सं. टीएएमपी/23/2007-जेएनपीटी. महापत्तन न्यास अधिनियम , 1963 (1963 का 38 ) की धारा 48 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए महापत्तन प्रशुल्क प्राधिकरण एतद्वारा संलग्न आदेशानुसार, जेएनपीटी में कंटेनर टर्मिनलों पर आईसीडी कंटेनरों के अंतर टर्मिनल रेल प्रहस्तन प्रचालनों के लिए प्रभारों के निर्धारण हेतु जवाहरलाल नेहरू पत्तन न्यास के प्रस्ताव का निपटान करता है ।

यह मामला जवाहरलाल नेहरू पत्तन न्यास ( जेएनपीटी ) में आईसीडी कंटेनरों के अंतर टर्मिनल रेल प्रहस्तन प्रचालनों (आईटीआरएचओ ) के लिए प्रभारों के निर्धारण से संबंधित है ।
2. इस प्राधिकरण ने अपने आदेश दिनांक 30 सितम्बर , 2008 द्वारा जेएनपीटी में रु. 400 प्रति टीईयू की आईटीआरएचओ दर की वैधता को 31 दिसम्बर , 2008 तक बढ़ाया था और जेएनपीटी को 15 नवम्बर , 2008 तक आईटीआरएचओ के निर्धारण हेतु प्रस्ताव दाखिल करने की सलाह दी थी ।
3. जेएनपीटी ने अपने पत्र दिनांक 24 नवम्बर , 2008 द्वारा निम्नलिखित मुख्य निवेदन किए हैं :-
(i) जून , 2008 से अक्तूबर, 2008 तक मिश्रित कंटेनर प्रहस्तन के ब्योरे निम्नवत् हैं:-

( ii ) जैसाकि जुलाई 2008 में निवेदन किया गया था, जेएनपीटी प्रत्येक गतिविधि अथवा प्रदत्त सेवाओं के लिए पृथक गतिविधि- वार लागत व्यवस्थित नहीं करता है ।
(iii ) जेएनपीटी ने टीएएमपी को अपना प्रशुल्क संशोधन प्रस्ताव प्रस्तुत किया है जिसमें कंटेनर संबंधित प्रशुल्क में 18 प्रतिशत की वृद्धि की मांग की गई है। इस प्रस्ताव में कंटेनर टर्मिनल से संबंधित लागत और आय के ब्यौरे दिए गए हैं जिसमें वित्तीय वर्ष 2007-08 से संबंधित आईटीआरएचओ शामिल किया गया है ।
(iv) दरमान के सामान्य संशोधन के अपने तत्संबंधी प्रस्तावों में जेएनपीटी, न्हावा शेवा इंटरनेशनल कंटेनर टर्मिनल लिमिटेड ( एनएसआईसीटी ) और गेटवे टर्मिनल्स इंडिया प्राइवेट लिमिटेड ( जीटीआईपीएल ) द्वारा प्रस्तुत किए गए ब्योरों को प्रभावी किए जाने के पश्चात् आईटीआरएचओ के प्रशुल्क को 31 दिसम्बर , 2008 के बाद वसूल किया जाना जारी रखा जाए ।
4. इस प्राधिकरण द्वारा अनुमोदित रु. 400 प्रति टीईयू की दर लागत ब्यौरों के आधार पर समीक्षा अधीन थी । इस प्राधिकरण ने

