का.आ. 403(अ).-केन्द्रीय सरकार ने , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है , की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल परिवहन और राजमार्ग मंत्रालय ( सड़क खंड ) की अधिसूचना संख्यांक का.आ. 78 ( अ) तारीख 4 फरवरी , 1999 , और पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय ( सड़क परिवहन और राजमार्ग विभाग ) द्वारा गुजरात और महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग सं. 8 के 0.00 कि. मी.से 381.600 कि.मी. और 381.600 कि.मी. से 502.27 कि.मी. , तक के भूखंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् प्राधिकरण कहा गया है ) को सौंपा था;
और भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा खण्ड 263.40 कि.मी. से 502 कि.मी. के खण्ड का निर्माण और विकास किया गया तथा उक्त खण्ड पर उपयोक्ताओं से फीस संग्रहण भारत सरकार द्वारा जारी की गई पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्यांक का.आ. 91 ( अ ) तारीख 15 जनवरी , 2004 , संख्यांक का.आ. 605 ( अ ) तारीख 2 मई , 2005 , संख्यांक का.आ. 645 ( अ ) तारीख 5 मई 2005 और संख्यांक का.आ. 1126( अ ) तारीख 9 मई 2008 , भारत के राजपत्र, असाधारण , भाग- II , खण्ड-3 , उप- खण्ड ( ii ) में प्रकाशित , के अनुसरण में होगा ।
और प्राधिकरण ने उक्त अधिनियम की धारा 14 द्वारा प्रदत्त शक्तियों के अनुसरण में राष्ट्रीय राजमार्ग संख्या 8 पर 263.000 कि.मी. से 502.000 कि.मी. तक के विद्यमान चार लेन वाले भाग को चौड़ा करने के लिए और छः लेन बनाने और विकास के लिए आई आर बी सूरत दाहीसर टौलवे प्राइवेट लिमिटेड, जिसका रजिस्ट्रीकृत कार्यालय कॉम्प्लेक्स, चाँदीवली फार्म, चाँदीवली गाँव , अन्धेरी ( ईस्ट) मुम्बई -400072 ( जिसे इसमें इसके पश्चात् " रियायतग्राही " कहा गया है ) के साथ करार जिसे इसमें इसके पश्चात् उक्त करार कहा गया है, किया है ।
अतः अब , केंद्रीय सरकार , राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्ग सेक्शन/राष्ट्रीय राजमार्गों पर स्थायी पुल/अस्थायी पुल के उपयोग के लिए किसी व्यक्ति द्वारा फीस का संग्रहण ) नियम , 1997 के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा 7 और ४क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त राष्ट्रीय राजमार्ग के खंडों के निर्माण , अनुरक्षण , प्रबंध और प्रचालन में अंतर्ग्रस्त व्यय , विनिघात पूंजी पर ब्याज , युक्तियुक्त प्रत्यागम , यातायात परिमाण और करार की अवधि को ध्यान में रखते हुए , यह अधिसूचित करती है कि उक्त खंड के उपयोग के लिए यांत्रिक यानों पर इसमें उपाबद्ध अनुसूची में विनिर्दिष्ट दरों पर फीस उद्ग्रहीत और संदत्त की जाएगी और उक्त रियायतग्राही को नियत दिन या इस अधिसूचना के राजपत्र में प्रकाशन इनमें से जो पश्चात् हो , की तारीख से ही उक्त करार में यथाविनिर्दिष्ट समाप्ति की तारीख तक फीस संग्रहीत करने और प्रतिधारित करने के लिए प्राधिकृत करती है ।

अनुसूची
रियायतग्राही नीचे दी गई सारणी के स्तंभ (2) में विनिर्दिष्ट यांत्रिक यानों पर उक्त खंड के उपयोग के लिए उक्त सारणी के स्तंभ (3 ) में विनिर्दिष्ट आधार फीस की दर पर फीस संग्रहीत और प्रतिधारित करेगा ।
फीस पथकर प्लाजा पर 297.300 कि.मी. (भोराच) , 356.200 कि.मी. ( भागवाडा) , 420.340 कि.मी. (चारोटी) , और 470.000 कि.मी. ( खानेवाडी) पर संग्रहीत की जाएगी ।

