अधिसूचना नई दिल्ली , 16 जनवरी , 2009 सं. 80 ( आर ई -2008 )/2004-2009 का.आ. 192( अ ). विदेश व्यापार नीति , 2004-2009 के पैरा 1.3 और 2.1 के साथ पठित विदेश व्यापार ( विकास और विनियमन) अधिनियम , 1992 ( 1992 की संख्या 22 ) की धारा 3(2) के साथ पठित धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार , एतद्वारा समय- समय पर यथासंशोधित अधि- सूचना संख्या 93 ( आर ई-2007)/2004-2009 दिनांक 1-4-2008 , में पैरा 2.1.7 को प्रतिस्थापित करते हुए निम्नलिखित संशोधन करती है, जिसे अधिसूचना संख्या 53 ( आर ई-2008 ) /2004-2009दिनांक 4-11-2008 के साथ पठित अधिसूचना संख्या 48 ( आर ई-2008 ) / 2004-2009 दिनांक 13-10-2008 , के द्वारा जोड़ा गया था :-
2. मौजूदा पैरा 2.1.7 निम्नलिखित अनुसार प्रतिस्थापित किया जाता है :
" 2.1.7 निम्नलिखित देशों को चावल का निर्यात करने पर गैर- बासमती चावल के निर्यात पर लगाया गया प्रतिबंध लागू नहीं होगा :

(ii) सेनेगल
15,000मीट्रिक टन

15,000 मीट्रिक टन
(iii) घाना
(iv) कैमरुन
10,000 मीट्रिक टन
उपरोक्त निर्यात निम्नलिखित शर्तों के मद्दे होगा :
(i) उपरोक्त मात्रा 30 अप्रैल , 2009 तक भारतीय राज्य व्यापार निगम ( एसटीसी) के माध्यम से निर्यात की जाएगी ;
(ii ) एसटीसी ऐसी चावल मिलों से चावल प्राप्त करेगा जिनके स्टाक में अतिरिक्त चावल/धान है ;
(iii) निर्यात किये जाने वाले चावल में कम से कम 25% टूटा चावल होना चाहिए ;
(iv) एसटीसी यह सुनिश्चित करेगा कि इस निर्यात के लिए उनकी बाजार में प्रविष्टि चावल की समग्र मूल्य स्थिति को प्रभावित न करे; और
(v) एसटीसी निर्यात किए जाने वाले चावल को एक से : अधिक राज्य से और चार अलग-अलग ट्रांचिज में प्राप्त करेगा । "
3. अधिसूचना संख्या 93 ( आर ई-2007 )/2004-2009 दिनांक 1 अप्रैल , 2008 के अन्य सभी प्रावधान अपरिवर्तित रहेंगे , और लागू होते रहेंगे ।
4. इसे लोकहित में जारी किया जाता है ।

NOTIFICATION
New Delhi , the 16th January, 2009
No. 80 (RE - 2008)/2004-2009
S.O. 192 (E) .- In exercise of the powers conferred by Section 5 read with Section 3 (2) of the Foreign Trade (Development & Regulation ) Act , 1992 (No. 22 of 1992) and also read with Para 1.3 and Para 2.1 of the Foreign Trade Policy, 2004-2009, the Central Government hereby makes following amendments to Notification No. 93 (RE- 2007)/2004-2009 , dated 1st April, 2008 as amended from time to time by substituting Para 2.1.7 added vide Notification No. 48 (RE - 2008 )/2004-2009 , dated 13thOctober, 2008 , read with Notification No. 53 (RE- 2008 )/ 2004-2009 , dated 4th November, 2008, as under :--
2. Existing para 2.1.7 shall stand substituted as follows:
"2.1.7 Ban on export ofnon - basmati rice shall notbe applicable to export of rice to the following countries :-

The above export shall be subject to the following conditions :-
(i) The above quantity shall be exported through State Trading Corporation ( STC) of India till 30thApril, 2009;
(ii) STC shall procure rice from such rice mills who have surplus rice/paddy in their stock;
(iii) The rice to be exported shall be with a minimum of 25% ofbrokens ;
(iv) STC shall ensure that their entry into market for this export does not affect the overall price situation of rice ; and
(v) STC shall source the rice to be exported from more than one State and in four different trenches ."
3.All other provisions of the Notification No. 93 (RE-2007)/2004-2009 ,ppdated 1st April , 2008 shall remain unchanged, and shall continue to apply.
4. This issues in public interest .
