सा.का.नि. 101 (अ). चूंकि वायुयान अधिनियम, 1934 (1934 का 22 ) की धारा 14 की अपेक्षानुसार, भारत सरकार , नागर विमानन मंत्रालय के दिनांक 18 दिसम्बर , 2008 की अधिसूचना संख्या सा.का.नि. 867( अ ) के द्वारा , वायुयान नियमावली , 1937 में और संशोधन करने के लिए, वायुयान ( संशोधन ) नियमावली, 2008 का प्रारूप प्रकाशित कर दिया गया था । उस तारीख से जब भारत के राजपत्र की प्रतियां जिसमें उक्त अधिसूचना प्रकाशित की गई थी तीस दिन की अवधि की समाप्ति से पूर्व ऐसे सभी व्यक्तियों से आपत्तियाँ और सुझाव मांगते हुए, जिनके उनसे प्रभावित होने की संभावना थी, उन्हें सार्वजनिक रूप से उपलब्ध करा दी गई थीं;
और चूंकि उक्त अधिसूचना की प्रतियां , दिनांक 22 दिसम्बर , 2008 को सार्वजनिक रूप से उपलब्ध करा दी गई थीं;
और चूंकि प्रारूप नियमों पर उक्त अधिसूचना में विनिर्दिष्ट अवधि में किसी भी व्यक्ति से कोई भी आक्षेप या सुझाव प्राप्त नहीं हुए हैं;
अतः , अब , केन्द्रीय सरकार उक्त वायुयान अधिनियम की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए वायुयान नियमावली , 1937 में आगे और संशोधन करने के लिए निम्नलिखित नियम बनाती है , नामशः:
1. ( 1 ) इन नियमों का संक्षिप्त नाम वायुयान ( चौथा संशोधन ) नियम, 2009 है ।
(2) ये राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त
होंगे ।
2. वायुयान नियमावली , 1937 में, नियम 35 के उप-नियम (4 ) में, नियम 48 के उप- नियम (2क) में, नियम 62 के

उप-नियम (2 ) में , नियम 87 के उप- नियम (3 ) में , नियम 133 ग के उप -नियम ( 4 ) में और अनुसूची XI के पैरा 5 के उप- पैरा ( 5 ) में" लेखा अधिकारी , केन्द्रीय वेतन एवं लेखा कार्यालय , नागर विमानन विभाग , नई दिल्ली " शब्दों के स्थान पर निम्नलिखित शब्दोंको प्रतिस्थापित किया जाएगा , नामशः
" वेतन एवं लेखा कार्यालय , नागर विमानन महानिदेशालय , नागर विमानन मंत्रालय , नई दिल्ली । "

टिप्पण:-मूल नियम अधिसूचना संख्या वी-26 , तारीख 23 मार्च , 1937 के द्वारा भारत के राजपत्र के भाग II , खण्ड 3 , उप-खण्ड ( i ) में प्रकाशित किए गए थे और उनमें तारीख 9 जनवरी , 2009 की संख्या सा.का.नि. 21 (अ) के द्वारा अंतिम संशोधन किया गया ।

New Delhi , the 19th February, 2009
G.S.R. 101 (E) .-Whereas the Draft of the Aircraft (Amendment) Rules , 2008 further to amend the Aircraft Rules , 1937, were published, as required by Section 14 of the Aircraft Act, 1934(22 of 1934) , vide notification ofthe Government of India in the Ministry of Civil Aviation numberG.S.R. 867(E) , dated the 18th December , 2008 , for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirtydays from the date on which copies of the Gazette of India in which the said notification was published, were made available to public;

And whereas copies of the said notification were made available to the public on the 22nd December , 2008 ;
And whereas no objections or suggestions have been received from any person in respect of the draft rules within the period specified in the said notification;
Now, therefore, in exercise of the powers conferred by Section 5 of the said Aircraft Act , the Central Government hereby makes the following rules further to amend the Aircraft Rules , 1937 , namely :-
1. (1) These rules may be called the Aircraft (4thAmendment) Rules, 2009.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Aircraft Rules , 1937 , in sub -rule (4) of
[PART II-SEC. 3 (i) ]
rule 35 , sub - rule (2A) of rule 48 , sub - rule (2) of rule 62 , sub - rule (3 ) of rule 87 , sub - rule (4) of rule 133C and sub - paragraph ( 5) of paragraph 5 of Schedule XI , for the words"Accounts Officer, Central Pay and Accounts Office , CivilAviationDepartment , New Delhi " , the following words shall be substituted , namely :
"Pay and Accounts Office , Director General ofCivil Aviation , Ministry of Civil Aviation , New Delhi . "
