टिप्पण: मूल अधिसूचना सं. 52/2003- सीमा शुल्क, दिनांक 31 मार्च , 2003 , भारत के राजपत्र, असाधारण, भाग II , खंड 3 , उप-खंड ( i ) में सं. सा.का.नि. 274( अ ) , दिनांक 31 मार्च, 2003 के जरिए प्रकाशित हुई थी और इसमें अंतिम बार संशोधन अधिसूचना सं. 60/2008- सीमा शुल्क, दिनांक 5 मई, 2008 द्वारा सं. सा.का.नि. 334( अं ) , दिनांक 5 मई , 2008 के जरिए किया गया था ।

सा.का.नि. 109(अ).-सीमा शुल्क अधिनियम, 1962 (1962 का 52 ) की धारा 25 की उप - धारा ( 1 ) के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार, इस बात से संतुष्ट होते हुए कि ऐसा करना सार्वजनिक हित में आवश्यक है , एतद्वारा निर्देश देती है कि भारत सरकार,वित्त मंत्रालय ( राजस्व विभाग ) , की अधिसूचना सं 52/2003-सीमा शुल्क, दिनांक 31 मार्च , 2003 , भारत के राजपत्र , असाधारण , भाग II , खण्ड 3 , उप-खण्ड ( i) सं. सा.का.नि. 274( अ) में प्रकाशित , दिनांक 31 मार्च, 2003 में संशोधन किया जायेगा , अर्थात्- उक्त अधिसूचना में,-
( 1) परिशिष्ट-1 में, क्रम संख्या 15क और उससे संबंधित प्रविष्टियों के बाद , निम्नलिखित क्रम संख्या और प्रविष्टियों को जोड़ा जायेगा , अर्थात्:-
" 15ख. दवाइयों के खुदरा पैक के नमूनों ( इकाई द्वारा निर्यातित थोक पैक से पुनः पैक ) का अनुरक्षण या स्थिरता की किसी वैधानिक जरूरतों के लिये आयात " ।
G.S.R. 109(E).-In exercise of the powers conferred by sub -section ( 1 ) ofSection 25 of the Customs Act, 1962 (52 of 1962), the Central Government being satisfiedthat it isnecessary in the public interest so to do , hereby makes the following further amendments in the notification ofthe Government of India in the Ministry ofFinance (Department ofRevenue) , No. 52/2003 - Customs , dated the 31st March, 2003, published in the Gazette of India, Extraordinary , Part II , Section, 3 , Sub - section ( i ) vide number G.S.R. 274(E) , dated the 31st March, 2003 , namely :----
Inthe said notification,--
(2) परिशिष्ट- V में , क्रम संख्या 31 की प्रविष्टि के लिये , निम्नलिखित प्रविष्टि को प्रतिस्थापित किया जाएगा , अर्थात्:- " निर्दिष्टित क्रम संख्या 1 से क्रम संख्या 29 तक संबंधित माल कीकीमत का प्रत्येक वित्तीय वर्ष में पुर्जों पर कीमत के 5 प्रतिशत तक " ।
(i) in ANNEXURE- I , after serial number 15A and the entries relatingthereto, the following serial number and entries shall be inserted, namely:-

(ii) in the ANNEXURE- V , for the entry against serial number 31 , the following entry shall be substituted, namely:---
"Spares upto a value of 5 per cent of the value of respective goods specified at Sl . No. 1 to Sl . No. 29 ineach financial year . " .

Note : The principal notification No. 52/ 2003- Customs , dated the 31st March, 2003 was published in the Gazette of India, Extraordinary , Part II , Section 3 , Sub- section (i ) vide number G.S.R. 274 ( E) , dated the 31stMarch, 2003 and last amended by notification No. 60/2008- Customs , dated the 5th May, 2008 published vide number G.S.R. 334(E), dated the 5th May,2008.

सा.का.नि. 110(अ).-अतिरिक्त उत्पाद शुल्क ( विशेष महत्व के सामान) अधिनियम , 1957 ( 1957 का 58 ) की धारा 3 की उप -धारा ( 3 ) और अतिरिक्त उत्पाद शुल्क ( वस्त्र एवं वस्त्र निर्मित सामान ) अधिनियम , 1978 ( 1978 का 40 ) की धारा 3 की उप - धारा (3 ) के साथ पठित, केन्द्रीय उत्पाद शुल्क अधिनियम, 1944 ( 1944 का 1 ) की धारा 5क की उप - धारा ( 1 ) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार , इस बात पर संतुष्ट होने पर कि ऐसा करना सार्वजनिक हित में आवश्यक है , एतद्वारा भारत सरकार , वित्त मंत्रालय ( राजस्व विभाग ) की अधिसूचना सं. 22/2003 केन्द्रीय उत्पाद शुल्क, दिनांक 31 मार्च, 2003 , भारत के राजपत्र , असाधारण, भाग- II , खण्ड 3 , उप- खण्ड ( i ) सं. सा.का.नि. 265( अ ) , दिनांक 31 मार्च, 2003 में आगे संशोधन करती है अर्थात्:-
उक्त अधिसूचना में , परिशिष्ट- V में , क्रम संख्या 31 की प्रविष्टिके लिये , निम्नलिखित प्रविष्टि को प्रतिस्थापित किया जायेगा , अर्थात्:-
" निर्दिष्टित क्रम संख्या 1 से क्रम संख्या 29 तक संबंधित माल की कीमत का प्रत्येक वित्तीय वर्ष में 5 प्रतिशत तक पुर्जों की कीमत" ।

G.S.R. 110(E) .-In exercise of the powers conferred by sub - section ( 1 ) of Section 5A of the Central Excise Act, 1944 (1 of 1944) , read with sub- section (3 ) ofSection 3 of the Additional Duties of Excise (Goods of Special Importance) Act, 1957 (58 of 1957) and sub - section (3 ) of Section 3 ofAdditional Duties ofExcise (Textile and Textile Articles) Act, 1978 (40 of 1978 ) , the Central Government, onbeing satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments inthe notification ofthe Government of India in the Ministry ofFinance (Department of Revenue) , No. 22/2003- Central Excise, dated the 31st March , 2003 , published in the Gazette ofIndia, Extraordinary , Part II , Section 3 , Sub- section (i) vide number G.S.R. 265 (E) , dated the 31st March , 2003 , namely:--
