प्रतिनिधित्व करते हैं , और उत्तर भारत के मैदानों में झीलों में विशिष्ट जलीय वनस्पति है;
पर्यावरण और वन मंत्रालय अधिसूचना
नई दिल्ली, 29 जनवरी , 2009
और सुलतानपुर राष्ट्रीय उद्यान महत्त्वपूर्ण है तथा जलीय पक्षीजात के लिए ज्ञात है जहां लगभग 30,000 पक्षी शीत ऋतु के दौरान इस उद्यान में लगभग 250 प्रज्यतियों को सूचीबद्ध किया गया है । इस उद्यान में आने वाले महत्वपूर्ण पक्षी श्वेत जल. पक्षी , पनकौआ, बगुला , एग्रेट्स , सारस पक्षी, फ्लेमिंगोज , इंस , बत्तख आदि हैं । पूरे वर्ष, जहां अनेक भारतीय मूल के राज्यक्षेत्रीय पक्षी निवास करते हैं । इस उद्यान में सारस , क्रेन और विरल काली गर्दन वाले सारस पक्षी का प्रजनन अभिलिखित किया गया है । यह उद्यान हरियाणा के गुड़गांव जिले के अंतर्गत आता है जो पश्चिम की ओर सुलतानपुर ग्राम से घिरा हुआ है पूर्व की ओर चंदू ग्राम , दक्षिण- पूर्व की ओर सधराना ग्राम और उत्तर की ओर कालीवास ग्राम से घिरा है;
का.आ. 364(अ).-निम्नलिखित प्रारूप अधिसूचना को जिसे केन्द्रीय सरकार , पर्यावरण ( संरक्षण ) अधिनियम , 1986 ( 1986 का 29 ) की धारा 3 की उप - धारा (2 ) के खण्ड ( v) और खण्ड (xiv) के साथ पठित उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए पर्यावरण ( संरक्षण ) नियम, 1986 के नियम 5 के उप- नियम (3 ) के अधीन अपेक्षानुसार ऐसे व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है प्रकाशित किया जाता है ; और सूचना दी जाती है कि उक्त प्रारूप अधिसूचना पर उस तारीख से जिसको इस अधिसूचना से युक्त राजपत्र की प्रत्तियां जनता को उपलब्ध करा दी जाती हैं साठ दिन के अवसान पर या उसके पश्चात् विचार किया जाएगा;
और सुलतानपुर राष्ट्रीय उद्यान के संरक्षित क्षेत्र की सीमा से पांच किलोमीटर तक के क्षेत्र का पारिस्थितिकी और पर्यावरणीय दृष्टि से पारिस्थितिकी संवेदन अंचल के रूप में संरक्षण और संरक्षा प्रतिरक्षणः आवश्यक है;
ऐसे व्यक्ति जो प्रारूप अधिसूचना में अंतर्विष्ट प्रस्तावों के संबंध में कोई आक्षेप या सुझाव देने में हितबद्ध हैं, वे ऐसा इस प्रकार विनिर्दिष्ट अवधि के भीतर लिखित में सचिन्न , पर्यावरण और वन मंत्रालय , भारत सरकार , पर्यावरण भवन , सी.जी.ओ. काम्पलेक्स, लोधी रोड, नई दिल्ली -110003 याया इलेक्ट्रानिकली ई - मेल पता-envisect @ nic.in पर भेज सकेंगे ।
प्रारूप अधिसूचना
अतः , अब , केन्द्रीय सरकार, पर्यावरण ( संरक्षण ) अधिनियम , 1986 ( 1986 का 29 ) की धारा 3 की उप- धारा ( 2 ) के खण्ड (v) और खण्ड़ (xiv) के साथ पठित उप - धारा ( 1 ) और पर्यावरण (संरक्षण ) नियम , 1986 के नियम 5 के उप- नियम ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सुलतानपुर राष्ट्रीय उद्यान के संरक्षित क्षेत्र की सीमा से पांच किलोमीटर तक के क्षेत्र को जो हरियाणा राज्य में नीचे वर्णित सीमा के भीतर संलग्न है पारिस्थितिक संवेदनशील अंचल (जिसे इसमें इसके पश्चात् पारिस्थितिकी संवेदनशील अंचल कहा गया है ) के रूप में अधिसूचित करती है, अर्थात्:-
