G.S.R. 112(E) .-In exercise ofthe powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following rules further to amend the Central Excise and Customs Department, Lower Division ClerkRecruitment Rules , 2002, namely :-
सा.का.नि. 112(अ). राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय उत्पाद शुल्क और सीमाशुल्क विभाग अवर श्रेणी लिपिक भर्ती नियम, 2002 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. ( 1) These rules may be called the Central Excise and Customs Department, Lower Division Clerk Recruitment (Amendment) Rules, 2009.
1. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय उत्पाद शुल्क और सीमा शुल्क विभाग अवर श्रेणी लिपिक भर्ती ( संशोधन ) नियम , 2009है ।
(2) These rules shall come into force on the date oftheir publication in the Official Gazette .
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. In the Schedule to the Central Excise and Customs Department, Lower Division Clerk Recruitment Rules , 2002, under column 12 , the existing "Note " shall be renumber as "Note 1" and after as renumbered "Note 1" the following "Note 2 " shall be added :-
2. केन्द्रीय उत्पाद शुल्क और सीमाशुल्क विभाग अवर श्रेणी लिपिक भर्ती नियम , 2002 की अनुसूची में , स्तंभ 12 के अधीन , विद्यमान ' टिप्पण ' को " टिप्पण 1 " के रूप में पुनःसंख्यांकित किया जाएगा और इस प्रकार पुनःसंख्यांकित " टिप्पण 1 " के पश्चात्, निम्नलिखित " टिप्पण 2 " जोड़ा जाएगा :
Note 2 : " If no suitable candidate is available from the cadre mentioned above for promotion for the particular year, the unfilled vacancies allotted to that cadre shall be filled up from among the qualified persons from the other cadres , notwithstanding the ratio mentioned above . " टिप्पण 2 :-" यदि विशिष्ट वर्ष के संबंध में प्रोन्नति के लिए ऊपर वर्णित काडर में से कोई उपयुक्त अभ्यर्थी उपलब्ध नहीं है , तो उस काडर में आवंटित भरी न गई रिक्तियां , ऊपर वर्णित अनुपात के होते हुए भी , अन्य काडरों के अर्हित व्यक्तियों में से भरी जाएंगी । "

Note : The principle rules were published in the Gazette of India, vide number G.S.R. 377, dated the 21st September, 2002 and subsequently amended vide G.S.R. 78 (E), dated the 28th January, 2004 and G.S.R. 73 (E) , dated the 15th February, 2005.
टिप्पण:-मूल नियम भारत के राजपत्र में , सा.का.नि. 377 , तारीख 21 सितम्बर , 2002 द्वारा प्रकाशित किए गए थे और उनमें पश्चात्वर्ती संशोधन सा.का. नि. 78 (अ ) , तारीख 28 जनवरी, 2004 तथा सा.का. नि. 73 ( अ ) , तारीख 15 फरवरी, 2005 द्वारा किए गए थे ।
