विषय: नायलॉन टायर कौर्ड फैब्रिक के चीन लोक गणराज्य से भारत में आयात से सम्बन्धित रक्षोपाय अन्वेषण का प्रारम्भ ।

सा.का.नि. 79 (अ).-भारत में नायलॉन टायर कौर्ड फैब्रिक केचीन लोक गणराज्य से आयात के परिणामस्वरूप नायलॉन टायर कौर्ड फैब्रिक के घरेलू उत्पादकों को मार्केट विदारण या इसकी शंका से बचाने के लिए इस आयात पर रक्षोपाय शुल्क लगाने के लिए मैसर्स एस.आर.एफ. लिमिटेड , ब्लाक- सी , सैक्टर -45 , गुडगाँव , हरियाणा -122003 और सेन्चुरी ऐनका लिमिटेड बखावतार , नरिमन प्वाईंट , मुम्बई -400021 के द्वारा सीमा शुल्क टैरिफ ( उत्पाद विशिष्ट परिवर्ती रक्षोपाय शुल्क ) नियमावली , 2002 के नियम 5 के अधीन मेरे समक्ष एक आवेदन प्रस्तुत किया गया है।
का है , जो कि अब अन्य इकाइयों के बन्द हो जाने के फलस्वरूप 100 प्रतिशत हो गया है । आवेदकों ने नायलॉन टायर कौर्ड फैब्रिक के चीन लोक गणराज्य से आयात पर रक्षोपाय शुल्क लगाने की मांग की है ।
3. संबद्ध उत्पाद. आवेदकों भारत में नायलॉन टायर कौर्ड फैब्रिक के वर्धित आयात से मार्केट विदारण या उसकी आशंका के पैदा होने का आरोप लगाया है । यह उत्पाद कस्टम टैरिफ नियमावली , 1975 की प्रथम अनुसूची के अन्तर्गत निम्न रूप में वर्गीकृत है ।

4. वर्धित आयात. भारत में चीन लोक गणराज्य से नायलॉन टायर कौर्ड फैब्रिक का आयात पिछले तात्कालिक वर्ष 2007-2008 (सारणी-1 का संदर्भ लें ) की तुलना में 2008-2009 ( अप्रैल से नवम्बर ) में निपेक्ष ( पूर्ण ) रूप से बढ़ा है । कुल आयात में चीन लोक गणराज्य से किए गए उत्पाद का आयात 2007-2008 में 37.71 मी.टन. (सारणी-2 का संदर्भ लें) की तुलना में नवम्बर , 2008 में 47.56 प्रतिशत बढ़ा है । इसके अतिरिक्त चीन लोक गणराज्य से किए गए उत्पाद के आयात का अंश कुल घरेलू बिक्री में वर्ष 2007-2008 में 15.83 प्रतिशत ( सारणी-3 का संदर्भ लें) की तुलना में नवम्बर , 2008 में 27.69 प्रतिशत बढ़ा है ।

2. घरेलू उद्योग.-जिन घरेलू उत्पादकों ने यह आवेदन प्रस्तुत किया है उनके नाम मैसर्स एस. आर.एफ. लिमिटेड, ब्लाक-सी, सैक्टर -45 , गुड़गाँव , हरियाणा-122003 और सेन्चुरी ऐनका लिमिटेड , बखावतार , नरिमन प्वाईंट , मुम्बई -400021 है । भारत में नायलॉन टायर कौर्ड फैब्रिक के कुल उत्पादन का 95 प्रतिशत शेयर आवेदकों 515 GI/2009 2

बिक्री- घरेलू उद्योग का मासिक बिक्री औसत वर्ष 2007-08 में 5141 मी.टन की तुलना में दिसम्बर 2008 में घटकर 1780 मी.टन जा पहुँचा । यह तीक्ष्ण गिरावट अक्टूबर 2008 से दिसम्बर 2008 की अवधि के दौरान दृष्टव्य है ।

उत्पादन घरेलू उद्योग का उत्पादन गम्भीर रूप से घटा है । वर्ष 2008 में मासिक घरेलू उत्पादन नवम्बर, दिसम्बर के महीनों में क्रमशः 3738 मी.टन और 1735 मी. टन था । जो वर्ष 2007-08 के मासिक औसत 4836 मी. टन से काफी कम हैं ।

