सा.का.नि. 48(अ). कार्बनिक कृषि उत्पाद श्रेणीकरण और ब्रिह्नांकन नियम, 2009 का निम्नलिखित प्रारूप जिसे केन्द्रीय सरकार , कृषि उपज ( श्रेणीकरण और चिह्नांकन ) अधिनियम, 1937 ( 1937 का 1 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव करती है , उक्त धारा की अपेक्षानुसार ऐसे सभी व्यक्तियों की जानकारी के लिए, जिनके उससे प्रभावित होने की संभावना है , प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियम उस तारीख से, जिसको भारत के राजपत्र की, जिसमें यह अधिसूचना अंतर्विष्ट हो , प्रतियां जनत्त को उपलब्ध करा दी जाती हैं, पैंतालीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ;

ऐसा कोई व्यक्ति, जो उक्त प्रारूप नियमों के संबंध में ऊपर विनिर्दिष्ट अवधि के भीतर कोई सुझाव या आक्षेप करना चाहता है, उन्हें केन्द्रीय सरकार के विचार के लिए, भारत सरकार के कृषिविपणन सलाहकार , विपणन और निरीक्षण निदेशालय , प्रधान कार्यालय, सी.जी.ओ. काम्प्लेक्स एनएच- IV , फरीदाबाद-121001 को भेज सकेगा ।

प्रारूप नियम

1. संक्षिप्त नाम और प्रारंभ:-

(1 ) इन नियमों का संक्षिप्त नाम कार्बनिक कृषि उत्पाद श्रेणीकरण और चिन्हांकन नियम, 2009 है ।

(2) ये कृषि उपज (श्रेणीकरण और चिन्हांकन) अधिनियम, 1937 के अधीन अनुसूची में सम्मिलित सभी प्रकार के कृषि उत्पादों को लागू होंगे ;

(3) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. परिभाषाएं:- इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो--

(क) " अधिनियम" से कृषि उपज (श्रेणीकरण और चिन्हांकन) अधिनियम, 1937 (1937 का अधिनियम सं ० 1 ) अभिप्रेत है ;

(ख) "साधारण श्रेणीकरण और चिन्हांकन नियम " से कृषि उपज ( श्रेणीकरण और चिन्हांकन अधिनियम, 1937 (1937 का 1 ) की धारा 3 के अधीन बनाया गया साधारण श्रेणीकरण और चिन्हांकन नियम 1988 अभिप्रेत है ;

(ग) "कृषि विपणन सलाहकार" से भारत सरकार का कृषि विपणन सलाहकार अभिप्रेत है ;

(घ) " वार्षिक रिपोर्ट" से प्राधिकृत निरीक्षण और प्रमाणन अभिकरणों द्वारा कृषि विपणन सलाहकार को वार्षिक प्रस्तुत किया गया अनुज्ञप्त ऑपरेटर/ उत्पादों और प्रसंस्करणों पर कोई रिपोर्ट अभिप्रेत है ।

(ङ) " अपील" से या उस चुनौती का तथ्य जिसके द्वारा कोई प्राधिकृत निरीक्षण और प्रमाणन अभिकरण इन नियमों के अधीन कृषि विपणन सलाहकार द्वारा जारी आदेश के पुनर्विचार के लिए अनुरोध कर सकता है ।

(च) " आवेदक" से ऐसा निरीक्षण और प्रमाणन अभिकरण अभिप्रेत है जिसने कृषि विपणन सलाहकार को प्राधिकरण प्रमाणपत्र के लिए आवेदन किया है ।

(छ) 66 प्राधिकृत निरीक्षण और प्रमाणन अभिकरण " से ऐसा अभिकरण अभिप्रेत है जिसे इन नियमों के अधीन प्राधिकरण प्रमाणपत्र जारी कर निरीक्षण और प्रमाणन के लिए प्राधिकृत किया गया है ;

(ज) " प्रमाणपत्र" से यह घोषित करते हुए प्राधिकृत निरीक्षण और प्रमाणन अभिकरण द्वारा जारी दस्तावेज अभिप्रेत है कि अनुज्ञप्त आपरेटर क्रियाकलाप कर रहा है या यह कि कथित उत्पादों के अधीन इन नियमों के अनुसार अपेक्षाओं के अनुसार किया गया है ;

(झ) " प्राधिकरण प्रमाणन" से इन नियमों के अधीन कृषि विपणन सलाहकार द्वारा कार्बनिक खेती उत्पाद और प्रक्रिया को प्रमाणित करने के लिए और कार्बनिक कृषि उत्पाद का श्रेणीकरण और चिन्हांकन के लिए निरीक्षण और प्रमाणम अभिकरण को प्राधिकृत करते हुए जारी किया गया प्रमाणपत्र अभिप्रेत है ;

(স) " प्रमाणन" से ऐसी प्रक्रिया अभिप्रेत है जिसके द्वारा प्राधिकृत निरीक्षण और प्रमाणन अभिकरण द्वारा एक लिखित आश्वासन दिया जाता है कि स्पष्टतः चिन्हांकित उत्पादन या प्रसंस्करण प्रणाली की उचित ढंग से निर्धारण किया गया है और यह अधिसूचना सं० 72 (आर ई-2003)/2002-2007 तारीख 21 जुलाई, 2004 द्वारा यथाविनिर्दिष्ट अपेक्षाओं के अनुरूप हैं ;

(ट) " प्रमाणन चिन्ह" से इन नियमों के अधीन विहित श्रेणी अभिधान चिन्ह अभिप्रेत है;

(8) " प्रमाणन प्रक्रिया" से समरूपता का प्रमाणन करने के लिए मावदंड के अनुसार प्राधिकृत निरीक्षण और प्रमाणन अभिकरण द्वारा अपनाई गई प्रणाली अभिप्रेत है ;

(ড) "संपरिवर्तन " से कृषि खेती को पारंपरिक से कार्बनिक खेती में परिवर्तन करने की प्रक्रिया अभिप्रेत है ;

(ढ) "अनुज्ञप्ति" से प्राधिकृत्त निरीक्षण और प्रमाणन अभिकरण द्वारा अनुज्ञप्त आपरेटर को दिया गया प्राधिकार है जो उसे इन नियमों के अधीन प्रमाणन का अधिकार अनुक्त करता है ।

(ण) "अनुज्ञप्त आपरेटर" से कोई व्यक्ति या व्यक्तियों का समूह या कार्बनिक खेती या कार्बनिक प्रसंस्करण में प्रैक्टिस करने वाले कारणार उद्यम अभिप्रेत है जिसे इन नियमों के अधीन प्राधिकृत निरीक्षण और प्रयोजन अधिकरण द्वारा अनुज्ञप्ति दी गई है ।

(त) "राष्ट्रीय प्रत्यायन निकाय" से विदेश व्यापार महानिदेशालय, वाणिज्य और उद्योग मंत्रालय , भारत सरकार की अधिसूचना सं 0 72 (आर ई- 2003)/2002-2007 तारीख 21 जुलाई 2004 द्वारा अधिसूचित और समय समय पर यथापुनिरीक्षत कार्बनिक उत्पादन के लिए राष्ट्रीय कार्यक्रम के अधीन केन्द्रीय सरकार द्वारा गठित अभिकरण अभिप्रेत है ।

(थ) " कार्बनिक" से अधिसूचना संख्या 72 (आर ई - 2003) /2002-2007 तारीख 21 जुलाई 2004 और समय समय पर यथापुनरीक्षित विदेश व्यापार महानिदेशालय, वाणिज्य और उद्योग मंत्रालय, भारत सरकार द्वारा अधिसूचित कार्बनिक उत्पाद के लिए राष्ट्रीय कार्यक्रम के अधीन यथाविहित विशिष्ट खेती प्रणाली अभिप्रेत है न कि रसायन विज्ञान में प्रयुक्त पद ।

(द) "प्रमाणित कार्बनिक कृषि उत्पाद" से ऐसा कृषि उपज से ऐसी कृषि उपज अभिप्रेत है जिसका उत्पादन कार्बनिक कृषि के माध्यम से हुआ है और इन नियमों के अधीन प्रमाणित हैं ।

(घ) " अनुसूची" से इन नियमों से संलग्न अनुसूची अभिप्रेत है ।

(ন) " मानक " से इन नियमों के अधीन विहित कार्बनिक उत्पादों के लिए मानक अभिप्रेत है ;

(प) " संव्यवहार या आयात प्रमाणन " से प्राधिकृत निरीक्षण और प्रमाणन अभिकरण द्वारा यह प्रस्तुत करते हुए जारी किया गया दस्तावेज है कि माल का विनिर्दिष्ट गठ्‌ठा या प्रेषण THE GAZETTE OF INDIA : EXTRAORDINARY

उत्पाद से लिया गया है और/ या प्रसंस्करण प्रणाली का उनके द्वारा प्रमाणित किया गया है ।

3. श्रेणी अभिधान इन नियमों के प्रयोजन के लिए , श्रेणी अभिधान " एगमार्क इंडिया कार्बनिक" लिखा या कहा जाएगा ।

श्रेणी अभिधान चिन्ह- श्रेणी अभिधान चिन्ह में प्राधिकरण संख्या प्रमाणन शामिल करते हुए 4. एक डिजाइन, वस्तु और श्रेणी अभिधान का नाम (एगमार्क इंडिया कार्बनिक) इन नियमों के अधीन अनुसूची 1 में यथाउपवर्णित डिजाइन के सदृश एगमार्क इंडिया कार्बनिक का चिन्ह होगा और जहां कहीं अपेक्षित हो कृषि उपज श्रेणीकरण और चिन्हांकन नियम , 1937 के अधीन अधिसूचित किसी विनिर्दिष्ट वस्तु श्रेणीकरण और चिन्हांकन नियमों के अधीन यथाउपबंधित कोई अन्य श्रेणी अभिधान भी इसमें शामिल किया जाएगा ।

5. गुणवत्ता - श्रेणी अभिधान द्वारा उपदर्शित गुणवत्ता का वर्णन इन नियमों के प्रयोजन के लिए

