सा.का.नि. 113 (अ). राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय उत्पाद शुल्क और सीमा शुल्क विभाग आशुलिपिक श्रेणी 2 और आशुलिपिक श्रेणी 3 नियम, 2004 का और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय उत्पाद शुल्क और सीमा शुल्क विभाग आशुलिपिक श्रेणी-2 और आशुलिपिक श्रेणी-3 भर्ती ( संशोधन ) नियम , 2009 है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे ।
2. केन्द्रीय उत्पाद शुल्क और सीमा शुल्क विभाग आशुलिपिक श्रेणीं -2 और आशुलिपिक श्रेणी-3 भर्ती नियम, 2004 की अनुसूची में,-
(क) आशुलिपिक श्रेणी-2 के पद से संबंधित क्रम सं. 1 केसामने ,-
( i ) स्तंभ 7 , 8 और 10 में की विद्यमान प्रविष्टियों के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्:-
"लागू नहीं होता । "
( ii) स्तंभ 11 में की विद्यमान प्रविष्टियों के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्:-
"प्रोन्नति द्वारा , जिसके न हो सकने पर प्रतिनियुक्ति द्वारा "

(iii) स्तंभ 12 में की विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्:-
"प्रोन्नति:
5200-20200 रु. के वेतनमान और 2400 रु. के ग्रेड वेतन में ऐसे आशुलिपिक श्रेणी 3 , जिन्होंने उस श्रेणी में आठ वर्ष नियमित सेवा की है , से प्रोन्नति ।
प्रतिनियुक्ति:
केन्द्रीय सरकार के ऐसे अधिकारी :
(क) (i) जो नियमित आधार पर सदृश पद धारण किए हुए हैं; या
(ii) जिन्होंने मूल काडर/ विभाग में, 5200-20200 रु. (पूर्वपुनरीक्षित 4000-6000 रु. ) के वेतनमान और 2400 रु. ग्रेड वेतन में या समतुल्य वेतनमान में आठ वर्ष नियमित सेवा की है ।
टिप्पण 1: - प्रतिनियुक्ति की अवधि , जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्तिकी अवधि है साधारणतया 3 वर्ष से अधिक नहीं होगी ।
टिप्पण 2:- प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । "
(ख) आशुलिपिक श्रेणी 3 के पद से संबंधित क्रम सं. 2 के सामने , स्तंभ 7 में की विद्यमान प्रविष्टियों के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्:-

namely:--- "By promotion failing which by deputation" ;
" 18 से 27 वर्ष ( केन्द्रीय सरकार द्वारा जारी किए गए अनुदेशों या आदेशों के अनुसार सरकारी सेवकों के लिए शिथिल करके 40 वर्ष तक की जा सकती है । )
(iii) in column 12 , for the existing entries , the following entries shall be substituted , namely:-
टिप्पण: आयु सीमा अवधारित करने की निर्णायक तारीख वह होगी जो कर्मचारी चयन आयोग द्वारा यथा विज्ञापित की जाए । "

टिप्पण: मूल नियम भारत के राजपत्र , भाग II, खण्ड 3 , उप-खण्ड (i) में सा.का.नि. 710 ( अ ) , तारीख 26 अक्तूबर , 2004 द्वारा प्रकाशित किए गए थे और अधिसूचना सं. सा.का.नि. 408 ( अ ) तारीख 28 मई , 2008 तथा द्वारा उसमें पश्चात्वर्ती संशोधन किए गए ।
(a) (i) holding analogous post on regular basis , or
MINISTRY OF FINANCE (Department of Revenue)
( ii) with eight years regular service in the pay scale of Rs . 5200-20200 ( Pre- revised Rs . 4000-6000) and grade pay of Rs . 2400 or equivalent in the parent cadre/department .

Note 1 : Period of deputation including the period of deputation in another ex - cadre post held imme- diately preceding this appointment in the same or some other organization/department of Central Government shall ordinarily not exceeded three years .
G.S.R. 113 (E) . In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules further to amend the Central Excise and Customs Department Stenographer Grade- II and Stenographer Grade - III Recruitment Rules , 2004, namely:-
Note 2: The maximum age limit for appointment by depu- tation shall not be exceeding 56 years on the closing date of receipt of application . " 1. (1 ) These rules may be called the Central Excise and Customs Department Stenographer Grade - II and Stenographer Grade - III Recruitment ( Amendment ) Rules , 2009.
(B) against serial number 2 , relating to the post of StenographerGrade - III , in column 7 for the exist- ing entries , the following entry shall be substi- tuted namely:-
(2) These rules shall come into force on the date oftheir publication in the Official Gazette.
" 18 to 27 years ( relaxable for Government Servants upto 40 years in accordance with the instructions or orders issued by the Central Government) .
2. In the Schedule to the Central Excise and Customs Department Stenographer Grade - II and Stenographer Grade- III Recruitment Rules, 2004 ,-
Note : The crucial date for determining the age limit shall be as advertised by the Staff Selection Commission . " (A) against serial number 1 relating to the post of Stenographer Grade - II ,-