इसके अतिरिक्त महानिदेशक के पास उपलब्ध आँकड़े लाभप्रदता पर दबाव की ओर संकेत करते हैं । भारतीय उद्योग का मार्केट शेयर 2007-08 में 58.02 प्रतिशत से कम होकर नवम्बर 2008 में 41.78 प्रतिशत हो गया ।
6. अन्य सूचना - वर्तमान में सम्बद्ध उत्पाद पर दिनांक 27-4-2005 की अधिसूचना संख्या 36/2005 के तहत पाटनरोधी शुल्क लागू किया गया है । आवेदकों द्वारा यह तर्क दिया गया है घरेलू उद्योग वर्धित आयात के चलते मार्केट विदारण या उसकी आशंका से गुजर रहे हैं और नायलॉन टायर कौर्ड फैब्रिक ( एन.टी.सी.एफ. ) के वर्धित आयात से मार्केट विदारण या उसकी आशंका से बचने हेतु , पूर्व में लागू पाटनरोधी शुल्क या पाटनरोधी शुल्क का सनसेट रिव्यू ही सिर्फ इसका कानूनी उपचार नहीं सुझा पाएंगे । महानिदेशक ( पाटनरोधी ) और समवर्गी ड्यूटीज़ ने 16 सितम्बर, 2008 को सनसेट रिव्यू को आरम्भ किया था । इसके अतिरिक्त घरेलू उद्योग द्वारा यह भी आवेदन किया गया है कि सिर्फ पाटनरोधी शुल्क से वर्तमान घरेलू उद्योग को होने वाली क्षति की स्थिति दुरूस्त नहीं हो सकेगी चूँकि यह पाटनरोधी तक ही सीमित है ।
7. इस मुद्दे को जाँचा गया कि यदि उत्पाद पर पहले से पाटनरोधी शुल्क लगा हो तो क्या रक्षोपाय शुल्क भी लागू किया जा सकता है अथवा नहीं । अनुभाग 9 ए पाटनरोधी शुल्क के लागू किए जाने से संबंधित है जो कि मूल्य गिरावट निश्चित सीमा तक ही सीमित है । अनुभाग ४सी किन्हीं विशिष्ट परिस्थितियों में चीन लोक गणराज्य से किए जा रहे आयात पर रक्षोपाय शुल्क लागू किए जाने से संबंधित है। वह परिस्थितियाँ जिस हेतु शुल्क लागू किए जाने चाहिए वह भिन्न है। इसके अतिरिक्त सीमाशुल्क नियमावली , 1975 के अनुभाग 8 सी के उपवर्ग 4 या अन्य प्रचलित कानून के अनुसार एक समय पर एक से अधिक शुल्क लागू किए जा सकते हैं । अनुभाग 8सी का उपवर्ग 4 इस प्रकार है-" इस अनुभाग मेंलगाया गया शुल्क इस अधिसूचना के अंतर्गत लगाये गये पूर्व किसी शुल्क से भिन्न हो सकता है अथवा पहले से लागू कानून के साथ भी लगाया जा सकता है । "
तदनुसार मेरे मत में पहले से लागू पाटनरोधी शुल्क, रक्षोपाय शुल्क के लागू किए जाने हेतु रोधन नहीं है , विशेष रूप से तब जब संरक्षण संबंधी आवश्यकताएं सुस्पष्ट हैं ।
8. घरेलू उत्पादकों ने नायलॉन टायर कौर्ड फैब्रिक के चीन लोक गणराज्य से किए जा रहे आयात पर रक्षोपाय शुल्क लगाए जाने की 4

मांग की है । उन्होंने उन गम्भीर परिस्थितियाँ जिनकी क्षति दुरूस्त करना काफी दुष्कर होता है उनसे बचने हेतु प्रारम्भिक रक्षोपाय शुल्क लगाने का आवेदन किया है ।
9. आवेदन पत्र को जाँचा गया और पहली दृष्टि में यह पाया गया है कि नायलॉन टायर कोर्ड फैब्रिक के चीन लोक गणराज्य से वर्धित आयात से वर्धित आयात के कारण मार्केट विदारण या इसकी आशंका उत्पन्न हो सकती है तदनुसार इस नोटिस के माध्यम से जाँच शुरू करने का निर्णय लिया गया है ।
10. सभी सांबद्ध पक्ष अपने दृष्टिकोण से अधोहस्ताक्षरी को 9 मार्च , 2009 तक सूचित कर सकते हैं ।

