का.आ. 452(अ).-चूंकि, केन्द्र सरकार को, मै. वेदरफोर्ड ऑयल टूल्स एम. ई. लिमिटेड, मुम्बई , से तेल खोज प्रयोजन के लिए संयुक्त राज्य अमेरिका से हवाई जहाज द्वारा कुछ विशेष विस्फोटकों को आयात करने की अनुमति हेतु पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन में एक प्रस्ताव प्राप्त हुआ है ;
और, चूंकि, पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन संतुष्ट है कि विस्फोटकों के प्रस्तावित आयात का उपयोग , तेल खोज प्रयोजन में किया जाएगा और , इसलिए, विस्फोटक नियमावली , 1983 ( इसे यहां उक्त नियमावली कहा गया है ) के नियम 31 के उप- नियम ( 2 ) के दायरे से आवश्यक छूट प्रदान की जा सकती है , जिसके तहत यहां विनिर्दिष्ट किए गए विस्फोटकों का हवाई जहाज द्वारा आयात अथवा निर्यात निषिद्ध है ;
और, चूंकि नागर विमानन महानिदेशक ने वायुयान नियमावली , 1937 के नियम 8 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , अपने परमिट सं. 159 -डीजी/2008 , दिनांक 2 जुलाई , 2008 द्वारा जो कि 31 दिसम्बर , 2008 तक वैध है , इस प्रकार के विस्फोटकों को वायु मार्ग द्वारा ले जाने के लिए मै. वेदरफोर्ड ऑयल टूल्स एम. ई. लिमिटेड , 931 , बिल्डिंग नं. १ , सोलिटेयर कार्पोरेट पार्क , 167 , गुरु हरगोविंद सिंह जी मार्ग , चकला , अंधेरी ( पूर्व ) , मुम्बई -400093 को कतिपय शर्तों के साथ आवश्यक अनुमति प्रदान की है;
अतः, अब, विस्फोटक अधिनियम, 1884 ( 1884 का 4 ) की धारा 14 की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , तथा पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन और नागर विमानन महानिदेशक द्वारा की गई सिफारिशों के आधार पर केन्द्र सरकार,

एतद्वारा , मै . वेदरफोर्ड ऑयल टूल्स एम.ई . लिमिटेड, मुम्बई को मै. प्रेसिजन एनर्जी सर्विसेज , इंक , प्रेसिजन ड्रिलिंग टैक्नोलॉजी की एक डिवीजन- सर्विसेज ग्रुप 500 विन्सकॉट रोड , बैनब्रूक , टेक्सास-76126 , संयुक्त राज्यअमेरिका से मुम्बई हवाईअड्डे पर निम्नलिखित विस्फोटकों का वायुमार्ग द्वारा आयात करने के लिए उक्त नियमावली के नियम 31 के उप- नियम ( 2 ) के उपबंधों से छूट देती है, जिसकी मदों और मात्राओं को नीचे दी गई तालिका में विनिर्दिष्ट किया गया है, नामतः:--- सारणी

2. उक्त सारणी में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा , नामतः :-
(i) नागर विमानन महानिदेशक और भारतीय हवाई अड्डा प्राधिकरण से आवश्यक स्वीकृति प्राप्त की जाएगी और उनके द्वारा लगाई गई शतों , यदि कोई हों, का पालन किया जाएगा;
(ii) 1 जनवरी , 1996 से लागू हुई अन्तरराष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियमावली की धारा 3 के 3.1 के तहत आने वाले प्रथम श्रेणी के विस्फोटकों से संबंधित प्रभाग के प्रभाग 1.4 के ही अनुरूप विस्फोटकों का आयात कियाजायेगा;
( iii) नियम 31 के उप- नियम ( 2 ) के अलावा , उक्त नियमों में यथानिहित विस्फोटकों के कब्जे, परिवहन, प्रयोग और आयात से संबंधित सुसंगत उपबंधों का सख्ती से पालन किया जायेगा;
(iv) उक्तनियमों के अधीन लाइसेंसशुदा विस्फोटक सामग्री के वाहनों की पर्याप्त संख्या हवाई अड्डे पर तैयार रखी जाएगी ताकि विस्फोटक सामग्री को , वायुयान के उतरते ही शीघ्रता से हटाया जासके;

