नई दिल्ली, 11 फरवरी , 2009 सं. 2/2009-केन्द्रीय उत्पाद शुल्क
सा.का.नि. 92( अ ).- केन्द्रीय सरकार , केन्द्रीय उत्पाद शुल्क अधिनियम, 1944 (1944 का 1 ) की धारा 5क की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह समाधान हो जाने पर कि लोकहित में ऐसा करना आवश्यक है , भारत सरकार के वित्त मंत्रालय (राजस्वविभाग ) की अधिसूचना सं. 8/2003- केन्द्रीय उत्पाद शुल्क तारीख 1 मार्च , 2003 भारत के राजपत्र , असाधारण , भाग II , खण्ड 3 , उप- खण्ड ( i ) में प्रकाशित सं. सा.का.नि. 138(अ ) , तारीख 1 मार्च , 2003 में निम्नलिखित और संशोधन करती है , अर्थात्:-
उक्त अधिसूचना में,-
(i ) पैराग्रॉफ 2 में खण्ड ( iii ) में, निम्नलिखित परंतुक अंतःस्थापित किए जाएंगे , अर्थात्:-
" बशर्ते विनिर्दिष्ट ऐसे माल के निर्माण में जो किसी ऐसे व्यक्ति के ब्रांड नाम या ट्रेड नाम धारण किए हैं जो पैराग्रॉफ 4 के निबंधनों के अनुसार इस छूट के पात्र नहीं हैं, प्रयुक्त निविष्टि पर इस खंड का कुछ भी लागू नहीं होगा । " ;
(ii ) पैराग्रॉफ 4 के खंड (ङ) में अक्षरों और शब्दों " पीपी कैप्स , क्राऊन कार्कस, मेटल लेबल्स " के स्थान पर अक्षर और शब्द " पीपी केप्स, क्राऊन कार्कस , मैटल लेबल्स , प्लास्टिक बैग्स " प्रतिस्थापित किए जाएंगे ।

No. 2/2009-Central Excise
G.S.R. 92 (E). In exercise of the powers conferred by sub-section ( 1 ) ofSection SA of the Central ExciseAct, 1944(1 of 1944), the Central Government, on being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance (Department of Revenue), No. 8/2003 - Central Excise published in the Gazette of India, Extraordinary , Part II, Section 3 , Sub - section (i ) dated the 1st March, 2003 vide number G.S.R. 138 (E) , dated the 1st March, 2003 , namely:-
In the said notification,
(i) in paragraph 2, in clause (iii ), the following proviso shall be inserted, namely :-

"Provided that nothing contained in this clause shall apply to the inputs used in the manufacture of specified goods bearing the brand name or trade name of another person , which are ineligible for the grant ofthis exemption in terms of paragraph 4. " ;
टिप्पण : मूल अधिसूचना , भारत के राजपत्र, असाधारण , भाग II , खंड 3 , उप- खण्ड ( i ) में सं. सा.का.नि. 118(अ) , तारीख 1 मार्च , 2002 द्वारा प्रकाशित की गई थी और उसमें अंतिम संशोधन अधिसूचना सं. 12/2009- सीमाशुल्क, तारीख 10 फरवरी , 2009 जो भारत के राजपत्र , असाधारण , भाग II , खंड 3 , उप-खण्ड ( i ) में सं. सा.का.नि. 91 ( अ ) , तारीख 10 फरवरी, 2009 द्वारा प्रकाशित की गई थी के द्वारा किया गया था ।
(ii) in paragraph 4, in clause (e) , for the letters and words , "PP caps , crown corks , metal labels " , the letters and words , " PP caps , crown corks , metal labels , plastic bags" , shall be substituted .

Note : The principal notification No. 8 /2003-Central Excise, dated the 1st March, 2003 was published in the Gazette of India , Extraordinary, Part II , Section 3 , Sub- section ( i ) vide number G.S.R. 138(E) , dated the 1st March , 2003 and was last amended by notification No. 47/2008- Central Excise dated the 1st September, 2008 which was published in the Gazette of India, Extraordinary vide number G.S.R. 629 (E ) , dated the the 1st September , 2008 .
G.S.R. 93 (E).- In exercise of the powers conferred by sub -section ( 1 ) of Section 25 of the Customs Act, 1962 (52 of 1962) , the Central Government , on being satisfied that it is necessary in the public interest so to do , hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance (Department of Revenue), No. 21 /2002- Customs , dated the 1st March , 2002, whiich was published in the Gazette of India, Extraordinary , Part II , Section 3 , Sub - section (i ) vide No.G.S.R. 118 (E ) , of the same date , namely:-

In the said notification , in the Table,--
(1) against Sl.No. 154 , for the entry in column (4), the entry "Nil " shall be substituted;
(ii) against Sl . No. 154 A, for the entry in column (4), the entry "Nil" shall be substituted;
(iii) against Sl . No. 156, for the entry in column (4), the entry "Nil " shall be substituted.

No. 354/51 /2009 - TRU] सा.का.नि 93( अ ) - केन्द्रीय सरकार , सीमा शुल्क अधिनियम, 1962 ( 1962 का 52 ) की धारा 25 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह समाधान हो जाने पर कि लोकहित में ऐसा करना आवश्यक है , भारत सरकार के वित्त मंत्रालय (राजस्व विभाग ) की अधिसूचना सं. 21/2002- सीमाशुल्क , तारीख 1 मार्च , 2002 , जो भारत के राजपत्र , असाधारण, भाग II , खण्ड 3 , उप-खण्ड ( i ) में सं. सा.का.नि. 118 ( अ ) , उसी तारीख से प्रकाशित की गई थी , में निम्नलिखित और संशोधन करती है, अर्थात्:-
उक्त अधिसूचना में सारणी में, --
UNMESH SHARAD WAGH, Under Secy.
(i) क्रम सं. 154 के सामने स्तम्भ (4 ) की प्रविष्टि के स्थान पर प्रविष्टि, " कुछ नहीं " प्रतिस्थापित की जाएगी;
(ii) क्रम सं. 154क के सामने , स्तम्भ ( 4 ) की प्रविष्टि के स्थान पर प्रविष्टि, " कुछ नहीं " प्रतिस्थापित की जाएगी;
(iii ) क्रम सं. 156 के सामने स्तम्भ ( 4 ) की प्रविष्टि के स्थान पर , प्रविष्टि, " कुछ नहीं " प्रतिस्थापित की जाएगी ।
