सं. टीएएमपी/12/2007-वीसीटीपीएल. महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 48 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , महापत्तन प्रशुल्क प्राधिकरण , एतद्वारा संलग्न आदेशानुसार, विशाखापत्तनम पत्तन न्यास में विशाखा कंटेनर टर्मिनल के इसके प्रचालनों के लिए विशाखा कंटेनर टर्मिनल प्राइवेट लिमिटेड के मौजूदा दरमान की वैधता को बढ़ाता है ।

यह मामला विशाखापत्तनम पत्तन न्यास ( वीपीटी) में विशाखा कंटेनर टर्मिनल के इसके प्रचालनों के लिए विशाखा कंटेनर टर्मिनल प्राईवेट लिमिटेड (वीसीटीपीएल ) के मौजूदा दरमान ( एसओआर) की वैधता को बढ़ाए जाने से संबंधित है ।
2. वीसीटीपीएल का मौजूदा दरमान ( एसओआर ) राजपत्र सं. 152 द्वारा दिनांक 25 जुलाई , 2007 को भारत के राजपत्र में प्रकाशित किया गया था ।

3. वीसीटीपीएल ने अपने दरमान (एसओआर ) के संशोधन के लिए अपना प्रस्ताव फरवरी , 2008 में दाखिल किया था । चूँकि प्रस्ताव विचार-विमर्श की अवस्था में था , इसलिए इस प्राधिकरण ने वीसीटीपीएल के मौजूदा दरमान की वैधता को 31 जुलाई , 2008 तक अथवा संशोधित दरमान के कार्यन्वयन की प्रभावी तारीख तक , जो भी पहले हो, बढ़ाया था । तत्पश्चात्, इस प्राधिकरण ने मौजूदा दरमान की वैधता को 31 दिसम्बर , 2008 तक अथवा राजपत्र सं. 162 द्वारा दिनांक 16 अक्तूबर , 2008 को भारत के राजपत्र में प्रकाशित आदेश द्वारा संशोधित दरमान के कार्यन्वयन की प्रभावी तारीख तक और बढ़ाया था ।
4. वीसीटीपीएल द्वारा दाखिल किए गए प्रशुल्क संशोधन प्रस्ताव पर एक संयुक्त सुनवाई 19 दिसम्बर, 2008 को विशाखापत्तनम पत्तन न्यास के परिसर में आयोजित की गई थी । संयुक्त सुनवाई में यथानिर्णीत , वीसीटीपीएल को कुछ अतिरिक्त सूचना/ स्पष्टीकरण भेजने की सलाह दी गई है , जिसकी प्रतीक्षा है ।
5. वीसीटीपीएल के मौजूदा दरमान की वैधता 31 दिसम्बर , 2008 को समाप्त हो चुकी है । इस मामले को अंतिम रूप देने में लगने वाले और समय को स्वीकार करते हुए, यह प्राधिकरण वीसीटीपीएल के मौजूदा दरमान की वैधता को 30 अप्रैल , 2009 तक अथवा अनुमोदित ( किए जाने वाले ) संशोधित दरमान के कार्यान्वयन की प्रभावी तारीख तक, जो भी पहले हो , बढ़ाता है ।

TARIFF AUTHORITY FOR MAJOR PORTS NOTIFICATION

No.TAMP/ 12/2007 - VCTPL . In exercise of the powers conferred by Section 48 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of the existing Scale of Rates ofthe Visakha Container Terminal Private Limited for its operation of Visakha Container Terminal at the Visakhapatnam Port Trust as in the Order appended hereto.

This case relates to the extension of the validity of the existing Scale of Rates ( SOR) of the Visakha Container Terminal Private Limited (VCTPL ) for its operation of Visakha Container Terminal at the Visakhapatnam Port Trust(VPT) .
2. The existing Scale of Rates (SOR) of the VCTPL was published in the Gazette of India on 25th July, 2007 vide Gazette No. 152. The validity of the SOR was prescribed till 31 March , 2008.
3. The VCTPL has filed its proposal for revision of its Scale of Rates (SOR) in February , 2008. Since the proposal was in the consultative stage , this Authority extended the validity of the existing SOR ofthe VCTPL till 31 July, 2008 or till effective date of implementation of the revised Scale of Rates whichever is earlier . Subsequently, thisAuthority further extended the validity of the existing SOR till 31 December , 2008 or till effective date of implementation of the revised SOR by Order which is published in the Gazette of India on 16th October , 2008 vide Gazette No. 162 .
4. A joint hearing on the tariff revision proposal filed by the VCTPL was held on 19 December , 2008 at the premises of the Visakhapatnam Port Trust . As decided at the joint hearing the VCTPL has been advised to furnish some additional information/classifications , which are awaited.
5. The validity of the existing Scale of Rates of VCTPL has expired on 31 December , 2008. Recognizing the further time involved in finalising this case , this Authority extends the validity of the existing SOR of the VCTPL from the date of its expiry till 30 April , 2009 or till effective date of implementation of the revised Scale of Rates (to be ) approved, whichever is earlier .