विदेश व्यापार महानिदेशालय , वाणिज्य और उद्योग मंत्रालय , भारत सरकार की अधिसूचना सं0 72 (आर ई - 2003) /2002-2007 तारीख 21 जुलाई , 2004 द्वारा अधिसूचित और समय समय पर यथा पुनरीक्षित कार्बनिक उत्पादन के लिए राष्ट्रीय कार्यक्रम में यथावर्णित होगा और जहां कहीं कृषि उपज (श्रेणीकरण और चिन्हांकन ) अधिनियम, 1937 के अधीन अधिसूचित किसी विनिर्दिष्ट वस्तु श्रेणीकरण और चिन्हांकन नियमों के अधीन यथाउपबंधित कोई अन्य श्रेणी अभिधान का भी चिन्हांकन किया गया है, यह ऐसे नियमों के अधीन विहित संबंद्ध श्रेणी की गुणवत्ता को भी उपदर्शित करेगा ।

6. पैकिंग की पद्धति .--

(1 ) प्रमाणित कार्बनिक कृषि उपज की पैकिंग विदेश व्यापार महानिदेशालय वाणिज्य और उद्योग मंत्रालय भारत सरकार की अधिसूचना सं072 (आर ई 2003) /2002-2007 तारीख 21 जुलाई, 2004 द्वारा अधिसूचित और समय समय पर यथा पुनरीक्षित कार्बनिक उत्पादन के लिए राष्ट्रीय कार्यक्रम में किए गए विभिन्न उपबंधों के अनुसार किया जाएगा और ऐसी पैकिंग , बोरियों, जूट थैलों, कपड़े के थैलों या अन्य उपयुक्त इको फ्रेंडली पैकजों में किया जा सकता है जो स्वच्छ, ठोस कीटाणु, जीवाणु से मुक्त होगा और पैकिंग सामग्री खाद्य अपमिश्रण निवारण अधिनियम, 1954 (1954 का 37) की धारा 23 के अधीन बनाए गए खाद्य अपमिश्रण निवारण नियम 1955 के अधीन यथाअनुज्ञात खाद्य श्रेणी गुणवत्ता की होगी ।

(2) विदेश व्यापार महानिदेशालय वाणिज्य और उद्योग मंत्रालय भारत सरकार की अधिसूचना सं ० 72 (आर. ई- 2003) /2002-2007 तारीख 21 जुलाई , 2004 द्वारा अधिसूचित और समय समय पर यथा पुनरीक्षित कार्बनिक उत्पादन के लिए राष्ट्रीय कार्यक्रम के अधीन केवल अनुमोदित यौगजों का उपयोग कार्बनिक खाद्य पदार्थ के पैकेजिंग के लिए प्रयुक्त पैकेजिंग फ़िल्मस के विनिर्माण में किया जाएगा ।

(3) प्रयुक्त सामग्री उत्पाद के जैविक स्वरूप को प्रभावित करने वाला नहीं होना चाहिए या मात्रा में कोई तत्व इसे संप्रेषित न करे जो मानव स्वास्थ्य के लिए नुकसान देय हो ।

(4) अभिधान और पैकेजिंग सामग्री ऐसे पदार्थ से बना होना चाहिए जो उनके आशयित उपयोग के लिए सुरक्षित और उपयुक्त हो । वह कोई विषैला पदार्थ या अवांछनीय दुर्गंध या उत्पाद के रंग को प्रभावित न करने वाला हो ।

(5) प्रमाणित कार्बनिक कृषि उपज को कृषि विपणन सलाहकार द्वारा समय समय पर जारी अनुदेशों के अनुसार आकारों में पैक किया जाना चाहिए ।

(6) प्रत्येक पैकेज में उसी प्रकार और उसी श्रेणी अभिधान / मानक का प्रमाणित कार्बनिक कृषि उपज होना चाहिए ।

(7) उसी ढेर /बैचःतथा श्रेणी के छोटे पैक आकारों के श्रेणिकृत सामग्री को श्रेणी अभिधान चिन्ह के साथ उस पर पूरे ब्यौरों के साथ मास्टर अभिधान में पैक किया जा सकता है ।

(8) प्रत्येक पैकेज को कृषि विपणन सलाहकार द्वारा यथाअनुमोदित सुरक्षित रूप से बंद किया जाएगा और मुद्रांकित किया जाएगा ।

7. चिन्हांकन और लेबल लगाने का तरीका

(1 ) उपज के उत्पादन या प्रसंस्करण के लिए विधिक रूप से उत्तरदायी व्यक्ति या कंपनी पहचान योग्यः होगा ।

(2) प्रमाणित एगमार्क इंडिया कार्बनिक उत्पाद के लिए अपनाए जाने वाले चिन्हांकन और लेबल लगाने का तरीका विदेश व्यापार महानिदेशालय , वाणिज्य और उद्योग मंत्रालय, भारत सरकार की अधिसूचना सं0 72(आर ई- 2003)/2002-2007 तारीख 21 जुलाई, 2004 द्वारा अधिसूचित और समय समय पर यथापुनीरीक्षित राष्ट्रीय कार्बनिक उत्पादन कार्यक्रम के उपबंधों के अनुसार होगा ।

(3) श्रेणी अभिधानः चिन्ह कृषि विपणन सलाहकार या इन नियमों के अनुसार इस बाबत उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित रीति में प्रत्येक पैकेज पर सुरक्षित रूप से चिपकाया या मुद्रित किया जाएमा ।

(4) श्रेणी अभिधान चिन्ह के अलावा प्रत्येक पैकेज पर निम्नलिखित विशिष्टियां स्पष्टतः और अमिट रूप से चिन्हित होगा: -

(क) पैकर का नाम और पता

(ख) पैकिंग या विनिर्माण का स्थान

(ग) पैकिंग की तारीख

-(घ) लाट या बैच संख्या

(ङ) श्रेणी

(च) फसल का मौसम 6

(छ) शुद्ध भार

(ज) अधिकतम खुदरा कीमत

(झ) .... मास.... वर्ष के पूर्व सर्वोत्तम

(5) पैकेजों पर चिन्हांकन के लिए उपयोग स्याही ऐसी क्वालिटी का होगा जो उपज को संदूषित न करें ।

(6) अनुज्ञप्त आपरेटर संबंद्ध प्राधिकृत निरीक्षण और प्रमाणन अभिकरण के माध्यम से कृषि विपणन सलाहकार का पूर्व अनुमोदन प्राप्त करने के पश्चात् श्रेणिकृत पैकजों पर अपना प्राइवेट व्यापार चिन्ह या व्यापार ब्रांड चिन्हित कर सकेगा बशर्तें यह कि यह इन नियमों के अनुसार श्रेणीकृत पैकजों पर उपाबद्ध श्रेणी अभिधान चिन्ह पर उस उपदर्शित के अलावा गुणवत्ता उपदर्शित न करें ।

8. प्रमाणित. कार्बनिक कृषि उत्पाद प्रमाणित कार्बनिक कृषि उत्पाद विदेश व्यापार महानिदेशालय , वाणिज्य और उद्योग मंत्रालय , भारत सरकार की अधिसूचना सं 0 72 (आर ई - 2003) /2002-2007 तारीख 21 जुलाई , 2004 द्वारा अधिसूचित और समय समय पर यथापुनीरीक्षित राष्ट्रीय कार्बनिक उत्पादन कार्यक्रम के उपबंधों का पालन करने के अलावा भारी खनिज कीटनाशक, एफलाटाक्सिन का अवशिष्ट स्तर और खाद्य अपदूषण निवारण नियम, 1955 में यथाविनिर्दिष्ट अन्य खाद्य सुरक्षा पैरामीटर का भी पालन करेगा ।

9. प्रत्यायित निरीक्षण और प्रमाणन अभिकरणों को प्राधिकार प्रमाणपत्र (1) विदेश व्यापार महानिदेशालय , वाणिज्य और उद्योग मंत्रालय, भारत सरकार की अधिसूचना सं0 72 (आर ई - 2003)/2002-2007 तारीख 21 जुलाई , 2004 द्वारा अधिसूचित और समय समय पर यथापुनीरीक्षित राष्ट्रीय कार्बनिक उत्पादन कार्यक्रम के अधीन कोई प्रत्यायित निरीक्षण और प्रमाणन अभिकरण इन नियमों के अधीन प्राधिकार प्रमाणपत्र की मांग के लिए और विहित प्ररूप (प्रारूप - 1 ) में इन नियमों में विनिर्दिष्ट और प्रयोजन के लिए विहित फीस के साथ कृषि विपणन सलाहकार द्वारा प्राधिकृत विपणन और निरीक्षण महानिदेशालय के अधिकारी को आवेदन फाइल कर इसके पुननर्वीकरण करने के लिए आवेदन करने का पात्र होगा । आवेदन के साथ निम्नलिखितं दस्तावेज प्रस्तुत किए जाने चाहिए --

(क) संगठन का लिखित प्रमाण वित्तीय स्थिति ( कुल कारोबार) , वार्षिक रिपोर्ट तथा कर्मचारियों

की संख्या उनके बायो-डाटा के साथ

(ख) प्रमाणीकरण समितियों, मानक समितियों , निरीक्षकों आदि का ब्यौरा

(ग) प्रचालन नियमावली, गुणवत्ता नियमावली की एक प्रति

(घ) प्रस्तावित टैरिफ

(ङ) किसी अन्य देश अथवा कार्यक्रम द्वारा प्रत्यानन का लिखित प्रमाण

(च) विहित प्ररूप-2 में शपथपत्र 1

का राजपत्र असाधारण

(छ) आवेदनों पर इस प्रयोजनार्थ समुचित रूप से प्राधिकृत संगठन प्रमुख, भागीदार , निदेशक, प्रबंध नियासी के हस्ताक्षर हों तथा यथास्थिति दस्तावेजी साक्षय / मुख्तारनामा/संकल्प की प्रति हो ।

2. प्रभार या फीस का संदाय - प्राधिकृत निरीक्षण और प्रमाणन अभिकरण ऐसे प्रभार अदा करेगा जो निम्नलिखित के संबंध में उपगत व्यय के संबंध में केन्द्रीय सरकार द्वारा समय- समय पर विहित किया जाए

(क) प्राधिकार प्रमाणपत्र की मंजूरी और सावधिक पुनर्नवीकरण :

(ख) प्राधिकार प्रमाणपत्र की द्वितीय प्रति का जारी किया जाना ;

और

;