(v) वायुयान को हवाई अड्डे पर दूरस्थ स्थान पर खड़ा किया जाएगा और विस्फोटकों का वायुयान से वाहन में अंतरण शुरू होने से पहले महानिदेशक , नागर विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गार्डों का प्रबंध करको अख्यान और विस्फोटक सामग्री वाहन के चारों ओर कम से कम 300 वर्गमीटर क्षेत्र को घेर लिया जाएगा । उक्त স্বরনো বা যক बनी रहेगी जब तक कि अन्तरण पूरा नहीं हो जाता और अच्छी तरह से बन्द वाहन उक्त स्थान से रवाला नहीं हो जाা:
(vi ) घिरे हुए क्षेत्र के अन्दर कोई भूम्रपान अथवा खुतो बत्ती के उपयोग की अनुमति नहीं होगीः तथा
(vii ) उपर्युक्त विस्फोटक सामग्री को ले जा रहे वाहन उक्त नियमों के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होंगे और रास्ते में कोई अनुचित विलम्ब नहीं किया जाएगा और विस्फोटकों के परिवहन के दौरान उक्त नियमां के सभी उपबंधों और स्थानीय यातायात नियमों और नगर पालिका के विनियमों, यदि कोई हों, का पालन किया जाएगा ।

NOTIFICATION
New Delhi , the 11th February, 2009
S.O.452 (E ) . Whereas , the Central Government has received a proposal made by M /s . Weatherford Oil Tools M.E. Limited, Mumbai , to the Petroleum and Explosives Safety Organisation for permission to import certain explosives by air from United States of America for oil exploration purposes ;
And, whereas , the Petroleum and Explosives Safety Organisation is satisfied that the proposed import of explosives shall be used for oil exploration purposes and, therefore , necessary exemption may be granted from the purview of sub- rule (2) of Rule 31 ofthe Explosives Rules , 1983 ( hereinafter referred to as the said Rules ) which prohibits import or export of explosives specified herein byair;
And, whereas , the Director General of Civil Aviation has , in exercise of the powers conferred by rule 8 of the Aircraft Rules , 1937 , granted necessary permission with certain conditions to M/ s . Weatherford Oil Tools M.Ε. Limited, 931 , Building No. 9 , Solitaire Corporate Park, 167, Guru Hargovindji Marg , Chakala , Andheri (East ) . Mumbai- 400 093 to carry such explosives by air vide their permut number 159 - DG/2008 dated the 2nd day of July , 2008 which is valid up- to the 31st day of December, 2008;
Now, therefore , in exercise of the powers conferred by sub - section (2 ) of Section 14 of the Explosives Act , 1884 (4 of 1884) , and on the recommendations made bythe Petroleum and Explosives Safety Organisation and the Director General of Civil Aviation , the Central Government hereby exempts M/ s . Weatherford Oil Tools M.E. Limited, Mumbai from the provisions of sub - rule ( 2)

of rule 31 of the Explosives Rules , 1983 for import of the following explosives , the items and quantities ofwhich are specified in the Table below , by air from M/ s . Precision Energy Services , Inc. a Division of Precision Drilling Technology Services Group 500 Winscott Road, Benbrook , Texas 75126 United States of America at Mumbai airport namely:--

2. The explosives mentioned in the Table shall be imported subject to the fulfilment of the following conditions , namely :----
(i) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions , if any , imposed by the said authorities shall be complied with;
(ii) explosives conforming only to Division 1.4 of the Divisionrelating to class - 1 Explosives falling under 3.1 of Section 3 of International Air Transport Association Dangerous Goods Regulations , 1996 (37thedition) which became effective on the 1st day ofJanuary, 1996 shall be imported;
(iii) the relevant provisions relating to the possession , transport , use and import of explosives [except sub- rule(2) ofRule 31 ] ofthe said Rules shall be complied with;
(iv) requisite number of explosives vans , licensed under the said Rules , shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing;
(v) aircraft shall be parked at a remote place at the airport and an area of at least five hundred square metres around the aircraft and the explosives van shall be cordoned off by providing adequate number of security guards in consultation with the Director General of Civil Aviation before the transfer of explosives from aircraft to van begins . The arrangement shall continue till such transfer is completed and the van is duly locked and leaves the site;
(vi) smoking or use of naked light shall not be permitted within the cordoned area , and
(vii) vans carrying the explosives shall proceed to the storage magazine licensed under the said Rules and no undue delay shall be made on the way and all provisions of the said Rules and local traffic rules and municipal regulations , if any , shall be complied with during the transportation of the explosives .
