का.आ. 487(अ).- यतः मै ० गोपालन इन्टरप्राइजेज (इंडिया) प्राईवेट लिमिटेड, जो कर्नाटक राज्य का निजी संगठन है, ने कर्नाटक राज्य में ग्राम हुडी, के आर पुरम, व्हाइटफील्ड, बंगलौर में सूचना प्रौद्योगिकी एवं सूचना प्रौद्योगिकी समर्थित सेवाओं हेतु एक क्षेत्र विशिष्ट विशेष आर्थिक जोन की स्थापना हेतु विशेष आर्थिक जोन अधिनियम, 2005 (2005 का 28) , (जिसे एतद्द्दश्चात् उक्त अधिनियम कहा गया है) की धारा 3 के अंतर्गत प्रस्ताव किया है;
और यतः केन्द्र सरकार इस बात से संतुष्ट है कि उक्त अधिनियम की धारा 3 की उप धारा (8 ) के अंतर्गत अपेक्षाओं तथा अन्य संबंधित अपेक्षाओं को पूरा कर लिया गया है और उसने कर्नाटक राज्य में ग्राम हुडी, के आर पुरम , व्हाइटफील्ड, बंगलौर में सूचना प्रौद्योगिकी एवं सूचना प्रौद्योगिकी समर्थित सेवाओं हेतु एक क्षेत्र विशिष्ट विशेष आर्थिक जोन की स्थापना हेतु क्षेत्र विशिष्ट विशेष आर्थिक जोन के विकास प्रचालन एवं रखरखाव हेतु उक्त अधिनियम की धारा 3 की उप धारा (10) के अंतर्गत दिनांक 7 जनवरी, 2008 को अनुमोदन पत्र प्रदान कर दिया है;
अतः अब विशेष आर्थिक जोन अधिनियम, 2005 की धारा 4 की उप धारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विशेष आर्थिक जोन नियम, 2006 के नियम 8 के अनुसरण में केन्द्र सरकार एतद्वारा कर्नाटक राज्य में ग्राम हुडी, के आर पुरम, व्हाइटफील्ड, बंगलौर में सूचना प्रौद्योगिकी एवं सूचना प्रौद्योगिकी समर्थित सेवाओं हेतु एक क्षेत्र विशिष्ट विशेष आर्थिक जोन की स्थापना हेतु निम्नलिखित क्षेत्र को एक विशेष आर्थिक जोन के रुप में अधिसूचित करती है जिसमें निम्नलिखित तालिका में उल्लिखित सर्वेक्षण संख्याएं और क्षेत्र शामिल हैं, अर्थात: -

S.O. 487 ( E ) .- Whereas M/ s Gopalan Enterprises ( India ) Private Limited , a Private Organization in the State of Karnataka , has proposed under section 3 of the Special Economic Zones Act , 2005 (28 of 2005 ) (hereinafter referred to as the said Act) , to set up a sector specific Special Economic Zone for information technology and information technology enabled services at Hoodi Village, K.R. Puram , Whitefield, Bangalore in the State of Karnataka;
And whereas the Central Government is satisfied that requirements under sub- section ( 8) of section 3 of the said Act, and other related requirements are fulfilled and it has granted letter of approval under sub- section (10) of section 3 of the said Act for development , operation and maintenance of the sector specific Special Economic Zone for information technology and information technology enabled services at Hoodi Village , K.R. Puram , Whitefield , Bangalore, in the State of Karnataka on 7th day of January 2008 ;
Now, therefore, in exercise of the powers conferred by sub - section (1) of section 4 of the Special Economic Zones Act, 2005 and in pursuance of rule 8 of the Special Economic Zones Rules , 2006, the Central Government hereby notifies the following area at Hoodi Village , K.R. Puram , Whitefield, Bangalore , in the State of Karnataka, comprising of the survey numbers and the area given below in the Table , as a Special T nic Zone , namely: - भारत का राजपत्र असाधारण

का.आ. 488(अ).विशेष आर्थिक जोन अधिनियम, 2005 (2005 का 28) की धारा 53 की उप धारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा दिनांक 16 फरवरी , 2009 को उस तारीख के रुप में नियत करती है जिस तारीख से मै० गोपालन इन्टरप्राइजेज (इंडिया) प्राईवेट लिमिटेड द्वारा कर्नाटक राज्य में ग्राम हुडी, के आर पुरम, व्हाइटफील्ड, बंगलौर में सूचना प्रौद्योगिकी एवं सूचना प्रौद्योगिकी समर्थित से वाओं हेतु एक क्षेत्र विशिष्ट विशेष आर्थिक जोन की स्थापना हेतु विशेष आर्थिक जोन को सीमाशुल्क अधिनियम, 1962की धारा 7 के अंतर्गत अंतर्देशीय कंटेनर डिपो माना जाएगा ।