टिप्पणः-
1. इस अधिसूचना के प्रयोजनो के लिए : -
(i) "वास्तविक फीस " से निम्नलिखित आधार पर उक्त खंड के सड़क प्रयोक्ताओं से प्रभारित वास्तविक फीस अभिप्रेत है
परियोजना राजमार्ग की लम्बाई, (क)
इस आधिसुचना की सारणी में दी गई आधार फीस , (ख) और जो एक रूपये के निकटतम पूर्णांक में होगी ।
(ii)
" नियत की तारीख से वह तारीख जिस दिन से रियायत अवधि आरंभ हुई है, अभिप्रेत है ।
(iii) " समाप्ति की तारीख " से वह तारीख अभिप्रेत है जिसको प्राधिकरण और रियायतग्राही के बीच किया गया उक्त करार, उक्त करार के उपबंधों के अनुसरण में समाप्त होता है या समाप्ति सूचना द्वारा समाप्त किया जाता है
(iv) उक्त तालिका की सारणी की क्रम संख्यांक एक में यान के प्रवर्ग से संदेय फीस के सम्बंध में " स्थानीय यातायात के निम्नलिखित प्रकार अभिप्रेत है ।
(क) "स्थानीय यातायात प्रवर्ग I " से निम्न लिखित प्रवर्गों में से किसी के अंतर्गत आने वाले प्रयोक्ता अभिप्रेत है और इसमें सम्मिलित है ।

(i) ऐसे ग्रामों/ कस्बों / शहर के निवासी जिसकी सीमा फीस संग्रहण बूथों (पथकर प्लाजा) से 10 कि.मी. के घेरे के भीतर आती है ।
(ii) फीस संग्रहण बूथों (पथकर प्लाजा) के 10 कि.मी. के घेरे के भीतर अवस्थित स्थापनों/औधोगिक ईकाई है ।
(iii ) ऐसे स्थापनों/ संस्था/औधोगिक ईकाईयों के कर्मचारी, जो फीस संग्रहण बूथों (पथकर प्लाजा) के दस कि.मी. के घेरे के भीतर अवस्थित हैं या उनका कार्यालय स्थित है; और
(iv) स्वनियोजित व्यक्ति/ कारोबारी जिनका काम करने का स्थान फीस संग्रहण बूथों ( पथकर प्लाजा) के दस कि.मी. के घेरे के भीतर अवस्थित है
(ख) ' स्थानीय यातायात प्रकार II में निम्न लिखित प्रवर्ग में से किसी के अंतगर्त आने वाले स्थानीय प्रयोक्ता अभिप्रेत है और इसमें सम्मिलित है ।
(1 ) ग्रामों/कस्बों/ शहर के निवासी जिसकी सीमा फीस संग्रहण बूथों (पथकर प्लाजा) के 10 से अधिक किन्तु 20 कि.मी. तक के घेरे के भीतर आती है ।
(2) फीस संग्रहण बूथों ( पथकर प्लाजा) के 10 कि.मी. से अधिक किन्तु 20 कि.मी. तक के घेरे के भीतर अवस्थित/ स्थापन ऐसे स्थापनों /औधोगिक ईकाईया है ।
(3) ऐसे स्थापनों/ औधोगिक ईकाइयों के कर्मचारी जो फीस संग्रहण बूथों (पथकर प्लाजा) के 10 कि.मी. से अधिक किन्तु टोल प्लाजा से 20 कि.मी. तक के घेरे के भीतर अवस्थित है या जिनका कार्यालय स्थित है।
(4) स्वनियोजित व्यक्ति/ कारोबारी जिनका काम करने का स्थान फीस संग्रहण बूथों (पथकर प्लाजा) के 10 कि.मी. से अधिक किन्तु 20 कि.मी. तक के घेरे के भीतर अवस्थित है
(v) शब्द और पदों को जो इस अधिसूचना में प्रयुक्त है और परिभाषित नहीं है किन्तु उक्त धारा के सम्बन्ध में - प्राधिकरण और रियायतग्राही के बीच किए गए करार में परिभाषित है वही अर्थ होंगे जो उक्त करार, उक्त करार में क्रमशः उनके हैं ।
2. फीस की वास्तविक दर की संगणना चालू वर्ष के लिए की जाएगी और प्रत्येक वर्ष 1 सितम्बर से निम्नलिखित आधार पर पुनरीक्षित की जाएगी: -

