का.आ. 371(अ). जबकि केन्द्रीय शैक्षिक संस्था अधिनियम , 2006 ( दाखिले में आरक्षण ) ( यहाँ इसे उक्त अधिनियम कहां जाए ) को केन्द्र सरकार द्वारा स्थापित , अनुरक्षित अथवा सहायता प्राप्त केन्द्रीय शैक्षिक संस्थाओं में अनुसूचित जाति , अनुसूचित जन जाति तथा अन्य पिछड़े वर्गों के छात्रों के दाखिले में आरक्षण के लिए तथा इससे संबंधित आनुषंगिक मामलों के लिए अधिनियमित किया गया । उक्त अधिनियम 3 जनवरी , 2007 से प्रभावी हुआ ।
और जबकि उक्त अधिनियम की धारा 5 की उप- धारा ( 1 ) के अनुसार प्रत्येक केन्द्रीय शैक्षिक संस्था, धारा 3 के खण्ड ( iii ) में तथा प्रभावी समय अवधि के लिए अन्य किसी विधान में निहित प्रावधानों के अनुसरण में उचित प्राधिकरण के पूर्व अनुमोदन से अपनी वार्षिक अनुमोदित कुल संख्या तक अध्ययन की किसी शाखा अथवा संकाय की सीटों की संख्या में वृद्धि करेगी ताकि अनुसूचित जाति, अनुसूचित जन जाति तथा अन्य पिछड़े वर्गों के व्यक्तियों के लिए आरक्षित सीटों के अलावा सीटों की संख्या, उक्त अधिनियम के प्रभावी होने की तारीख से पूर्ववर्ती शैक्षिक सत्र के लिए उपलब्ध सीटों की संख्या से कम न हो ।
और जबकि उक्त अधिनियम की धारा 5 की उप- धारा ( 2 ) में यह प्रावधान है कि " किसी केन्द्रीय शैक्षिक संस्था के प्रतिवेदन पर , केन्द्र सरकार उचित प्राधिकरण की सलाह से शैक्षिक संस्था की वित्तीय , भौतिक अथवा शैक्षिक बाध्यताओं के कारणों से संतुष्ट है अथवा शिक्षा के स्तरों के रखरखाव के उद्देश्य से उक्त संस्था में अध्ययन की किसी भी शाखा अथवा संकाय की वार्षिक अनुमोदित

संख्या की इस अधिनियम के अधिनियमित होने से पहले शैक्षिक सत्र के लिए बढ़ाया नहीं जा सकता । शासकीय राजपत्र में अधिसूचना देकर केन्द्र सरकार उस संस्था को इस अधिनियम के अधिनियमित होने से पहले शैक्षिक सत्र के शुरू होने से तीन वर्ष की अधिकतम अवधि में वार्षिक अनुमोदित संख्या में वृद्धि करने की अनुमति दे सकती है तथा तत्पश्चात् धारा 3 के खण्ड ( iii ) में यथाप्रपत्र अन्य पिछड़े वर्गों के लिए आरक्षण की सीमा उस तरीके से उस शैक्षिक सत्र के लिए सीमित होगी कि प्रत्येक शैक्षिक सत्र के लिए अन्य पिछड़े वर्गों हेतु उपलब्ध सीटों की संख्या प्रत्येक वर्ष के लिए अनुमोदित संख्या में वृद्धि के अनुरूप होगी । "
और जबकि, अपनी वार्षिक अनुमोदित संख्या से अधिक सीटों की संख्या में वृद्धि करने के लिए निम्नलिखित तालिका में विनिर्दिष्ट संस्थाओं द्वारा प्रतिवेदन किए गए हैं ।
और जबकि केन्द्र सरकार विश्वविद्यालय अनुदान आयोग जो एक उपयुक्त प्राधिकरण है के साथ उक्त अधिनियम की धारा 2 के खण्ड ( ग ) के संदर्भ में परामर्श से शैक्षिक संस्था की वित्तीय , भौतिक तथा शैक्षिक बाध्यताओं के कारणों से आश्वस्त है अथवा शिक्षा के स्तरों के अनुरक्षण के उद्देश्यार्थ उक्त संस्था में अध्ययन की किसी भी शाखा अथवा संकाय की वार्षिक अनुमोदित संख्या की इस अधिनियम के प्रभावी होने से पहले शैक्षिक सत्र के लिए बढ़ाया नहीं जा सकता ।
अतएव अब केन्द्र सरकार , विश्वविद्यालय अनुदान आयोग जो उचित प्राधिकरण है , के साथ परामर्श से उक्त अधिनियम की धारा 5 की उप - धारा ( 2 ) में प्रदत्त शक्तियों को प्रयुक्त करते हुए निम्न तालिका में उल्लिखित संस्थाओं को उक्त अधिनियम के प्रभावी होने कीतारीख से पहले शैक्षिक सत्र के लिए उक्त अधिनियम की धारा 3 के प्रावधानों के अनुसरण में आरक्षण को बढ़ाने के प्रयोजनार्थ तीन. वर्ष की अधिकतम अवधि के अध्ययन की प्रत्येक शाखा अथवा संकाय में अपनी वार्षिक अनुमोदित संख्या में वृद्धि करने की अनुमति प्रदान करती है ।

session following the commencement ofthis Act, the Central Government may permit by notification in the Official Gazette, such institution to increase the annual permitted strength over a maximum period of three years beginning withacademic session following the commencement ofthis Act; and then, the extent of reservation for the Other Backward Classes as provided in clause (iii ) of Section 3 shall be limited for that academic session in such manner thatthe number of seats available to the Other Backward Classes for each academic session are commensurate with the increase in the permitted strength for each year" ;

NOTIFICATION
And, whereas , the Central Government, in consultation with the University Grants Commission , who , being the appropriate authority , referred to in clause (c) of Section 2 of the said Act , is satisfied that for reasons of financial , physical or academic limitations and in order to maintain the standards of education , the annual permitted strength , in all branches of study of faculty of such institutions cannot be increased for the academic session following the commencement of the said Act; New Delhi , the 30th January , 2009
S.O. 371 (E) . Whereas , the Central Educational Institutions ( Reservation in Admission) Act , 2006 (hereinafter referred to as the said Act) has been enacted to provide for the reservation in admission of the students belonging to the Scheduled Castes , the Scheduled Tribes and the Other Backward Classes of citizens , to certain Central Educational Institutions established , maintained or aided by the Central Government , and for matters connected therewith or incidental thereto . The said Act has come into force with effect from the 3rd January, 2007;
Now, therefore, the Central Government , in consultation with the University Grants Commission, who, being the appropriate authority, in exercise of the powers conferred under sub - section (2 ) of Section 5 of the said Act , hereby permits the institutions mentioned in the Table below to increase their annual permitted strength in each branch of study or faculty over a maximum period ofthree years for the purpose of extending reservation in accordance with the provisions of Section 3 of the said Act for the academic session immediately preceding the date of commencement of the said Act .

And, whereas , as per sub - section ( 1 ) of Section 5 of the Act , every Central Educational Institution shall , notwithstanding anything contained in clause (iii) of Section 3 and in any other law for the time being in force , with the prior approval of the appropriate authority , increase the number of seats in a branch of study or faculty over and above its annual permitted strength so that the number of seats , excluding those reserved for the persons belonging to the Scheduled Castes , the Scheduled Tribes and the Other Backward Classes , is not less than the number of such seats available for the academic session immediately preceding the date of the coming into force of the said Act ;
