immediate imposition ofprovisional Safeguard Duty in view of the prevailing critical circumstances leading to irreparable damage.
4. Increased Imports : Oxo Alcohols (Acylic Alcohols) is imported into India from Republic of Keorea, Iran, Saudia Arbia , UAE , Germany, Malaysia, and USA , The imports Oxo Alcohols (Acylic Alcohols) have shown an increasing trend in absolute terms as well as compared to the domestic production. The imports show a surge from 2006-07 onwards and have increased drastically to 63181MT
7. The application has been examined and it is found prima facie that increased imports of Oxo Alcohols (Acylic Alcohols) have caused and are threatening to cause serious injury to the domestic producers of Oxo Alcohols (Acylic Alcohols) and accordingly it has been decided to initiate an investigation through this notice .