*डब्लयू पी आई-ए = जून 1997 ( 131.4) को यथा विधमान थोक कीमत सूचकांक है
* डब्लयू पी आई- बी - फीस पुनरीक्षण तारीख के पूर्ववर्ती 31 मार्च को समाप्त होने वाले वर्ष की समाप्ति के लिए थोक औसत कीमत सूचकांक है
* डब्लयू पी आई से आर्थिक सलाहाकार, वाणज्यिक और औधिगिक मंत्रालय भारत सरकार द्वारा जारी किया गया थोक कीमत सूचकांक या उसकों प्रतिस्थापित करने वाला कोई अन्य सूचकांक अभिप्रेत है ।

3. जब एक ही यान को राष्ट्रीय राजमार्ग के उक्त खण्ड को एक दिन में एक से अधिक बार पार करना हो, तो उपयोक्ता के पास यह विकल्प होगा कि वह पहले ही चक्कर में गेट को पार करते समय अनुसूची में यथाविनिर्दिष्ट दरों पर अनेक चक्करों के लिए फीस का एक ही बार संदाय कर दे या यदि उसी यांत्रिक यान को उक्त खंड का पूरे मास में बार- बार प्रयोग करना हो तो यान का स्वामी उक्त अनुसूची में यथाविनिर्दिष्ट उसको लागू तीस एकल दरों के समतुल्य प्रभारों को संदाय करके मासिक पास प्राप्त कर सकता है।
स्पष्टीकरणः- इस अधिसूचना के प्रयोजन के लिए "दिन पद से 24 घंटे की निरंतर अवधि अभिप्रेत है ।
4. निम्नलिखित प्रकार के यानों के संबंध में कोई फीस प्रभारित या संग्रहीत नही की जाएगी , अर्थातः-
(i) ऐसेयान-
(अ) जो " अति महत्वपूर्ण व्यक्ति " प्रतीक वाले हैं या शासकीय रूप से निम्नलिखित के हैं : - भारत के राष्ट्रपतिः
(क)
भारत के उपराष्ट्रपतिः
(ख)
राज्य के राज्यपाल या संघ राज्य क्षेत्रों के उप- राज्यपाल;
(ग)
(घ) भारत के राजकीय दौरे पर उच्च पदस्थ विदेशी व्यक्ति;
(ड) " सी डी" । " सी सी" नंबर प्लेटों वाली कारों का उपयोग करने वाले भारत में रह रहे विदेशी राजनयिक;
(च) राज्य सभा के सभापति या लोक सभा के अध्यक्ष या राज्य विधान परिषद या राज्य विधान सभा के अध्यक्ष या केंद्रीय अथवा राज्य मंत्री अथवा लोक सभा या राज्य सभा या राज्य विधान मंडलों के विपक्ष के नेता जिनकी हैसियत कैबिनेट मंत्री की है , यदि वे स्वयं यान में बैठें हों; या
(छ) सम्पूर्ण देश में संसद सदस्य , या अपने राज्य किसी राज्य की विधान सभा का सदस्य या राज्य की विधान परिषद का सदस्य , यदि वह, यथास्थिति, संसद अथवा राज्य के संबंधित विधान मंडल द्वारा जारी किया गया पहचान पत्र प्रस्तुत करता है;
(आ) शौर्य पुरस्कारों अर्थात् परमवीर चक्र, अशोक चक्र, महावीर चक्र, कीर्ति चक्र, वीर चक्र और शौर्य चक्र के विजेता यदि ऐसा पुरस्कार प्राप्तकर्ता ऐसे पुरस्कार के लिए सक्षम प्राधिकारी द्वारा सम्यक् रूप से अधिप्रमाणित किया गया अपना फोटो पहचान पत्र प्रस्तुत करता है ;
(ii ) रक्षा यान, जिनके अतंर्गत वे यान भी है जो भारतीय पथकर ( सेना और वायुसेना) अधिनियम 1901 और उसके अधीन बनाए गए नियमों (नौसेना को यथा विस्तारित ) के उपबन्धों के अनुसार छूट के पात्र हैं ।
(iii) पुलिस यान , अग्नि शमन यान, एम्बुलेंस, अन्त्येष्टि यान, डाक और तार विभाग के यान, केंद्रीय सरकार और राज्य सरकार के कर्त्तव्यारूढ़ यान ।
5. रियायतग्राही स्थानीय निजी यातायात और स्थानीय वाणिज्यिक यातायात से निम्निलिखित छूट प्राप्त दरों से अधिक कोई फीस वसूल नहीं करेगा अर्थात्ः
कार/जीप/ वैन के लिए
(क) भारत का राजपत्र असाधारण

