फा. सं. 01 /91 /180/179/एएम 09 /निर्यात प्रकोष्ठ, विदेश व्यापार नीति, 2004-2009 के पैराग्राफ 2.4 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए , महानिदेशक विदेश व्यापार, एतद्वारा प्रक्रिया पुस्तक, खण्ड -1 , (आर ई-2008 ) में तत्काल प्रभाव से निम्नलिखित संशोधन करते हैं :
2. प्रक्रिया पुस्तक खण्ड -1 के पैरा 2.50 के अन्त में मुक्त बिक्री और वाणिज्य प्रमाण-पत्र से संबंधित उप -पैरा को निम्नानुसार प्रतिस्थापित किया जाता है :-
" क्षेत्रीय प्राधिकारी , आवेदन करने पर , औषध और प्रसाधन सामग्री अधिनियम , 1940 के तहत शामिल न की गई मदों के निर्यात के लिए , मुक्त बिक्री और वाणिज्य प्रमाण- पत्र जारी कर सकते हैं, जिनका अस्पतालों, नर्सिंग होम्स औरक्लिनिक्स में मेडिकल और सर्जिकल प्रयोजनों के लिए प्रयोग होता है और जो निर्यात के लिए निषिद्ध नहीं है। ऐसे प्रमाण- पत्रों की वैधता इन्हें जारी किए जाने की तारीख से जब तक अन्यथा विनिर्दिष्ट न किया गया हो , एक वर्ष होगी ।
प्रक्रिया- पुस्तक, खण्ड-1 के परिशिष्ट 39 और अनुलग्नक क के तहत इसमें निर्धारित दस्तावेजों के साथ किए गए आवेदन के आधार पर मुक्त बिक्री और वाणिज्य प्रमाण- पत्र जारी किया जाएगा । "
3. परिशिष्ट 39 को इस सार्वजनिक सूचना के साथ संलग्न करके यथा संशोधित परिशिष्ट 39 के रुप में प्रतिस्थापित और अधिसूचित किया जाता है ।
4. इसे लोकहित में जारी किया जाता है।

अनुलग्नक (कुल मदें) के अनुसार मैसर्स ( फर्म का नाम और पूरा पता) द्वारा विनिर्मित मैडिकल यंत्रों/ उपकरणों का मुक्त रुप से निर्यात किया जा सकता है !
यह प्रमाण - पत्र जारी किए जाने की तिथि से एक वर्ष की अवधि के लिए वैध है ।

टिप्पणीः यह प्रमाण - पत्र उपरोक्त फर्म द्वारा की गई इस घोषणा पर आधारित है कि अनुलग्नक में दर्शाई गई निर्यात मदों का उपयोग अस्पतालों , नर्सिंग होम्स और क्लिनिक्स में मैडिकल सर्जिकल प्रयोजनों के लिए किया जाता है और अनुलग्नक में दर्शाई गई निर्यात मदें निर्यात हेतु न तो प्रतिबंधित हैं और न ही निषिद्ध हैं । पूर्वोक्त फर्म द्वारा की गई घोषणा के अनुसार इस प्रमाण - पत्र में आने वाली मदें औषध और प्रसाधन सामग्री अधिनियम 1940 के तहत भी शामिल नहीं हैं ।

8. मैं अनुलग्नक- क में सूचीबद्ध मदों के संबंध में, एतद्द्वारा , घोषणा करता हूँ, कि
(i ) आई टी सी ( एच एस) की अनुसूची-2 के तहत निर्यात के लिए निषिद्ध अथवा प्रतिबंधित नहीं है और निर्यात के लिए मुक्त है ;
(ii ) अनुलग्नक- क में सूचीबद्ध सभी मदों का प्रयोग अस्पतालों, नर्सिंग होम्स तथा क्लिनिकों में मेडिकल और सर्जिकल प्रयोजनों में होता है ;
(iii ) ऊपर सूचीबद्ध सभी मदें औषध और सामग्री प्रसाधन अधिनियम, 1940 के तहत शामिल नहीं हैं ।

