सा.का.नि. 74(अ).-अण्डमान और निकोबार द्वीप समूह ( पंचायत) विनियम, 1994 ( 1994 का 1 ) की धारा 185 की उप - धारा ( 2 ) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , राष्ट्रपति एतद्वारा अण्डमान और निकोबार द्वीप समूह ( चुनाव आयुक्त की सेवा शर्तें) नियम , 1994 में संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. ( 1 ) इन नियमों को अण्डमान और निकोबार द्वीप समूह ( चुनाव आयुक्त की सेवा शर्तें) ( संशोधन ) नियम, 2009 जाएगा ।
(2 ) ये 1 जनवरी , 2006 से लागू हुए माने जाएंगे ।
2. अण्डमान और निकोबार द्वीप समूह ( चुनाव आयुक्त की सेवा शर्तें) नियम , 1994 में, नियम 4 में " 26000 रु. (छब्बीस हजार रुपये मात्र ) " शब्दों, अंकों और कोष्ठकों के स्थान पर " 80000 रु. ( अस्सी हजार रुपये मात्र ) " शब्दों, अंकों और कोष्ठकों को प्रतिस्थापित किया जाएगा ।

टिप्पण : प्रधान नियम भारत के राजपत्र में सा.का.नि. 794( अ ) , दिनांक 9 नवम्बर , 1994 के अंतर्गत प्रकाशित तत्पश्चात्सा.का. नि. 575 ( अ ) , दिनांक10 सितम्बर, 1998 के अंतर्गत संशोधित किए गए थे ।
स्पष्टीकरण ज्ञापन
यह स्पष्ट किया जाता है कि चुनाव आयोग एक सदस्यीय आयोग है और नियम 4 के उपबंधों से संघ राज्य क्षेत्र अण्डमान एवं निकोबार द्वीप समूह के चुनाव आयोग के किसी अन्य सदस्य पर भूतलक्षी प्रभाव से कोई प्रतिकूल प्रभाव पड़ने की संभावना नहीं है ।

NOTIFICATION
New Delhi , the 4th February , 2009
GS.R. 74 (E) . In exercise of the powers conferred by sub -section (2) of Section 185 of the Andaman and Nicobar Islands (Panchayats ) Regulation, 1994 ( 1 of 1994) , the President hereby makes the following rules further to amend the Andaman and Nicobar Islands (Election Commissioner's Conditions of Service) Rules , 1994 , namely :-
1. ( 1) These rules may be called the Andaman and Nicobar Islands (Election Commissioner's Conditions of Service ) Amendment Rules , 2009 .
(2) They shall be deemed to have come into force on the 1st January, 2006.
2. In the Andaman and Nicobar Islands (Election Commissioner's Conditions of Service ) Rules , 1994, in rule 4, for the words , figures and brackets , "Rs . 26,000 ( Rupees twenty six thousand only) " , the words , figures and brackets " Rs . 80,000 (Rupees eighty thousand only) " shall be substituted .

Note : The Principal rules were published in the Gazette of India , Extraordinary vide Number G.S.R. 794 (E) , dated the 9th November , 1994 and subsequently amended vide number G.S.R. 575 (E), dated the 10thSeptember , 1998 .
EXPLANATORY MEMORANDUM
It is clarified that the Election Commission is a single member Commission, and that the provisions of rule 4 are not likely to have any adverse effect on any other member of the Election Commission of the Union Territory of the Andaman and Nicobar Islands by its retrospective effect .
