का.आ.347( अ ).-यतः , मै विवो बायो टेक लि. , जो आंध्र प्रदेश राज्यमें एक निजी संगठन है , ने विशेष आर्थिक जोन अधिनियम, 2005 (2005 का 28 ) ( जिसे एतपश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 के अंतर्गत गांव प्रेगनापुर , गजवेल मंडल, जिला मेडक , आंध्र प्रदेश में जैव प्रौद्योगिकी हेतु क्षेत्र विशिष्ट विशेष आर्थिक जोन की स्थापना करने का प्रस्ताव किया है ;
और, यतः , केन्द्र सरकार , इस बात से संतुष्ट है कि उक्त अधिनियम की धारा 3 की उप - धारा ( 8 ) के अंतर्गत अपेक्षाओं तथा अन्य संबंधित अपेक्षाओं को पूरा कर लिया गया है और उसने 2 जून , 2008 को गांव प्रेगनापुर , में जैव प्रौद्योगिकी हेतु क्षेत्र विशिष्ट विशेष आर्थिक जोन की स्थापना , प्रचालन एवं रख - रखाव हेतु उक्त अधिनियम की धारा 3 की उप- धारा ( 10 ) के अंतर्गत अनुमोदन पत्र प्रदान कर दिया है;
अतः , अब , विशेष आर्थिक जोन अधिनियम , 2005 की धारा 4 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और 'विशेष आर्थिक जोन नियम , 2006 के नियम 8 के अनुसरण में केन्द्र सरकार , एतद्वारा गांव प्रेगनापुर, गजवेल मंडल , जिला मेडक, आंध्र प्रदेश में जैव प्रौद्योगिकी हेतु क्षेत्र विशिष्ट विशेष आर्थिक जोन

की स्थापना हेतु निम्नलिखित क्षेत्र को एक विशेष आर्थिक जोन के रूप में अधिसूचित करती है जिसमें निम्नलिखित तालिका में उल्लिखित सर्वेक्षण संख्याएं और क्षेत्र शामिल हैं, अर्थात्:-

New Delhi , the 27th January, 2009
S. O. 347 (E) .- Whereas , M/ s . Vivo Bio Tech Limited, a Private Organization in the State of Andhra Pradesh, has proposed under Section 3 of the Special Economic Zones Act , 2005 (28 of 2005 ) , (hereinafter referred to as the said Act) , to set up a sector specific Special Economic Zone for biotech sector at village Pregnapur, Gajwel Mandal, Medak District in the State of Andhra Pradesh;

And, whereas , the Central Government is satisfied the requirements under sub - section (8) of Section 3 ofthe said Act, and other related requirements are fulfilled and it has granted letter of approval under sub - section ( 10) of Section 3 of the said Act for development , operation and maintenance ofthe sector specific Special Economic Zone forbiotech sector at Pregnapur village Area on 2nd June, 2008;
Now, therefore, in exercise of the powers conferred by sub - section ( 1) of Section 4 of the Special Economic Zones Act , 2005 and in pursuance of rule 8 of the Special Economic Zones Rules , 2006, the Central Government hereby notifies the following area at village Pregnapur , Gajwel Mandal , Medak District in the State of Andhra Pradesh , comprising of the survey numbers and the area given below in the Table , as a Special Economic Zone , namely:-

का.आ. 348( अ ).---विशेष आर्थिक जोन अधिनियम , 2005 (2005 का 28 ) की धारा 13 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का उपयोग करते हुए , केन्द्र सरकार , एतद्वारा , उक्त अधिनियम के प्रयोजनार्थ मै. विवो बायो टेक लि. , द्वारा गांव प्रेगनापुर , गजवेल मंडल , जिला मेडक , आंध्र प्रदेश में जैव प्रौद्योगिकी हेतु क्षेत्र विशिष्ट विशेष आर्थिक जोन के लिए एक समिति , जिसे अनुमोदन समिति कहा जाएगा , गठित करती है , जिसके अध्यक्ष और सदस्य निम्नानुसार हैं, अर्थात्: -

या केन्द्रीय उत्पाद शुल्क आयुक्त अथवा उनका नामिती जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा

-सदस्य, पदेन विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाले आयकर आयुक्त अथवा उनका नामिती जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा
-सदस्य, पदेन 6. निदेशक ( बैंकिंग ) , बैंकिंग प्रभाग वित्त मंत्रालय , भारत सरकार
-सदस्य, पदेन 7. आंध्र प्रदेश सरकार द्वारा नामित दो अधिकारी , जिनका स्तर संयुक्त सचिव से कम नहीं होगा
-विशेष आमंत्रिती मै. विवो बायो टेक लि. , ( विकासकर्ता ) का प्रतिनिधि 8.
2. विशेष आर्थिक जोन के विकास आयुक्त की अनुपस्थिति में उनका प्रतिनिधित्व वह अधिकारी करेगा जिसका स्तर संयुक्त विकास आयुक्त से कम नहीं होगा ।

In exercise of the powers conferred by sub - section ( 1 ) of Section 13 of the Special Economic Zones Act, 2005 (28 of 2005 ) , the Central Government hereby constitutes a Committee to be called the Approval Committee forthe Biotech Special Economic Zone at village Pregnapur , Gajwel Mandal , Medak District in the State of Andhra Pradesh developed by M/ s . Vivo Bio Tech Limited for the purposes of the said Act consisting of the following Chairperson and Members , namely : ----

का. आ. 349 ( अ ).-विशेष आर्थिक जोन अधिनियम, 2005 (2005 का 28 ) की धारा 53 की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का उपयोग करते हुए , केन्द्र सरकार, एतद्वारा , दिनांक 27 जनवरी , 2008 को उस तारीख के रूप में निर्धारित करती है जिस तारीख से मै. विवो बायो टेक लि. , द्वारा गांव प्रेगनापुर , गजवेल मंडल, जिला मेडक , आंध्र प्रदेश में जैव प्रौद्योगिकी हेतु क्षेत्र विशिष्ट विशेष आर्थिक जोन को सीमाशुल्क अधिनियम, 1962 की धारा 7 के अंतर्गत अंतर्देशीय कंटेनर डिपो माना जाएगा ।

NOTIFICATION
New Delhi , the 27th January, 2009
S. O. 349 (E) . In exercise of the powers conferred by sub -section (2) of Section 53 of the Special Economic Zones Act, 2005 (28 of 2005 ) , the Central Government hereby appoints the 27th January, 2008 as the date from which the sector specific Special Economic Zone for biotech sector at village Pregnapur, Gajwel Mandal , Medak District in the State of Andhra Pradesh proposed to be developed by M/s . Vivo Bio Tech Limited shall be deemed to be Inland Container Deport under Section 7 of the Customs Act, 1962 .
