सा.का.नि. 43(अ ) खाद्य अपमिश्रण निवारण नियम, 1955 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप , जिसे केन्द्रीय सरकार, केन्द्रीय खाद्य मानक समिति से परामर्श करने के पश्चात् खाद्य अपमिश्रण निवारण अधिनियम, 1954 ( 1954 का 37 ) की धारा 23 की उप- धारा ( 1 ) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव करती है उन सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है , जिनके उससे प्रभावित होने की संभावना है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से , जिसको उस राजपत्र की जिसमें यह अधिसूचना प्रकाशित की जाती है , प्रतियां जनता को उपलब्ध करा दी जाती हैं, साठ दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ।

आक्षेप या सुझाव , यदि कोई हो , सचिव , स्वास्थ्यऔर परिवार कल्याण मंत्रालय , भारत सरकार , निर्माण भवन , नई दिल्ली-110011 को भेजे जा सकेंगे ।

ऐसी अपेक्षाओं और सुझावों पर , जो उक्त प्रारूप नियमों के संबंध में किसी व्यक्ति से इस प्रकार विनिर्दिष्ट अवधि की समाप्ति के पूर्व प्राप्त हो, केन्द्रीय सरकार द्वारा विचार किया जाएगा ।

प्रारूप नियम

1. ( 1 ) इन नियमों का संक्षिप्त नाम खाद्य अपमिश्रण निवारण ( दूसरा संशोधन ) नियम , 2009 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. खाद्य अपमिश्रण निवारण नियम , 1955 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 42 में, उप -नियम ( ययय ) ( 25 ) के पश्चात् निम्नलिखित उप-नियम अंतःस्थापित किए जाएंगे , अर्था

" ( ययय ) (26 ) पालीओलस वाले खाद्य के प्रत्येक पैकेज पर निम्नलिखित लेबल लग जाएगा :

पालीओलस का मृदुरेचब प्रभाव को सकेगा (ययय) ( 27 ) पालीडेक्स्ट्रोज वाले खाद्य के प्रत्येक पैकेज पर निम्नलिखित लेबल लगाया जाएगा :- पालीडेक्स्ट्रोज का मृदुरेचक प्रभाव हो सकेगा " ।

3. उक्त नियमों के नियम 47 में,-

(क) सारणी में,-

( i ) एस्परटेम ( मेथिल एस्टर ) से संबंधित क्रम सं. 2. के सामने स्तंभ 3 और स्तंभ 4 में विद्यमान प्रविष्टियों के पश्चात् निम्नलिखित प्रविष्टियां अंतःस्थापित की जाएंगी , अर्थात्:-

( ii ) एससल्फेम पोटाशियम से संबंधित क्रम सं. 3 के सामने स्तंभ 3 और स्तंभ 4 में विद्यमान प्रविष्टियों के पश्चात् निम्नलिखित प्रविष्टिअंतःस्थापित की जाएगी , अर्थात्:-

300 पीपीएम". , "नान-कार्बोनेटीकृत जल आधारित पेय (नान- अल्कोहलिक)

( iii ) सुक्रालूज से संबंधित क्रम सं. 4 के सामने स्तंभ 3 और स्तंभ 4 में विद्यमान प्रविष्टियों के पश्चात् निम्नलिखित प्रविष्टि अंतःस्थापित की जाएगी :-

(iv ) क्रम सं. 4 और उससे संबंधित प्रविष्टियों के पश्चात् निम्नलिखित प्रविष्टियां अंतःस्थापित की जाएंगी, अर्थात्:-

(ख) सारणी के पश्चात् स्पष्टीकरण 2 में " मृदु पेय सांद्र में कृत्रिम मीठा करने वाले पदार्थ की अधिकतम सीमा " शब्दों से प्रारंभ होने वाला और " उत्पादों के पुनर्गठित के लिए स्पष्ट अनुदेश होगा " शब्दों पर समाप्त होने वाले पैरा के स्थान पर निम्नलिखित पैरा रखा जाएगा, अर्थात्:-