Sub: Initiation ofSafeguard Investigation concerning imports of Nylon Tyre Cord Fabric (NTCF ) into India from the People'sRepublic ofChina .
Under Rule 6 of the Customs Tariff
(Transitional Product Specific Safeguard Duty) Rules , 2002
G.S.R 79 (E) . An application has been filed before me Under Rule 5 of the Custom Tariff (Transitional Product Specific Safeguard Duty) Rules, 2002 by M/s . SRF Limited Block- C , Sector -45, Gurgaon (Haryana)-122003 And CENTURY ENKA Limited Bakhawatar, Nariman Point Mumbai -400021 for imposition of Safeguard duty on imports of Nylon Tyre Cord Fabric (NTCF ) into India from People's Republic of China to protect the domestic producers of Nylon Tyre Cord Fabric (NTCF) from market disruption or threat of market disruption caused by the increased imports from People's Republic of China.
2. Domestie Industry : The application has been filed by M/s . SRF LIMITED , Block-C, Sector- 45 , Gurgaon (Haryana) -122003 and CENTURY ENKA LIMITED Bakhawatar , Nariman Point Mumbai -400021 . The share ofthe applicant in production ofNylon Tyre Cord Fabric (NTCF ) has been 95 % of the total production of the same product in India, which has increased to 100 % share on account of closure ofthe other production facilities . They have requested for imposition of Safeguard duty on imports ofNylon Tyre Cord Fabric (NTCF ) into India from People's Republic of China.
3.Product Involved : The applicant has alleged that increased imports of Nylon Tyre Cord Fabric (NTCF) from People's Republic of China into India have caused market disruption and threatened to cause market disruption . The product is classified under Customs Tariff Act , 1975 as follows :

4. Increased Imports : Imports of Nylon Tyre Cord Fabric from People's Republic of China into India have increased significantly in absolute terms during 2008-09 (April- November) compared to the immediate preceding year 2007-08 (Table 1 ) . The share of imports of the product involved from Peoples Republic of China in total imports has gone up to 47.56% during November 2008 compared to 37.71 % during 2007-08 (Table 2) . Further share of the imports ofthe products involved from Peoples Republic of China in total domestic sale has increased to 27.69% during November 2008 from 15.83% in the year 2007-08 (Table 3).

→ Sales : The average monthly sales volume of the domestic industries has reduced to 1780 MT in December, 2008 compared to 5141 MT in the year 2007-08 . The sharp fall is evident during the period October 08 to December 2008 .

→ Production : The productions ofdomestic industries have gone down significantly . The monthly domestic production duringNovember and December 2008 have been 3,738 MT and 1,735 MT respectively compared to monthly average of4,836 MT during 2007-08.

→ Capacity utilization : The capacity utilization of domestic industries has gone down to 30% during December 2008 compared to 94% in 2007-08 and more than 100% during the earlier years .

→ Further the data available with the Directorate General indicates pressure on profitability. The market share of Indian industries have gone down to 41.78 % in Nov. 2008 compared to 58.02 % during 2007-08.
6. Other Information : At present the products under consideration attract anti - dumping duty as per Notification No. 36/2005 dated 27-4-2005 . It has been contended by the applicant that the domestic industries are facing market disruption and threat of market disruption on account of increased imports and anti - dumping duties as applicable , or Sunset review of the Anti-dumping duty on import of Nylon Tyre Cord Fabric (NTCF ) , cannot alone provide legal remedy for market disruption and threat of market disruption on account of increased imports . The Directorate General of Anti- Dumping & Allied Duties has initiated the Sunset Review on 16th September , 2008. Further , it has been contended by the domestic industry that dumping duties would not address the current injury being suffered by the domestic industry , as it maybe limited to only dumping margin .
7. The issue , especially, whether safeguard duty can be imposed when anti - dumping duty is already in place , was examined. The Section 9A deals with imposition of anti - dumping duty not exceeding the margin of dumping . The Section 8C deals with imposition of safeguard duty on goods imported from the People's Republic of China in certain circumstances. The circumstances under which the two duties could be imposed are different. Further, the sub - section (4) of the Section 8C envisages imposition of a number of duties at the same time under the Customs Tariff Act , 1975 or any other law in force. The sub- section (4) of the Section 8C reads as :
"(4) The duty chargeable under this section shall in addition to any other duty imposed under this Act or under anyother law for the time being in force . " 7

Accordingly, I do not find any bar imposed by law on imposition of safeguard duty when anti -dumping duty is already in place , provided the requisites of imposition of safeguard are met.
8. The domestic producers have requested for imposition of Safeguard duty as on imports of Nylon Tyre Cord Fabric (NTCF) originating from People's Republic of China. They have also requested for imposition of provisional Safeguard duty in light of critical circumstances, leading to damage which would be difficult to repair.
9. The application has been examined and it appears that primafacie increased imports ofNylon Tyre Cord Fabric (NTCF) from People's Republic of China have caused/ threatened to cause market disruption to the domestic producers of Nylon Tyre Cord Fabric (NTCF ) and accordingly it has been decided to initiate an investigation through this notice.