150.00 रूपये का मासिक पास
स्थानीय यातायात प्रवर्ग 1 :
( i)
300.00 रूपये का मासिक पास
स्थानीय यातायात प्रवर्ग 2 :
(ii)
(ख) बसों के लिए
(i) राज्य परिवहन बसों के लिए मासिक पास ऐसे सक्षम प्राधिकारी के प्रमाणन पर जो महाप्रबंधक राज्य सरकार सडक परिवहन की पंक्ति से निम्न नहीं होगा द्वारा उस मार्ग पर प्रतिदिन चलने वाली बसों की संख्या प्रमाणित किए जाने पर विनिर्दिष्ट दर पर राज्य सरकार परिवहन के पक्ष में मासिक पास जारी किये जायेगें और निजी स्थानीय प्रचालकों के मामले में मासिक पास जिला परिवहन प्राधिकारी द्वारा स्म्यक् रूप से प्रमाणित मार्ग प्रचालन के लिए अपने परमिट और मार्ग प्रचालन की समय सारणी प्रस्तुत किये जाने पर जारी किए जाएंगे ।
(ii) स्कूली छात्रों को ले जाने वाली स्कूल बसों के लिए पथकर प्लाजा पार करने के लिये स्कूल के प्राचार्य के लिखित अनुरोध के साथ स्कूल की मान्यता तथा बस का रजिस्ट्रीकरण दर्शाने वाले दस्तावेजों की प्राप्ति पर 1,000/ - रू० (एक हजार रूपये) की दर से मासिक पास जारी किये जायें ।
हल्के वाणिज्यिक यान/ ट्रक ( स्थानीय परिवहन प्रचालक):
(ग)
स्थानीय परिवहन प्रचालकों कों 20 कि.मी. के भीतर उन्हें चलानें का सबूत (अर्थात् स्पष्ट रूप से वाहन की वापसी के ब्योरे विनिर्दिष्ट करते हुये प्रारम्भिक और अन्तिम स्थान के लिए माल का चालान) प्रस्तुत करने पर रियायती फीस ली जाएगी और ऐसे वाहनों के लिये , प्रत्येक प्रवेश पर ट्रकों के लिये 25 रू० (पच्चीस रूपये) और हल्के वाणज्यिक वाहनों के लिये 15 रू० ( पन्द्रह रूपये) की फीस होगी:
परन्तु, जहां स्थानीय यातायात द्वारा स्वतंत्र उपयोग के लिए पृथक सेवा लेन खुली हुई है वहाँ ऐसे वाहनों से चार लेन के राजमार्ग का उपयोग करने पर ही रियायतग्राही फीस उद्ग्रहीत और संग्रहीत करेगा ।

6. जब कभी किसी सेवा लेन का निर्माण किया जाएगा तो रियायतग्राही सेवा लेन के उपयोक्ताओं से कोई संग्रहीत नही करेगा ।
7. प्रत्येक पथकर प्लाजा से गुजरने वाले वाहनों और पूरी परियोजना राजमार्ग अथवा उसके किसी भाग का उपयोग करने हेतु नीचे निम्न लिखित लम्बाई के लिये शुल्क प्लाजा पर शुल्क एकत्रित किया जाएगा ।
पथकर प्लाजा 297.30 कि.मी.
55.20 कि.मी. लम्बाई के लिए
(i)
63.00 कि.मी. लम्बाई के लिए
पथकर प्लाजा 356.20 कि.मी.
(ii)
57.40 कि.मी. लम्बाई के लिए
(iii) पथकर प्लाजा 420.30 कि.मी.