(ग) प्राधिकृत पैकर द्वारा नियोजित रसायनज्ञों का प्रशिक्षण

(घ) नमूनों के परीक्षण और ऐसी वस्तुओं के निरीक्षण समेत श्रेणि अभिधान चिन्ह के साथ चिन्हित अनुसूचीगत वस्तुओं के गुणवत्ता नियंत्रण को प्रवृत करने के उपाय ;

(ङ) वस्तुओं के किसी वर्ग के विक्रय का संवर्धन करने के लिए कोई प्रचार कार्य

(3) प्राधिकार प्रमाणपत्र (1 ) प्राधिकृत निरीक्षण और प्रमाणन अभिकरणों को इन नियमों के अधीन अधिकथित प्रक्रिया का पालन करने के लिए प्राधिकार प्रमाणपत्र अनुदत्त किया जाएगा जो अहस्तांतरणीय होगा ।

(4) प्राधिकार का पुनर्नवीकरण और अद्यतनीकरण - प्राधिकृत निरीक्षण और प्रमाणन अभिकरणों को प्राधिकार के पुनर्नवीकरण के लिए आरंभिक प्राधिकार प्रक्रिया के समान ही अद्यतनीकरण प्रक्रिया का पालन करना होगा ।

(क) कृषि विपणन सलाहकार नवीकरण के लिए आवेदन के साथ संदत्त की जाने वाली विहित फीस के संदाय पर तीन वर्षों के समूह के लिए प्रमाणपत्र का पुनर्नवीकरण करेगा जो प्राधिकार प्रमाण पत्र की विधिमान्यता अवधि की समाप्ति के कम से कम तीस दिन पूर्व निरीक्षण और प्रमाणन, अभिकरण द्वारा फाइल किया जाएगा ।

(ख) विहित फीस के साथ प्राधिकार के पुनर्नवीकरण के लिए आवेदन प्राधिकार अवधि की समाप्ति के तीस दिन पूर्व इस प्रयोजन के लिए कृषि विपणन सलाहकार द्वारा प्राधिकृत अधिकारी के पास पहुंचने के लिए निरीक्षण और प्रमाणन अभिकरण द्वारा प्रस्तुत किया जाएगा ।

(ग) कृषि विपणन सलाहकार को इसके लिए दर्शाए गए युक्तियुक्त हेतुक की दशा में उक्त पुनर्नवीकरण आवेदन को प्रस्तुत करने में किसी विलंब को माफ करने की शक्ति होगी ।

(घ) प्राधिकार प्रमाणषत्र का पुनर्नवीकरण प्रत्यायित निरीक्षण और प्रमाणन अभिकरण के पिछले कार्य निष्पादन पर आधारित होगा और कृषि विपणन सलाहकार को ऐसे आवेदनों को नामंजूर करने का अधिकार होगा ।

(ङ) पुनर्नवीकरण के आवेदन की नामंजूरी की दशा में कृषि विपणन सलाहकार ऐसी नामंजूरी के कारण लिखित रूप में प्रस्तुत करेंगा ।

(च) नियम 14 के उपनियम (1 ) के अधीन गठित अपील समिति ऐसी किसी नामंजूरी के कारण फाइल की गई किसी अपील का विनिश्चय करने के लिए अपीली प्राधिकारी होगी और अपील पर अपीली समिति का विनिश्चय अंतिम होगा और सभी संबद्ध पर आबद्धकर होगा ।

(छ) कृषि विपणन सलाहकार सभी अपीलों को प्राप्त करने और प्रक्रियागत करने और समुचित विनिश्चयों के लिए अपील समिति के सक्षम प्रस्तुत करने का सक्षम प्राधिकारी होगा ।

(5) मार्गदर्शक सिद्धांत जारी करने की शक्ति कृषि विपणन सलाहकार को समय समय पर निरीक्षण और प्रमाणन प्रक्रिया के लिए प्रमाणन अभिकरणों को आवश्यक मार्गदर्शक सिद्धांत जारी करने की शक्तियां होंगी ।

(6 ) कृषि विपणन सलाहकार प्राधिकार प्रमाणपत्र जारी करेगा जिसमें निम्नलिखित ब्यौरे होंगे

(क) प्राधिकार प्रमाणपत्र संख्या

(ख) निरीक्षण और प्रमाणन अभिकरण का नाम और पता

(ग) किए जाने वाले क्रियाकलापों की प्रकृति

(घ) जारी करने की तारीख और समाप्ति की तारीख

(7) प्राधिकृत निरीक्षण और प्रमाणन अभिकरण ने विदेश व्यापार महानिदेशालय , वाणिज्य और उद्योग मंत्रालय , भारत सरकार की अधिसूचना सं 0 72 (आर ई- 2003) / 2002-2007 तारीख 21 जुलाई , 2004 द्वारा अधिसूचित और समय समय पर यथापुनीरीक्षित राष्ट्रीय कार्बनिक उत्पादन कार्यक्रम के अधीन विहित कार्बनिक उत्पादन के मानक और विभिन्न अन्य प्रक्रियाएं जिसके अंतर्गत निरीक्षण , प्रमाणन, आंतरिक नियंत्रण प्रणाली का क्रियान्वयन, बाह्य निरीक्षण , आंतरिक नियंत्रण प्रणाली का मूल्यांकन, अनुज्ञप्ति की मंजूरी आदि की प्रक्रिया शामिल है का अनुपालन सुनिश्चित करेंगे ।

(8) साधारण श्रेणीकरण और चिन्हांकन नियम, 1988 के नियम 3 के उपनियम (8 ) में और कार्बनिक कृषि उपज श्रेणीकरण और चिन्हांकन नियम, 2008 में विनिर्दिष्ट शर्तों के अलावा प्रत्त्येक प्राधिकृत पैकर कृषि विपणन सलाहकार द्वारा समय समय पर जारी विभिन्न अनुदेशों का भी पालन करेंगे ।

10. प्राधिकृत निरीक्षण और प्रमाणन अभिकरणों द्वारा वार्षिक रिपोर्ट :-

(1 ) प्राधिकृत निरीक्षण और प्रमाणन अभिकरण आवर्त ( वित्तीय और कर्मचारीवृंद) प्रमाणित प्रमाणाधीन परियोजनाओं की संख्या, कृषि विपणन सलाहकार को गुणवत्ता और मूल्य के निबंधनानुसार निर्यातित उत्पाद शामिल करते हुए एक वार्षिक रिपोर्ट प्रस्तुत करेगा । इस वार्षिक रिपोर्ट में निरीक्षण और प्रमाणन अभिकरण की प्रक्रिया हाल ही के विकास पर नवीनतम रिपोर्ट जैसे प्रमाणित अनुज्ञप्ति आपरेटरों की संख्या, संपरिवर्तनाधीन प्रचालन का भौगोलिक क्षेत्र और कार्मिकों का परिवर्तन और अनुपालन रिपोर्ट जिसमें अधिरोपित शर्तों के साथ अनुपालन की रिपोर्ट दी गई हो और दस्तावेजी साक्ष्य द्वारा समर्थित हो । रिपोर्ट में मानकों के लागू होने के 9

संबंध में अनुज्ञप्त आपरेटरों की उजागर किन्हीं अनियमितताओं या अतिलंघनों का वर्णन होना चाहिए ।

(2) इस आधार पर कि क्या प्राधिकृत निरीक्षण और प्रमाणन अभिकरण में कृषि विपणन सलाहकार द्वारा अधिरोपित शर्तों का पालन किया है और प्राधिकृत निरीक्षण और प्रमाणन अभिकरण की प्रक्रिया में किए गए परिवर्तनों के विस्तार और प्रकृति के आधार पर कृषि विपणन सलाहकार निम्नलिखित में से कोई कार्रवाई कर सकेगा, अर्थात् :-

(क) प्राधिकार अवधि का नवीकरण , यदि वह समाप्त हो गई है

(ख) सम्मत समय सारणी के अनुसार सुधारात्मक कार्रवाई की अपेक्षा करते हुए नई शर्तों का अधिरोपण

(ग) नियम 12 में सूचीबद्ध किन्हीं शास्तियों का अधिरोपण ;

11. शिकायतें (1 ) प्राधिकृत निरीक्षण और प्रमाणन अभिकरण के कार्य करने के संबंध में शिकायतें सर्वप्रथम प्राधिकृत निरीक्षण और प्रमाणन अभिकरण को की जानी चाहिए । केवल उन मामलों में जहां शिकायतकर्ता यह महसूस करता है कि प्राधिकृत निरीक्षण और प्रमाणन अभिकरण द्वारा संतोषजनक रूप से निपटारा नहीं किया गया है वहां शिकायत कृषि विपणन सलाहकार को ऐसी रीति में की जाए कि ऐसी शिकायत के स्रोत की गोपनीयता बनाई रखी जाएं ।

(2) कृषि विपणन सलाहकार ऐसी शिकायतों को उपयुक्त कार्रवाई के लिए विदेश व्यापार महानिदेशालय , वाणिज्य और उद्योग मंत्रालय , भारत सरकार की अधिसूचना सं0 72 (आर ई - 2003)/2002-2007 तारीख 21 जुलाई , 2004 द्वारा अधिसूचित और समय समय पर यथापुनरीक्षित राष्ट्रीय कार्बनिक उत्पादन कार्यक्रम के अधीन गठित राष्ट्रीय प्रत्यायन निकाय को निर्दिष्ट कर सकेगा ।

(3) यदि राष्ट्रीय प्रत्यायन निकाय ऐसी किसी शिकायत के आधार पर प्राधिकृत निरीक्षण और प्रमाणन अभिकरण के विरुद्ध कोई कार्रवाई करने या कोई अनुशास्ति अधिरोपित करने का विनिश्चय करता है तो कृषि विपणन सलाहकार संबद्ध अभिकरण के प्राधिकार प्रमाणपत्र के संबंध में भी समुचित कार्रवाई कर सकेगा ।

12. अनुशास्तियां (1 ) अननुपालन या शर्तों को पूरा करने की असफलता की दशा में कृषि विपणन सलाहकार निम्नलिखित एक या अधिक अनुशास्तियां लागू कर सकेगा, अर्थात् :-

(क) चेतावनी पत्र या धिग्दंड पत्र जारी किया जाना ;

(ख) अतिरिक्त शर्तें अधिरोपित करना और विहित समय सीमा के भीतर सुधार पर बल देना;

(ग) न केवल शर्तों के अननुपालन बल्कि विलंबित या दोषपूर्ण वार्षिक रिपोर्ट फाइल के लिए शास्तियां अधिरोपित करना ;