" उत्पाद में कृत्रिम मीठा करने वाले पदार्थ की अधिकतम सीमा वह होगी , जो यथास्थिति, पुनर्गठित पेय या खाद्य या अंतिम पेय अथवा उपयोग के लिए खाद्य पदार्थ में होती है । उत्पाद लेबल पर यथास्थिति अंतिम पेय या उपभोग के लिए खाद्य पदार्थ बनाने के लिए स्पष्ट अनुदेश होंगे । ";

(ग ) स्पष्टीकरण 2 के पश्चात्, परन्तुक में,-

( i ) " या सुक्रालोस " शब्दों के पश्चात् " या नियोटेम " शब्द रखे जाएंगे ;

( ii ) वाहक या पूरक वस्तुओं की सूची के अंत में निम्नलिखित अंतःस्थापित किया जाएगा , अर्थात्

" 22. एरिथ्रिटोल";

(घ) उप-नियम ( 2 ) में विद्यमान परन्तुक के पश्चात् निम्नलिखित परन्तुक अंतःस्थापित किया जाएगा , अर्थात्:-

" परन्तु यह और कि एम्परेटम ( मिथिल ईस्टर ) और एसिसुल्फेम के पोटेशियम ( 2 : 1 के अनुपात में ) के मिश्रण को खाद्य मधुकारक के रूप में विपणित किया जा सकेगा और उसमें ऐसे वाहक या पूरक वस्तुएं अंतर्विष्ट हो सकेंगी जो उपनियम ( 1 ) में दी गई सारणी के नीचे परन्तुक में और नियम 42 के उपनियम ( ययय ) के खंड ( 1 ) और खंड ( 2 ) में यथाउपबंधि त लेबल के नीचे उल्लिखित हैं । " ।

4. उक्त नियमों के नियम 47 के पश्चात् निम्नलिखित अंतःस्थापित किए जाएंगे , अर्थात्:-

" 47-क खाद्यों में पोलीओल्स के उपयोग पर निर्बंधन-इन नियमों और परिशिष्ट ' ग ' में विनिर्दिष्ट खाद्य वस्तु के सिवाय किसी अन्य खाद्य वस्तु में कोई पोलीओल्स नहीं मिलाया जाएगा । नीचे दी गई सारणी में उल्लिखित खाद्य वस्तुओं में पोलीओल्स का उपयोग किया जा सकेगा और नियम 42 के उप-नियम ( ययय ) ( 26 ) में यथा उपबंधित लेबल घोषणा होगी:

2. एरीथ्रीटोल

जीएमपी डेयरी पेय ( चाकलेट और फ्लेवर्ड मिल्क) , कार्बोनेटीकृत पेय , गैर कार्बोनेटीकृत जल आधारित पेय (नान एल्कोहलिक ) , आइसक्रीम , योगहर्ट , पुडिंग ,नान डेयरी टयापिंग , बेकरी मिश्रण , केक , कुकीज और पेस्ट्रीज , खाने के लिए तैयार कलेवा , अनाज , साफ्ट केण्डी, चाकलेट और हार्ड केन्डी ।

47-ख. खाद्यों में पालीडेक्सट्रोज का उपयोग पालीडेक्सट्रोज का उपयोग निम्नलिखित खाद्य वस्तुओं में जीएमपी के अनुसार अधिकतक स्तर के अधीन और नियम 42 के उप-नियम (ययय) (27 ) में यथाउपबंधित उचित लेबल घोषणा के अधीन रहते हुए किया जा सकेगा:-

( iii ) क्रम संख्यांक ञ में, सोडियम हेक्सामेटा फास्फोरस के सामने कार्बोनेटीकृत फ्रूट बीवरेज या फ्रंट ड्रिंक से संबंधित स्तंभ (7) के नीचे विद्यमान प्रविष्टि के स्थान पर निम्नलिखित अंतःस्थापित किया जाएगा , अर्थात्