(iv) पथकर प्लाजा 470.00 कि.मी.
63.00 कि.मी. लम्बाई के लिए
8. किसी ऐसे यांत्रिक यान से कोई फीस उदगृहीत नहीं की जाएगी जो इस अधिसूचना की सारणी के अंतर्गत नहीं है ।
9. रियायतग्राही, वाणिज्यिक प्रचालन की तारीख से कम से कम दस दिन पहले इस अधिसूचना का सार कम से कम दो स्थानीय समाचार पत्रों में ( जिनमें से एक स्थानीय भाषा में होगा) प्रकाशित करेगा , जिसमें इस अधिसूचना के उपबन्धों के अनुसार वाणिज्यिक प्रचालन की तारीख का भी उल्लेख होगा और ऐसा सार, इस अधिसूचना के अनुसार पुनरीक्षित फीस को प्रभावी करने के लिए 10 दिन पहले पुनः प्रकाशित किया जाएगा
10. रियायतग्राही फीस संग्रहण के भार साधक के रूप में किसी अधिकारी को नामनिर्दिष्ट करेगा तथा रियायतग्राही के साथ वह यह सुनिश्चित करने के लिए उत्तरदायी होगा कि फीस का संग्रहण करार की गई दरों पर ही किया जाए और सड़क उपयोक्ताओं को और उससे संबंधित विषयों के लिए असम्यक् कठिनाई पहुँचाए बिना सहज रूप से किया जाता है ।
11. फीस की दर, फीस के संदाय से छूट प्राप्त यानों के प्रवर्ग और रियायतग्राही का नाम , पता और टेलीफोन संख्या, जिसे शिकायत, यदि कोई हो, संबोधित की जानी चाहिए , पथकर बूथों से 500 मी. आगे, पथकर बूथों से 100 मी . आगे और पथकर बूथों पर भी सहजदृश्य रूप से और प्रमुख रूप से संप्रदर्शित की जाएगी और संप्रदर्शन बोर्ड की ऊंचाई और अक्षरों का आकार इस प्रकार का होगा कि चालकों के लिए संप्रदर्शन बोर्ड का पढ़ना आसान हो सकें ।
12. उपयोक्ताओं से प्रभारित की जाने वाली वास्तविक फीस की संगणना रियायतग्राही द्वारा की जाएगी और प्रतिवर्ष 31 मार्च के बाद किंतु पुनरीक्षित दर प्रभावी होने से कम से कम 45 दिन पहले, यथासम्भव शीघ्र विधिमान्यता के लिए प्राधिकरण को भेजी जाएगी । जिससे कि प्राधिकरण , उक्त प्रस्ताव की प्रप्ति की तारीख से 15 दिन के भीतर कोई टीका टिप्पणियां कर सके या स्पष्टीकरण यदि कोई हो मांग सके और यदि प्राधिकरण इस अवधि के दौरान कोई टीका टिप्पणी नहीं करता है या स्प्ष्टीकरण नहीं मांगता है तो रियायतग्राही द्वारा यथा प्रस्तावित पुनरीक्षित फीस की प्राधिकरण द्वारा पुष्टि की गई मानी जाएगी ।

NOTIFICATION
New Delhi, the 5th February, 2009
S.O. 403 (E) .- Whereas , by the notification of the Government of India in the erstwhile Ministry of Surface Transport and Highways (Road Wing ) number S.O. 78 (E) , dated the 4th February , 1999 , issued under section 11 of the National Highways Authority of the India Act , 1988 (68 of 1988 ) , hereinafter referred to as said Act, the Central Government entrusted the stretches from Km 0.00 to Km 381.600 and from km 381.600 to km 502.27 of National Highway No. 8 in the State of Gujarat and Maharashtra respectively to the National Highways Authority of India (hereinafter referred to as the Authority) ;
And whereas , the National Highways Authority of India had constructed and developed the stretch from km . 263.40 to Km . 502.00 and was collecting fee from the user of the said stretch in accordance with notifications of the Government of India in the erstwhile Ministry of Road Transport and Highways , number S.O. 91 (E) , dated 15th January , 2004 , number S.O. 605 ( E) , dated 2nd May, 2005 , number S.O. 645 (Ε) , dated 5th May , 2005 and number S.O. 1126 ( E) dated 9th May , 2008 , published in part II , Section 3 , sub- section (ii ) of Gazette of India Extra - ordinary ;
And whereas , pursuantto the powers conferred by section 14 of the said Act , the Authority has entered into an agreement with IRB Surat Dahisar Tollway Private Limited having its registered office at IRB Complex, Chandivali Farm , Chandvali 400072 (hereinafter referred to as Village , Andheri (East) Mumbai the Concessionaire ) for the construction , development , operation and maintenance of existing four lane road to six lane from Km 263.000 to Km 502.000 of Surat - Dahisar section of National Highway Number 8 ( hereinafter referred to as the said section;
Now, therefore , in exercise of the powers conferred by sections 7 and 8A of the National Highways Act , 1956 (48 of 1956) , read with rule 3 of the National Highways (Collection of Fees by any person for the use of Section of National Highways / Permanent Bridge / Temporary Bridge on National Highway) Rules , 1997, and in supersession of the aforesaid notifications number S.O. 91 (E) , dated 15th January , 2004 , number S.O. 605 ( E) , dated 2nd May , 2005 , number S.O. 645 ( E) , dated the Central 5th May, 2005 and number S.O. 1126 (E) dated 9th May, 2008 Government, having regard to the expenditure involved in building , maintenance , management and operation of the said section , interest on the capital invested, reasonable return , the volume of traffic and the period of the agreement entered into between the Authority and the Concessionaire , hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the at the rate specified in the Schedule annexed hereto and authorises the said Concessionaire to collect and retain the fee on and from the Appointed date or publication of this notification in the Official Gazette , whichever is later , till the termination date as specified in the agreement;