सुलतानपुर राष्ट्रीय उद्यान ( गुड़गांव से लगभग 15 कि.मी. और दिल्ली से लगभग 45 कि.मी. ) ( अनुलग्नक ' क' ) शीत उत्प्रवासी ऋतु के दौरान बड़ी संख्या में और अनेक किस्म की उत्प्रवासी पक्षियों को आकर्षित करता है । जहां तक इस राष्ट्रीय उद्यान की जैव विविधता का संबंध है , इस क्षेत्र के फ्लोरी इसके बाहर अर्द्धशुष्क वनस्पति का

1. पारिस्थितिक संवेदनशील अंचल की सीमाएं- पारिस्थितिक संवेदनशील अंचल सुलतानपुर राष्ट्रीय उद्यान के संरक्षित क्षेत्र की सीमा से पांच किलोमीटर तक का क्षेत्र है जो हरियाणा के गुडगांव जिला में 28 ° 24' 00" से 29 ° 32' 00 " उत्तरी अक्षांस के बीच और 76 ° 48' 00" से 76 ° 58' 00 " पूर्वी देशांतर के बीच अवस्थित है । पारिस्थितिक संवेदनशील अंचल का मानचित्र उपाबंध ' क ' पर है और पारिस्थितिक संवेदनशील अंचल में सुलतानपुर राष्ट्रीय उद्यान की सीमा के पांच किलोमीटर के भीतर आने वाले ग्राम की सूची निम्नानुसार है :
मनक्रोला, झंझरोला , मोहम्मदपुर, पातली , धनवास, वजीरपुर, धानी , रामनगर , सिखावला, घड़ीहारसरु , तुगलकपुर , दयाविहार , कलियावास , इकबालपुर , शैदपुर , खुंटावाश , हमरपुर , चंदू, ओमनगर , विधेड़ा, सुलतानपुर , हरसिंगवाली , धानी मिर्चीवाली धानी , सधराना , बरमरीपुर ।
सुलतानपुर राष्ट्रीय उद्यान में सभी क्रियाकलाप वन्य जीव (संरक्षण ) अधिनियम , 1972 ( 1972 का 53 ) के उपबंधों द्वारा शासित किए जा रहे हैं ।
2. पारिस्थितिक संवेदनशील अंचल के लिए आंचलिक मास्टर प्लान-
(i ) पारिस्थितिक संवेदनशील अंचल के लिए आंचलिक मास्टर प्लान राज्य सरकार द्वारा राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से और भारत सरकार के पर्यावरण और वन मंत्रालय के अनुमोदन से एक वर्ष की अवधि के भीतर तैयार किया जाएगा । आंचलिक मास्टर प्लान में सभी संबद्ध राज्य विभागों को सम्यक् रूप से सम्मिलित करके तैयार किया जाएगा जिसमें पर्यावरण , वन , शहरी विकास , पर्यटन , नगर पालिका विभाग , राजस्व विभाग सम्मिलित होंगे और इसमें पर्यावरणीय और पारिस्थितिकी विचारों को समन्वित करने के लिए हरियाणा राज्य प्रदूषण नियंत्रण बोर्ड भी सम्मिलित होगा । आंचलिक मास्टर प्लान में अनाच्छादित क्षेत्र को बनाए रखने , विद्यमान जल निकायों के संरक्षण , संलग्न क्षेत्रों के प्रबंध , जल प्रबंध , भूमिगत जल बहाव , मृदा और आर्द्रता संरक्षण , स्थानीय समुदाय की आवश्यकताएं और पारिस्थितिकी विज्ञान तथा पर्यावरण के ऐसे अन्य पहलुओं के लिए उपबंध है जिन पर ध्यान देने की आवश्यकता है ।
(ii) आंचलिक मास्टर प्लान सभी विद्यमान ग्राम स्थापन , वनों के प्रकार और किस्म, कृषि क्षेत्र , उर्वरक भूमि, हरित क्षेत्र , बागवानी क्षेत्र , बागानों, झीलों और अन्य जल निकायों का सीमांकन करेगा । हरित उपयोग से भूमि के उपयोग में जैसे बागान , बागवानी क्षेत्र , कृषि उद्यान और ऐसे ही अन्य स्थानों को गैर हरित उपयोग के लिए परिवर्तित करना तब के सिवाय आंचलिक मास्टर प्लान में राज्य सरकार के पूर्व

