भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( कार्य
संचालन ) संशोधन विनियम , 2009 सं. भाराराप्रा/बीएम-11041 /98/2008-प्रशासन,- भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 7 के साथ पठित धारा 35 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय राष्ट्रीय राजमार्ग प्राधिकरण , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (कार्य संचालन) विनियमावली, 1997 में संशोधन करने के लिए एतद्वारा निम्नलिखित विनियम बनाता है , अर्थात्:-
1. (1) ये विनियम भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( कार्य संचालन ) , संशोधन विनियम , 2009 कहलाएंगे ।
(2) ये विनियम राजपत्र में प्रकाशन की तारीख से प्रवृत
होंगे ।
2. भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( कार्य संचालन ) विनियम , 1997 के विनियम 4 के स्थान पर , निम्नलिखित विनियम प्रतिस्थापित किया जाएगा , अर्थात्
"4. कोरम:
(1) प्राधिकरण की कोई बैठक तब तक वैध और मान्य नहीं होगी जब तक
(1) दो तिहाई पूर्णकालिक सदस्य बैठक में भाग न लें, बशर्ते, यदि पूर्णकालिक सदस्यों की दो अथवा अधिक , परन्तु चार से कम रिक्तियाँ हैं, तब कम से कम

शेष दो पूर्णकालिक सदस्य बैठक में भाग लेंगे और यदि पूर्णकालिक सदस्यों की चार अथवा अधिक रिक्तियाँ हैं , तब सभी शेष पूर्णकालिक सदस्य बैठक में भाग लेंगे; और
(i ) तीन चौथाई अंशकालिक सदस्य बैठक में भाग न लें, बशर्ते , यदि अंशकालिक सदस्य की एक रिक्ति है, तब शेष तीन अंशकालिक सदस्यों में से कम से कम दो सदस्य बैठक में भाग लेंगे और यदि दो रिक्तियाँ हैं , तब शेष दो अंशकालिक सदस्यों में से , कम से कम एक सदस्य बैठक में भाग लेगा ।
(2) कार्यसूची की मदें, जिन पर निर्णय लिया जाना अपेक्षित है, प्राधिकरण की बैठक आयोजित होने से कम से कम सात दिन पहले परिचालित कर दी गई हों । " ।

The National Highways Authority of India (Transaction ofBusiness ) Amendment Regulations , 2009
No. NHAI/BM - 11041 /98/2008 - Admn . In exercise of the powers conferred by Section 35 , read with Section 7 , of the National Highways Authority of India Act, 1988 (68 of 1988 ) , the National Highways Authority of India hereby makes the following regulations further to amend the National Highways Authority of India (Trans- action ofBusiness ) Regulations , 1997 , namely:-
1. ( 1 ) These regulations may be called the National Highways Authority of India (Transaction of Business ) Amendment Regulations , 2009.
(2) They shall come into force on the date oftheir publication in the Official Gazette .
2. For regulation 4 of the National Highways Authority of India (Transaction of Business) , Regulations , 1997, the following regulation shall be substituted , namely:-
"4. Quorum:
(1) No meeting of the Authority is to be considered legal and valid unless-
(1) attended by two- third of the full -time members , subject to the condition that if there are two or more but less than four vacancies of the full- time members , then at least two remaining full- time members shall attend the meeting and ifthere are four or more vacancies of full -time members , all the remaining full - time members shall attend the meeting; and
(ii) attended by three- fourth of the part - time mem- bers, subject to the condition that if there is one vacancy in the part-time members , then at least two ofthe remaining three part - time members shall attend the meeting and if there are two vacan- cies , then at least one of the remaining two part- time members shall attend the meeting.
(2) The agenda papers for decision required should have been circulated at least seven days before the scheduled meeting of the Authority . " .