" 1000 पीपीएम अधिकतम" ।

(ग) सारणी 9 में,

आइसक्रीम , फ्रोजन डेजर्ट, केक , बिस्कुट, योगहर्ट, व्हिप टापिंग , चीनी क्वथित कन्फेक्शनरी, लोजेन्जज, जेम , फल जैली , पारम्परिक भारतीय मिठाइयां ( कार्बोहाड्रेट और दुग्ध उत्पाद आधारित ) हलवा, मैसूर पाक , बूंदी- लड्डू, जलेबी, खोया बर्फी , पेडा, गुलाब जामुना , रसगुल्ला और इसी प्रकार के दुग्ध उत्पाद आधारित मिठाइयां, जिनका किसी भी नाम से विक्रय किया जाता हो । " ।

5. उक्त नियमों के नियम 61 -च के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा , अर्थात्:-

( i ) क्रम संख्यांक झा में, मद संख्यांक 3 और उससे संबंधित प्रविष्टियों के पश्चात् निम्नलिखित मद संख्यांक और प्रविष्टियांरखी जाएंगी, अर्थात्

"61 -छ चीनी कन्फेक्शनरी में अम्ल ट्रीटेड स्टार्च का उपयोग-चीनी आधारित कन्फेक्शनरी में जीएमपी स्तर से अनधिक अम्ल ट्रीटेड स्टार्च का उपयोग किया जा सकेगा । " ।

(घ) सारणी 10 की क्रम संख्यांक त में , 6. उक्त नियमों की परिशिष्ट ' ख ' में, कार्बोनेटीकृत जल से संबंधित मद क .01.01 के पैरा 2 में ,-

( i ) मद संख्यांक 4 और उससे संबंधित प्रविष्टियों के पश्चात् निम्नलिखित मद संख्यांक और प्रविष्टियां रखी जाएंगी , अर्थात्

(क) " 100 भाग प्रति दस लाख से अनधिक एस्टरगम ( काष्ठ रेजन का ग्लिसरोल एस्टर ) " संख्याओं और शब्दों के पश्चात् निम्नलिखित शब्द अंतःस्थापित किए जाएंगे , अर्थात् :-

7. उक्त नियमों की परिशिष्ट ' ग ' में,

( ii ) मद संख्यांक द और उससे संबंधित प्रविष्टियों के पश्चात निम्नलिखित मद संख्यांक और प्रविष्टियां रखी जाएंगी , अर्थात्

" 2.0 प्रतिशत अधिकतम " ।

G.S.R. 43 (E) . The following draft of certain rules further to amend the Prevention of Food Adulteration Rules , 1955 , which the Central Government , after consultation with the Central Committee for Food Standards , proposes to make , in exercise of the powers conferred by sub - section ( 1 ) of Section 23 of the Prevention of Food Adulteration Act, 1954 (37 of 1954) , ishereby published , as required by the said sub - section , for the information of all persons likely to be affected thereby, and notice is hereby given that the said draft rules will be taken into consideration after the expiry of a period of sixty days from the date on which copies of the Gazette of India in which this notification is published, are made available to the public ;

Objection or suggestions , if any, may be addressed to the Secretary, Ministry of Health and Family Welfare , Government of India, Nirman Bhawan, New Delhi- 110011 ;

[PART- II-SEC. 3 ( i ) ]

(a) in the Table,

(i) against serial number 2 relating to Aspartame (me- thyl ester) , after the existing entries in columns 3 and 4, the following entries shall be inserted, namely:-

The objection and suggestions , which may be received from any person with respect to the said draft rules before the expiry of the period so specified, will be considered by the Central Government .

DRAFT RULES

1. ( 1) These rules may be called the Prevention of Food Adulteration (2nd Amendment) Rules , 2009.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. In the Prevention of Food Adulteration Rules , 1955 (hereinafter refer to as the said rules), in rule 42, after sub - rule ( ZZZ ) ( 25 ) , the following sub - rules shall be inserted, namely :-

"(ZZZ) (26) Every package of food containing Polyols shall bear the following label :---

Polyols may have laxative effect

( ZZZ) ( 27 ) Every package of food containing Polydextrose shall bear the following label :---

Polydextrose may have laxative effect " .