(घ) प्राधिकार निलंबित करना ;

(ङ) विदेश व्यापार महानिदेशालय , वाणिज्य और उद्योग मंत्रालय , भारत सरकार की अधिसूचना सं 0 72 (आर ई 2003 ) /2002-2007 तारीख 21 जुलाई , 2004 द्वारा अधिसूचित और समय समय पर यथापुनीरीक्षित राष्ट्रीय कार्बनिक उत्पादन कार्यक्रम के अधीन गठित राष्ट्रीय प्रत्यायन निकाय को मामला निर्दिष्ट करना और राष्ट्रीय प्रत्यायन निकाय द्वारा की गई कार्रवाई के आधार पर संबद्ध अभिकरण के विरुद्ध आगे समुचित कार्रवाई करना ।

(2) निलंबन की दशा में, कृषि विपणन सलाहकार को अनुज्ञप्त आपरेटरों के हित के संरक्षण के लिए प्रमाणन कार्य को चालू रखने के लिए किसी अन्य प्राधिकृत निरीक्षण और प्रमाणन अभिकरण को नामनिर्दिष्ट करने की शक्तियां होंगी ।

13. प्राधिकार की समाप्ति (1 ) कृषि विपणन सलाहकार निरीक्षण और प्रमाणन अभिकरण की प्राधिकार प्रास्थिति को समाप्त कर सकेगा यदि अभिकरण का कार्य निष्पादन और आचरण प्राधिकार मापदंड या प्राधिकार के लिए अधिकथित शर्तों के अनुसार नहीं है ।

(2) जब प्राधिकार प्रमाणपत्र प्रत्याहृत किया जाता है तो कृषि विपणन सलाहकार विपणन और निरीक्षण निदेशालय की वैबसाइट पर निरीक्षण और प्रमाणन अभिकरण का नाम प्रकाशित करेगा और सार्वजनिक सूचना जारी कर सकेगा ।

(3) प्राधिकार अवस्थिति को समाप्त किए जाने की शर्तों में निम्नलिखित भी सम्मिलित हैं, परंतु इन्हीं तक सीमित नहीं है :

(क) निरीक्षण और प्रमाणन अभिकरण द्वारा प्राधिकार मापदंड या कार्बनिक कृषि उपज श्रेणिकरण और चिन्हांकन नियमों का अननुपालन

(ख) प्राधिकार प्रास्थिति का दुरुपयोग

(ग) समय समय पर फीस और प्रभार देने की असफलता

(घ) किन्हीं अधिरोपित अनुशास्तियों के पालन की असफलता

14. अपील (1 ) आवेदक या प्राधिकृत निरीक्षण और प्रमाणन अभिकरण इस प्रयोजन के लिए केन्द्रीय सरकार द्वारा गठित अपील समिति के समक्ष यथास्थिति समाप्ति आदेश समेत प्राधिकृत विनिश्चयों या अधिरोपित अनुशास्तियों के विरुद्ध अपील कर सकता है जिसमें तीन प्रतिनिधि कृषि और सहकारिता विभाग , वाणिज्य विभाग और उपभोक्ता मामले विभाग, प्रत्येक से एक . भारत सरकार के अपर सचिव की पंक्ति से अन्यून तीन प्रतिनिधि होंगे । कृषि और सहकारिता विभाग का प्रतिनिधि समिति का अध्यक्ष होगा । अपीलें विवादित विनिश्चयों के तीस दिनों के भीतर फॉइल की जानी चाहिए । अपीलें कृषि विपणन सलाहकार के माध्यम से निर्देशित की जाएं ।

(2) कृषि विपणन, सलाहकार अपील प्राप्त करेगा और प्रक्रियागत करेगा और इस पर अंतिम विनिश्चय के लिए अपील समिति को रिपोर्ट प्रस्तुत करेगा ।

(3) अपील पर अपील समिति का विनिश्चय अंतिम होगा और सभी संबद्ध पर आबद्धकर होगा ।

(4) अपील फाइल करने में विलंब को संबद्ध अपील प्राधिकारी द्वारा आवेदक द्वारा युक्तियुक्त हेतुक दर्शाए जाने की दशा में माफ किया जा सकता है ।

15. पारस्परिकता ( 1 ) इन नियमों के अधीन किसी प्राधिकृत निरीक्षण और प्रमाणन अभिकरण द्वारा एगमार्क इंडिया कार्बनिक के रूप में प्रमाणित कृषि उत्पादों को देश के किसी भाग के भीतर भी अन्य प्रमाणन अभिकरणों द्वास कार्बनिक के रूप में स्वीकार किया जाएगा ।

(2) राष्ट्रीय कार्बनिक उत्पादन कार्यक्रम के अधीन इस प्रयोजन के लिए, अधिसूचित निरीक्षण और प्रमाणन अभिकरणों द्वारा आयात करने वाले देशों के कार्बनिक मानकों के अधीन प्रमाणित कार्बनिक कृषि उत्पादन को भारत में आयात करने पर पुनःप्रमाणित किए जाने की अपेक्षा नहीं होगी यदि आयात द्विपक्षीय समतुल्य करार के अधीन किया गया है और कार्बनिक उत्पाद का प्रेषण इन नियमों के अधीन प्राधिकृत निरीक्षण और प्रमाणन अभिकरण द्वारा जारी संव्यवहार प्रमाणपत्र साथ में लगा हुआ है ।

16. प्राधिकृत निरीक्षण और प्रमाणन अभिकरण के कार्य (1 ) विपणन और निरीक्षण निदेशालय को अनुज्ञप्त आपरेटरों पर उनके द्वारा की गई कार्रवाई के बारे में प्राधिकृत निरीक्षण और प्रमाणन अभिकरण द्वारा सूचित किया जाएगा । यदि विपणन और निरीक्षण निदेशालय , निरीक्षण और प्रमाणन अभिकरणों द्वारा विदेश व्यापार महानिदेशालय, वाणिज्य और उद्योग मंत्रालय , भारत सरकार की अधिसूचना सं0 72 (आर ई 2003 ) /2002-2007 तारीख 21 जुलाई , 2004 द्वारा अधिसूचित और समय - समय पर यथापुनरीक्षित राष्ट्रीय कार्बनिक उत्पादन कार्यक्रम के उपबंध के लागू होने के संबंध में अनियमितताएं या अतिलंघन पाता है तो वह उन नियमों के अधीन अतिरिक्त कार्रवाई करेगा 1

(2) इच्छुक प्रयोगशालाओं के मूल्यांकन के पश्चात् कृषि विपणन सलाहकार उन्हें मृदा के अवशिष्ट परीक्षण, कार्बनिक उत्पाद और कार्बनिक इनपुट के लिए उन्हें प्राधिकृत करेगा । प्राधिकृत निरीक्षण और प्रमाणन अभिकरण ने विदेश व्यापार महानिदेशालय, वाणिज्य और उद्योग मंत्रालय , भारत सरकार की अधिसूचना सं0 72 (आर ई- 2003) /2002-2007 तारीख 21 जुलाई , 2004 द्वारा अधिसूचित और समय समय पर यथापुनरीक्षित राष्ट्रीय कार्बनिक उत्पादन कार्यक्रम के अधीन विभिन्न मानदंडों का पालन करने के लिए परीक्षण के प्रयोजनों के लिए केवल अनुमोदित प्रयोगशालाओं की सेवाओं का उपयोग करेगा ।

17. प्रमाणन (1 ) प्राधिकृत निरीक्षण और प्रमाणन अभिकरण विदेश व्यापार महानिदेशालय, वाणिज्य और उद्योग मंत्रालय, भारत सरकार की अधिसूचना सं 0 72(आर ई 2003)/2002- 2007 तारीख 21 जुलाई , 2004 द्वारा अधिसूचित और समय समय पर यथापुगीरीक्षित राष्ट्रीय कार्बनिक उत्पादन कार्यक्रम के अधीन प्रमाणन के लिए विहित प्रक्रिया का अनुपालन करेंगे ।

(2) जहां ऐसा अतिलंघन जो कार्बनिक संपूर्णता को प्रभावित करता है, पाया जाता है वहां प्राधिकृत निरीक्षण और प्रमाणन अभिकरण यह सुनिश्चित करेगी कि प्रमाणन का उपदर्शन को उत्पादन माल की संपूर्ण ढेरी से हटा दिया गया है जो संबद्ध उल्लंघन द्वारा प्रभावित है । जहां कोई उल्लंघन अनुज्ञप्त आपरेटर द्वारा किया जाता है वहां प्राधिकृत निरीक्षण और प्रमाणन अभिकरण ने विनिर्दिष्ट अवधि के लिए अनुज्ञप्त आपरेटर से प्रमाणपत्र वापस ले लेगी और अपने विनिश्चय की सूचना कृषि विपणन सलाहकार को देगी ।

18. प्राधिकृत निरीक्षण और प्रमाणन अभिकरण द्वारा अधिरोपित की जानेवाली अनुशास्तियां - (1 ) प्राधिकृत निरीक्षण और प्रमाणन अभिकरण को समूह द्वारा और / या व्यक्तिगत अनुज्ञप्त प्रचालकों द्वारा अननुपालन की दशा में अनुशास्तियों की स्पष्ट नीति होगी ।

(2) प्राधिकृत निरीक्षण और प्रमाणन अभिकरण समूह द्वारा या इसके व्यक्तिगत अनुज्ञप्त प्रचालकों द्वारा अननुपालन का पता चलने पर और आंतरिक न्यूनतम प्रणाली की असफलता पर समूह पर अनुशास्तियां लगा सकेगा । अनुशास्ति में संपूर्ण समूह के प्रमाणन के वापस लेने के उपबंध भी शामिल होंगे ।

19. प्रमाणन फीस- (1 ) प्रभार प्राधिकृत निरीक्षण और प्रमाणन अभिकरण के प्रचालन लागत को शामिल करते हुए प्राधिकृत निरीक्षण और प्रमाणन अभिकरण द्वारा तय किया जाएगा । प्रभार वार्षिक रूप से निम्नलिखित प्रवर्गों में प्रवृत्त होंगे , अर्थात् : -

(i ) फसल उत्पादक समूह (लघु और सीमांत कृषक)

