और यतः केन्द्र सरकार इस बात से संतुष्ट है कि उक्त अधिनियम की धारा 3 की उप - धारा ( 8 ) के अंतर्गत अपेक्षाओं तथा अन्य संबंधित अपेक्षाओं को पूरा कर लिया गया है और उसने पश्चिम बंगाल राज्य में बिधाननगर टाउनशिप , दुर्गापुर , बर्दवान जिले में सूचना प्रौद्योगिकी एवं सूचना प्रौद्योगिकी समर्थित सेवाओं एक क्षेत्र विशिष्ट विशेष आर्थिक जोन के विकास एवं प्रचालन हेतु उक्त अधिनियम की धारा 3 की उप - धारा ( 10 ) के अंतर्गत दिनांक 25 जून , 2008 को अनुमोदन पत्र प्रदान कर दिया है;

S.O. 422 ( E ) . Whereas M/s . Bengal Shapoorji Infrastructure Development Private Limited, has proposed under Section 3 of the Special Economic Zones Act, 2005 (28 of2005 ), (hereinafter referred to as the said Act)to set up a sector specific Special Economic Zone for information technology and information technology enabled services atBidhannagar Township , Durgapur, District Burdwan in the State of West Bengal ;
अतः अब विशेष आर्थिक जोन अधिनियम , 2005 की धारा 4 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विशेष आर्थिक जोन नियम , 2006 के नियम 8 के अनुसरण में केन्द्र सरकार एतद्वारा पश्चिम बंगाल राज्य में बिधाननगर टाउनशिप , दुर्गापुर, बर्दवान जिले में निम्नलिखित क्षेत्र को एक विशेष आर्थिक जोन के रूप में अधिसूचित करती है जिसमें निम्नलिखित तालिका में उल्लिखित सर्वेक्षण संख्याएं और क्षेत्र शामिल हैं, अर्थात्: -

3. क्षेत्रीय संयुक्त विदेश व्यापार महानिदेशक, कोलकाता -सदस्य, पदेन
4. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार-सदस्य, पदेन रखने वाले सीमाशुल्क आयुक्त अथवा केन्द्रीय उत्पाद शुल्क आयुक्त अथवा उनके नामिती जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा

And whereas, the Central Government is satisfied that requirements under sub - section (8 ) of Section 3 of the said Act, and other related requirements are fulfilled and it has granted letter of approval on 25th June , 2008 under sub - section ( 10) of Section 3 of the said Act for development and operation of the sector specific Special Economic Zone for information technology and information technology enabled services at Bidhannagar Township, Durgapur , District Burdwan in the State ofWest Bengal;

Now, therefore , in exercise ofthe powers conferred by sub - section (1 ) of Section 4 of the Special Economic Zones Act, 2005 and in pursuance of rule 8 of the Special Economic Zones Rules , 2006, the Central Government hereby notifies the following area at Bidhannagar Township, Durgapur District Burdwan in the State ofWest Bengal, comprising of the survey numbers and the area given in the Table below, as a Special Economic Zone , namely:-

2. विकास आयुक्त के रूप में अपने कार्यों के निर्वहन के लिए निदेशक, सॉफ्टवेयर टेक्नॉलोजी पार्क्स ऑफ इंडिया , बोरझार को केन्द्र सरकार , वाणिज्य विभाग तथा विशेष आर्थिक जोन अनुमोदन बोर्ड द्वारा समय - समय पर जारी किए गए अनुदेशों का अनुपालन करना होगा । वह वाणिज्य विभाग तथा विशेष आर्थिक जोन अनुमोदन बोर्ड द्वारा यथानिर्धारित आवधिक रिपोर्ट भी भेजेंगे । वह विकास आयुक्त के रूप में की गई सभी कार्यवाहियों के लिए वाणिज्य विभाग के प्रति जवाबदेह होंगे । तथापि, पदधारी की छुट्टी , स्थानांतरण , तैनाती आदि जैसे वैयक्तिक मामले सूचना प्रौद्योगिकी विभाग/ सॉफ्टवेयर टेक्नोलॉजी पार्क ऑफ इण्डिया , जैसी भी स्थिति हो , द्वारा शासित होंगे ।
[फा. सं. 1 /48/2008- एस ई जेड ] अनिल जी. मुकीम, संयुक्त सचिव का.आ. 424(अ).-विशेष आर्थिक जोन अधिनियम, 2005 (2005 का 28 ) , की धारा 53 की उप - धारा (2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा दिनांक 9 फरवरी , 2009 को उस तारीख के रूप में नियत करती है जिस तारीख से मै. बंगाल शापुर्जी इन्फ्रास्ट्रक्चर डेवलपमेंट प्राइवेट लिमिटेड द्वारा पश्चिम बंगाल राज्य में बिधाननगर टाउनशिप , दुर्गापुर , बर्दवान जिले में सूचना प्रौद्योगिकी एवं सूचना प्रौद्योगिकी समर्थित सेवाओं हेतु विकसित विशेष आर्थिक जोन को सीमाशुल्क अधिनियम , 1962 की धारा 7 के अंतर्गत अंतर्देशीय कंटेनर डिपो माना जाएगा ।

2. For discharge of the functions as Development Commissioner, Director , Software Technology Parks of India, Borjhar shall abide by the instructions ofthe Central Government, Department of Commerce and the Board of Approval on Special Economic Zones , issued from time to time .He shall also be sending periodic reports, as prescribed bythe Department ofCommerce and the Board of Approval on Special Economic Zones . He shall be responsible to the Department of Commerce for all the actions taken as Development Commissioner . The personal matters like leave, transfer , posting etc. of the incumbent shall be governed by the Department of Information Technology orthe Software Technology Park of India, as the case may be.
