सा.का.नि. 76(अ).-केन्द्र सरकार , महापत्तन न्यास अधिनियम , 1963 (1963 का 38 ) की धारा 132 की उप- धारा ( 1 ) के साथ पठित धारा 124 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , नव मंगलूर पत्तन न्यास के न्यासी मंडल द्वारा बनाए गए और इस अधिसूचना के साथ संलग्न अनुसूची में दिए गए नव मंगलूर पत्तन न्यास ( आवासों का आबंटन ) संशोधन विनियम, 2008 का अनुमोदित करती है ।
(2) उक्तविनियम भारत के राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
अनुसूची
पत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , नव मंगलूर पत्तन न्यास का न्यासी मंडल नव मंगलूर पत्तन न्यास (आवासों का आबंटन ) विनियम , 1980 में पुनः संशोधन करते हुए निम्नलिखित विनियम बनाता है:
1. इन विनियमों को नव मंगलूर पत्तन न्यास ( आवासों का आबंटन ) संशोधन विनियम , 2008 कहा जाएगा ।
2. उक्त विनियम भारत के राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे । नव मंगलूर पत्तन न्यास ( आवासों का आबंटन) विनियम, 1980 में विनियम 4 उप विनियम ( 1 ) खंड ( ग ) की जगह निम्नलिखित प्रतिस्थापित होंगे , अर्थात्:-

" (ग ) कर्मचारी , जिन्होंने मंडल से गृह निर्माण पेशगी सुविधा लेकर कार्यस्थल से 8 कि. मी . रेडियस की दूरी के अंदर बनाए. अपने घर को बेच दिया हो , को अपने घर बेचने के बाद दो वर्ष तक की अवधिके लिए उच्च वर्ग के आवास अर्थात् टाइप II ( पुराने ) व उससे उच्च टाइप के आवासों के आबंटन के संदर्भ में और यदि घर बेचने के समय पहले से वे टाइप II (पुराने ) व उससे उच्च टाइपके आवासों में रह रहे हों तो घर बेचने की तिथि से एक माह के अदर उसे आवास खाली करना होगा । "

G.S.R. 76(E) .-In exercise of the powers conferred by sub -section( 1) of Section 124 read with sub -section (1 )

of Section 132 of the Major Port Trusts Act, 1963 ( 38 of 1963 ), the Central Government hereby approves that New Mangalore Port Trust (Allotment of Residences ) Amendment Regulations , 2008 made by the Board of Trustees ofthe New Mangalore Port Trust as set out in the Schedule annexed to this notification .
2. The said regulations shall come into force on the dateofpublication ofthis notification in the Official Gazette.
SCHEDULE
Inexercise ofthe powers conferred by Section 28 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Board of Trustees of the New Mangalore Port Trust hereby makes the following regulations further to amend the New Mangalore Port Trust ( Allotment of Residences) Regulations , 1980 , nemely :-
1. These Regulations may be called the New Mangalore Port Trust (Allotment of Residences ) Amendment Regulations , 2008 .
2. They shall come into force on the date of their publication in the Official Gazette . In the New Mangalore PortTrust (Allotment of Residences) Regulations , 1980 , in regulation 4, in sub - regulation ( 1 ) , for clause ( c) , the

following shall be substituted, namely :-
"( c) he , when permitted , has disposed of the house constructed by him within a radius of eight kilometers fromthe place of work having availed the facility of house building advance from the Board, for higher type of quarters , that is , type II (Old) and above for a period of two years from the date of disposal and if he is already residing in the higher type of quarter , that is , type II (Old) and above at the time of disposal , he shall vacate the said quarter within one month from the date ofdisposal . "