(ii) सहकारिता और कुटीर उद्योग

(iii ) बड़े किसान संपदा और निर्यातक

(iv) मध्यम और बड़े आकार के उत्पादक

2. फीस में निम्नलिखित शामिल होगा

(i) आवेदन फीस

(ii) यात्रा और निरीक्षण

(iii ) निर्धारण और रिपोर्ट तैयारी, (दैनिक मज़दूर की लागत)

(iv) प्रमाणपत्र का जारी किया जाना (स्कोप प्रमाणपत्र , उत्पाद प्रमाणपत्र और संव्यवहार प्रमाणपत्र)

3. प्राधिकृत निरीक्षण और प्रमाणन अभिकरण उपरोक्त उपनियम ( 1 ) में विहित फीस के अलावा ऐसे प्रभार एकत्र करेगा और कृषि विपणन निदेशालय के पास जमा करेगा जैसा केन्द्रीय सरकार द्वारा निम्नलिखित के संबंध में उपगत व्ययों पर समय समय पर विहित किया जाए -

(क) प्राधिकार प्रमाणपत्र की मंजूरी और सावधिक पुनर्नवीकरण ;

(ख) प्राधिकार प्रमाणपत्र की द्वितीय प्रति का जारी किया जाना ;

(ग) प्राधिकृत पैकर द्वारा नियोजित रसायनज्ञों का प्रशिक्षण और 13

(घ) नमूनों के परीक्षण और ऐसी वस्तुओं के निरीक्षण समेत श्रेणी अभिधान चिन्ह के साथ चिन्हित अनुसूचीगत वस्तुओं के गुणवत्ता नियंत्रण को प्रवृत करने के उपाय ;

(ङ) वस्तुओं के किसी वर्ग के विक्रय का संवर्धन करने के लिए कोई प्रचार कार्य

20. अनुज्ञप्त आपरेटरों और फसल उत्पादनकर्ता समूहों के दावित्व (1 ) प्राधिकृत निरीक्षण और प्रमाणन अधिकरण को किए जाने वाले अनुज्ञप्ति की मंजूरी के लिए कोई आवेदन इन नियमों 'के अधीन विहित प्ररूप -4 में होगा जिसको प्रक्रियागत किया जाएगा और अनुज्ञप्ति विदेश व्यांपार महानिदेशालय, वाणिज्य और उद्योग मंत्रालय, भारत सरकार की अधिसूचना सं० 72(आर ई - 2003) /2002-2007 तारीख 21 जुलाई , 2004 द्वारा अधिसूचित और समय समय पर यथापुनरीक्षित द्वारा अधिसूचित राष्ट्रीय कार्बनिक उत्पादन कार्यक्रम के उपबंधों के अनुसार मंजूर की जाएगी ।

(2) उपरोक्त उपनियम (1 ) के अधीन प्राधिकृत निरीक्षण और प्रमाणन अधिकरण द्वारा मंजूर की जाने वाली अनुज्ञप्ति प्ररूप -4 में होगी और अनुज्ञप्त आपरेटर द्वारा फाइल की जाने वाली घोषणा इन नियमों के अधीन विहित प्रारूप-6 में होगा ।

(3) अनुज्ञप्त आपरेटर और फसल उत्पादनकर्ता समूह इन नियमों के अधीन यथाउपबंधित प्रमाणन या श्रेणी अभिधान चिन्ह के उपयोग के हकदार होंगे और ऐसे माल या सेवाओं के अपने उपयोग को निर्बंधित करेंगे जो उत्पादों के मानकों और विनिर्दिष्ट मानदंड को पूरा करेगा । प्रमाणन चिन्ह उत्पादों पर चिपकाया जा सकेगा और/ या पैकेजिंग या प्रोत्साहन सामग्री या विज्ञापन क्रियाकलापों के संदर्भ में उपयोग किया जा सकेगा ।

(4) उपरोक्त चिन्ह के प्रयोग के अधिकार को वापस लिए जाने की स्थिति में, प्रमाणपत्र अथवा लाइसेंस को निरीक्षण तथा प्रमाणीकरण एजेन्सी को वापस लौटाया जाएगा । श्रेणी अभिधान चिन्ह के प्रयोग का अधिकार उसी समय समाप्त हो जाता है और इससे पदनामित प्रत्यानन एजेंसी और/या प्राधिकृत निरीक्षण और प्रमाणन अभिकरण के विरूद्ध कोई क्षतिपूर्ति दावा उत्पन्न नहीं होगा ।

(5) अनुज्ञप्त आपरेटर और फसल उत्पादनकर्ता समूहों को उपरोक्त चिन्ह का प्रयोग करने का अधिकार तो होगा परंतु वे अपने उत्पादों की सुरक्षा हेतु स्वयं उत्तरदायी होंगे. । प्राधिकृत निरीक्षण और प्रमाणन अभिकरण द्वारा मांगे जाने पर, वे उनके संदर्भ में पर्याप्त उत्पाद उत्तरदेयता बीमा धारण करने का प्रमाण प्रस्तुत करेगा । तथापि, प्राधिकृत निरीक्षण और प्रमाणन अभिकरण या इस बाबत कृषि विपणन सलाहकार द्वारा कोई जिम्मेदारी स्वीकार्य नहीं होगी ।

(6) अनुज्ञप्त आपरेटरों के अनुरोध पर प्राधिकृत निरीक्षण और प्रमाणन अभिकरण के प्रमाणक द्वारा इन नियमों से उपाबद्ध प्ररूप -3 में क्रेता को उत्पाद प्रमाणपत्र जारी किया जाएगा ।

जैविक कृषि उपज श्रेणीकरण एवं चिह्नांकन नियमों पर आधारित , इस शपथ - पत्र में भारत में जैविक उत्पादों के लिए प्राधिकृत निरीक्षण और प्रमाणन एजेंसी के रुप में कार्य करने के लिए मैसर्स को मूल्यांकन और प्राधिकरण के लिए सभी आवश्यक पूर्व शर्तों की व्यवस्था की गई है ।

मैं/ हम और निवासी पुत्र आयु ... एतद्वारा सत्यनिष्ठापूर्वक सूचित करता हूं/ करते हैं कि वर्ष

1. कि मैं , भारतीय परियोजनाओं के जैविक उत्पादों का निरीक्षण और प्रमाणन करने के लिए मैसर्स में स्थित है , नामक फर्म जो का एकमात्र स्वामी/सहभागी/निदेशक हूं ।

2. मैसर्स अपने प्रमाणन प्रदर्शन और प्रमाणित कार्यों के सभी प्रलेखनों का मूल्यांकन , मूल्यांकन समिति द्वारा किए जाने के लिए आवश्यक सम्पूर्ण सूचना प्रदान करेगा ।

4. मैसर्स फील्ड मूल्यांकन के दौरान मूल्यांकन के लिए सभी आवश्यक प्रबंध करेगा और सम्पूर्ण सूचना प्रदान करेगा ।

5. मैसर्स जैविक कृषि उपज श्रेणीकरण एवं चिह्नांकन नियम , 2008 में निर्धारित मापदंडों के अनुसार निरीक्षण , मूल्यांकन और प्रमाणन कार्य को पूरा करेगा । इसके अतिरिक्त मैसर्स अन्य ऐसी सेवाएं प्रदान कर सकता है जो जैविक कृषि उपज श्रेणीकरण एवं चिह्नांकन नियमों का उल्लंघन नहीं करती हैं ।

6. मैसर्स नियम 19 के अनुसार विपणन एवं निरीक्षण निदेशालय को श्रेणीकरण प्रभारों का भुगतान करेगा और समय - समय पर कृषि विपणन सलाहकार द्वारा यथा निर्धारित तरीके से, आवधिक विवरण भी प्रस्तुत करेगा ।

7 . मैसर्स एगमार्क लेबलों , यदि कोई जारी किए गए हैं , एगमार्क प्रतिकृति लगे आधानों , सीलिंग प्लायर्स , इत्यादि और सरकारी देनदारियों की वसूली एवं समय पर उनके प्रेषण के लिए उत्तरदायी होगा ।

8. मैसर्स ..वस्तुओं के निरीक्षण , नमूना विश्लेषण , पैकिंग , चिह्नांकन और सीलिंग के लिए जारी किए गए अनुदेशों का कड़ाई से पालन करेगा ।

9. मैसर्स कृषि विपणन सलाहकार अथवा अन्य कोई विधिवत् प्राधिकृत अधिकारी द्वारा किसी भी अनुसूचित वस्तु के संबंध में मांगी गई ऐसी सूचना , विवरण अथवा रिपोर्ट भी प्रदान करेगा जिसे प्राधिकारी कृषि उपज ( श्रेणीकरण एवं चिह्नांकन) अधिनियम , 1937 के उपबंधों को कार्यान्वित करने के लिए आवश्यक समझता है ।

10. मैसर्स प्रत्येक वर्ष 30 अप्रैल तक विपणन एवं निरीक्षण निदेशालय को वार्षिक रिपोर्ट सौंपेगा । वार्षिक रिपोर्ट में प्रमाणन प्रक्रिया में हाल में हुई गतिविधियां जैसे प्रमाणित लाइसेंस प्राप्त संचालकों (परिवर्तन के अधीन/ परिवर्तित) की संख्या का कार्य भौगोलिक क्षेत्र , वित्तीय कुल बिक्री , कार्मिक परिवर्तन , मानकों के अनुप्रयोग के संबंध में लाइसेंसी संचालकों में पाई गई अनियमितताओं अथवा उल्लंघन संबंधित वर्ष में 31 मार्च को समाप्त पूर्ववर्ती वित्तीय वर्ष के लिए निर्यात किए गए उत्पादों की मात्रा और कीमत तथा गंतव्य देश पर अद्यतन रिपोर्ट शामिल होगी ।

9. निरीक्षण प्रमाणीकरण एजेन्सी द्वारा कोई भी प्रारंभिक जांच किये जाने की स्थिति में , मैं / हम अपने यहां पर उपलब्ध समस्त तर्कसंगत सुविधाओं को निरीक्षण प्रमाणीकरण एजेन्सी को उपलब्ध कराने को सहमत हूं/ हैं तथा मैं/ हम उक्त जांच के समस्त व्ययों का भुगतान करने पर भी सहमत हूं/ हैं जिसमें निरीक्षण तथा प्रमाणीकरण एजेन्सी द्वारा यथा आवश्यकतानुसार परीक्षण शुल्क भी सम्मिलित है ।

