का.आ. 199 (अ).-केन्द्रीय सरकार, सूक्ष्म , लघु और मध्यम उद्यम विकास अधिनियम , 2006 ( 2006 का 27 ) की धारा 7 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , अधिनियम की धारा 7 की उप- धारा (4 ) के अधीन सलाहकार समिति की सिफारिश अभिप्राप्त करने के पश्चात् भारत सरकार के सूक्ष्म, लघु और मध्यम उद्यम मंत्रालय की अधिसूचना सं. का.आ. 1642 ( अ) , तारीख 29 सितम्बर , 2006 में निम्नलिखित संशोधन करती है, अर्थात्
उक्त अधिसूचना में " ( i ) उद्योग ( विकास और विनियमन ) अधिनियम , 1951 " से आरम्भ होने वाले और " उद्यमों की दशा में जैसे-" पर समाप्त होने वाले भाग के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्:---
" ( i ) उद्योग ( विकास और विनियमन ) अधिनियम , 1951 की पहली अनुसूची में विनिर्दिष्ट किसी उद्योग से संबंधित माल के विनिर्माण या उत्पादन में लगे हुए या अंतिम उत्पाद, जो एक सुभिन्न नाम या लक्षण या उपयोग रखता हो, के मूल्य वर्धन की प्रक्रिया में संयंत्र और मशीनरी का नियोजन करने वाले , उद्यमों की दशा में, "

New Delhi, the 16th January, 2009
S.O. 199 (E) . In exercise of the powers conferred by sub - section ( 1 ) of section 7 of the Micro , Small and Medium Enterprises Development Act , 2006 (27 of 2006), the Central Government , after obtaining the recommendation of the Advisory Committee under sub - section (4) of section 7 of the Act , hereby makes the following amendment in the notification of the Government of India in the Ministry of Micro , Small and Medium Enterprises , number S.O. 1642 (E) , dated the 29th September, 2006, namely: -
In the said notification, for the portion beginning with the brackets , letter and words " ( i) in the case of the enterprises " and ending with words , brackets and figures " the Industries (Development and Regulation) Act , 1951 , as-- " the following shall be substituted, namely, -
66 (i) in case of the enterprises engaged in the manufacture or production of goods pertaining to any industry specified in the First Schedule of the Industries (Development and Regulation) Act , 1951 or employing plant and machinery in the process of value addition to the final product having a distinct name or character or use , as "

का.आ. 200 (अ) . केन्द्रीय सरकार, सूक्ष्म, लघु और मध्यम उद्यम विकास अधिनियम, 2006 (2006 का 27) की धारा 8 की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए इस निमित्त सलाहकार सनिति की सिफारिशों को प्राप्त करने के पश्चात् भारत सरकार के सूक्ष्म, लघु और मध्यम उद्यम मंत्रालय की अधिसूचना सं० का०आ० 1643 (अ), तारीख 29 सितंबर, 2006 में निम्नलिखित संशोधन करती है, अर्थात् : -
उक्त अधिसूचना में, -- (क) अनुसूची -1 में,
(i) क्रम संख्यांक 2 और उससे संबंधित प्रविष्टियां के स्थान पर निम्नलिखित क्रम संख्यांक और प्रविष्टियां रखी जाएंगी , अर्थात् : - भारत का राजपत्र : असाधारण

3 " 2. सूक्ष्म और लघु उद्यमों के लिए ज्ञापन की तीन प्रतियां और मध्यम उद्यमों के लिए ज्ञापन की चार प्रतियां फाइल की जानी चाहिए ।

"[ पहले दो खाने राज्य और संघ राज्यक्षेत्र के कोड के लिए, अगले तीन खाने जिला कोड के लिए, छठा और सातवां खाना उद्यम के प्रवर्ग के लिए (विनिर्माण या सेवा के लिए छठा खाना और सातवां खाना सूक्ष्म और अंतिम पांच खाने उद्यमी ज्ञापन संख्या के लिए है) ] "