SCHEDULE
The Concessionaire shall collect and retain the fee on category of vehicles specified in column (2 ) of the Table below , for the use of the said section at the rate of base fee specified in column (3) of the said Table .
The fee shall be collected at four fee plazas located at Km 297.300 (Boirach) , Km 356.200 ( Bhagwada ) , Km 420.340 ( Charoti ) , and Km 470.000 ( Khanivade) .

Notes : -
1. For the purposes of this notification , -
(i) " actual fees " means the fees actually charged from the road users of the said stretch or any part thereof on crossing any fee plaza ( s ) derived on the basis of,
(a) length of the project highway assigned to a particular fee plaza , and;
(b) base fee given in the Table to this notification , and shall be rounded off to nearest one rupees .
( ii) "Appointed Date " means the date on which the concession period is deemed to commence ;
(iii) " termination date " means the date on which the said agreement entered into between the Authority and the Concessionaire expires pursuant to the provisions of the said agreement or is terminated by termination notice ;
(iv) " local traffic " means the following type of traffic in relation to the fee payable for category of vehicles at serial number 1 of the table above ;

(a) " Local Traffic" category I " means and includes users falling into any of the following categories
( 1) residents of villages / towns / cities whose boundary falls within a radius of ten kilometer of the toll plaza.
establishments /industrial units located within a radius of ten kilometer of the toll plaza. (2)
(3) employees of Establishments /Industrial units located or which have their office , within a radius of ten kilometer of the toll plaza; and
(4) self employed persons/ businessmen having a place of work within a radius of ten kilometer of the toll plaza .
(b) " Local Traffic category II " means and includes local users falling into any of the following categories ,
( 1) residents of villages / towns /cities whose boundary falls within a radius of more than ten kilometer but upto twenty kilometer of the toll plaza .
(2) establishments / industrial units located within a radius of more than ten kilometer but upto twenty kilometer of the toll plaza .
(3) employees of establishments / industrial units located or which have their office , within a radius of more than ten kilometer but upto twenty kilometer of the toll plaza: and (4) self employed persons/ business having a place of work within a radius of more than ten kilometer but upto twenty kilometer of the toll plaza .
(v) words and expressions used in this notification and not defined but defined in the agreement entered into between the Authority and the Concessionaire in respect of the said section , shall have the same meaning as assigned to them respectively in the said agreement .
2. The rate of fee and the revision thereof effective from 1st September every year shall be calculated as follows: -

WPI - A = is the Wholesale Price Index on June, 1997( 131.4) .
WPI - B is the Average Wholesale Price Index for the year ending March 31st preceding the fee revision date .
WPI means the Whole Sale Price Index as released by the Office of the Economic Advisor , Ministry of Commerce and Industry , Government of India or any other index replacing the same.
3. When the same vehicle has to cross the said section more than once in a day , the user shall have the option to pay the fee for multiple 10