S.O. 488 (E) .- In exercise of the powers conferred by sub-section (2) of section 53 of the Special Economic Zones Act, 2005 (28 of 2005 ) , the Central Government hereby appoints the 16th day of February , 2009 as the date from which the sector specific Special Economic Zone for information technology and information technology enabled services at Hoodi Village , K.R. Puram , Whitefield, Bangalore in the State of Karnataka proposed to be developed by M/ s . Gopalan Enterprises (India) Private Limited shall be deemed to be Inland Container Deport under section 7 of the Customs Act , 1962: -

का.आ. 489(अ) .-विशेष आर्थिक जोन अधिनियम, 2005 (2005 का 28) की धारा 13 की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का उपयोग करते हुए केन्द्रीय सरकार एतद्वारा उक्त अधिनियम के प्रयोजनार्थ मै० गोपालन इन्टरप्राइजेज (इंडिया) प्राईवेट लिमिटेड द्वारा कर्नाटक राज्य में ग्राम हुडी, के आर पुरम , व्हाइटफील्ड, बंगलौर में सूचना प्रौद्योगिकी एवं सूचना प्रौद्योगिकी समर्थित सेवाओं हेतु एक क्षेत्र विशिष्ट विशेष आर्थिक जोन की स्थापना हेतु क्षेत्र विशिष्ट विशेष आर्थिक जोन के लिए एक समिति, जिसे अनुमोदन समिति कहा जाएगा, गठित करती है, जिसके अध्यक्ष और सदस्य निम्नानुसार हैं, अर्थातः-

S.O. 489(E) .-- In exercise of the powers conferred by sub-section (1) of section 13 ofthe Special Economic Zones Act, 2005 (28 of 2005) , the Central Government hereby constitutes a Committee to be called the Approval Committee for the sector specific Special Economic Zone for information technology and information technology enabled services at Hoodi Village, K.R. Puram, Whitefield, Bangalore in the State of Karnataka proposed to be developed by M/ s Gopalan Enterprises (India) Private Limited for the purposes of the said Act consisting of the following Members , namely: -
1. Development Commissioner of the Special Economic Zone
Chairperson , ex-Officio 2.
Member , ex-Officio Director or Deputy Secretary to the Government of India, Ministry of Commerce and Industry , Department of Commerce or his nominee not below the rank of Under Secretary to the Government of India
3. Zonal Joint Director General of Foreign Trade, Bangalore Member , ex-Officio 4.
Member, ex -Officio Commissioner of Customs or Central Excise having territorial jurisdiction over the Special Economic Zone or his nominee not below the rank of Joint Commissioner

6. Director (Banking) in the Ministry of Finance , Banking Division, Government of India

2. विकास आयुक्त के रुप में कार्यों का निष्ष्पादन करने के लिए निदेशक, सॉफ्टवेयर टेक्नॉलोजी पार्क्स ऑफ इंडिया, बंगलौर को केन्द्र सरकार, वाणिज्य विभाग तथा विशेष आर्थिक जोन अनुमोदन बोर्ड द्वारा समय- समय पर जारी किए गए अनुदेशों का अनुपालन करना होगा । वह वाणिज्य विभाग तथा विशेष आर्थिक जोन अनुमोदन बोर्ड द्वारा यथानिर्धारित आवधिक रिपोर्ट भी भेजेंगे । वह विकास आयुक्त के रुप में की गई सभी कार्य वाहियों के लिए वाणिज्य विभाग के प्रति जवाबदेह होंगे । तथापि, पदधारी की छुट्टी, स्थानांतरण, तैनाती आदि जैसे वैयक्तिक मामले सूचना प्रौद्योगिकी विभाग/सॉफ्टवेयर टेक्नोलॉजी पार्क ऑफ इण्डिया, जैसी भी स्थिति हो, द्वारा शासित होंगे ।

2. For discharge of the functions as Development Commissioner, Director , Software Technology Parks of India, Bangalore, shall abide by the instructions of the Central Government , Department of Commerce and the Board of Approval on Special Economic Zones , issued from time to time . He shall also be sending periodic reports, as prescribed by the Department of Commerce and the Board of Approval on Special Economic Zones . He shall be responsible to the Department of Commerce for all the actions taken as Development Commissioner . However, the personal matters like leave, transfer , posting etc. of the incumbent shall be governed by the Department of Information Technology /Software Technology Park of India, as the casemaybe.
