सा.का.नि. 44(अ).-खाद्य अपमिश्रण निवारण नियम, 1955 का और संशोधन करने के लिए कतिपय मिश्रमों का प्रारूप , केन्द्रीय सरकार ने, केन्द्रीय खाद्य मानक समिति से परामर्श करने के पश्चात्, खाद्य अपमिश्रण मिवारण , 1954 ( 1954 का 37 ) की धारा 23 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , प्रकाशित करती है और उक्त धारा की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिएजिनके उससे प्रभावित होने की संभावना है प्रकाशित किया जाता है, और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से जिसको भारत के उस राजपत्र की प्रतियां , जिसमें यह सूचना प्रकाशित की जाती है , जनता को उपलब्ध करा दी जाती हैं, साठ दिन की समाप्ति के पश्चात् विचार किया जाएगा;
ऐसे किन्हीं आक्षेपों और सुझावों पर विनिर्दिष्ट अवधि के समाप्त होने से पूर्व उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से प्राप्त होंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा ;
आक्षेप और सुझाव यदि कोई हो, सचिव, भारत सरकार, स्वास्थ्यऔर परिवार कल्याण मंत्रालय , भारत सरकार , निर्माण भवन , नई दिल्ली-110011 को भेजे जा सकेंगे ।
प्रारूप नियम
1. ( 1) इन नियमों का संक्षिप्त नाम खाद्य अपमिश्रण निवारण (तीसरा संशोधन ) नियम, 2009 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. खाद्य अपमिश्रण निवारण नियम , 1955 ( जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 22 की सारणी में,-
(1) 306GI/2009
(क) क्रम सं. 2 के सामने , स्तंभ ( 2 ) के अधीन, " 250 मिली" अंकों और शब्दों के स्थान पर, " 500 मिली" अंक और शब्द रखे जाएंगे;
(ख) क्रम सं. 4 के सामने , स्तंभ ( 2 ) के अधीन , " 300 ग्राम" अंकों और शब्दों के स्थान पर , " 500 ग्राम " अंक और शब्द रखे जाएंगे ।
(ग) क्रम सं. 13 के सामने , स्तंभ ( 2 ) के अधीन , " 250 ग्राम" अंकों और शब्दों के स्थान पर , " 400 ग्राम" अंक और शब्द रखे जाएंगे।
(घ) क्रम सं. 14 के सामने , स्तंभ ( 2 ) के अधीन , "600 मिली" अंकों और शब्दों के स्थान पर , " 3 लीटर " अंक और शब्द रखे जाएंगे;
(ङ) क्रम सं. 18 के सामने , स्तंभ ( 2 ) के अधीन , " 200 ग्राम" अंकों और शब्दों के स्थान पर , " 500 ग्राम " अंक और शब्द रखे जाएंगे;
(च ) क्रम सं. 19 के सामने , स्तंभ ( 2 ) के अधीन, " 250 ग्राम" अंकों और शब्दों के स्थान पर, " 500 ग्राम " अंक और शब्द रखे जाएंगे;
(छ) क्रम सं. 20 के सामने , स्तंभ ( 2 ) के अधीन, " 150 ग्राम" अंकों और शब्दों के स्थान पर, " 250 ग्राम " अंक और शब्द रखे जाएंगे;
(ज ) क्रम सं. 27 के सामने , स्तंभ ( 2 ) के अधीन, "400 मिली" अंकों और शब्दों के स्थान पर , " 1 लीटर " अंक और शब्द रखे जाएंगे;
(झ) क्रम सं. 32 के सामने , स्तंभ ( 2 ) के अधीन, " 200 ग्राम" अंकों और शब्दों के स्थान पर, " 500 ग्राम " अंक और शब्द रखे जाएंगे;

