S.O. 372(E). In exercise of the powers , conferred by paragraphs 9 and 11 of the Drugs (Prices Control) Order, 1995 read with S.O. 637 (E), dated the 4th September , 1997 issued by the Government of India, Ministry of Chemicals and Fertilizers , the National Pharmaceutical Pricing Authority hereby notifies that any formulation/ composition not covered in the table of standing orders issued by the NPPA that has any scheduled drug as one of its ingredients , shall be subject to the price ceiling mentioned at the respective serial number ofthe respective notification, as the case may be, unless the manufacturer has subsequently got a specific price fixed by the NPPA for that formulation/composition.
का.आ. 372( अ ).-राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण , भारत सरकार के रसायन और उर्वरक मंत्रालय द्वारा जारी का.आ. 637 ( अ) , तारीख 4 सितम्बर , 1997 के साथ पठित औषध (कीमत नियंत्रण ) आदेश , 1995 के पैरा 9 और पैरा 11 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एतद्वारा अधिसूचित करता है कि कोई भीफॉर्मूलेशन/संयोजन जिसमें इसके घटकों में से कोई एक अनुसूचित औषध हो एवं जो एनपीपीए द्वारा जारी स्थायी आदेशों की सारणी में सम्मिलित नहीं हैं , वे संबंधित अधिसूचनाओं के संबंधित क्रमांक पर दर्शाये उच्चतम मूल्य की शर्त के अधीन होंगे , जैसा भी मामला हो , जब तक कि उक्तफॉर्मूलेशन/संयोजन के लिए विनिर्माता ने तत्पश्चात् एनपीपीए द्वारा निर्धारित विशेषीकृत मूल्य प्राप्त नहीं कर लिया है ।
The manufacturer or marketing company not complying with the ceiling prices and the condition specified in the respective notification shall be liable to deposit the overcharged amount alongwith interest under the provision ofDrug Price Control Order, 1995 read with theEssential Commodities Act, 1995 .
विनिर्माता या विपणन कम्पनी, सम्बन्धित अधिसूचना में दर्शाये उच्चतम मूल्यों और शतों का पालन नहीं करती हैं तो , वे आवश्यक वस्तुएं अधिनियम, 1955 के साथ पठित डीपीसीओ, 1995 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित राशि को जमा करने के लिए दायी होंगे।