(ख) अनुसूची-2 में क्रम सं. 12 और उससे संबंधित प्रविष्टियों के पश्चात् निम्नलिखित क्रम संख्यांक और प्रविष्टियां अंतःस्थापित की जाएंगी, अर्थात् : -
" 13. "अभिस्वीकृत उद्यमी ज्ञापन " रद्द किए जाने के लिए दायी होगा यदि इकाई छह मास से अधिक के लिए बंद पायी जाती है या फाइल किए गए उद्यमी ज्ञापन में गलत जानकारी दी है या इस अनुसूची के क्रम सं 10 पर अनुदेशों का पालन नहीं किया है (उक्त अधिनियम की धारा 8 उपधारा (3) और उपधारा (4) के उपबंधों के अधीन उद्यमी ज्ञापन को स्वीकार करने के लिए अधिसूचित प्राधिकारी से अन्यून किसी अधिकारी के अधीन किसी जांच द्वारा अनुसरित की जाने वाली लिखित शिकायत पर आधारित आरंभ की जाए ) ।
14. उद्यम पुनः उद्यमी ज्ञापन भाग-2 फाइल करेगा यदि उद्यम की प्रास्थिति संयंत्र और मशीनरी /उपस्करों में विनिधान की वृद्धि कमी के परिणामस्वरूप सूक्ष्म से लघु या लघु से मध्यम या विपर्येन परिवर्तित हो जाती है । ऐसे मामलों में पहले जारी की गई अभिस्वीकृति को रद्द किए जाने की आवश्यकता है और रद्द की गई अभिस्वीकृति की प्रति प्रमाणित के साथ रद्दकरण का पत्र उद्योगपति को उपलब्ध कराया जाना चाहिए जिससे कि वह कार्यकरण की अवधि के लिए फायदा यदि कोई हो उठा सके ।
15. सूक्ष्म और लघु उद्यमों (विनिर्माण और सेवा दोनों) द्वारा फाइल की गई उद्यमी ज्ञापन की तीन प्रतियों में से पहली जिला उद्योग केन्द्र द्वारा रखी जानी चाहिए, दूसरी उद्यमी ज्ञापन संख्या आबंटित कर उद्यमी को वापस की जानी चाहिए और तीसरी प्रति संबद्ध सूक्ष्म, लघु और मध्यम उद्यम विकास संस्थान को अग्रेषित की जानी चाहिए ।

कर 16. मध्यम उद्यमों (विनिर्माण और सेवा दोनों) द्वारा फाइल की गई उद्यमी ज्ञापन की चार प्रतियों में से पहली जिला उद्योग केन्द्र द्वारा रखी जानी चाहिए, दूसरी उद्यमी ज्ञापन संख्या आबंटित उद्यमी को वापस की जानी चाहिए और तीसरी प्रति संबद्ध सूक्ष्म, लघु और मध्यम उद्यम विकास संस्थान को अग्रेषित की जानी चाहिए , और चौथी प्रति विकास आयुक्त (सूक्ष्म, लघु और मध्यम उद्यम) के सूक्ष्म लघु और मध्यम उद्यम नीति प्रभाग, सातवां तल, ए- विंग, निर्माण भवन, नई दिल्ली को अग्रेषित की जानी चाहिए ।
17. कंपनी अधिनियम, 1956 (1956 का 1 ) में यथा परिभाषित कंपनियों सहकारी/ भागीदारी फर्म और न्यासों की दशा में उद्यम के नाम का परिवर्तन यदि कोई हो, महा प्रबंधक, जिला उद्योग केन्द्र या राज/ संघ राज्यक्षेत्र में उद्यमी ज्ञापन फाइल करने के लिए अधिसूचित प्राधिकारी को परिवर्तन होने की तीन मास के भीतर सूचना दी जानी चाहिए । स्वामित्व फर्मों की दशा में उसकी संसूचना किसी शपथ पत्र के साथ नाम में परिवर्तन की प्रभावी होने के तीन मास के भीतर दी जानी चाहिए ।"

(B) In Schedule II , after the serial number 12 and entries relating thereto , the following serial numbers and entries shall be inserted , namely , --

The Acknowledged Entrepreneurs ' Memorandum shall be liable to be cancelled in case the unit is found closed for more than 6 months or furnished wrong information in the Entrepreneurs ' Memorandum filed or did not follow the instructions at serial number 10 of this Schedule ( to be initiated based on any complaint in writing followed by an enquiry under an official not below the authority notified for accepting the Entrepreneurs ' Memorandum under the provisions of sub - sections (3 ) and (4) of section 8 of the said Act.
14. The enterprise has to file the Entrepreneurs ' Memorandum Part II again, in case , the status of the enterprise changes from micro to small or small to medium or vice versa, as a result of enhancement/decrease in the investment in plant and machinery/equipments. In such cases , the acknowledgement issued earlier need to be cancelled and the letter of cancellation along with the copy of the cancelled acknowledgement (certified) should be provided to the industrialist so that it may take benefit , if any, for that period of functioning.

15. Out of the three copies of the Entrepreneurs ' Memorandum filed by the Micro and Small enterprises (both manufacturing and service) , first should be retained by the District Industries Centre, second returned to the Enterprise with Entrepreneurs ' Memorandum No. allotted, and third should be forwarded to Micro , Small and Medium Enterprises Development Institute concerned .
16. Out of the four copies of the Entrepreneurs ' Memorandum filed by the medium enterprises (bothmanufacturing and service) , first should be retained by the District Industries Centre , second returned to the Enterprise with Entrepreneurs' Memorandum No. allotted, third forwarded to Micro , Small and Medium Enterprises Development Institute concerned and fourth copy should be forwarded to the Micro , Small and Medium Enterprises Policy Division of the Development Commissioner (Micro , Small and Medium Enterprises ) , 7th floor , A Wing , Nirman Bhavan , New Delhi .
17. In case of companies as defined in Companies Act , 1956, ( 1 of 1956) cooperative/partnership firms and trusts , the change of name of the enterprise , if any , should be informed to General Manager , District Industries Centre or the authority notified for filing of Entrepreneurs ' Memorandum in the State/UT within three months of change . In case of ownership firms , the same should be communicated within three months of effecting the change in name along with an affidavit. "