मैं/ हम अनुरोध करता हूं/ करते हैं कि स्थल का प्रारंभिक निरीक्षण (तिथि इंगित करिये) तक कर लिया जाये ।

(ग) मुझे/ हमें अपने किसी भी ऐसे कार्य हेतु निरीक्षण तथा प्रमाणीकरण एजेन्सी द्वारा चेतावनी/ परामर्श नहीं दिया गया था जो कि जैविक उत्पादों हेतु मानकों के प्रतिमानों तथा पद्धतियों का उल्लंघन करता हो ।

जैविक उत्पादों हेतु मानकों के प्रतिमानों तथा पद्धतियों का उल्लंघन करने पर मुझे/हमें दी गई चेतावनी/परामर्श के विवरण निम्नलिखित हैं

11. मैं/ हम यह प्रतिज्ञा करते हैं किं आवेदन पत्र में उपरोक्त वर्णित किसी भी सूचना के गलत पाये जाने की स्थिति में , आवेदन को उसी समय अस्वीकृत कर दिया जाये ।

12. यदि लाइसेंस प्रदान कर दिया जाता है और जितनी अवधि तक वह प्रभावी रहता है , तो मैं/हम एतद्वारा लाइसेंस के सभी नियम एवं शर्तों तथा विहित विनियमों का पालन करने की प्रतिज्ञा करता हूं/ करते हैं । लाइसेंस को निलंबित अथवा रद्द किये जाने की स्थिति में , मैं/ हम यह भी प्रतिज्ञा करता हूं/करते हैं कि लाइसेन्स में शामिल किसी भी उत्पाद पर प्रमाणीकरण चिह्न का प्रयोग करना तत्काल प्रभाव से रोक दूंगा/ देंगे तथा समस्त संबंद्ध विज्ञापन मामलों को वापस ले लूंगा/लेंगे और पूर्वोक्त विनियमों के प्रावधानों को पूरा करने हेतु तत्काल अन्य सभी आवश्यक कदम उठाऊंगा/ उठायेंगे । लाइसेन्स प्रदान किये जाने की स्थिति में , हम पूर्वोक्त विनियमों में अन्तर्विष्ट प्रत्येक प्रावधान का अनुपालन करने की प्रतिज्ञा करते हैं ।

1. एगमार्क इंडिया ऑरगैनिक लोगो के प्रमाणीकरण चिह्न के संबंध में ऑरगैनिक कृषि उपज श्रेणीकरण एवं चिह्नांकन नियमों के द्वारा प्रदत्त शक्तियों के अधिकार से निरीक्षण तथा प्रमाणीकरण एजेन्सी एतद्वारा को (जिसे आगे चलकर "लाइसेंसधारी आपरेटर" के नाम से जाना जाएगा ) एगमार्क इंडिया ऑरगैनिक चिह्न का प्रयोग इन नियमों की प्रथम अनूसूची में यथा-निर्धारित वस्तुओं पर अथवा कृषि उपज (श्रेणीकरण एवं चिह्नांकन) अधिनियम , 1937 की अनुसूची में शामिल किसी भी प्रकार की कृषि उपज जो उपर्युक्त नियमों में निर्धारित जैविक उत्पादों हेतु मानकों से संबंधित प्रतिमानों और प्रक्रिया के अनुसरण में/अनुरुप उत्पादित हो , पर करने के लिए प्रदान किया जाता है और संबंधित एजेन्सी के विरुद्ध आगे उपयुक्त कार्रवाई महानिदेशक , विदेश व्यापार , वाणिज्य एवं उद्योग मंत्रालय , भारत सरकार की अधिसूचना सं0-72 ( RE -2003 )/ 2002-2007 , दिनांक 21.7.2004 , समय - समय पर यथासंशोधित , द्वारा अधिसूचित राष्ट्रीय जैविक उत्पाद कार्यक्रम द्वारा , NAB द्वारा की गई कार्रवाई के आधार पर की जाएगी ।

2. इस लाइसेंस में उक्त उल्लिखित विनियमों में विनिर्दिष्ट अधिकार तथा उत्तर देयताएं निहित हैं ।

यह लाइसेंस 3. से तक वैध रहेगा ।

4. यह लाइसेंस

को इस शर्त के अध्यधीन प्रदान किया जाता है कि ..ऑरगैनिक कृषि उपज श्रेणीकरण एवं चिह्नांकन नियमों में किए गए उपबंधों के अध्यधीन रहने के लिए तथा इसके लिए सहमत है कि संबंधित एजेन्सी के विरुद्ध आगे उपयुक्त कार्रवाई महानिदेशक , विदेश व्यापार , वाणिज्य एवं उद्योग मंत्रालय , भारत सरकार की अधिसूचना सं0-72 ( RE - 2003 )/ 2002-2007 , दिनांक 21.7.2004 , समय- समय पर यथासंशोधित , द्वारा अधिसूचित राष्ट्रीय जैविक उत्पाद कार्यक्रम द्वारा , NAB द्वारा की गई कार्रवाई के आधार पर की जाएगी ।

G.S.R. 48 (E ) .-the following draft of the Organic Agricultural Produce Grading and Marking Rules , 2009 , which the Central Government proposes to make in exercise of the powers conferred by section 3 of the Agricultural Produce (Grading and Marking ) Act, 1937 (1 of 1937) , are hereby published as required by the said section , for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of forty five days from the date on which copies of the Gazette of India containing this notification are made available to the public;

Any person desirous to make any suggestion or objection in respect of the said draft rules , may forward the same for consideration of the Central Government, within the period specified above , to the Agricultural Marketing Adviser to the Government of India , Directorate of Marketing and Inspection , Head Office , CGO Complex , NH -4, Faridabad ( Haryana ) 121001 .

DRAFT RULES

1. Short title and commencement ( 1 ) These rules may be called the OrganicAgricultural Produce Grading and Marking Rules , 2009.

(2)They shall apply to all kinds of Agricultural Produce included in the Schedule under the Agricultural Produce (Grading & Marking ) Act , 1937 .

(3)They shall come into force on the date of their final publication in the Official Gazette .

2. Definitions - In these rules , unless the context otherwise requires , -

(a) "Act" means the Agricultural Produce ( Grading and Marking ) Act, 1937 (Act No. 1 of 1937) ;

(b) " General Grading and Marking Rules " means the General Grading and Marking Rules, 1988 made under section 3 of the Agricultural Produce (Grading and Marking ) Act , 1937 (1 of 1937) ;

(d) " annual report " means any report on Licensed Operators , products and processors submitted annually to the Agricultural Marketing Adviser by the Authorized Inspection and Certification Agencies .

(e) "appeal " means the act or fact of challenging by which an Authorized Inspection and Certification Agency can request for reconsideration of an order issued by the Agricultural Marketing Adviser under these rules.

(f) " applicant" means an Inspection and Certification Agency that has applied for Certificate of Authorization to the Agricultural Marketing Adviser.

(g ) " Authorized Inspection and Certification Agency" means an agency which has been authorized for Inspection and Certification by issuing a Certificate of Authorization under these rules .

(h) "certificate " means a document issued by an Authorized Inspection and Certification Agency declaring that the licensed operator is carrying out the activities or that the stated products have been produced in accordance with the specified requirements in accordance with these rules .

(i ) "certificate of authorization " means a certificate issued by the Agricultural Marketing Adviser under these rules authorizing an Inspection and certification agency for certifying organic farms , products and process , to grade and mark organic agricultural produce;

(j ) "certification " means the procedure by which a written assurance is given by the Authorized Inspection and Certification Agency that a clearly identified production or processing system has been methodically assessed and it conforms to the specified requirements as specified vide notification No. 72 ( RE- 2003) / 2002-2007 dated 21st July, 2004.

(k) "certification mark " means the grade designation mark prescribed under these rules.

(1 ) "certification process " means the system followed by an Authorized Inspection and Certification Agency in accordance with the criteria for carrying out certification of conformity.

(m) " conversion " means the process of changing an agricultural farm from conventional to organic farm.

(n) " license " means the authorization given by an Authorized Inspection and Certification Agency a licensed operator that grants him the rights of certification under these rules.

(0) "licensed operator" means an individual or a group of persons or a business enterprise practicing organic farming or organio processing which has been given a license by the authorized Inspection and Certification Agency under these rules.

(p) "National Accreditation Body means the agency set up by the Central Government under the National Programme for Organic Production notified by the Director General of, Foreign Trade, Ministry of Commerce and Industry Government of India vide notification No.72 ( RE - 2003 ) /2002-2007 dated 21 July,2004 and as revised from time to time .

(q) "organic" means a particular farming system as described under the National Programme for Organic Production notified by the Director General of Foreign Trade, Ministry of Commerce and Industry, Government of India vide notification No.72 ( RE - 2003 )/2002-2007 dated 21st July,2004 and as revised from time to time and not the term used in chemistry.

(r) "certified organic agricultural produce " means such agricultural produce which has been produced through organic agriculture and certified under these rules .

(8) "Schedule " means a Schedule appended to these rules.

(t) " standards " means the standards for organic products prescribed under these rules.

(u) " transaction or import certification " means a document issued by a Authorized Inspection and Certification Agency declaring that the specified lot or consignment of goods is derived from production and or processing system that has been certified by them .

3. Grade designations : - For the purpose of these rules, the grade designations shall be written or stated as " Agmark India Organic" .

4. Grade Designation Mark The grade designation mark shall consist of Agmark India Organic Insignia consisting of a design incorporating the certificate of authorization number , name of the commodity and grade designation (Agmark India Organic) , resembling the design as set out in Schedule - l under these rules , and, wherever required , any other grade designation , as provided under any Specific Commodity Grading And Marking Rules notified under the Agricultural Produce (Grading and Marking ) Act , 1937, shall also be included in it .

5. Quality - The quality indicated by the grade designation shall be as mentioned in the National Programme for Organic Production notified by the Director General of Foreign Trade , Ministry of Commerce and Industry , Government of India vide notification No.72 ( RE - 2003) /2002-2007 dated 21st July, 2004 and as revised from time to time, for the purpose of these Rules , and , wherever any other grade designation , as provided under any Specific Commodity Grading And Marking Rules notified under the Agricultural Produce ( Grading and Marking) Act , 1937, has also been marked , it shall also indicate the respective grade's quality prescribed under such rules .