अनुमोदन के बिना अनुज्ञात नहीं किया जाएगा जब कृषि भूमियों का बिल्कुल सीमित संपरिवर्तन विद्यमान स्थानीय जनसंख्या के प्राकृतिक विकास के साथ विद्यमान स्थानीय निवासियों की आवासीय आवश्यकताओं को पूरा करने के लिए अनुज्ञात न किया गया हो । आंचलिक मास्टर प्लान राज्यस्तरीय मानीटरी समिति के लिए उनके द्वारा लिए जाने वाले किसी विनिश्चय के लिए जिसके अंतर्गत शिथिल करने के लिए विचार किया जाना भी है , एक संदर्भ दस्तावेज होगा ।
(iii) आंचलिक मास्टर प्लान , यातायात के विनियमन के लिए उपायों को उपदर्शित करेगा और अनुबंधों को अधिकथित करेगा ।
(iv) पारिस्थितिक संवेदनशील अंचल के लिए आंचलिक मास्टर प्लान की तैयारी का लंबित रहने और पर्यावरण और वन मंत्रालय द्वारा उसके अनुमोदन सभी नए संनिर्माण प्रस्तावों की संवीक्षा किए जाने और पैरा चार में यथानिर्दिष्ट मानीटरी समिति द्वारा अनुमोदन किए जाने के पश्चात् ही अनुज्ञात किया जाएगा । वन क्षेत्र , हरित क्षेत्र और कृषि क्षेत्र में कोई पारीणामिक कमी नहीं होगी । राज्य सरकार उद्देश्यों को आगे बढ़ाने और इस अधिसूचना के उपबंधों को प्रवृत्त करने के लिए अतिरिक्त उपाय , यदि आवश्यक हों, विहित करेगी ।
3. पारिस्थितिक संवेदनशील अंचल में विनियमित और निर्बंधित क्रियाकलाप-
( क ) औद्योगिक इकाइयां : -
I. सुलतानपुर राष्ट्रीय उद्यान की सीमा से दो किलोमीटर के भीतर नए काष्ठ आधारित उद्योग की स्थापना नहीं होगी
II. सुलतानपुर राष्ट्रीय उद्यान की सीमा से तीन किलोमीटर के भीतर किसी नए प्रदूषणकारी उद्योग की स्थापना नहींहोगी ।
III. सुलतानपुर राष्ट्रीय उद्यान की सीमा से पांच किलोमीटर के भीतर किसी नए उच्च प्रदूषणकारी उद्योग की स्थापना नहीं होगी ।
(ख ) संनिर्माण क्रियाकलाप: -
I. सुलतानपुर राष्ट्रीय उद्यान की सीमा से तीन सौ मीटर की दूरी तक एक हजार घन इंच से अनधिक की विमाओं के नलकूप चैंबर के सिवाय , किसी प्रकार का संनिर्माण अनुज्ञात नहीं किया जाएगा ।
II . सुलतानपुर राष्ट्रीय उद्यान की सीमा से तीन सौ मीटर से पांच सौ मीटर तक के क्षेत्र में दो मंजिला ( पच्चीस फीट) से अधिक किसी भवन का संनिर्माण अनुज्ञात नहीं किया जाएगा ।

III. सुलतानपुर राष्ट्रीय उद्यान की सीमा से पांच सौ मीटर की दूरी तक नया उच्च विभव पारेषण तार बिछाया जाना अनुज्ञात नहीं किया जाएगा ।
(ग ) उत्खनन और खनन:-
का प्रयोग करते हुए , इस अधिसूचना के उपबंधों का अनुपालन की निगरानी करने के लिए निगरानी समिति के नाम से ज्ञात एक समिति का गठन करती है । निगरानी समिति दस से अनधिक सदस्यों से मिलकर बनेगी । निगरानी समिति का अध्यक्ष एक सुख्यात व्यक्ति होगा जिसके पास सिद्ध प्रबंधकीय या प्रशासनिक अनुभव और स्थानीय मुद्ददों की समझ होगी । अन्य सदस्य निम्नलिखित होंगे:-

I सुलतानपुर राष्ट्रीय उद्यान के संरक्षित क्षेत्र की सीमा से एक किलोमीटर तक खनन कार्य अनुज्ञात नहीं किया जाएगा ।
