आ.अ. 11(अ).-यतः, भारत के राष्ट्रपति लोक प्रतिनिधित्व अधिनियम, 1951 ( 1951 का 43 ) की धारा12 के अधीन तारीख 27 जनवरी , 2009 को जारी और भारत के राजपत्र में प्रकाशित अधिसूचना द्वारा जम्मू व कश्मीर राज्य के विधान सभा के निर्वाचित सदस्यों से यह अपेक्षा करते हैं कि वे जम्मू व कश्मीर राज्य से राज्य सभा के सदस्य श्री तरलोक सिंह की पदावधि समाप्त होने तथा उनके सेवानिवृत्त होने पर 25 नवम्बर, 2008 को हो चुकी रिक्ति को भरने के लिए जम्मू व कश्मीर से राज्य सभा के लिए एक सदस्य निर्वाचित कर दें :-
अतः , अब , उक्त अधिनियम की धारा 39 कीउप - धारा ( 1 ) और धारा 56 के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा-- (अ ) उक्त निर्वाचन के संबंध में-
(क) नामनिर्देशन करने की अन्तिम तारीख
3 फरवरी , 2009 (मंगलवार)
(ख) नामनिर्देशनों की संवीक्षा की तारीख
4 फरवरी , 2009 ( बुधवार)
(ग) अभ्यर्थिताएं वापस लेने की अंतिम तारीख
6फरवरी , 2009 ( शुक्रवार )
( घ) वह तारीख जिसको यदि आवश्यक हुआ तो मतदान होगा 13 फरवरी , 2009 ( शुक्रवार)
(ङ ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न करा लिया जाएगा 16 फरवरी , 2009 ( सोमवार)
नियत करता है; और
( आ) 9.00 बजे पूर्वाह्न से 4.00 बजे अपराह्न तक का समय , ऐसे समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ तो, निर्वाचन के लिए उक्त विनिर्दिष्ट तारीख को , मतदान होगा ।

New Delhi , the 27th January, 2009
Ο.Ν. 11 (E ) . Whereas , the President of India has by notification issued under Section 12 of the Representation ofthe People Act , 1951 (43 of 1951 ) and published in the Gazette of India on 27th January , 2009, been pleased to call upon the elected members ofthe Legislative Assembly of the State of Jammu and Kashmir to elect one member to the Council of States from Jammu and Kashmir to fill the vacancy in that House occurred due to the retirement of Shri S. Tarlok Singh on 25th November , 2008 on the expiration ofhis term of office;
Now, therefore, in pursuance of sub - section ( 1 ) of Section 39 and Section 56 of the said Act , the Election Commission of India hereby-
(A) appoints , with respect to the said election-
(a) the 3rd February, 2009 (Tuesday) , as the last date for making nominations;
(b) the 4th February , 2009 ( Wednesday) , as the date for the scrutiny of the nominations ;
(c) the 6th February , 2009 (Friday), as the last date for the withdrawal of candidatures ;
(d) the 13th February , 2009 (Friday ) , as the date on which a poll shall, if necessary, be taken, and (e) the 16th February , 2009 (Monday ) , as the date before which the election shall be completed; and (B) fixes the hours from 9.00 A.M. to 4.00 P.M. , as the hours during which the poll shall , if necessary , be taken on the date specified above for the election .

Now, therefore, in pursuance of sub- section ( 1 ) of Section 39 and Section 56 of the said Act, the Election Commission of India hereby :-
(A) appoints , with respect to the said election-
(a) the 3rd February , 2009 ( Tuesday) , as the last date for making nominations;

आ.अ. 14(अ) .-लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 21 के अनुसरण में एवं उक्त अधिनियम की धारा 22 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत निर्वाचन आयोग एतद्वारा जम्मू व कश्मीर सरकार के परामर्श से 27 जनवरी, 2009 को भारत के राजपत्र में प्रकाशित आयोग की अधिसूचनाओं सं. 318/रा.स. ज. व क./ 2009 ( 1 ) , 318/रा.स. -ज. व क./2009 ( 2 ) एवं 318/रा.स. - ज. व क./ 2009 ( 3 ) के अनुसरण में और राज्य सभा के लिए होने वाले द्विवार्षिक निर्वाचनों के संबंध में ,
( i ) नीचे की सारणी के स्तम्भ ( 1 ) में विनिर्दिष्ट अधिकारी को रिटर्निंग आफिसर के रूप में पदाभिहित करता है , तथा;
( ii ) उक्त सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट अधिकारी को रिटर्निंग आफिसर के कृत्यों के निष्पादन में सहायता करने के लिए, सहायक रिटर्निंग आफिसर के रूप में नियुक्त करता है ;

O.N. 14(E) . In pursuance of Section 21 , and in exercise ofthe powers conferred by sub-section (1 ) of Section 22 , ofthe Representation of the People Act , 1951 (43 of 1951 ) , the Election Commission of India, in consultation with the Government ofthe State of Jammu and Kashmir , hereby :---
(i) designates the officer, specified in column (1 ) ofthe Table below, to be the Returning Officer; and (ii ) appoints the officer, specified in column (2) of the said Table , to be the Assistant Returning Officer to assist the Returning Officer in the performance of his functions;
in respect of the biennial elections to the Council of States , to be held in that State in pursuance of the Commission's Notifications No. 318 /CS - JK/2009 ( 1 ) , 318 / CS -JK/2009(2), and 318/CS- JK/2009 (3 ) , published in the Gazette of India on 27th January, 2009 :-
