सं. टीएएमपी/34/2005-आईजीटीपीएल.-महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 48 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, महापत्तन प्रशुल्क प्राधिकरण , एतद्द्वारा , संलग्न आदेशानुसार , कोचीन पत्तन न्यास ( सीओपीटी ) में राजीव गांधी कंटेनर टर्मिनल ( आरजीसीटी ) पर अपने प्रचालन के लिए प्रशुल्क व्यवस्था के अनुमोदन हेतु इंडिया गेटवे टर्मिनल प्राइवेट लिमिटेड ( आईजीटीपीएल ) के मौजूदा दरमान की वैधता को बढ़ाता है ।

यह मामला कोचीन पत्तन न्यास ( सीओपीटी ) में राजीव गांधी कंटेनर टर्मिनल ( आरजीसीटी ) पर अपने प्रचालन के लिए इंडिया गेटवे टर्मिनल प्राइवेट लिमिटेड ( आईजीटीपीएल ) के मौजूदा दरमान ( एसओआर ) की वैधता को बढ़ाए जाने से संबंधित है ।
2. आईजीटीपीएल का दरमान ( एस ओ आर ) इस प्राधिकरण द्वारा आदेश सं. टीएएमपी/34/2005- आईजीटीपीएल दिनांक 6 अक्तूबर , 2005 द्वारा अंतिम बार अनुमोदित किया गया था ।
3. आईजीटीपीएल के मौजूदा दरमान ( एसओआर ) की वैधता 31 मार्च , 2008 तक निर्धारित की गई थी । आईजीटीपीएल के अनुरोध पर , इस प्राधिकरण ने अपने आदेश दिनांक 22 अप्रैल , 2008 द्वारा मौजूदा दरमान की वैधता को इसके समाप्त होने की तारीख से 30 सितम्बर , 2008 तक अथवा आईजीटीपीएल के प्रस्ताव का अंतिम निपटान किए जाने तक, जो भी पहले हो, बढ़ाया था । यह आदेश जी. सं. 88 द्वारा दिनांक 27 मई , 2008 को भारत के राजपत्र में अधिसूचित किया गया था ।
4. आईजीटीपीएल ने पत्र दिनांक 23 अप्रैल , 2008 द्वारा अपने दरमान के सामान्य संशोधन के लिए अपना प्रस्ताव दाखिल किया था । तत्पश्चात् इसके पत्र दिनांक 1 जुलाई , 2008 द्वारा सूचना/ स्पष्टीकरण की प्राप्ति पर, आईजीटीपीएल का प्रस्ताव दिनांक 22 जुलाई , 2008 को प्रशुल्क मामला रूप में पंजीकृत किया गया था । निर्धारित परामर्शी प्रक्रिया के अनुसार आईजीटीपीएल का प्रस्ताव टिप्पणियों के लिए परिचालित किया गया है । प्रस्ताव की प्राथमिक संवीक्षा पर , आईजीटीपीएल से अतिरिक्त सूचना/स्पष्टीकरण भेजने के लिए अनुरोध किया गया है ।
5. इस तथ्य पर विचार करते हुए कि इस मामले का अंतिम निपटान किए जाने से पूर्व कुछ और समय जरूरी होगा , यह प्राधिकरण आईजीटीपीएल के मौजूदा दरमान की वैधता को इसके समाप्त होने की तारीख से 30 जून , 2009 तक अथवा आईजीटीपीएल द्वारा दाखिल प्रशुल्क प्रस्ताव के अंतिम निपटान तक, जो भी पहले हो , बढ़ाता है ।

NOTIFICATION
Mumbai , the 18th February , 2009
No. TAMP/34/2005 - IGTPL .-In exercise of the powers conferred by Section 48 ofthe Major Port Trusts Act, 1963 ( 38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of the existing Scale of Rates of the India Gateway Terminal Private Limited (IGTPL ) for approval of tariff arrangement for its operation at Rajiv Gandhi Container Terminal (RGCT) in Cochin Port Trust ( COPT ) as in the Order appended hereto.

This case relates to the extension of the validity of the existing Scale of Rates (SOR) of India Gateway Terminal Private Limited ( IGTPL) for its operation at Rajiv Gandhi Container Terminal (RGCT) in Cochin Port Trust (COPT ) .
2. The Scale of Rates ( SOR) of the IGTPL was last approved by the Authority vide Order No. TAMP/ 34/ 2005- IGTPL dated 6th October , 2005 , which was notified in the Gazette of India on 21st October , 2005 vide Sl . No. 145 .
3. The validity ofthe existing Scale of Rates (SOR) of the IGTPL was prescribed till 31st March , 2008. At the request ofthe IGTPL , the Authority , vide its Order dated 22nd April , 2008, has extended the validity of the existing SOR from the date of its expiry till 30th September, 2008 or till final disposal of the proposal ofthe IGTPL , whichever is earlier . This Order isnotified in the Gazette of India on 27th May , 2008 vide Sl .. No. 88 .
4. The IGTPL, vide letter dated 23rd April . 2008 , had filed its proposal for general revision of its Scale of Rates . Subsequently , on receipt of the information/ clarification vide its letter dated 1st July, 2008 , the proposal of the IGTPL was registered as tariff case on 22nd July, 2008. The proposal of the IGTPL is circulated for comments as per the consultative procedure prescribed . On preliminary scrutiny of the proposal , the IGTPL has been requested to furnish additional information/ clarifications .
5. Considering the fact that some more time will be necessary before this case matures for final disposal , this Authority extends the validity of the existing Scale of Rates of the IGTPL from the date of its expiry till 30th June , 2009 or till final disposal of the tariff proposal filed by IGTPL , whichever is earlier .