भारत सरकार के पर्यावरण और वन मंत्रालय का एक प्रतिनिधि;
II. सुलतानपुर राष्ट्रीय उद्यान के संरक्षित क्षेत्र की सीमा से दो किलोमीटर तक संदलन क्रियाकलाप अनुज्ञात नहीं किया जाएगा ।
II. पर्यावरण ( धरोहर संरक्षण सहित ) के क्षेत्र में गैर- सरकारी संगठनों का एक प्रतिनिधि जो भारत सरकार द्वारा नामनिर्दिष्ट किया जाए;
(घ ) वृक्ष: -वन और राजस्व भूमि पर वृक्षों की कटाई भारत सरकार या इस प्रयोजन के लिए नामनिर्दिष्ट किसी प्राधिकारी द्वारा अनुमोदित प्रबंध योजना के अनुमोदन के अधीन रहते हुए की जाएगी ।
III. प्रादेशिक कार्यालय , हरियाणा राज्य प्रदूषण नियंत्रण बोर्ड, गुड़गांव;
IV. क्षेत्र का ज्येष्ठ नगर योजनाकार;
(ङ ) जल: -भूमिगत जल का निष्कर्षण केवल भूखण्ड के
उप वन संरक्षण (वन्य जीवन) गुड़गांव सदस्य सचिव; V.
VL उपायुक्त, गुड़गांव अध्यक्ष ।
अधिभोगी की सद्भावपूर्वक कृषि और घरेलू खपत के लिए अनुज्ञात किया जाएगा । राज्य भूमिगत जल बोर्ड के पूर्व अनुमोदन के शिवाय, भू-जल का क्रय अनुज्ञात नहीं किया जाएगा । जल के संदूषण या प्रदूषण को रोकने के लिए सभी उपाय जिसके अंतर्गत कृषि भी है, किए जाएंगे ।
(2) निगरानी समिति की शक्तियां और कृत्य केवल इस अधिसूचना के उपबंधों के अनुपालन तक निर्बंधित होंगे ।
(घ) ध्वनि प्रदूषण:-पर्यावरण विभाग या राज्य वन विभाग हरियाणा पारिस्थितिकी संवेदनशील अंचल में ध्वनि नियंत्रण के लिए मार्गदर्शक सिद्धांत और विनियम बनाने के लिए प्रधिकारी होगा ।
(छ) बहिस्रावों का निर्वहन पारिस्थितिकी संवेदनशील
(3 ) उन क्रियाकलापों की दशा में, जिनमें पूर्व अनुज्ञा या पर्यावरणीय अनुमति अपेक्षित है, ऐसे क्रियाकलाप राज्य स्तर पर्यावरण प्रभाव निर्धारण प्राधिकरण ( एसईआईएए ) को निर्दिष्ट किए जाएंगे जो पर्यावरण प्रभाव निर्धारण अधिसूचना तोरीख 14 सितम्बर, 2007 के उपबंधों के अनुसार ऐसी अनुमति देने के लिए सक्षम प्राधिकारी होगा ।
अंचल के भीतर किसी जल निकाय में कोई अनुपचारित या औद्योगिक बहिस्राव निर्गमन अनुज्ञात नहीं किया जाएगा । उपचारित बहिस्राव जल ( प्रदूषण निवारण तथा नियंत्रण ) अधिनियम, 1974 के उपबंधों कोपूरा करेंगे ।
(ज) ठोस अपशिष्ट:-ठोस अपशिष्ट का व्ययन समय-समय
(4) निगरानी समिति, मुद्दा दर मुद्दा आधार की अपेक्षाओं पर आश्रित रहते हुए उसके निष्कर्षों में सहायता करने के लिए संबद्ध विभागों या संगमों से प्रतिनिधियों या विशेषज्ञों को आमंत्रित कर सकेगी ।
(5) निगरानी समिति का अध्यक्ष सदस्य सचिव इस अधि- सूचना के उपबंधों के अननुपालन के लिए पर्यावरण ( संरक्षण ) अधि- नियम, 1986 की धारा 19 के अधीन परिवाद फाइल करने के लिए सक्षम होगा ।