(2) These rules shall come into force on the date oftheir publication in the Official Gazette .
(ञ) क्रम सं. 38 के सामने , स्तंभ ( 2 ) के अधीन , " 500 ग्राम " अंकों और शब्दों के स्थान पर , " 1 कि. ग्राम " अंक और शब्द रखे जाएंगे ;
2. In the Prevention of Food Adulteration Rules , in rule 22, in the Table,-
(ट) क्रम सं. 48 के सामने , स्तंभ ( 2 ) के अधीन , " 1 ग्राम" अंकों और शब्दों के स्थान पर , " 2 ग्राम" अंक और शब्द रखे जाएंगे;
(a) against serial number 2 , under column (2) , for the figures and words " 250 ml . " , the figures and words , " 500 ml . " shall be substituted ;
(b) against serial number 4, under column (2) , for the figures and words , " 300 gms . " , the figures and words , " 500 gms . " shall be substituted ;
(ठ) क्रम सं. 50 के सामने , स्तंभ ( 2 ) के अधीन , " 300 ग्राम" अंकों और शब्दों के स्थान पर, " 500 ग्राम " अंक और शब्द रखे जाएंगे;
(c) against serial number 13 , under column (2) , for the figures and words , " 250 gms . " , the figures and words , " 400 gms . " shall be substituted;
(ड) क्रम सं. 52 के सामने , स्तंभ ( 2 ) के अधीन, " 300 ग्राम" अंकों और शब्दों के स्थान पर , " 500 ग्राम " अंक और शब्द रखे जाएंगे;

(d) against serial number 14 , under column (2) , for the figures and words , " 600 ml . " , the figures and words , " 3 litre " shall be substituted;

टिप्पण: खाद्य अपमिश्रण निवारण नियम , 1955 , भारत के राजपत्र , भाग II , खंड 3 में अधिसूचना सं. का.नि.आ. 2106, तारीख 12 सितम्बर , 1955 द्वारा प्रकाशित किए गए थे और सं. सा.का.नि. 754 ( अ ) , तारीख 27 अक्तूबर , 2008 द्वारा उनका अंतिम संशोधन किया गया था ।

(h) against serial number 27 , under column (2) , for the figures and words , " 400 ml . " , the figures and words , 1 litre " shall be substituted ;
(i) against serial number 32 , under column (2) , for the figures andwords , " 200gms . " , the figures and words , " 500gms . " shall be substituted ;
(j ) against serial number 38 , under column (2), for the figures and words , " 500 gms . " , the fig- ures and words , " 1 kg . " shall be substituted;
(k) against serial number 48 , under column (2), for the figures and words, " 1 gm. " , the figures and words , " 2 gms . " shall be substituted ;
G.S.R. 44 (E). The following draft of certain rules further to amendthe Prevention of Food Adulteration Rules , 1955, which the Central Government, after consultation with the Central Committee for Food Standards , proposes to make in exercise of the powers conferred by sub - section ( 1 ) read with sub- section ( 1A) of Section 23 of the Prevention of Food Adulteration Act, 1954 (37 of 1954 ) , is hereby published, for the information of all persons likely to be affected thereby , and notice is hereby given that the said draft rules will be taken into consideration after the expiry of a period of sixty days from the date on which the copies of the Gazette of India in which this notification is published, are made available to the public;
(1) against serial number 50, under column (2) , for the figures and words , " 300 gms . " , the figures and words , " 500 gms . " shall be substituted ;
(m) against serial number 52 , under column (2 ) , for the figures and words , " 300 gms. " , the figures and words , " 500 gms . " shall be substituted.
Objections or suggestions which may be received from any person with respect to the said draft rules within the period specified above , will be considered by Central Government;

DRAFT RULES
1. (1) These rules may be called the Prevention ofFood Adulteration (3rd Amendment) Rules , 2009 .
Note: The Prevention of Food Adulteration Rules , 1955 were published in Part II, Section 3 ofGazette of India vide Notification No. S.R.O. 2106 dated the 12th September , 1955 and were last amended vide Notification No. G.S.R. 754 (E) dated the 27thOctober, 2008 .
