का.आ. 440(अ).-यतः , मै . एन्फील्ड एनर्जी लिमिटेड ने
पश्चिम बंगाल राज्य में कान्क्सा, पानागढ़ बर्दवान जिले में सौर ऊर्जा
उपकरण/सेल सहित गैर- परम्परागत ऊर्जा हेतु एक क्षेत्र विशिष्ट
विशेष आर्थिक जोन की स्थापना हेतु विशेष आर्थिक जोन अधिनियम ,
2005 ( 2005 का 28 ) ( जिसे एतपश्चात् उक्त अधिनियम कहा
गया है ) , की धारा 3 के अंतर्गत प्रस्ताव किया है;
और, यतः , केन्द्र सरकार इस बात से संतुष्ट है कि उक्त
अधिनियम की धारा 3 की उप- धारा ( 8 ) के अंतर्गत अपेक्षाओं तथा
अन्य संबंधित अपेक्षाओं को पूरा कर लिया गया है और उसने पश्चिम
बंगाल राज्य में कान्क्सा , पानागंढ़ , बर्दवान जिले में सौर ऊर्जा
उपकरण/सेल सहित गैर - परम्परागत ऊर्जा हेतु क्षेत्र विशिष्ट विशेष
आर्थिक जोन के विकास एवं प्रचालन हेतु उक्त अधिनियम की धारा
3 की उप- धारा ( 10 ) के अंतर्गत दिनांक 26 जून , 2008 को
अनुमोदन पत्र प्रदान कर दिया है;
अतः , अब , विशेष आर्थिक जोन अधिनियम , 2005 की धारा
4 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और
विशेष आर्थिक जोन नियम , 2006 के नियम 8 के अनुसरण में केन्द्र
सरकार एतद्वारा पश्चिम बंगाल राज्य में कान्क्सा, पानागढ़ बर्दवान
जिले में निम्नलिखित क्षेत्र को एक विशेष आर्थिक जोन के रूप में
अधिसूचित करती है जिसमें निम्नलिखित तालिका में उल्लिखित

Enfield Energy Limited, has proposed under Section 3 of the Special Economic Zones Act, 2005 (28 of2005) , (hereinafter referred to as the said Act) to set up a sector specific Special Economic Zone for non- conventional energy including solar energy equipment/ cell at Kanksa , Panagarh , District Burdwan in the State of West Bengal;

And whereas , the Central Government is satisfied that requirements under sub - section (8) of Section 3 of the said Act, and other related requirements are fulfilled and it has granted letter of approval on 26th June, 2008 under sub - section ( 10 ) of Section 3 of the said Act for development and operation of the sector specific Special Economic Zone for non- conventional energy including solar energy equipment/ cell at Kanksa , Panagarh , District Burdwan in the State of West Bengal ;

Now, therefore, in exercise of the powers conferred by sub - section ( 1 ) of Section 4 of the Special Economic Zones Act, 2005 and in pursuance of rule 8 of the Special Economic Zones Rules , 2006, the Central Government hereby notifies the following area at Kanksa , Panagarh , DistrictBurdwan in the State of West Bengal, comprising the survey numbers and the area given in the table below, as a Special Economic Zone , namely: --

का.आ. 441 (अ).-विशेष आर्थिक जोन अधिनियम, 2005 (2005 का 28 ) की धारा 13 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का उपयोग करते हुए केन्द्रीय सरकार एतद्वारा उक्त अधिनियम की धारा 14 के प्रयोजनार्थ मै. एनफील्ड एनर्जी लिमिटेड ने पश्चिम बंगाल राज्य में कान्क्सा , पानागढ़ , बर्दवान जिले में सौर ऊर्जा उपकरण/सेल सहित गैर - परम्परागत ऊर्जा हेतु एक क्षेत्र विशिष्ट विशेष आर्थिक जोन की एक समिति, जिसे अनुमोदन समिति कहा जाएगा , गठित करती है , जिसके सदस्य निम्नानुसार हैं , अर्थात्:-
-अध्यक्ष , 1. विशेष आर्थिक जोन के विकास आयुक्त
2. निदेशक अथवा उप - सचिव , भारत सरकार , सदस्य, पदेन वाणिज्य एवं उद्योग मंत्रालय , वाणिज्य विभाग या उसके नामिती जिनका स्तर अवर सचिव, भारत सरकार से कम नहीं होगा
3. क्षेत्रीय संयुक्त विदेश व्यापार महानिदेशक , कोलकाता -सदस्य, पदेन
4. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार सदस्य, पदेन रखने वाले सीमाशुल्क आयुक्त अथवा केन्द्रीय उत्पाद शुल्क आयुक्त या उनका नामिती जिनका स्तर संयुक्त आयुक्त से कम नहीं होगा ।
5. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार -सदस्य, पदेन रखने वाले आयकर आयुक्त अथवा उनका नामिती जिनका स्तर संयुक्त आयुक्त से कम नहींहोगा
6. निदेशक ( बैंकिंग ) , वित्त मंत्रालय , बैंकिंग प्रभाग , सदस्य , पदेन भारत सरकार
7. पश्चिम बंगाल सरकार द्वारा नामित किए गए सदस्य , पदेन दो अधिकारी, जिनका स्तर संयुक्त सचिव से कम नहीं होगा
8. मै. एन्फील्ड एनर्जी लिमिटेड ( विकासकर्त्ता ) विशेष आमंत्रिती
2. विशेष आर्थिक जोन के विकास आयुक्त की अनुपस्थिति में उनका प्रतिनिधित्व वह अधिकारी करेगा जिसका स्तर संयुक्त विकास आयुक्त से कम नहीं होगा ।

1 का.आ. 442(अ). विशेष आर्थिक जोन अधिनियम , 2005 (2005 का 28 ) , की धारा 53 की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा दिनांक 10 फरवरी , 2009 को उस तारीख के रूप में नियत करती है जिस तारीख से मै. एन्फील्ड एनर्जी लिमिटेड ने पश्चिम बंगाल राज्य में कान्क्सा, पानागढ़ , बर्दवान जिले में सौर ऊर्जा उपकरण/सेल सहित गैर- परम्परागत ऊर्जा हेतु विकसितविशिष्ट विशेष आर्थिक जोन को सीमाशुल्क अधिनियम , 1962 की धारा 7 के अंतर्गत अंतर्देशीय कंटेनर डिपो माना जाएगा ।

In exercise of the powers conferred by sub - section (2 ) of Section 53 of the Special Economic Zones Act, 2005 (28 of 2005 ) , the Central Government hereby appoints the 10th day of February , 2009 as the date from which the non- conventional energy including solar energy equipment/cell Special Economic Zone at Kanksa , Panagarh, District Burdwan, West Bengal developed by M/s.Enfield Energy Limited shall be deemed to be Inland ContainerDepot under section 7 ofthe Customs Act, 1962.