(ii) As submitted in July 2008 , JNPT does not maintain separate activity wise costing foreach activity or services rendered.
5. जेएनपीटी ने अपने दरमान की समीक्षा के लिए हाल ही में दाखिल किए गए अपने सामान्य संशोधन प्रस्ताव में अपने टर्मिनल और अन्य दो निजी प्रचालकों द्वारा प्रचालित कंटेनेर टर्मिनलों पर आईटीआरएचओ की वसूली के लिए एक समान दर प्रस्तावित की है । इसके प्रचालनों की लागत के आधार पर जेएनपीटी के दरमान में अनुमोदित ( की जाने वाली ) आईटीआरएचओ की दर अन्य कंटेनर टर्मिनलों पर लागू नहीं होगी । चूँकि जेएनपीटी ने आईटीआरएचओ के लिए एक समान दर का प्रस्ताव किया है , इस प्राधिकरण ने पत्र दिनांक 21 जनवरी , 2009 द्वारा जेएनपीटी को सलाह दी थी कि रेल द्वारा चालित आईसीडी कंटेनरों के अतिरिक्त संचलन के लिए प्रचालनों के मानक लागत के आधार पर जेएनपीटी , एनएसआईसीटी और जीटीआईपीएल पर प्रभार्य आईटीआरएचओ के लिए एक समान दर हेतु पृथक प्रस्ताव दर विश्लेषण और दस्तावेज़ी साक्ष्य के साथ 20 फरवरी , 2009 तक दाखिल किया जाए ।
(iii) JNPT has submitted its tariff revision proposal to TAMP which seeks an increase of 18 % in the container related tariff. This proposal contains details of cost and income in respect ofcontainer terminal , which includes ITRHO in respect of the financial year 2007-08 .
आईटीआरएचओ के लिए एक समान दर निर्धारित करने हेतु जेएनपीटी द्वारा दाखिल किए जाने वाले प्रस्ताव पर कार्यवाही करने के लिए अपेक्षित समय पर विचार करते हुए, इस प्राधिकरण ने रु. 400 प्रति टीईयू की मौजूदा दर की वैधता को 30 अप्रैल , 2009 तक अथवा जेएनपीटी से प्राप्त होने वाले प्रस्ताव पर पारित किए जाने वाले आदेश के कार्यान्वयन की प्रभावी तारीख तक, जो भी पहले हो, बढ़ाने का निर्णय लिया है ।

No. TAMP/ 23/ 2007 - JNPT .-In exercise of the powers conferred under Section 48 of the Major Port Trust Act, 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby disposes of the proposal of the Jawaharlal Nehru Port Trust for fixation of charges for Inter Terminal Rail Handling Operations of ICD containers at the container terminals in JNPT as in the Order appended hereto .

This case relates to fixation of charges for Inter Terminal Rail Handling Operations ( ITRHO ) of ICD Containers at Jawaharlal Nehru Port Trust ( JNPT) .
2.ThisAuthority vide its Order dated 30th September , 2008 had extended the validity ofthe ITRHO rate of Rs . 400 per TEU at JNPT upto 31st December , 2008 and had advised JNPT to file a proposal for fixation of ITRHO , by 15th November, 2008.
3. The JNPT vide its letter dated 24th November , 2008 has made the following main submissions :
(iv) The tariff of ITRHO may be continued to be levied beyond 31st December , 2008 after factoring the details submitted by JNPT, Nhava Sheva International Container Terminal Limited (NSICT) and Gateway Terminals India Private Limited (GTIPL) in their respective proposals for general revision of Scale of Rates .
4. The rate of Rs . 400 per TEU was approved by this Authority subject to review based on the cost details. The Authority vide its Orders dated 28th June , 2007 , 28th January, 2008 , 22nd April , 2008 and 30th September, 2008 had , inter alia, advised JNPTto file a detailed proposal with cost analysis .
5.The JNPT in its general revision proposal filed recently for review of its Scale of Rates has , inter alia , proposed a common rate for levy of ITRHO at its terminal and at the container terminals operated by the other two private operators . A rate for ITRHO (to be ) approved in the Scale of Rates of JNPT based on its cost of operations will not be applicable to the other container terminals . Since the JNPT has proposed a common rate for ITRHO, this Authority has vide letter dated 21st January , 2009 advised JNPT to file a separate proposal for a common rate for ITRHO leviable at JNPT, NSICT and GTIPL based on the standard cost of operations for the additional movement ofICD containers moved by rail supported by rate analysis and documentary evidence latest by 20th February, 2009.
Considering the time required for processing the proposal to be filed by JNPT for prescribing a common rate for ITRHO, this Authority , decides to extend the validity of the existing rate ofRs . 400 per TEU till 30th April , 2009 or till the effective date of implementation of the Order to be passed on the proposal to be received from JNPT , whichever is earlier .