पर यथासंशोधित केन्द्रीय सरकार द्वारा जारी अधिसूचना सं. का.आ. 908 (अ ) तारीख 25 सितम्बर, 2008 के अधीन नगर पालिक ठोस अपशिष्ट ( प्रबंध और हथालन ) नियम, 2000 के उपबंधों के अनुसार क्रियान्वन किया जाएगा । स्थानीय प्राधिकारी जैव निम्नीकरणीय और अजैव निम्नीकरणीय संघटकों में ठोस अपशिष्टों के संपृथकन के लिए योजना तैयार करेंगे । जैव निम्नीकरणीय सामग्री खाद बनाकर या क्रमित अधिमानतः खाद या कृषि खेती के माध्यम से पुनःचक्रित की जाएगी । अकार्बनिक सामग्री का व्ययन किसी पर्यावरणीय स्वीकृत रीति में पारिस्थितिकी संवेदनशील अंचल के बाहर चिन्हित किए गए स्थल पर किया जाएगा । पारिस्थितिकी संवेदनशील अंचल में ठोस अपशिष्टों का जलाना या भस्मीकरण अनुज्ञात नहीं किया जाएगा ।
(6) निगरानी समिति, प्रत्येक वर्ष पर्यावरण और वन मंत्रालय को 31 मार्च तक अपनी वार्षिक की गई कार्यवाही रिपोर्ट प्रस्तुत करेगी। मंत्रालय समय- समय पर निगरानी समिति के कृत्यों के लिए प्रभावी निर्वहन के लिए अपने निदेश दे सकेगी ।

from the boundary of the protected area of Sultanpur National Park enclosed within the boundary describedbe- low in the State of Haryana as the Eco - sensitive Zone (herein after called as the Eco- sensitive Zone), namely:-
1.Boundaries ofEco- sensitive Zone-The saidEco- sensitive Zone is the area up to five kilometers from the boundary ofthe protected area of Sultanpur National Park situated in the Gurgaon District of Haryana between 28° 24' 00" to 29 ° 32' 00 " North latitude and between 76° 48' 00" to 76°58' 00 " East longitude . The map ofthe Eco- sensitive Zone is at Annexure - A and the list of the villages falling within five kilometers distance of the boundary of Sultanpur National Park in the Eco- sensitive Zone are as follows:

The following draft ofa notification, which the Central Government proposes to issue in exer- cise ofthe powers conferred by sub- section ( 1 ) read with clause (v) and clause (xiv) ofsub - section (2) ofSection 3 of the Environment (Protection ) Act, 1986 (29 of 1986) is hereby published, as required under sub- rule (3 ) ofrule 5 ofthe Environment (Protection) Rules , 1986, for the infor- mation of the public likely to be affected thereby ; and notice is hereby given that the said draft notification shall betaken into consideration on or after the expiry of a pe- riod of sixty days from the date on which copies of the Gazette of India containing this notification are made avail- able to the Public;

2.Zonal Master Plan for the Eco-sensitive Zono- DraftNotification
Whereas the Sultanpur National Park ( about 15 km fromGurgaon and about 45 km from Delhi) Annexure A attracts a large number and variety of migratory birds dur- ing the winter migratory season . As regards biodiversity ofthisNational Park, the flora ofthis area is representedby semi arid vegetation outside it, and a typical aquatic veg- etation ofthe lakes in plains of North India.
