का.आ. 365(अ).- जबकि , लोक कल्याण संस्थान , 52, प्रेम पुरी, मुजफ्फरनगर , उत्तर प्रदेश ( इसके बाद इसे उक्त सोसायटी कहा जाए ) द्वारा दंड स्वरूप ब्याज तथा ब्याज सहित 6,53,207 रु. (छः लाख तिरपन्न हजार दो सौ सात रुपए मात्र ) की राशि खादी और ग्रामोद्योग आयोग ( इसके बाद इसे उक्त आयोग कहा जाए ) को देयहै ;
और जबकि, खादी और ग्रामोद्योग आयोग नियम , 2006 ( इसके बाद इसे उक्त नियम कहा जाए) के नियम 29 के उप- नियम ( 1 ) के अधीन आयोग ने 2 फरवरी , 2007 को उक्त सोसायटी को नोटिस जारी करते हुए उक्त नोटिस की प्राप्ति से 30 दिन के भीतर उक्त आयोग को बकाया राशि का भुगतान करने का निदेश दिया था , ऐसा न करने पर आयोग उक्त राशि की वसूली भू- राजस्व बकाया के रूप में करेगा ;
और जबकि, उक्त सोसायटी ने आयोग को 6,53,207 रु. (छः लाख तिरपन्न हजार दो सौ सात रुपए मात्र ) की राशि के भुगतान के अपने दायित्व पर विवाद पैदा किया है, जो आयोग को देय है ।
अब इसलिए खादी और ग्रामोद्योग आयोग नियम, 2006 के नियम 30 के उप-नियम (2 ) के साथ पठित खादी और ग्रामोद्योग आयोग अधिनियम, 1956 ( 1956 का 61 ) की धारा 19ख द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत सरकार , एक अधिकरण का गठन 418 GI/2009
करती है जिसमें एक व्यक्ति नामतः श्री प्रवीण महतो , अपर आर्थिक सलाहकार , विकास आयुक्त कार्यालय , सूक्ष्म, लघु और मध्यम उद्यम मंत्रालय , निर्माण भवन, नई दिल्ली-110011 होंगे , जो लोक कल्याण संस्थान, मुजफ्फरनगर द्वारा खादी और ग्रामोद्योग आयोग को देय राशि के भुगतान से संबंधित मामले में निर्णय लेंगे ।
2. उक्त अधिकरण केन्द्र सरकार को अपनी रिपोर्ट यथाशीघ्र लेकिनअधिक से अधिक सरकारी राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से 3 महीने के भीतर प्रस्तुत करेगा ।
3. उक्त अधिकरण का मुख्यालय नई दिल्ली में होगा ।

New Delhi , the 28th January , 2009
S.O.365(E)-Whereas, a sum Rs . 6,53,207.00 (Rupees six lakh fifty -three thousand two hundred and seven only) including interest and penal interest as on 31st December 2007, is payable by the Lok Kalyan Sansthan , 52, Prem Puri ,Muzaffarnagar, Uttar Pradesh (hereinafter referred to. as the said Society) , to the Khadi and Village Industries Commission (theCommission) ;

And whereas , a notice was served on the said society under sub- rule ( 1 ) of rule 29 of the Khadi and Village Industries Commission Rules , 2006 dated the 2nd February, 2007 directing the said Society to pay the sum due to the Commission within thirty days from the receipt of the notice failing which the Commission shall proceed to recover the same as arrears of land revenue ;
And whereas , the said Society has disputed its liability to pay the sum of Rs . 6,53,207.00 ( Rupees six lakh fifty -three thousand two hundred and seven only) which is due to the Commission .
Now therefore, in exercise of the powers conferred by Section 19B of the Khadi and Village Industries Commission Act, 1956 (61 of 1956) read with sub - rule (2) of rule 30 of the Khadi and Village Industries Commission, Rules, 2006 , the Central Government hereby constitute a

Tribunal consisting of one person , namely, Shri Praveen Mahto , Additional Economic Adviser , Office of Development Commissioner , Ministry of Micro , Small and Medium Enterprises , Nirman Bhawan, New Delhi - 110011 , to decide the question on the payment of dues by Lok Kalyan Sansthan , Muzaffarnagar to the Khadi and Village Industries Commission .
2. The Tribunal shall submit its report to the Central Government as soon as possible but not later than three months from the date of publication of this notification in the Official Gazette .
3. The headquarter of the said Tribunal shall be at New Delhi .