4क. मैं/ हम एतद्वारा प्रमाणित करता है/ करते हैं कि फर्म/ कम्पनी, जिसके लिए आवेदन किया गया है, सीमाशुल्क अधिनियम, उत्पाद शुल्क अधिनियम, विदेश व्यापार (विकास और विनियमन) अधिनियम 1992 और फेरा/ फेमा के तहत दण्डित नहीं किया गया है ।
4ख . मैं / हम एतद्वारा प्रमाणित करता हूँ।करते हैं कि कोई भी स्वामी/ साझीदार (साझीदारों) / निदेशक (निदेशकों) कर्ता/फर्म का न्यासी/ कम्पनी, जैसा भी मामला हो, किसी अन्य फर्म/ कम्पनी में स्वामी/ साझीदार (साझीदारों) निदेशक (निदेशकों) कर्ता/न्यासी नहीं है जो कि विदेश व्यापार महानिदेशक की जानकारी में प्रतिकूल है ।
4ग. मैं/ हम प्रमाणित करता हूँ। करते हैं कि फर्म/ कम्पनी का स्वामी/साझीदार/ निदेशक/ कर्ता/न्यासी , जैसा भी मामला हो , किसी ऐसी अन्य फर्म /कम्पनी में स्वामी/ साझीदार/ निदेशक/ कर्ता के रुप में सम्बद्ध नहीं है जो भारतीय रिजर्व बैंक की चेतावनी सूची में आती है ।

5. मैं/हम एतद्वारा घोषणा करता/करते हैं कि मैंने/ हमने हमारे पंजीकृत/प्रधान कार्यालय के नाम अथवा किसी अन्य क्षेत्रीय कार्यालय की किसी शाखा (शाखाओं) /यूनिट (यूनिटों) /प्रभाग (प्रभागों) के नाम से ऐसे लाभों (आयातक निर्यातक कोड संख्या के जारी करने सहित) के लिए न तो आवेदन किया है, न ही प्राप्त किया है ।
6. मैं/ हम एतद्वारा घोषणा करता हूँ। करते हैं कि मैंने/ हमने आईटीसी (एचएस) की अनुसूची 2 के परिशिष्ट 3 में शामिल स्कोमेट मदों की सूची का अनुसरण किया है और निर्यातित/ निर्यात के लिए प्रस्तावित मद (मदें) इस सूची में नहीं आती हैं और मैं/ हम विदेश व्यापार नीति, आईटीसी (एचएस) की अनुसूची 2 और प्रक्रिया पुस्तक खण्ड-1 में शामिल स्कोमेट मदों के निर्यात के लिए विदेश व्यापार नीति के प्रावधानों का पालन करने का वचन देता हूँ/ देते हैं चाहे स्कीम कोई भी हो जिसके अधीन मद का निर्यात किया गया है/किया जाना है ।

7 . मैं/ हम निष्ठापूर्वक घोषणा करता हूँ। करते हैं कि मैंने/ हमने निर्यात संवर्धन परिषद को आर सी एम सी के लिए आवेदन कर दिया है/प्राप्त कर लिया है जो कि हमारे मुख्य व्यापार से संबंधित है । यदि हमने किसी अन्य परिषद को आवेदन किया हो तो आवेदन प्रक्रिया पुस्तक खण्ड-1 के पैरा 2.67 और 2.67.1 के प्रावधानों की परिसीमा के अधीन किया गया है ।
8. मैं एतद्वारा घोषणा करता हूँ कि मैं नीति के पैराग्राफ 9.9 के अनुसार इस घोषणा की जाँच और हस्ताक्षर करने के लिए प्राधिकृत हूँ ।

F. No. 01/ 91 / 180/ 179/AM 09 /Export Cell.-In exercise of powers conferred under Paragraph 2.4 of the Foreign Trade Policy, 2004-2009 , the Director General of Foreign Trade hereby makes , with immediate effect, the following amendments in the Handbook of Procedures , Vol . 1 ( RE - 2008 ) :
2. Sub -para at the end of Para 2.50 in the Handbook of Procedures Vol . I , relating to Free Sale and Commerce Certificate stands substituted as under :
"RAs may also issue , on application , Free Sale and Commerce Certificate for export of items not covered under Drugs & Cosmetics Act, 1940, which have usage in hospitals , nursing homes and clinics , for medical and surgical purposes and are not prohibited for export . -Validity of such certificate shall be one year from date of issue unless otherwise specified .
Free Sale and Commerce Certificate shall be issued as per Annexure 1 to this Public Notice, based on application made under Appendix 39 and Annexure A of HBP Vol . I along with documents prescribed therein . "
3. Appendix 39 stands substituted and notified as amended Appendix 39 annexed with this Public Notice .
4. This issues in public interest .

6. 1 / We hereby declare that I/we have perused the list of SCOMET items as contained in the Appendix 3 to the Schedule 2 of the ITC (HS) and that the item(s) exported / proposed to be exported does not fall within this list and that I / We agree to abide by the provisions of FTP for export of SCOMET items contained in the FTP , Schedule 2 of ITC ( HS) and the HBP v1 , irrespective of the scheme under which the item is exported / proposed to be exported.