Andwhereas, Sultanpur National Park is importan and known for aquatic avifauna where about 30,000 birds belonging to about 250 species have been listed in this park duringwinters . The important birds visiting this park are Pelicans , Cormorants , Herons , Egrets , Storks , Flamingoes, Geese, Ducks , etc. A number ofterritorial birds of Indian origin stay here the year round . Breeding ofSaras , Crane andtheRare Black Necked Stork have been recorded inthis park. This park falling in Gurgaon district ofHaryana is surrounded by Sultanpur village towards West, Chandu village towards East, Sadhrana village towards South East and Kaliwas towards the North ;
(1) A Zonal master Plan for the Eco-sensitive Zone shallbe prepared by the State Government within aperiod of one year from the date of publication ofthis notification in the Official Gazette and approved by the Ministry of Environment and Forests, Government of India. The ZonalMas- ter Plan shall be prepared with due involvement ofall concerned State Departments ofEnviron- ment, Forest, Urban Development, Tourism , Municipal Department, Revenue Department and Haryana State Pollution Control Board for integrating evironmental and ecological consid- erations into it. The Zonal Master plan shall pro- vide for restoration of denuded areas, conser- vation of existing water bodies , management of catchment areas , watershed management , groundwater management , soil and moisture conservation , needs of local community and such other aspects of the ecology and evironment that need attention .
And whereas, it is necessary to conserve and pro- tect the areaup to five kilometers from the boundary ofthe protected area of Sultanpur National Park as Eco- sensi- tive Zone from ecological and environmental point ofview;
(ii) The Zonal Master Plan shall demarcate all the existing village settlements , types and kinds of forests , agricultural areas , fertile lands, green areas, horticultural areas , orchards , lakes and otherwater bodies . No change of land use from green uses such as orchards , horticulture areas, agriculture parks and others like places tonon- green uses shall be permitted in the Zonal Mas- ter Plan, except that strictly limited conversion Now, therefore , in exercise of the powers conferred by sub- section ( 1 ) read with clause (v) and clause (xiv) of sub- section (2 ) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and sub-rule (3) ofrule 5 ofthe Environment (Protection) Rules , 1986, the Central Government hereby notifies the area up to five kilometers 6

(c) Quarrying and Mining :--
I. Mining up to one kilometer will not be allowed from the boundary of the protected area of Sultanpur National Park .
II . Crushing activity upto two kilometers will not be allowed from the boundary of the protected area of Sultanpur National Park .
of agricultural lands maybe permitted to meet the residential needs of the existing local resi- dents together with natural growth of the exist- ing local populations, without the prior approval of the State Government. The Zonal Master Plan shall be a reference document for the State LevelMonitoring Committee for any decision to be taken by them including consideration for relaxation .
(iii) The Zonal Master Plan shall indicate measures and lay down stipulations for regulation oftraf- fic.
(d) Trees :-Felling of trees on forest and revenue land should be subject to the approved management plan by the Government of India or an authority nominated for that purpose.
