एट प्रोडक्शन्स श्लम्बर्गर , 1 यू हेनरी बेक्यूरल , बी.पी. 202 , 92142 , क्लेमार्ट सीडेक्स, फ्रांस से कोलकाता हवाई अड्डे पर निम्नलिखित विस्फोटकों का वायुमार्ग द्वारा आयात करने के लिए उक्त नियमावली , केनियम 31 के उप- नियम ( 2 ) के उपबंधों से छूट देती है जिसकी मदोंऔर मात्राओं को नीचे दी गई तालिका में विनिर्दिष्ट किया गया है, नामतः :-

(3) (4) (5) का.आ. 484(अ). चूंकि, केन्द्र सरकार को मै. श्लम्बर्गर एशिया सर्विसेज लिमिटेड, दूसरा तल , वेलिंगटन प्लाजा , 90 , अन्ना सलाई, चेन्नई-600002 तमिलनाडु से तेल खोज प्रयोजनार्थ फ्रांस से हवाई जहाज द्वारा कुछ विशेष विस्फोटकों को आयात करने की अनुमति हेतु पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन में एक प्रस्ताव प्राप्त हुआ है;

2. उक्त सारणी में उल्लिखित विस्फोटकों का आयात निम्नलिखित शर्तों के अध्यधीन होगा , नामतः :-
और , चूंकि, पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन संतुष्ट है कि विस्फोटकों के प्रस्तावित आयात का उपयोग , तेल खोज प्रयोजन में किया जाएगा और , इसलिए विस्फोटक नियमावली , 1983 ( इसे यहां उक्त नियमावली कहा गया है ) के नियम 31 के उप-नियम (2) के दायरे से आवश्यक छूट प्रदान की जा सकती है , जिसके तहत यहां विनिर्दिष्ट किए गए विस्फोटकों का हवाई जहाज द्वारा आयात अथवा निर्यात निषिद्ध है;
(i) नागर विमानन महानिदेशक और भारतीय हवाई अड्डा प्राधि- करण से आवश्यक स्वीकृति प्राप्त की जाएगी और उनके द्वारा लगाई गई शतों, यदि कोई हों, का पालन किया जाएगा;
(ii) 1 जनवरी , 1996 से लागू हुई अन्तर्राष्ट्रीय वायु परिवहन एसोसिएशन खतरनाक माल विनियमावली की धारा 3 के 3.1 के तहत आने वाले प्रथम श्रेणी के विस्फोटकों से संबंधित प्रभाग के प्रभाग 1.4 के ही अनुरूप विस्फोटकों का आयात कियाजायेगा;
और, जबकि नागर विमानन महानिदेशक ने वायुयान नियमावली, 1937 के नियम 8 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , अपने परमिट सं. 238-डीजी/2008 , दिनांक 29 सितम्बर , 2008 द्वारा जो कि 31 जनवरी , 2009 तक वैध है, इस प्रकार के विस्फोटकों को वायु-मार्ग द्वारा ले जाने के लिए मै. श्लम्बर्गर एशिया सर्विसेस लिमिटेड, चेन्नई को कतिपय शतों के साथ आवश्यक अनुमति प्रदान की है; (iii) नियम 31 के उप-नियम ( 2 ) के अलावा , उक्त नियमों में यथा निहित विस्फोटकों के कब्जे, परिवहन , प्रयोग और आयात से संबंधित सुसंगत उपबंधों का सख्ती से पालन किया जायेगा;
अतः , अब , विस्फोटक अधिनियम, 1884 ( 1884 का 4 ) की धारा 14 की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा पेट्रोलियम तथा विस्फोटक सुरक्षा संगठन और नागर विमानन महानिदेशक द्वारा की गई सिफारिशों के आधार पर केन्द्र सरकार एतद्वारा मै. श्लम्बर्गर एशिया सर्विसेज लिमिटेड , दूसरा तल , वेलिंगटन प्लाजा, 90 , अन्ना सलाई, चेन्नई-600002 तमिलनाडु को मै. एट्यूड्स
(iv) उक्तनियमों के अधीन लाइसेंसशुदा विस्फोटक सामग्री के वाहनों की पर्याप्त संख्या हवाई अड्डे पर तैयार रखी जाएगी ताकि विस्फोटक सामग्री को, वायुयान के उतरते ही शीघ्रता से हटाया जासके;

said rules, for import of the following explosives , the items and quantities of which are specified in the Table below , by air from M/ s . Etudes Et Production Schlumberger 1 , Rue Henri Becquerel , B.P. 202, 92142 Clamart Cedex, France at Kolkata airport , namely :---

