का.आ. 289(अ).-जबकि वायुयान अधिनियम , 1934 ( 1934 कर 22 ) की धारा 6 की उप- धारा ( 1 ) के खण्ड ( घ ) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए भारत सरकार , नागर विमानन मंत्रालय ने अधिसूचना सं. का. आ. 281 ( अ ) दिनांक 22 जनवरी , 2009 के द्वारा नागर विमानन मंत्रालय अथवा गृह मंत्रालय के चुनिंदा अधिकारी , जो संयुक्त सचिव पद के नीचे न हो, को केंद्रीय सरकार के पास जनसेवा हेतु वायुयान की माँग करने संबंधी उद्देश्यों के लिए शक्तियाँ प्रदान की थी;
जबकि केंद्रीय सरकार का यह मत है कि इस प्रकार की शक्तियाँ राष्ट्रीय सुरक्षा गारद के महानिदेशक अथवा सुरक्षा गारद के किसी अन्य सदस्य , जो महानिरीक्षक के पद से नीचे न हो , को भी प्रदान की जानी चाहिए ताकि वे वायुयान अधिनियम , 1934 की धारा 6 उप - धारा ( 1 ) के खंड ( घ) के अंतर्गत प्राधिकृत अधिकारी की शक्तियों का प्रयोग कर सकें;
और जबकि केंद्रीय सरकार, राष्ट्रीय सुरक्षक अधिनियम , 1986 ( 1986 का 47 ) की धारा 137 की उप- धारा ( 1 ) के अंतर्गत , सरकारी राजपत्र में प्रकाशित सामान्य अथवा विशेष आदेश के द्वारा , उस आदेश में यथा विनिर्दिष्ट शर्तों और सीमाओं के अधीन यह निदेश देती है कि सुरक्षा गारद का कोई सदस्य , किसी केंद्रीय अधिनियम के अधीन ऐसी शक्तियों का प्रयोग करेगा तथा कर्तव्यों का निर्वहन करेगा जो उक्त आदेश में विनिर्दिष्ट की जाएँ तथा जिन्हें केंद्रीय सरकार के मतानुसार उस अधिकारी के समकक्ष अथवा उससे नीचे के रैंक का अधिकारी उक्त प्रयोजनों के लिए शक्तियों का प्रयोग करने अथवा निर्वहन करने में सक्षम है;
अब , इसलिए केंद्रीय सरकार राष्ट्रीय सुरक्षक अधिनियम , 1986 ( 1986 का 47 ) की धारा 137 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एतद्वारा यह निदेश देती है कि राष्ट्रीय सुरक्षा गारद के महानिदेशक अथवा इस कार्य के लिए उनके द्वारा प्राधिकृत सुरक्षा गारद का कोई अन्य सदस्य , जो महानिदेशक के रैंक से नीचे न हो , उक्त अधिसूचना में संदर्भित प्राधिकृत अधिकारी की शक्तियों का प्रयोग कर सकेंगे ।

NOTIFICATION
New Delhi , the 23rd January, 2009
S. O. 289 ( E) .Whereas in exercise of powers conferred under clause (d) of sub - section ( 1 ) of Section 6 of the Aircraft Act , 1934 (22 of 1934 ) , the Government of India in the Ministry of Civil Aviation by notification No. S.O. 281 (E) dated 22nd January, 2009 empowered certain officers of the Central Government not below the rank of Joint Secretary to that Government in the Ministry of Civil Aviation or Ministry of Home Affairs as authorized officers for the purposes of requisitioning aircrafts to be placed at the disposal of the Central Government for public service;
And whereas the Central Government is of the opinion that such power should be also conferred on the Director General ofthe National Security Guard or any other Member of the Security Guard not below the rank of Inspector General to exercise the powers of the authorized officer under clause (d ) of sub -section ( 1 ) of Section 6 of the Aircraft Act , 1934;
Andwhereas the Central Government under sub Section ( 1 ) of Section 137 of the National Security Guard Act , 1986 (47 of 1986) may by general or special order published in the Official Gazette direct , subject to such conditions and limitations as may be specified in the order, that any member of the Security Guard shall exercise or discharge such of the powers or duties under any Central Act as may be specified in the said order being powers and duties which in the opinion ofthe Central Government an officer of the corresponding or lower rank is empowered to exercise or discharge for the said purposes;
Now, therefore, in exercise of the powers conferred by sub - section ( 1 ) of Section 137 of the National Security GuardAct , 1986 (47 of 1986) the Central Government hereby directs that the Director General ofthe National Security Guard or any other Member of the Security Guard not below the rank of Inspector General authorized by him in this behalf, may exercise the powers of the authorized officer referred to in the said notification.
