सा.का.नि. 46( अ ). औषधि और प्रसाधन सामग्री नियम , 1945 का और संशोधन करने के लिए कतिपय नियमों का एक प्रारूप औषधि और प्रसाधन सामग्री अधिनियम, 1940 ( 1940 का 23 ) की धारा 12 और धारा 33 के अधीन भारत सरकार के स्वास्थ्यऔर परिवार कल्याण मंत्रालय (स्वास्थ्यविभाग ) की अधिसूचना सं. सा.का.नि. 636( अ ) , तारीख 13 अक्तूबर, 2006 के द्वारा भारत के राजपत्र , असाधारण , भाग II , खंड 3 , उप- खंड ( i ) , तारीख 13 अक्तूबर , 2006 में प्रकाशित किया गया था जिसमें उन सभी व्यक्तियों से जिनके उससे प्रभावित होने की संभावना थी , उस तारीख से जिसको राजपत्र की प्रतियाँ जनता को उपलब्ध करा दी गई थीं, पैंतालीस दिन की अवधि की समाप्ति से पूर्व आक्षेप और सुझाव मांगे गए थे;
और राजपत्र की प्रतियाँ तारीख 20-10-2006 को , जनता को उपलब्ध करा दी गई थीं;
और केन्द्रीय सरकार ने उक्त नियमों के संबंध में जनता से प्राप्त आक्षेपों और सुझावों पर विचार कर लिया गया है ;
अतः , अब , केन्द्रीय सरकार उक्त अधिनियम की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, औषधि तकनीकी सलाहकार बोर्ड से परामर्श करने के पश्चात् औषधि और प्रसाधन सामग्री नियम , 1945 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री ( पहला संशोधन ) नियम , 2009 है ।
(2) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख से छः मास के पश्चात् प्रवृत्त होंगे ।
2. औषधि और प्रसाधन सामग्री नियम , 1945 के नियम 148 में,-
क) (i ) उप- नियम ( 1 ) में खंड ( ख ) के पश्चात् निम्नलिखित खंड अंतःस्थापित किया जाएग , अर्थात्: - (
" (ग ) ...... .( मास और वर्ष ) के पूर्व उपयोग के लिए " ।
(ii ) उप- नियम ( 6 ) के पश्चात् निम्नलिखित उप- नियम अंतःस्थापित किए जाएंगे , अर्थात्: -
" (7) सांद्रण में एक प्रतिशत से अधिक विद्यमान संघटकों की सूची में उनको जोड़े जाते समय भार या आयतन के. अवरोहण क्रम में सूचिबद्ध किया जाएगा, किसी क्रम में एक प्रतिशत से कम या समान सांद्रण में उन्हें अनुसरित किया जाएगा और ' संघटक' शब्द द्वारा प्रारम्भ होगा :

परन्तु यह विवरण द्रवों के 60 मिली से कम के और ठोस तथा अर्द्ध ठोस के 30 ग्राम के पैकों पर दर्शाने की आवश्यकाता नहीं है ।
( 8 ) लेबल लगाने के लिए अपेक्षाएं , यदि कोई हों, जो अनुसूची " ध " के अधीन आने वाली प्रसाधन सामग्री के लिए भारतीय मानक ब्यूरो द्वारा अधिकथित सुसंगत भारतीय मानकों में विनिर्दिष्ट की गई हैं ।
(ख) नियम 148 - क, के पश्चात् निम्नलिखित नियम अंतःस्थापित किया जाएगा , अर्थात् :-
" 148-ख. मिथ्या या भ्रामक दावों का प्रतिषेध कोई प्रसाधन सामग्री किसी ऐसी धारणा को , जो आशयित उपभोक्ता के लिए मिथ्या या भ्रामक है , तात्पर्यिंत या तात्पर्यत का दावा या संप्रेषित नहीं कर सकेगी । "

NOTIFICATION
New Delhi , the 22nd January, 2009
G.S.R. 46 (E) .- Whereas a draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 was published , as required by Sections 12 and 33 of the Drugs and Cosmetics Act , 1940 (23 of 1940 ) , vide the notification of the Government of India in the Ministry of Health and Family Welfare ( Department of Health) , No. G.S.R. 636(E ) dated the 13th October , 2006 in the Gazette of India , Extraordinary , Part II , Section 3 , sub- section ( i ) dated the 13th October , 2006 for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of forty- five days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
And, whereas, copies of the said Gazette were made available to the public on 20-10-2006;
And, whereas , objections and suggestions received from the public on the said draft rules have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by Sections 12 and 33 ofthe said Act, the Central Government , after consultation with the Drugs Technical Advisory Board , hereby makes the following rules further to amend the Drugs and Cosmetics Rules , 1945 , namely:-
1. ( 1 ) These rules may be called the Drugs and Cosmetics (First Amendment ) Rules , 2009.
(2) They shall come into force after six months from the date of their final publication in the Official Gazette .
2. In the Drugs and Cosmetics Rules , 1945 , in rule 148 ,---
(a) ( i) in sub - rule (1 ) , after the clause (b) the following clause shall be inserted , namely :---
"(c) use before . .(month and year) " .
(ii) after sub -rule (6) , the following sub - rules shall be inserted , namely :--
"(7) The list of ingredients , present in concentration of more than one per cent shall be listed in the descending order of weight or volume at the time they are added , followed by those in concentration of less than or equal to one per cent, in any order , and preceded by the words ' INGREDIENTS ' :
Provided that this statement need not appear for packs of les . han 60 ml of liquids and 30 gm of solid and semi solids .
(8) Labeling requirements , if any , specified in the relevant Indian Standardas laid down by the Bureau ofIndian Standards for the cosmetics covered under Schedule " S " .
(b) after rule 148 -A , the following rule shall be inserted, namely :-
" 148- B . Prohibition against false or misleading claims : --No cosmetic may purport or claim to purport or convey any idea which is false or misleading to the intending user. "

Foot Note :--The principle rules were published in the Official Gazette vide notification No. F. -28-10/45 /( 1 ), dated 21st December , 1945 and were last amended vide notification No. G.S.R. 780(E) dated the 10th November, 2008 .
