अधिसूचना
पर निम्नलिखित विस्फोटकों का वायुमार्ग द्वारा आयात करने के लिए उक्तनियमावली के नियम 31 के उप- नियम ( 2 ) के उपबंधों से छूट देती है जिसकी मदों और मात्राओं को नीचे दी गई तालिका में विनिर्दिष्ट किया गया है , नामतः:-

का.आ. 186(अ) .-चूंकि, केन्द्र सरकार को मै . श्लम्बर्गर एशिया सर्विसेज लिमिटेड , एन.ई.एस. एस्टेट, वेस्टर्न एक्सप्रेस हाइवे , गोरेगाँव ( ईस्ट) , मुम्बई-400063 से तेल खोज के प्रयोजन हेतु संयुक्त राज्य अमेरिका से हवाई जहाज द्वारा कुछ विशेष विस्फोटकों को आयात करने की अनुमति हेतु पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन में एक प्रस्ताव प्राप्त हुआ है;

2. उक्त सारणी में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा , नामतः
(i ) नागर विमानन महानिदेशक और भारतीय हवाई अड्डा प्राधिकरण से आवश्यक स्वीकृति प्राप्त की जाएगी और उनके द्वारा लगाई गई शर्तों , यदि कोई हों, का पालन किया जाएगा;
और , चूंकि, पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन संतुष्ट है किविस्फोटकों के प्रस्तावित आयात का उपयोग , तेल खोज प्रयोजन में किया जाएगा और , इसलिए विस्फोटक नियमावली , 1983 ( इसे यहां उक्तनियमावली कहा गया है ) के नियम 31 के उप- नियम (2 ) के दायरे से आवश्यक छूट प्रदान की जा सकती है , क्योंकि उक्त नियम के उपबन्धों के अनुसार जिसके तहत यहां विनिर्दिष्ट किए गए विस्फोटकों का हवाई जहाज द्वारा आयात अथवा निर्यात निषिद्ध है;
(ii ) 1 जनवरी , 1996 से लागू हुई अन्तर्राष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियमावली , 1996 (37वां संस्करण ) की धारा 3 के 3.1 के तहत आने वाले प्रथम श्रेणी के विस्फोटकों से संबंधित प्रभाग के प्रभाग 1.4 के ही अनुरूप विस्फोटकों का आयात किया जायेगा;
और, चूंकि, नागर विमानन महानिदेशक ने वायुयान नियमावली , 1937 के नियम 8 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, अपने परमिट सं. 250 - डीजी/2008 , दिनांक 20 अक्तूबर , 2008 द्वारा जो कि 31 दिसम्बर , 2008 तक वैध है, इस प्रकार के विस्फोटकों को वायुमार्ग द्वारा ले जाने के लिए मै. श्लम्बर्गर एशिया सर्विसेज लिमिटेड , मुम्बई को कतिपय शर्तों के साथ आवश्यक अनुमति प्रदान की है;
(iii ) नियम 31 के उप- नियम ( 2 ) के अलावा , उक्त नियमों में यथा निहित विस्फोटकों के कब्जे, परिवहन , प्रयोग और आयात से संबंधित सुसंगत उपबंधों का सख्ती से पालन किया जायेगा;
(iv) उक्तनियमों के अधीन लाइसेंसशुदा विस्फोटक सामग्री के वाहनों की पर्याप्त संख्या हवाई अड्डे पर तैयार रखी जाएगी ताकि विस्फोटक सामग्री को , वायुयान के उतरते ही शीघ्रता से हटाया जासके;
अतः , अब , विस्फोटक अधिनियम , 1884 ( 1884 का 4 ) की धारा 14 की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार , एतद्द्वारा , मै. श्लम्बर्गर एशिया सर्विसेज लिमिटेड, मुम्बई को मै. श्लम्बर्गर रिजर्वायर कंप्लीशंस , 14910 एयरलाइन रोड , रोशराँ, टेक्सास-77583 , संयुक्त राज्य अमेरिका से मुम्बई हवाई अड्डे