(e) Water :-Extraction of ground water shall be permitted only for the bona fide agricultural and domestic consumption of the occupier of the plot . No sale of ground water shall be permitted except with the prior approval of the State Ground Water Board . All steps shall be taken to prevent contamination or pollution of water including from agriculture .
(f) Noise Pollution :--The Environment Department or State Forest Department , Haryana shall be the authority to draw up guidelines and regulations for the control of noise in the Eco-sensitive Zone .
(iv) Pending the preparation of the Zonal Master Planfor Eco- sensitive Zone and approval thereof by the Ministry of Environment and Forests all new constructions shall be allowed only after the proposals are scrutinized and approved by the Monitoring Committee as referred in para- graph 4. There shall be no consequential reduc- tion in Forest area , Green area and Agricultural area . The State Government shall prescribe additional measures , ifnecessary, in furtherance of the objectives and for giving effect to the provisions of this notification.
3. Regulated or restrictive activities in the Eco- sensitive Zone-
(a) Industrial Units :-
(g) Discharge of Effluents :-No untreated or in- dustrial effluent shall be permitted to be discharged into any water body within the Eco- sensitive Zone . Treated effluent must meet the provisions of the Water (Preven- tion and Control ofPollution) Act , 1974.
I. No establishment of new wood based industry withintwo kilometers from the boundary of the Sultanpur National Park.
II . No establishment of any new polluting industry within three kilometers from the boundary of the Sultanpur National Park.
III. No establishment of any new highly polluting industry within five kilometers from the bound- ary of the Sultanpur National Park.
(b) Construction Activities :---
(h) Solid Wastes :-The solid waste disposal shall be carried out as per the provisions of the Municipal Solid Wastes (Management and handling) Rules , 2000 issued by the central Government vide notification number S.O. 908(E), dated the 25th September , 2000 and amended from time to time. The local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non -biodegradable components . The biodegradable material may be recycled preferably through composting orvermiculture . The inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco- sensitive Zone . No burning or incinera- tion of solid wastes shall be permitted in the Eco - sensitive Zone.
4.Monitoring Committee:-
L. From the boundary of Sultanpur National Park to a distance of three hundred meters , no con- struction of any kind will be allowed except tube well chamber of dimension not more than one thousand cubic inches .
II. In the area falling between three hundred meters to five hundred meters from the boundary of Sultanpur National Park, construction of any building more thatn two storey ( twenty five ft) will not be allowed.
( 1) In exercise of the powers conferredby sub- section (3 ) of Section 3 of the Environment (protection) Sct 1986 (29 of 1986) , the Central Government hereby consti- tutes a committee to be called the Monitoring Committee to monitor the compliance with the provisions of this notifica- tion . The Monitoring Committee shall consist of not more than ten members . The Chairman of the Monitoring Commit- tee shall be an eminent person with proven managerial or administrative experience and understanding of local issues . The other members shall be :--
III . From the boundary of Sultanpur National Park to a distance of five hundred meters , laying of new high tension transmission wire will not be allowed.

(2) The powers and functions of the Monitoring Committee shall be restricted to the compliance ofthe pro- visions of this notification only .
(3) In case ofactivities requiring prior permission or environmental clearance , such activities shall be referred to the State Level Environment Impact Assessment Authority ( SEIAA ) , which shall be the Competent Authority for grant of such clearances as per the provi- sions of the Environmental Impact Assessment Notifica- tion , dated the 14th September, 2007.
(4) The Monitoring Committee may also invite repre- sentatives or experts from concerned Departments or Associations to assist in its deliberations depending on the requirements on issue to issue basis .
(5) The Chairman or Member Secretary ofMonitor- ing Committee shall be competent to file complaints under Section 19 of the Environment (Protection ) Act, 1986 for non-compliance of the provisions of this noification .
(6) The Monitoring Committee shall submit its annual action taken reports by the 31st March'of every year to the Ministry of Environment and Forests . The Ministry shall give its directions from time to time for effective discharge of the functions of the Monitoring Committee.