6. Method of packing ( 1 ) Certified organic agricultural produce shall be packed in accordance with various provisions made in the National Programme for Organic Production notified by the Director General of Foreign Trade , Ministry of Commerce and Industry, Government of India vide Notification. No.72 ( RE- 2003)/2002-2007 dated 21st July, 2004 and as revised from time to time and such packing may be done in gunny bags or jute bags , cloth bags or other suitable eco-friendly packages which shall be clean , sound , free from insects , fungal infestation and the packing material shall be of food grade quality as permitted under the Prevention of Food Adulteration Rules , 1955 made under section 23 of the Prevention of Food Adulteration Act , 1954 (37 of 1954).

(2) Only approved additives under the National Programme for Organic Production notified by the Director General of Foreign Trade , Ministry of Commerce and Industry, Government of India vide notification No.72 ( RE- 27

2003 )/2002-2007 dated 21st July, 2004 and as revised from time to time shallbe used in manufacturing the packaging films used for packaging of Organic foodstuff.

(3) The materials used must not affect the organoleptic character of the product or transmit to it any substances in quantities that may be harmful to human health.

(4) Containers and packaging material shall be made of substances which are safe and suitable for their intended use. They should not impart any toxic substance or undesirable odour or flavour to the produce.

(5) Certified Organic Agricultural Produce shall be packed in pack sizes as per the instructions issued by the Agricultural Marketing Adviser from time to time.

(6) Each package shall contain Certified Organic Agricultural Produce of the same type and of the same grade designation /standard.

(7) Graded material of small pack sizes of the same lot/ batch and grade maybe packed in a master container with complete details thereon along with grade designation mark .

(8) Each package shall be securely closed and sealed in a manner approved by theAgricultural Marketing Adviser.

7. Method of Marking and Labeling ( 1 ) The person or company legally responsible for the production or processing of the product shall be identifiable.

(2) The method of marking and labeling to be followed for certified Agmark India Organic products shall be in accordance with the provisions of the National Programme for Organic Production notified by the Director General of Foreign Trade, Ministry of Commerce and Industry , Government of India vide notification No.72 ( RE-2003 )/2002-2007 dated 21st July, 2004 and as revised from time to time.

(3) A grade designation mark shall be securely affixed to or printed on each package in a manner approved by the Agricultural Marketing Adviser or an officer authorized by him in this behalf in accordance with these rules.

(4) In addition to the grade designation mark following particulars shall be clearly and indelibly marked on each package: -

(a) Name and address of the Packer

(b) Place of packing or manufacturing

(d) Lot or batch No.

(5) The ink use for marking on packages shall be of such quality which may not contaminate the produce .

(6) The licensed operator may, after obtaining prior approval of the Agricultural Marketing Adviser through the concerned Authorized Inspection and Certification Agency, mark his private trade mark or trade brand on the graded packages provided that the same do not indicate quality other than that indicated on the grade designation mark affixed to the graded packages in accordance with these rules .

8. Certified Organic Agricultural Produce : The Certified Organic Agricultural Produce shall , besides complying with the provisions of the National Programme for Organic Production notified by the Director General of Foreign Trade, Ministry of Commerce and Industry, Government of India vide Notification No.72 (RE- 2003)/2002-2007 dated 21st July, 2004 and as revised from time to time , shall also comply with the residue levels of heavy metals , pesticides , aflatoxin and other Food Safety parameters as specified in Prevention of Food Adulteration Rules'1955.

9. Certificate of Authorization to Accredited Inspection and Certification Agencies- ( 1 ) Any accredited Inspection and Certification Agency under the National Programme for Organic Production notified by the Director General of Foreign Trade , Ministry of Commerce and Industry, Government of India vide notification No.72 ( RE - 2003 )/ 2002-2007 dated 21st July, 2004 and as revised from time to time , shall be eligible to apply for seeking Certificate of Authorization under these Rules or a renewal thereof by filing an application to an officer of the Directorate of Marketing and Inspection authorized by the Agricultural Marketing Adviser in the prescribed form ( Form 1 ) , along with fee prescribed for the purpose and specified in these rules . Following documents should be submitted along with the application :

(a) Documentary evidence of the organization , financial status (turnover) , annual report and number of employees along with their bio-data .

(b) Details of the certification committees , standards committees , inspectors etc ,

(d) Tariff proposed.

(e) Documentary evidence of authorization by any other country or agency.

(f) Affidavit in prescribed form - 2 .

(g) The applications should be signed by the head of the organization , partner, director , managing trustee , duly authorized for the purpose and a documentary evidence/power of attorney/copy of the resolution , as the case maybe.

(2) Payment of Charges or Fees The authorized Inspection and Certification Agency shall pay such charges as may be prescribed by the Central Government from time to time towards the expenses incurred in connection with the-

(a) grantand periodical renewal of Certificate of Authorization;

(b) issue of duplicate Certificate of Authorization ;

(d) measures for enforcing the quality control of scheduled articles marked with grade designation mark including testing of samples and inspection of such articles of

(e) with any publicity work carried out to promote the sale of any class of articles.

(3) Certificate of authorization - An Authorized Inspection and Certification Agencies shall be granted a certificate of authorization following the procedure laid under these rules , which shall be non -transferable...

(4) Updation and renewal of authorization The authorized inspection and certification agencies will have to undergo an updating procedure on the lines similar to the initial authorization procedure for renewal of certificate of authorization!

(a) The agricultural marketing adviser shall renew the certificate for a block of three years on payment of a prescribed fee to be paid along with the application for renewal , which shall be filed by the Inspection and Certification Agency at least thirty days before the expiry of the validity period of the certificate of authorization .

(b) Application for renewal of Authorization along with the fees prescribed shall be submitted by the Inspection and Certification Agency to reach the Officer authorized by Agricultural Marketing Adviser for this purpose, thirty days before the expiry of Authorization period.

(c) The Agricultural Marketing Adviser shall , however, have the power to condone any delay in submitting the said renewal application , in the event of a reasonable cause shown for the same.

(d) The renewal of the Certificate for Authorization shall be based on the past performance of the accredited Inspection and Certification Agency and the Agricultural Marketing Adviser shall have the right to reject such applications.

(e) In the event of rejection of an application for renewal , the Agricultural Marketing Adviser shall furnish the reasons for such rejections , in writing.

(f) The appeal committee constituted under sub-rule ( 1) of rule 14 shall be the appellate authority for deciding any appeal filed on account of any such rejection and the decision of Appeal Committee on an appeal shall be final and binding on all concerned .

( g) The Agricultural Marketing Adviser shall be the Competent Authority for receiving and processing all appeals and submitting the same before the Appeal Committee for appropriate decisions .

(5) Power to Issue Guidelines The Agricultural Marketing Adviser, shall have the powers to issue necessary guidelines to the certification agencies for inspection and certification process , from time to time.

(6) The Agricultural Marketing Adviser will issue a Certificate of Authorization , containing at least the following details:

(a) Certificate of Authorization Number;

(b) the name and address of the Inspection and Certification Agency ;

(d) the date of issue and date of expiry.

(7) The Authorized Inspection and Certification Agencies shall ensure compliance of the Standards for Organic Production and various other procedures including the procedure of inspections , certification , implementation of Internal Control System , external inspections , evaluation of Internal Control System, grant of license etc. , prescribed under the National Programme for Organic Production notified by the Director General of Foreign Trade, Ministry of Commerce and Industry , Government of India vide Notification No.72(RE- 2003)/2002-2007 dated 21st July, 2004 and as revised from time to time.

(8) In addition to the conditions specified in sub- rule ( 8) of rule 3 of the General Grading and Marking Rules , 1988 and Organic Agricultural Produce Grading and Marking Rules , 2008 , every authorized packer shall also follow various instructions issued by Agricultural Marketing Adviser from time to time.

10. Annual Reports by Authorized Inspection and Certification Agencies- (1) The Authorized Inspection and Certification Agency shall submit an annual report covering the turnover ( financial and staff) , number of projects certified, under certification and products exported in terms of quantity and value to the Agricultural Marketing Adviser . This annual report should also contain an updated report on recent developments in the Inspection and Certification Agency's Process , such as , the number of Licensed Operators certified , under conversion , geographical area of operation and changes in personnel , and a compliance report in which compliance with imposed conditions is reported , supported by documentary evidence . The report should also mention any 31

irregularities or infringements found with the licerised operators related to the application of the standards .

(2) Depending upon whether the Authorized Inspection and Certification Agency has complied with conditions imposed by the Agricultural Marketing Adviser, and the extent and nature of changes made in the authorized inspection and certification agency's process , the Agricultural Marketing Adviser may take any of thefollowing courses of action , namely:-

(a) Renew the Authorization period if the period has expired;

(b) impose new conditions requiring corrective action according to an agreed timetable;

11. Complaints- ( 1 ) Complaints regarding the functioning of an authorized inspection and certification agency should , in the first instance, be directed to the Authorized Inspection and Certification Agency in question . Only in cases where the complainant feels that the complaint has not been handled satisfactorilyby the Authorized Inspection and Certification Agency, the complaint be lodged with the Agricultural Marketing Adviser in such a manner that confidentiality regarding the source of such a complaint is maintained.

(2) The Agricultural Marketing Adviser may refer such complaints for suitable action to the National Accreditation Body constituted under the National Programme for Organic Production notified by the Director General of Foreign Trade, Ministry of Commerce and Industry, Government of India vide notification No.72( RE-2003) / 2002-2007 dated 21st July, 2004 and as revised from time to time, if required.

(3) If the National Accreditation Body decides to take any action or impose any sanctions against the Authorized Inspection and Certification Agency on the basis of any such complaint , the agricultural marketing adviser may also take appropriate action with regard to the certificate of authorization of concerned agency.

12. Sanctions- (1 ) In the event of non -compliance or failure to fulfill conditions, the agricultural marketing adviser may apply one or more of the following sanctions , namely:-

(a) Issue a warning letter or letter of reprimand;

(b) impose additional conditions and insist for rectification within a prescribed timelimit;

(c) impose penalty, not only for non -compliance with conditions but also for being late or filing a deficient annual report ;

(d) suspendAuthorization;

(e) refer the matter to the National Accreditation Body constituted under the National Programme for Organic Production notified by the Director General of Foreign Trade , Ministry of Commerce and Industry, Government of India vide Notification No.72 ( RE -2003) /2002-2007 dated 21st July, 2004 and as revised from time to time and based action taken by the National Accreditation Body, take further appropriate action against the concerned agency.