3. In rule 47 of the said rules ,-

(iv) after serial number 4, and the entries relating thereto , the following entries shall be inserted , namely:-

(b) in the Explanation II after the Table , the paragraph beginning with the words "Maximum limit of artificial sweetener in soft drink concentrate " and ending with the words " reconstitution of products for making final beverage" shall be substituted with the follow- ing paragraph , namely :-

"Maximum limit of artificial sweetener in the product shall be as in reconstituted beverage or food or in the final beverage or food for consumption , as the case may be . The product label shall give clear instructions for reconstitution of products for making final beverage or food for consumption as the case may be . " ;

(1) after the words " or sucralose " , the words " or Neotame" shall be inserted;

(ii) at the end ofthe list of carrier or filler articles, the following shall be inserted namely :-

"22.Erythritol";

(d) in sub -rule (2) , after the existing proviso , the following proviso shall be inserted, namely:-

"Provided further that mixture of aspartame (methyl ester) and acesulfame K potassium (in ratio 2 : 1 ) may be marketed as Table Top Sweetener and may contain the carrier or filler articles as mentioned in the proviso given under the Table in sub -rule (1 ) and under label declaration as provided in clause ( 1 ) and (2) of sub -rule (ZZZ) ofrule 42." .

4. after rule 47 ofthe said rules , the following rules shall be inserted , namely:-

"47 -A. Restriction on use of Polyols in foods. No Polyols shall be added to any article of food except specified in these rules and Appendix ' C' . Polyols may be used in food articles mentioned in the Table given below and shall bear the label declaration as provided in sub - rule (ZZZ)(26) ofrule 42:-

GMP 2. Erythritol Diary drinks (chocolate and flavoured milk) , carbonated beverages , non - carbonated water based beverages (non- alcoholic), icecream, yoghurt, puddings, non -dairy toppings , bakerymixes, cake, cookies and pastries, ready to eat breakfast cereals, soft candies , chocolate and hard candies .

47-B. Use of Polydextrose in foods.- Polydextrose may beused in following food articles subject to maximum level as per GMP and proper label declaration as provided in sub -rule ( ZZZ)(27 ) of rule42:-

Ice - cream , Frozen dessert , Cakes , biscuits , yoghurt , whip topping , sugar boiled confectionary, lozenges , jam, fruitjelly, Traditional Indian Sweets (carbohydrates based and milk products based) Halwa, Mysore Pak, Boondi Ladoo, Jalebi, Khoya Burfi , Peda, Gulab Jamun , Rasogolla and similar milk product based sweets sold by any name ." .

5. After Rule 61 -F of the said rules, the following shall be inserted, namely:-

"61 -G Use of Acid Treated Starch in Sugar Confec- tionery.--Acid Treated Starch may be used in sugar confectionery not exceeding GMP level " .

6. Inthe said rules, in Appendix ' B ' , in item A.01.01 relating to Carbonated water, in para -2,

(a) after the words and figures "Estergum (Glycerol esters of wood rosin) not exceeding 100 parts per million, " , the following words and letters shall be inserted, namely:-

"Gellan gum not exceeding GMP level";

(b) after the words and figures "Sucralose not ex- ceeding 300 ppm", the following words and fig- ures shall be inserted, namely:- "orNeotame not exceeding 33 ppm" .

7. In the said rules , in Appendix ' C' ,

(a) inTable 2, in Serial Number C, for item number 1 , and the entries relating thereto, under column 2, the following item and the entries shall be in- serted, namely:-

"1. Sorbic Acid and its sodium , potassium and calcium salt (calculated as Sorbic Acid)" ;

(b) inTable 8, in serial number G,-

(1) against item number 4 relating to ester gum , for the existing entry under column (7) relating to carbonated fruit beverage or fruit drink, the following shall be inserted, namely:-

"100 ppm maximum" ;

(ii) in Serial Number G , after item number 7 and the entries relating thereto, the following item number andthe entries shall be inserted, namely:

(ii) after serial number M and the entries relating thereto , the following item number and the entries shall be inserted , namely :-

(iii) in Serial Number J, against Sodium Hexameta Phos- phate, for the existing entry under column (7) relating to carbonated fruit beverage or fruit drink, the following entry shall be inserted, namely:-
