[फा. सं. ए.वी. 11012/11 /2005-ए] आर. के. सिंह , संयुक्त सचिव सा.का.नि. 68(अ).-केन्द्र सरकार , वायुयान अधिनियम, 1934 ( 1934 का 22 ) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए वायुयान नियम , 1937 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , नामशः :-
1. ( 1 ) इन नियमों को वायुयान (द्वितीय संशोधन ) नियम, 2009 कहा जाएगा ।
टिप्पण:-( 1 ) मूल नियम भारत के राजपत्र में अधिसूचना संख्या वी-26, तारीख 23 मार्च , 1937 के द्वारा प्रकाशित किए गए थे और अंतिम संशोधन भारत के राजपत्र के भाग II , खंड ( 3 ) , उप-खंड ( i ) में प्रकाशित सा.का.नि. 21 ( अ ) , तारीख 9-1-2009 द्वारा किया गया था ।
(2) ये सरकारी राजपत्र में अंतिम प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. वायुयान नियम , 1937 में , अनुसूची II में ,-
(1) अनुभाग ज, पैरा 1 में , खंड ( ज) में, " आवेदन की तारीख से ठीक पूर्ववर्ती छह माह की अवधि के भीतर सक्षमता में प्रकट करनी होगी " शब्दों के स्थान पर निम्नलिखित प्रतिस्थापित किए जाएंगे , नामशः :-
(2) केन्द्र सरकार ने वायुयान अधिनियम, 1934 ( 1934 का 22) के खंड 14 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए नागर विमानन मंत्रालय द्वारा जारी तारीख 30 जनवरी , 2009 के अपने आदेश सं. ए,बी. 11012/ 11 /2005 - ए द्वारा इस अधिसूचना के मामले में पूर्व प्रकाशन की शर्तों से जनहित में छूट दी है ।

" आवेदन की तारीख से ठीक पूर्ववर्ती छह माह की अवधि के भीतर तथापि महानिदेशक , कौशल परीक्षण या उसके भाग को , वायुयान की किस्म के लिए वायुयान/अनुमोदित शून्य उड़ान समय प्रशिक्षण सिमुलेटर स्तर ' घ ' पर संचालित करने की अनुज्ञा दे सकेंगे । सक्षमता का प्रदर्शन में करना होगा - "
G.S.R. 68(E) .-In exercise of the powers conferred by Section 5 of the Aircraft Act, 1934 (22 of 1934 ) , the Central Government hereby makes the following rules further to amend the Aircraft Rules , 1937, namely :-
(2) अनुभाग ड में पैराग्राफ 1 में, खंड ( छ ) के वर्तमान मूल पाठ के अंत में, निम्नलिखित शब्द अंतःस्थापित किए जाएंगे , नामशः :
1. (1) These rules may be called the Aircraft (2nd Amendment) Rules, 2009.
" तथापि , महानिदेशक, कौशल परीक्षण या उसके भाग को, वायुयान की किस्म के लिए वायुयान/
(2)They shall come into force on the date oftheir final publication in the Official Gazette.

2. In the Aircraft Rules , 1937, in Schedule II ,-
(1) in Section J, in paragraph 1 , in clause (h), for the words " within a period of six months immediately preceding the date of application . The competency shall be demonstrated in-", the following shall be substituted , namely :----
"within a period of six months immediately preceding the date of application . The Director General may , however , allow Skill Test or part thereof to be carried out on aircraft/approved Zero Flight Time Training simulator level ' D ' for the type of aircraft . Thecompetency shall be demonstrated as in "
(2) in Section M, in paragraph 1 , in the end of existing text of clause (g) , the following words shall be inserted , namely :-
"The Director General may , however , allow skill tests or part thereof to be carried out on

aircraft/ approved Zero Flight Time Training simulator level ' D ' for the type of aircraft. "

Note: ( 1 ) The principal rules were published in the Official Gazette vide notification number V-26, dated the 23rd March, 1937 and last amended by G.S.R. 21 (E ), dated 9-1-2009 published in Part II, Section 3, Sub - section ( i ) ofthe Gazette of India .
(2) The Central Government in exercise of the powers conferred by proviso to Section 14 of theAircraft Act, 1934 (22 of 1934) has in the public interest dispensed with the condition of previous publication in case of the notification vide its Order No. AV . 11012/ 11 / 2005 -A, dated 30th January , 2009 issued in the Ministry of Civil Aviation .
