सा.का.नि. 73(अ).-बीड़ी कर्मकार कल्याण निधि नियम , 1978 का और संशोधन करने के लिये कतिपय नियमों का निम्नलिखित प्रारूप जिसे केन्द्रीय सरकार बीड़ी कर्मकार कल्याण निधि अधिनियम , 1976 ( 1976 का 62 ) की धारा 12 की उप- धारा ( 2 ) के खंड ( च ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और संशोधन करना चाहती है , उन सभी व्यक्तियों की जानकारी के लिए, प्रकाशित किया जाता है , जिनके उससे प्रभावित होने की संभावना है; और यह सूचना दी जाती है कि उक्त प्रारूप नियम पर उस तारीख से, जिसको इस अधि- सूचना से युक्त भारत के राजपत्र की प्रतियां जनता को उपलब्ध कराई जाती हैं , पैंतालिस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा;
ऐसे आक्षेप और सुझावों पर , जो उक्त प्रारूप नियमों के संबंध में किसी व्यक्ति से ऊपर विनिर्दिष्ट अवधि के अवसान पर या उसके पूर्व प्राप्त हो सकेंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
आक्षेप या सुझाव , यदि कोई हों, महानिदेशक, ( श्रम कल्याण ) 26, जैसलमेर हाउस , मान सिंह रोड , नई दिल्ली -110011 को भेजे जा सकेंगे ।
प्रारूप नियम
1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम बीड़ी कर्मकार कल्याण निधि ( संशोधन ) नियम , 2008 है;

2. बीड़ी कर्मकार कल्याण निधि नियम, 1978 के नियम 3 के उप-नियम ( 1 ) , के खंड ( क) , के उप- खंड ( ii ) के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्:---
" ( ii ) सरकार द्वारा दो उपाध्यक्ष नामनिर्दिष्ट किए जाएंगे जिनमें से एक केन्द्रीय सरकार का अधिकारी होगा पदेन; और दूसरा या तो नियोजकों का प्रतिनिधि होगा अथवा बीड़ी स्थापनों में लगे हुए व्यक्तियों का प्रतिनिधि होगा; "

टिप्पण. मूल नियम भारत के राजपत्र में सं. सा.का.नि. 1232 तारीख 25 सितम्बर, 1978 द्वारा प्रकाशित किए गए थे और तत्पश्चात् निम्नलिखित द्वारा उनमें संशोधन किए गए :-
( i ) सा.का.नि. 703 , तारीख6-8-1982;
(ii ) सा.का.नि. 750 , तारीख 22-9-1989 ;
(iii) सा.का.नि. 40( अ ) , तारीख 22-1-1991 ;
(iv) सा.का.नि. 78 (अ ) , तारीख 19-2-1988 ; और
(v) सा.का.नि. 328 ( अ) , तारीख 11-4-20001

NOTIFICATION
New Delhi , the 4th February, 2009
G.S.R. 73(E) . The following draft ofcertain rules which the Central Government proposes to make further to amend the Beedi Workers Welfare Fund Rules , 1978 , in exercise ofthepowers conferred by clause (f) ofsub-section (2) of Section 12 ofthe Beedi Workers Welfare Fund Act, 1976 (62 of 1976), are hereby published for information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration on or after the expiry of a period of forty five days from the date onwhich copies of the Official Gazette containing the said notification are made available to the public.
Any objections or suggestions , which may be received from any persons with respect to the said draft rules on or before the expiry of the period specified above , will be considered by the Central Government .
The objections or suggestions , if any, may be sent to the Director General (Labour Welfare) , 26, Jaisalmer House,Man Singh Road, New Delhi - 110011.
DRAFT RULES
1. Short title and commencement. ( 1 ) These rules may be called the Beedi Workers Welfare Fund (Amendment) Rules, 2008 ;
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Beedi Workers Welfare Fund Rules , 1978 , inrule 3 , in sub-rule (1 ) , in clause (a), for sub-clause ( ii) , the following shall be substituted, namely :---
"(ii) two Vice Chairmen to be nominated by the Government, out of which one shall be an officer of the Central Government, ex- officio; and the other either a representative of the employers or a representative of the persons engaged in beedi establishments; "