(inkilograms) ( v ) वायुयान को हवाई अड्डे पर दूरस्थ स्थान पर खड़ा किया जाएगा और विस्फोटकों का वायुयान से वाहन में अंतरण शुरू होने से पहले महानिदेशक, नागर विमानन से परामर्श करके पर्याप्त संख्या में सुरक्षा गार्डों का प्रबंध करके वायुयान और विस्फोटक सामग्री वाहन के चारों ओर कम से कम 500 वर्गमीटर क्षेत्र को घेर लिया जाएगा । उक्त व्यवस्था तब तक बनी रहेगी जब तक कि अन्तरण पूरा नहीं हो जाता और अच्छी तरह से बन्द वाहन उक्त स्थान से रवाना नहीं हो जाता;

(vi ) घिरे हुए क्षेत्र के अन्दर कोई धूम्रपान अथवा खुली बत्ती के उपयोग की अनुमति नहीं होगी ; तथा

2. The explosives mentioned in the Table shall be imported subject to the fulfillment of the following conditions , namely :--
(vii ) उपर्युक्त विस्फोटक सामग्री को ले जा रहे वाहन उक्त नियमों के अधीन लाइसेंसयुक्त भण्डारण मैगजीन की ओर अग्रसर होंगे और रास्ते में कोई अनुचित विलम्ब नहीं किया जायेगा और विस्फोटकों के परिवहन के दौरान उक्त नियमों के सभी उपबंधों और स्थानीय यातायात नियमों और नगर पालिका के विनियमों , यदिकोई हों, का पालन किया जायेगा ।
(i) necessary clearances are obtained from the Director General of Civil Aviation and the Airports Authority of India and conditions , if any, imposed by the said authorities shall be complied with;

(ii) explosives conforming only to Division 1.4 of the Division relating to class 1 Explosives falling under 3.1 of Section 3 of International Air Transport Association Dangerous Goods Regulations , (37th Edition) which became effective on the 1st January, 1996 shall be imported;

(iii) the relevant provisions relating to the possession , transport , use and import of explosives , [ cxcept sub- rule (2) of Rule 31 ] of the said rules shall be complied with;
S.O. 484 ( E) .-Whereas the Central Government has received a proposal made by M/ s . Schlumberger Asia Services Limited , 2nd Floor , Wellington Plaza, 90 , Annai Salai , Chennai - 600 002 , Tamil Nadu, to the Petroleum and Explosives Safety Organisation for permission to import certain explosives by air from France for oil exploration purposes;
(iv) requisite number of explosives vans , licensed under the said Rules , shall be kept ready at the airport so that the explosives can be removed expeditiously from the aircraft after its landing;
And, whereas the Petroleum and Explosives Safety Organisation is satisfied that the proposed import of ex- plosives shall be used for oil exploration purposes and , therefore necessary exemption may be granted from the purview of sub - rule (2 ) of rule 31 of the Explosives Rules , 1983 (hereinafter referred to as the said rules ) which pro- hibitimport or export of explosives specified herein by air;
(v) aircraft shall be parked at a remote place at the airport and an area of at least five hundred square metres around the aircraft and the explosives van shall be cordoned off by providing adequate number of security guards in consultation with the Director General of Civil Aviation before the transfer of explosives from aircraft to van begins . The arrangement shall continue till such transfer is completed and the van is duly locked and leaves the site;
(vi) smoking or use of naked light shall not be permitted within the cordoned area ; and
And, whereas the Director General of Civil Aviation has , in exercise of the powers conferred by rule 8 of the Aircraft Rules , 1937, granted necessary permission with certain conditions to M/ s . Schlumberger Asia Services Lim- ited, Chennai to carry such explosives by air vide their permit number 238 -DG/2008 dated the 29th September, 2008 which is valid up to the 31st January , 2009 .
(vii) vans carrying the explosives shall proceed to the storage magazine licensed under the said rules and no undue delay shall be made on the way and all provisions of the said rules and local traffic rules and municipal regulations , if any , shall be complied with during the transportation of the explosives .

No. 2 ( 71 )/2008-Expl . ] Now, therefore, in exercise of the powers conferred by sub - section (2) of Section 14 of the Explosives Act , 1884 (4 of 1884) , the Central Government hereby exempts M/s. Schlumberger Asia Services Limited, 2nd Floor , Wellington Plaza, 90, Annai Salai , Chennai - 600 002 , Tamil Nadu, from the provisions of sub -rule (2) of rule 31 of the
