का.आ. 453(अ).-चूंकि , केन्द्र सरकार को, मै. ऑयल इंडिया लिमिटेड, मैटीरियल डिपार्टमेन्ट, पी.ओ. दुलियाजन-786602, जिला डिब्रूगढ़ , असम से तेल खोज प्रयोजन के लिए संयुक्त राज्य अमेरिका से हवाई जहाज द्वारा कुछ विशेष विस्फोटकों को आयात करने की अनुमति हेतु पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन में एक प्रस्ताव प्राप्त हुआ है;
और , चूंकि, पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन संतुष्ट है किविस्फोटकों के प्रस्तावित आयात का उपयोग , तेल खोज प्रयोजन में किया जाएगा और , इसलिए , विस्फोटक नियमावली, 1983 ( इसे यहां उक्त नियमावली कहा गया है ) के नियम 31 के उप- नियम (2 ) के दायरे से आवश्यक छूट प्रदान की जा सकती है , जिसके तहत यहां विनिर्दिष्ट किए गए विस्फोटकों का हवाई जहाज द्वारा आयात अथवा निर्यात निषिद्ध है;
और , चूंकि नागर विमानन महानिदेशक ने वायुयान नियमावली, 1937 के नियम 8 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , अपने परमिट सं. 254- डीजी/2008 दिनांक 20 अक्तूबर, 2008 द्वारा जो कि 31 मार्च, 2009 तक वैध है , इस प्रकार के विस्फोटकों को वायुमार्ग द्वारा ले जाने के लिए मै . ऑयल इंडिया लिमिटेड, डिब्रूगढ़ , असम को कतिपय शर्तों के साथ आवश्यक अनुमति प्रदान की है;
अतः , अब, विस्फोटक अधिनियम , 1884 ( 1884 का 4 ) की धारा 14 की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन और नागर विमानन महानिदेशक द्वारा की गई सिफारिशों के आधार पर केन्द्र सरकार एतद्वारा मै. ऑयल इंडिया लिमिटेड , पी.ओ. दुलियाजन-786602, असम को मै. हैलीबर्टन एक्सपोर्ट इंक. , एक्सप्लोसिव प्रोडक्टस सेन्टर, 8432 साउथ , 1-35 डब्ल्यू, अलवरेडो, टेक्सास-76009 संयुक्त राज्य अमेरिका से कोलकाता हवाई अड्डे पर निम्नलिखित विस्फोटकों का वायुमार्ग द्वारा आयात करने के लिए उक्त नियमावली के नियम 31 के उप - नियम ( 2 ) के उपबंधों से छूट देती है , जिसकी मदों और मात्राओं को नीचे दी गई तालिका में विनिर्दिष्ट किया गया है, नामतः :---

2. उक्त सारणी में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा , नामतः :-
(i ) नागर विमानन महानिदेशक और भारतीय हवाई अड्डा प्राधिकरण से आवश्यक स्वीकृति प्राप्त की जाएगी और उनके द्वारा लगाई गई शर्तों, यदि कोई हों, का पालन किया जाएगा ;
(ii) 1 जनवरी , 1996 से लागू हुई अन्तर्राष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियमावली की धारा 3 के 3.1 के तहत आने वाले प्रथम श्रेणी के विस्फोटकों से संबंधित प्रभाग के प्रभाग 1.4 के ही अनुरूप विस्फोटकों का आयात कियाजायेगा;
(iii) नियम 31 के उप- नियम ( 2 ) के अलावा , उक्त नियमों में यथानिहित विस्फोटकों के कब्जे, परिवहन , प्रयोग और आयात सेसंबंधित सुसंगत उपबंधों का सख्ती से पालन किया जायेगा;
(iv) उक्त नियमों के अधीन लाइसेंसशुदा विस्फोटक सामग्री के वाहनों की पर्याप्त संख्या हवाई अड्डे पर तैयार रखी जाएगी ताकि विस्फोटक सामग्री को, वायुयान के उतरते ही शीघ्रता से हटाया जासके;

