सा.का.नि. 116(अ). औषध और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप , भारत के राजपत्र , असाधारण , भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय (स्वास्थ्यविभाग ) की अधिसूचना संख्यांक सा.का.नि. 556(अ) तारीख 20 अगस्त, 2007 द्वारा प्रकाशित की गई थी जिससे ऐसे व्यक्तियों से जिनके उससे प्रभावित होने की संभावना थी उस तारीख से जिसको उस राजपत्र की प्रतियां जनता को उपलब्ध करा दी गई थी से 45 दिन की अवधि समाप्त होने के पूर्व आक्षेप और सुझाव मांगे गए थे;
और उक्त राजपत्र की प्रतियां जनता को 24 अगस्त, 2007 को उपलब्ध करा दी गई थी;
और केन्द्रीय सरकार द्वारा उक्त प्रारूप नियम पर जनता से प्राप्त आक्षेपों और सुझावों पर विचार कर लिया गया है ;
अतः , अब , केन्द्रीय सरकार , औषध और प्रसाधन सामग्री अधिनियम , 1940 (1940 का 23 ) की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए औषधि तकनीकी सलाहकार बोर्ड के परामर्श के पश्चात् औषधि और प्रसाधन सामग्री नियम , 1945 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-

1. ( 1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री ( दूसरा संशोधन ) नियम, 2009 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. औषध और प्रसाधन सामग्री नियम , 1945 के नियम 43क में ," रानाघाट , बोनागेन और मोहिसान रेलवे स्टेशन : बंगलादेश के सीमा से रेलवे द्वारा आयात औषधियों की बाबत " शब्दों के पश्चात्, " पश्चिमी बंगाल में पैटरापोल , असम में सूतारकंडी, त्रिपुरा में पुराना रघना बाजार और अगरतला; बंगलादेश से सड़क द्वारा आयात औषधियों के संबंध की बाबत " शब्द अंतःस्थापित किए जाएंगे ।

टिप्पण. मूल नियम भारत के राजपत्र सं. फा. 28-10/45- एच ( 1 ) तारीख 21 दिसम्बर , 1945 को प्रकाशित किए गए थे और पश्चात्वर्ती संशोधन संख्यांक सा.का.नि. 46 (अ ) , तारीख 22-1-2009 द्वारा किया गया ।

G.S.R. 116(E) .- Whereas a draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945, was published in the Gazette of India, Extraordinary vide

1. ( 1 ) These rules may be called the Drugs and Cosmetics ( Second Amendment) Rules, 2009 .
(2) They shall come into force on the date of their publication in the Official Gazette .
notification ofthe Government of India in the Ministry of Health and Family Welfare (Department of Health ) , number G.S.R. 556(E ) , dated the 20th August, 2007 , inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of forty -five days from the date on which the copies of the Gazette were made available to the public ;
And, whereas copies of the notification were made available to the public on 24th August , 2007;
2. In the Drugs and Cosmetics Rules , 1945 , in rule 43-A, after the words "Ranaghat, Bongaon and Mohiassan Railway Station: in respect of drugs imported by rail across the frontier with Bangladesh " , the words " Petrapole Road in West Bengal , Sutarkandi in Assam , Old Raghna Bazar andAgartala in Tripura : in respect of drugs imported by road from Bangladesh " shall be inserted.
And, whereas , objections and suggestions received from the public on the said rules have been considered by the Central Government;

Foot Note . The principal rules were published in the Now, therefore , in exercise of the powers conferred by Sections 12 and 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940) the Central Government, after consultation with the Drugs Technical Advisory Board , hereby makes the following rules further to amend the Drugs and Cosmetics Rules , 1945, namely:-
Gazette of India vide notification number F. 28-10 /45 - H ( 1 ) , dated the 21st December, 1945 and subsequently amended vide number G.S.R. 46(E), dated the 22-1-2009 .
