ऊपर यथाविनिर्दिष्ट अवधि के अवसान के पूर्व उक्त प्रारूप नियमों के संबंध में किसी व्यक्ति से प्राप्त किन्हीं आक्षेपों या सुझावों पर प्राप्त केन्द्रीय सरकार द्वारा विचार किया जाएगा ।

1. (1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री ( तीसरा संशोधन ) नियम, 2009 है ।
को प्रवृत्त होंगे । (2) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख सा.का.नि. 115(अ).-औषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप जिसे केन्द्रीय सरकार औषधि तकनीकी सलाहकार बोर्ड से परामर्श किए बिना बनाने का प्रस्ताव करती है , क्योंकि उसकी यह राय है कि ऐसी परिस्थितियां उत्पन्न हो गई हैं जिनके कारण ऐसा परामर्श किए बिना नियम बनाना आवश्यक हो गया है ;
और केन्द्रीय सरकार , इन नियमों के बनने के छह मास के भीतर औषधि तकनीकी सलाहकार बोर्ड से परामर्श करने का प्रस्ताव करती है ;
2. औषधि और प्रसाधन सामग्री नियम , 1945 के नियम , 43क में " चेन्नई , कोलकाता, मुंबई , कोचीन , न्हवा शेवा और कांडला; समुद्र द्वारा भारत में आयातित औषधि की बाबत " शब्दों के स्थान पर " चेन्नई , कोलकाता , मुम्बई, कोचीन , न्हवा शेवा , कांडला और इनलैंड कंटेनर डिपो , तुगलकाबाद और पटपड़गंज , दिल्ली : समुद्र द्वारा भारत में आयातित औषधि की बाबत " शब्द रखे जाएंगे ।

पाद टिप्पण :-30 जून, 2005 तक यथा संशोधित मूल नियम अतः अब, औषधि और प्रसाधन सामग्री अधिनियम , 1940 (1940का 23 ) की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित प्रारूप नियम उक्त अधिनियम की उक्त धाराओं की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है , प्रकाशित किया जाता है और सूचना दी जाती है कि उक्त प्रारूप पर उस तारीख से , जिसको उस राजपत्र की प्रतियां जिसमें यह अधिसूचना प्रकाशित की जाती है, जनता को उपलब्ध करा दी जाती हैं , पैंतालिस दिन की अवधि के अवसान पर या उसके पश्चात् विचार किया जाएगा ।
औषधि और प्रसाधन अधिनियम , 1940 और औषधि और प्रसाधन नियम , 1945 पर भारत सरकार के प्रकाशन पीडीजीएचएस-93 में प्रकाशित किए गए थे और अंतिम संशोधन सा.का.नि. 46( अ ) तारीख 22 जनवरी , 2009 द्वारा किया गया ।
आक्षेप या सुझाव , यदि कोई हो, सचिव , ( स्वास्थ्य) स्वास्थ्य और परिवार कल्याण मंत्रालय , भारत सरकार , निर्माण भवन , नई दिल्ली-110011 को भेजे जा सकेंगे ;

NOTIFICATION
New Delhi , the 24th February , 2009
G.S.R. 115 ( E ).-Whereas the following draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 which the Central Government proposes to make without consulting the Drugs Technical Advisory Board, as it is of the opinion that circumstances have arisen which render it necessary to make rules without such consultations ;
And whereas the Central Government proposes to consult the Drugs Technical Advisory Board within six month of making these rules ;
Now, therfore , in exercise of the power conferred by Section 12 and 33 of the Drugs and Cosmetics Act , 1940 (23 of 1940) the following draft rules is hereby published as required by the said sections of the said Act for the informaton of all persons likely to be affected thereby and notice is hereby given that the said draft will be takan into consideration on or after the expiry of a period of forty five days from the date on which the copies of the Official Gazette in which the notification is published are made available to the public .
Objection or suggestion , if any, may be addressed to the Secretary ( Health) , Ministry of Health and Family Welfare, Government of India, Nirman Bhawan , New Delhi- 110001.
[PART II- SEC. 3 ( i) ]
Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the period as specified above will be taken into consideration by the Central Government .
DRAFT RULES
1 . (1) These rules may be called the Drugs and Cosmetics (Third Amendment) Rules , 2009 .
(2) They shall come into force from the date of their final publication in the Official Gazette .
2. In the Drugs and Cosmetics Rules , 1945 , in rule 43 -A, for the words , "Chennai , Kolkata , Mumbai , Cochin, Nhava Sheva and Kandla in respect of drugs imported by sea into India ". The words " Chennai , Kolkata , Mumbai , Cochin , Nhava Sheva , Kandla and Inland container Depots at Tuglakabad and Patparganj , Delhi : in respect of drugs imported by sea into India " shall substituted.

Foot Note : The principal rule as amended upto the 30th June , 2005 have been published in the Government of India publications PDGHS- 93 on the Drugs and Cosmetics Act , 1940 and the Drugs and Cosmetics Rules , 1945 and last amended vide G.S.R. 46 ( E ) dated 22nd January, 2009.