( v ) वायुयान को हवाई अड्डे पर दूरस्थ स्थान पर खड़ा किया जाएगा और विस्फोटकों का वायुयान से वाहन में अंतरण शुरू होने से पहले महानिदेशक , नागर विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गाडों का प्रबंध करके वायुयान और विस्फोटक सामग्री वाहन के चारों ओर कम से कम 500 वर्गमीटर क्षेत्र को घेर लिया जाएगा । उक्त व्यवस्था तब तक बनी रहेगी जब तक कि अन्तरण पूरा नहीं हो जाता और अच्छी तरह से बन्द वाहन उक्त स्थान से रवाना नहीं हो जाता;

(vi ) घिरे हुए क्षेत्र के अन्दर कोई धूम्रपान अथवा खुली बत्ती के उपयोग की अनुमति नहीं होगी; तथा

2. The explosives mentioned in the Table shall be imported subject to the fulfilment of the following conditions , in addition to the conditions mentioned in the permit No. 254 - DG/2008 dated the 20th October, 2008 namely:-
(vii ) उपर्युक्त विस्फोटक सामग्री को ले जा रहे वाहन उक्त नियमों के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होंगे और रास्ते में कोई अनुचित विलम्ब नहीं किया जाएगा और विस्फोटकों के परिवहन के दौरान उक्त नियमों के सभी उपबंधों और स्थानीय यातायात नियमों और नगर पालिका के विनियमों, यदि कोई हों, का पालन किया जाएगा ।
[फा. सं. 2 (81 )/2009-विस्फो. ] (i) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions , if any, imposed by the said authorities shall be complied with;

S.O. 453( E) .-Whereas , the Central Government has
(ii ) explosives conforming only to Division 1.4 of the Division relating to class - 1Explosives falling under 3.1 of Section 3 of International Air Transport Association Dangerous Goods Regulations , 1996 (37thEdition) which became effective on the 1st day ofJanuary , 1996, shall be imported;
received a proposal made by M/ s . Oil India Limited, Material
Department, P.O. Duliajan - 786602, Distt . Dibrugarh ,
Assam, to the Petroleum and Explosives Safety
Organisation for permission to import certain explosives
(iii) strict compliance with the relevant provisions relating to the possession , transport , use and import of explosives except sub - rule (2 ) of Rule 31 of the said Rules;
by air from United States of America for oii exploration
purposes;
(iv) requisite number of explosives vans , licensed under the said Rules , shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing ;
And,whereas, the Petroleum and Explosives Safety Organisation is satisfied that the proposed import of explosives shall be used for oil exploration purposes and , therefore , necessary exemption may be granted from the purview of sub - rule (2) of Rule 31 of the Explosives Rules , 1983 (hereinafter referred to as the said Rules ) which prohibit import or export of explosives specified herein by air;
(v) aircraft shall be parked at a remote place at the airport and an area of at least five hundred square metres around the aircraft and the explosives van shall be cordoned off by providing adequate number of security guards in consultation with the Director General of Civil Aviation before the transfer of explosives from aircraft to van begins . The arrangement shall continue till such transfer is completed and the van is duly locked and leaves the site;
(vi) smoking or use of naked light shall not be permitted withinthe cordoned area ; and
And, whereas , the Director General of Civil Aviation has, in exercise of the powers conferred by rule 8 of the Aircraft Rules, 1937 , granted necessary permission with certain conditions to M/ s . Oil India Limited, Dibrugarh , Assam to carry such explosives by air vide their permit number 254 - DG/2008 dated the 20th day of October , 2008 which is valid up to the 31st day ofMarch , 2009;
(vii) vans carrying the explosives shall proceed to the storage magazine licensed under the said Rules and no undue delay shall be made on the way and all provisions of the said Rules and local traffic rules andmunicipal regulations , if any , shall be complied with during the transportation of the explosives .

No. 2 ( 81 )/2008 -Expl . ] Now, therefore, in exercise of the powers conferred by sub - section ( 2 ) of Section 14 of the Explosives Act, 1884 (4 of 1884) , and on the recommendations made by the Petroleum and Explosives Safety Organisation and the Director General of Civil Aviation, the Central Government hereby exempts the M/s . Oil India Limited, P.O. Duliajan -786 602, Assam , from the provisions of sub-
