सा.का.नि. 45( अ )-औषधि और प्रसाधन सामग्री नियम , 1945 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप केन्द्रीय सरकार ने औषधि तकनीकी सलाहकार बोर्ड के परामर्श के पश्चात्, औषधि और प्रसाधन सामग्री अधिनियम , 1940 ( 1940 का 23) की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , प्रकाशित करती है और उक्त अधिनियम की उक्त धारा की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है , प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से जिसको भारत के उस राजपत्र की प्रतियां, जिसमें यह सूचना प्रकाशित की जाती है, जनता को उपलब्ध करा दी जाती हैं , तीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ;
आक्षेप और सुझाव , यदि कोई हो, सचिव , भारत सरकार, स्वास्थ्यऔर परिवार कल्याण मंत्रालय , भारत सरकार , निर्माण भवन , नई दिल्ली-110011 को भेजे जा सकेंगे ;
ऐसे किन्हीं आक्षेपों और सुझावों पर विनिर्दिष्ट अवधि के समाप्त होने से पूर्व उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से प्राप्त होंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
प्रारूप नियम
1. ( 1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री ( पहला संशोधन ) नियम , 2009 है ।

(2) ये राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. औषधि और प्रसाधन सामग्री नियम , 1945 के नियम 3क के उप-नियम ( 3 ) के स्थान पर निम्नलिखित उप -नियम रखा जाएगा, अर्थात्:-
" (3 ) कंडोम के परीक्षण के बाबत प्रयोगशाला के कृत्य केन्द्रीय औषधि परीक्षण प्रयोगशाला , चेन्नई में किए जाएंगे और उक्त उत्पाद की बाबत निदेशक के कृत्य उक्त प्रयोगशाला के निदेशक द्वारा प्रयोग किए जाएंगे । "

G.S.R. 45 (E). The followingdraft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 , which the Central Government proposes to make , after consultation with the Drugs Technical Advisory Board, in exercise ofthe powers conferred by Section 12 and Section 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940 ), is

hereby published as required by the said sections , of the said Act, for the information of all persons likely to be affected thereby, and the notice is hereby given that the said draft rules will be taken into consideration after the expiry ofa period of thirty days from the date on which the copies of the Official Gazette in which this notification is published, are made available to the public;
Objections or suggestions , if any , may be addressed to the Secretary, Ministry of Health and Family Welfare, Government of India, Nirman Bhawan, New Delhi - 110011;
Any objection or suggestion which may be received from any person with respect to the said draft rules , before the expiry of the period as specified above , will be taken into consideration by the Central Government .
DRAFT RULES
1. ( 1 ) These rules may be called the Drugs and Cosmetics ( First Amendment) Rules , 2009.
(2) They shall come into force on the date of their final publication in the Official Gazette.
[PART II-SEC. 3 ( i ) ]
2. In the Drugs and Cosmetics Rule's , 1945 , in rule 3A , for sub - rule (3 ) , the following sub - rule shall be substituted, namely : -
"(3) The functions of the laboratory in respect of testing of condoms shall be carried out at the Central Drugs Testing Laboratory , Chennai , and the functions of the Director in respect of the said products shall be exercised by the Director of the said Laboratory.".

upto 30th June , 2005 have been published in the Government of India publications PDGHS -93 on the Drugs and Cosmetics Act, 1940 and the Drugs and Cosmetics Rules , 1945 and last amended vide No. G.S.R. 780 (E) , dated 10-11-2008.