(2) In the case of suspension , the Agricultural Marketing Adviser shall have the powers to nominate any other Authorized Inspection and Certification Agency to continue the work of certification in order to protect the interest of the Licensed Operators.

13. Termination of Authorization-( 1 ) The Agricultural Marketing Adviser may terminate the authorization status of an Inspection and Certification Agency if performance and conduct of the agericy is not in accordance with the Authorization criteria or the conditions laid down for the Authorization .

(2) When a certificate of authorization is withdrawn , the Agricultural Marketing Adviser will publish the name of the Inspection and Certification Agency on the Directorate of Marketing and Inspection's website and may release a public statement.

(3) Conditions where authorization status may be terminated include , but are not limited to:

(a) Non -compliance with the Authorization criteria or the Organic Agricultural Produce Grading and Marking Rules by the Inspection and Certification Agency;

(b) misuse of Authorization status;

(d) failure to comply with any sanctions imposed .

14. Appeals- ( 1 ) The applicant or an Authorized Inspection and Certification Agency can appeal against the Authorization decisions or sanctions imposed upon including the termination order, as the case may be, before the Appeal Committee, constituted by the Central Government for this purpose , consisting of three representatives , not below the rank of Additional Secretary to the Government of India , one each from the Department of Agriculture and Cooperation , Department of Commerce and the Department of Consumer Affairs . The representative of the Department of Agriculture and Cooperation shall be the Chairman of the Committee . Appeals must be lodged within thirty days of the disputed decision . Appeals should be directed through the Agricultural Marketing Adviser.

(2) The Agricultural Marketing Adviser shall receive and process the appeal and shall submit a report thereupon to the Appeal Committee for a final decision .

(3) The decision of the Appeal Committee on an appeal shall be final and binding on all concerned .

(4) The delay in filing an appeal can be condoned by the respective appellate Authority in the event of a reasonable cause being shown by the applicant.

15. Reciprocity- ( 1 ) Agricultural products certified as Agmark India Organic by any Authorized Inspection and Certification Agency under these rules shall be accepted as organic by the other Certification Agencies also within any partof the country.

(2) Organic Agricultural products certified under the exporting countries' organic standards by the Inspection and Certification Agencies notified for this purpose under National Programme for Organic Production shall not be required to be re-certified on import into India if the import is taking placeunder a bilateral equivalence agreement and the consignment of the organic produce is accompanied by a transaction certificate issued by an authorized inspection and certification agency under these rules .

16. Functions of the Authorized Inspection and Certification Agencies- (1) The Directorate of Marketing and Inspection shall be informed by the Authorized Inspection and Certification Agency about the action taken by them on the licensed operators . In case the Directorate of Marketing and Inspection , finds irregularities or infringements related to the application of provision of the National Programme for Organic Production notified by the Director General of Foreign Trade , Ministry of Commerce and Industry , Government of India vide Notification No.72 ( RE - 2003 )/2002-2007 dated 21st July, 2004 and as revised from time to time , by the inspection and certification agencies , it shall take further action under these rules .

(2) After evaluation of the willing laboratories , the Agricultural Marketing Adviser shall authorize them for residue testing of the soil , organic products and organic inputs . The Authorized Inspection and Certification Agencies shall utilize the services of only approved laboratories for the purposes of testing to comply with various criteria under the National Programme for Organic Production notifiedby the Director General of Foreign Trade , Ministry of Commerce and Industry, Government of India vide Notification No.72 ( RE- 2003 )/2002-2007 dated 21st July, 2004 and as revised from time to time.

17. Certification- ( 1 ) The Authorized Inspection and Certification Agencies shall comply with the procedure prescribed for certification under the National Programme for Organic Production notified by the Director General of Foreign Trade, Ministry of Commerce and Industry, Government of India vide Notification No.72( RE- 2003 )/2002-2007 dated 21st July, 2004 and as revised from time to time.

(2) Where an infringement that affects the organic integrity is found, the Authorized Inspection and Certification Agencies shall ensure that the indication of certification is removed from the entire lot of the production run which is affected by the infringement concerned . Where a violation is made by the Licensed Operator, the Authorized Inspection and Certification Agencies shall withdraw certification from the licensed operator for a specified period and inform about their decision to agricultural marketing adviser.

18. Sanctions to be imposed by the Authorized Inspection and Certification Agencies- ( 1 ) The Authorized Inspection and Certification Agency shall have a clear policy for sanctions in the event of non- compliances by the group and/ orby individual licensed operators .

(2) The Authorized Inspection and Certification Agency on detection of non- compliance by the group or its individual licensed operators and failure of the internal control system , shall invoke sanctions on the group . The sanction shall also include provisions for withdrawal of certification of the whole group .

19. Certification Fee- ( 1 ) The Charges shall be set by the Authorized Inspection and Certification Agencies to cover the operating cost of the Authorized Inspection and certification agency. Charges shall be fixed in the following categories annually, namely: -

i) Grower groups (small and marginal farmers ) ;

ii) cooperatives and cottage industries ;

large farmers , estates and exporters ;

iv) medium and large sized processors

(2) The components of the fee would cover the following

i) Application fee

ii) Travel and inspection

Assessment and report preparation (man - day cost)

iv) Issue of certificates (Scope Certificate , Product certificate and Transaction certificate)

(3) TheAuthorized Inspection and Certification Agencies shall , besides the fee prescribed in sub - rule ( 1 ) above , collect and deposit with the Directorate of Marketing and Inspection such charges as may be prescribed by the Central Government from time to time towards the expenses incurred in connection with the -

(a) grant and periodical renewal of Certificate of Authorization;

(b) issue of duplicate Certificate of Authorization ;

(c) training of chemists employed by the Authorized Inspection and certification Agencies , if any required to be undertaken in the laboratories ofthe Directorate of Marketing and Inspection;

(d) measures for enforcing the quality control of scheduled articles marked with grade designation mark including testing of samples and inspection of such articles ; or

(e) publicity work carried out to promote the sale of any class of articles .

20. Responsibilities of Licensed Operators and Grower Groups- ( 1 ) Any application for grant of a license to be made to the Authorized Inspection and Certification Agency shall be in Form -4 prescribed under thesé rules , which shall be processed and license be granted as per provisions of the National Programme for Organic Production notified by the Director General of Foreign Trade , Ministry of Commerce and Industry, Government of India vide Notification No.72 ( RE - 2003 )/2002-2007 dated 21st July, 2004 and as revised from time to time.

(2) The license to be granted by the Authorized Inspection and Certification Agency under sub - rule ( 1 ) above shall be in Form- 5 and the declaration to be filed by the licensed operator shall be in Form-6 prescribed under these rules.

(3) The licensed operators and grower groups shall be entitled to use the certification or grade designation mark as provided under these rules and restrict his use thereof to goods or services , which will meet the norms and standard specification of the products . The certification mark may be affixed to the products and/ or used on packaging or promotional material or in the context of advertising activities.

(4) In the event of a withdrawal of the right to use the aforesaid mark the license shall be returned to the Authorized Inspection and Certification Agency. The right to use the grade designation mark expires at the same time without giving rise to any indemnification claim against the agricultural marketing adviser orAuthorized Inspection and Certification Agency.

(5) Thelicensed operators and grower groups shall be entitled to use the aforesaid mark but shall be answerable for the safety of their products themselves. They shall furnish proof of holding sufficient product liability insurance in ' respect thereof, if required by the authorized inspection and certification agency. No liability, whatsoever , will be accepted by the Authorized Inspection and Certification Agency or the agricultural marketing adviser in this regard.

(6) Aproduct certificate shall be issued to the buyer in Form- 3 annexed to these rules by the certifier of the Authorized Inspection and Certification Agency on the request of the Licensed Operators .

5. M/s. shall fulfill its inspection , evaluation and certification according to the criteria set in the Organic Agricultural Produce Grading and Marking Rules , 2008. In addition hereto , M/ s .--- may render such other services that are not in contravention with the Organic Agricultural Produce Grading and Marking Rules .

6. M /s.shall pay the grading charges as per rule 19 to the Directorate of Marketing and Inspection and submit periodical returns in the prescribed manner as may be specified by the Agricultural Marketing Adviser from time to time.

7. M /s.shall be responsible for safe custody and proper accounting of Agmark labels , if any issued , Agmark replica bearing containers , sealing pliers , etc. , and for realization and timely remittance of Government dues .

8. M /s.shall strictly follow the instructions issues for inspection , sampling analysis , packing , marking and sealing of the articles .

9. M / s.shall furnish on demand to the Agricultural Marketing Adviser or any other duly authorized officer such information , return or repot in respect of any of the scheduled articles which the authority may consider necessary for carrying out the provisions of the Agricultural Produce(Grading & Marking) Act , 1937

10. M/s. shall submit an annual report to Directorate of Marketing and Inspection by 30th April every year . The annual report would contain anupdated report on the recent developments in the certification process such as number of Licensed Operators certified ( under conversion / converted ) geographical area of operations , financial turnover, change in personnel , irregularities or infringements found with the Licensed Operators related to the application of standards , products exported in terms of quantity and value and country of destination for the preceding financial year ending 31st of March of the year concerned .

8. In order to ensure conformity of the said product/process to the related norms and procedures of the Standard for Organic Products:

1. By virtue of the powers conferred on it by the Organic Agricultural Produce Grading and Marking Rules pertaining to Certification Mark of Agmark India Organic Logo, the Inspection and Certification Agency hereby grants to

( hereinafter called ' the Licensed Operator ' ) this License to use Agmark India Organic Insignia set out in the Schedule - I of these Rules , upon or in respect of any kind of Agricultural Produce included in the Schedule under the Agricultural Produce (Grading & Marking ) Act, 1937 which is produced in accordance with/conforms to the related norms and procedures of Standards for Organic Products prescribed under the above said Rules and the National programme for Organic Production ( NPOP ) notified by the Director General of Foreign Trade , Ministry of Commerce and Industry , Government of India vide Notification No. 72 ( RE - 2003 )/2002-2007 dated 21-07-2004 and as revised from time to time and based action taken by the NAB , take further appropriate action against the concerned agency.