Class Net weight No. (inkilograms) (v) वायुयान को हवाई अड्डे पर दूरस्थ स्थान पर खड़ा किया जाएगा और विस्फोटकों का वायुयान से वाहन में अंतरण शुरू होने से पहले महानिदेशक, नागर विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गार्डों का प्रबंध करके वायुयान और विस्फोटक सामग्री वाहन के चारों ओर कम से कम 500 वर्गमीटर क्षेत्र को घेर लिया जाएगा । उक्त व्यवस्था तब तक बनी रहेगी जब तक कि अन्तरण पूरा नहीं हो जाता और अच्छी तरह से बन्द वाहन उक्त स्थान से रवाना नहीं हो जाता;

2. The explosives mentioned in the Table shall be imported subject to the fulfilment of the following conditions , namely:-
(vii ) उपर्युक्त विस्फोटक सामग्री को ले जा रहे वाहन उक्त नियमों के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होंगे और रास्ते में कोई अनुचित विलम्ब नहीं किया जायेगा और विस्फोटकों के परिवहन के दौरान उक्त नियमों के सभी उपबंधों और स्थानीय यातायात नियमों और नगरपालिका के विनियमों , यदिकोई हों, का पालन किया जायेगा ।
(i) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions , if any, imposed by the said authorities shall be complied with;

(ii) explosives conforming only to Division 1.4 of the Division relatingto class 1-- Explosives fallingunder 3.1 of Section 3 of International Air Transport Association Dangerous Goods Regulations (37th Edition) which became effective on the 1st January, 1996 shallbe imported;

(iii) the relevant provisions relating to the possession , transport, use and import of explosives , [ except sub- rule (2) of Rule 31 , ofthe said rules ) shall be complied with;
(iv) requisite number of explosives vans , licensed under the said Rules , shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing ;
S.O. 186 ( E ). Whereas the Central Government has received a proposal made by M/ s . Schlumberger Asia Services Limited, NSE Estate , Western Express Highway, Goregaon (East ) , Mumbai - 400 063 through the Petroleum and Explosives Safety Organisation for permission to import certain explosives by air from United States of America for oil exploration purposes ;
And whereas the Petroleum and Explosives Safety Organisation is satisfied that the proposed import of ex- plosives shall be used for oil exploration purposes and, therefore necessary exemption may be granted from the purview of sub -rule (2) of rule 31 ofthe Explosives Rules , 1983 (hereinafter referred to as the said rules) which prohibit import or export of explosives specified therein by air;
(v) aircraft shall be parked at a remote place at the airport and an area ofat least five hundred square metres around the aircraft and the explosives carrying van shall be cordoned off by providing adequate number ofsecurity guards in consultation with the Director General of Civil Aviation before the transfer of explosives from aircraft to van begins . The arrangement shall continue till such transfer is completed and the van is duly locked and leaves the site;
(vi) smoking or use of naked light shall not be permitted within the cordoned area; and
And whereas the Director General of Civil Aviation has , in exercise of the powers conferred by rule 8 of the Aircraft Rules 1937 , granted necessary permission with certain conditions to M/ s . Schlumberger Asia Services Lim- ited , Mumbai to carry such explosives by air vide their permit number 250- DG/2008 dated the 20th October, 2008 which is valid upto the 31st December , 2008 ;
(vii) vans carrying the explosives shall proceed to the storage magazine licensed under the said rules and no undue delay shall be made on the way and all provisions of the said rules and local traffic rules and municipal regulations , if any , shall be complied with during the transportation of the explosives .

No. 2 (77)/2008 -Expl . ] Now, therefore, in exercise of the powers conferred by sub - section (2) of Section 14 of the Explosives Act , 1884 (4 of 1884 ) , the Central Government hereby exempts M/s. Schlumberger Asia Services Limited, Mumbaifrom the provisions of sub - rule ( 2) ofrule 31 of the said rules , for