trips at one and half times the rates as given in the Schedule above while crossing the toll plaza in the first trip itself. If the vehicle has to use the said stretch continuously and frequently for entire month or even beyond that , the vehicle owner can have a monthly pass on payment of charges equal to thirty ( 30 ) times rate applicable for single trip as application to it as specified in the aforesaid Schedule .
Explanation: - For the purpose of this notification , " day" shall be counted as continuous period of twenty- four hours .
4. No fee shall be charged or collected in respect of the following vehicles , namely : -
(i) Vehicles-
(A) having VIP symbols or officially belonging to :
(a) the President of India ;
(b) the Vice- President of India ;
(c) the Governor of a State and Lt. Governor of a Union territory;
(
d) a Foreign dignitary on State visit to India ;
(e) a Foreign Diplomat stationed in India using cars with " CD " / " CC " number plates ;
(f) the Chairman of Rajya Sabha or Speaker of Lok Sabha or Chairman of a State Legislative Council or Speaker of a State Legislature Assembly or a Minister for the Union or State or Leader of Opposition in Lok Sabha or Rajya Sabha or State Legislatures having the Status of Cabinet Minister if he is sitting in the vehicle ; or
(g) a Member of Parliament in the entire country or a Member of Legislative Assembly of a State or a Member of Legislative Council of a State , in the respective State if he produces his identity card issued by the Parliament or concerned Legislature of a State , as the case may be ;
(B) belonging to winner of Gallantry awards such as Param Vir Chakra , Ashok Chakra , Maha Vir Chakra , Kirti Chakra , Vir Chakra and Shaurya Chakra , if such awardee produces his photo identity card duly authenticated by the Competent Authority for such award;
(ii) Defence vehicles , including those eligible for exemption in accordance with the provisions of the Indian Toll (Army and Air Force) Act , 1901 and the rules made there under ( as extended to Navy);
(iii) Police vehicles , Fire fighting vehicles , Ambulances , Funeral vans , Post and Telegraph Department's vehicles , Central and State Government vehicles on duty .

5. Concessionaire shall not collect fees from local traffic in excess of the following discounted rate;
(a) Car / Jeep / Van :
Monthly pass of Rs 150.00 i) Local Traffic Category I :
Monthly pass of Rs 300.00 ;
ii) Local Traffic Category II :
(b) Buses:
( i) monthly passes for the State Transport buses may be given at the specified rate in favour of the State Government Transport on the certification of the competent authority ( not less than General Manager , State Government Road Transport) certifying the number of buses plying in the route per day and in case of private local operators , monthly passes shall be issued on production of their route permit and timetable of the route operation duly certified by the District Transport Authority;
( ii) monthly passes for school buses , for school students , crossing the toll plaza may be given at a monthly rate of Rs 1000 ( Rupees one thousand) after obtaining written request of the school principal along with the documents showing recognition of the school and the registration of the bus ;
(c) LCV / Trucks ( Local Transport Operators) :
Concessional Fee for Local Transport Operators may be given on production of proof for plying within 20 km such as goods challan origin and destination clearly specifying the return details of the vehicle , at the rate of Rs 25 ( Rupees twenty five) for trucks for each entry and Rs 15 (Rupees fifteen ) for LCV for each entry
Provided, that if a separate service lane is opened for free use by local traffic , the Concessionaire shall levy and collect fee from such local traffic, if they use the four lane highway only .
6. As and when a service lane is constructed , the Concessionaire shall not collect any fee from the users of such lane ( s) .
7 . Fee shall be collected at the fee plaza from the vehicles crossing the fee plaza and using the whole or part of the project highway for the length mentioned as under ;
for the length of 55.20 km.
Toll plaza at km . 297.30
(i)
for the length of 63.00 km .
(ii) Toll plaza at km . 356.20
for the length of 57.40 km .
(iii) Toll plaza at km . 420.30
for the length of 63.00 km.

8. No fee shall be levied and collected from a mechanical vehicle , which is not covered under the table shown in the fee notification .
9. The concessionaire shall publish substance of this notification in two local newspapers (one of which shall be in vernacular language) , which shall also state the date of commercial operation as per the provisions of this notification , at least ten days prior to the date of commercial operation and such substance shall also be repeated , ten days prior to giving effect to revision in fee in accordance with this notification .
10. The Concessionaire shall nominate an officer who shall be in- charge of fee collection and along with the concessionaire , be responsible for ensuring that fee is collected at the agreed rates smoothly without causing undue hardship to the road users and also for all matters connected therewith .
11. The rate of fee , the categories of vehicles exempted from payment of fee and the name , address and telephone number of Concessionaire to whom complaints , if any , should be addressed , shall be conspicuously and prominently displayed 500 meters ahead of the toll booths , 100 meters ahead of the toll booths and at the toll booths also , the height of the display boards and size of letters being such that the driver can easily read the display boards .
12. The actual iee to be charged from users shall be computed by the concessionaire and sent to Authority for validation as soon as possible after 31st March , in every year but at least forty- five days before the revised rate is to be effective so as to enable the Authority to provide any comments or seek clarifications , if any , within a period of fifteen days from the date of receipt of the said proposal and if the Authority does not offer comments or seek clarifications during this period , the revised fee , as proposed by the Concessionaire , shall be deemed to have been confirmed by the Authority.
